2023 COUNCIL REPRESENTATION ON BOARDS AND COMMITTEES
26 1400 K Street, Suite 400, Sacramento, CA 95814 • 916.658.8200 • calcities.org DATE: Wednesday, June 21, 2023
TO: Mayors, Council Members, City Clerks, and City Managers RE: DESIGNATION OF VOTING DELEGATES AND ALTERNATES
League of California Cities Annual Conference and Expo, Sept. 20-22, 2023, Sacramento SAFE Credit Union Convention Center
Every year, the League of California Cities convenes a member-driven General Assembly at the Cal Cities Annual Conference and Expo. The General Assembly is an important opportunity where city officials can directly participate in the development of Cal Cities policy.

Taking place on Sept. 22, the General Assembly is comprised of voting delegates appointed by each member city; every city has one voting delegate. Your appointed voting delegate plays an important role during the General Assembly by representing your city and voting on resolutions.

To cast a vote during the General Assembly, your city must designate a voting delegate and up to two alternate voting delegates, one of whom may vote if the designated voting delegate is unable to serve in that capacity. Voting delegates may either be an elected or appointed official.

Please complete the attached voting delegate form and email it to Cal Cities office no later than Monday, August 28.

New this year, we will host a pre-conference information session for voting delegates to explain their role. Submitting your voting delegate form by the deadline will allow us time to establish voting delegate/alternate records prior to the conference and provide preconference communications with voting delegates.

Please view Cal Cities’ event and meeting policy in advance of the conference.

Action by Council Required. Consistent with Cal Cities bylaws, a city’s voting delegate and up to two alternates must be designated by the city council. When completing the attached Voting Delegate form, please attach either a copy of the council resolution that reflects the council action taken or have your city clerk or mayor sign the form affirming that the names provided are those selected by the city council.

Please note that designating the voting delegate and alternates must be done by city council action and cannot be accomplished by individual action of the mayor or city manager alone.

Council Action Advised by August 28, 2023
Attachment B
27 Conference Registration Required. The voting delegate and alternates must be registered to attend the conference. They need not register for the entire conference; they may register for Friday only. Conference registration is open on the Cal Cities website.

For a city to cast a vote, one voter must be present at the General Assembly and in possession of the voting delegate card and voting tool. Voting delegates and alternates need to pick up their conference badges before signing in and picking up the voting delegate card at the voting delegate desk. This will enable them to receive the special sticker on their name badges that will admit the voting delegate into the voting area during the General Assembly.

Transferring Voting Card to Non-Designated Individuals Not Allowed. The voting delegate card may be transferred freely between the voting delegate and alternates, but only between the voting delegate and alternates. If the voting delegate and alternates find themselves unable to attend the General Assembly, they may not transfer the voting card to another city official.

Seating Protocol during General Assembly. At the General Assembly, individuals with a voting card will sit in a designated area. Admission to the voting area will be limited to the individual in possession of the voting card and with a special sticker on their name badge identifying them as a voting delegate.

The voting delegate desk, located in the conference registration area of the SAFE Credit Union Convention Center in Sacramento, will be open at the following times:

Wednesday, Sept. 20, 8:00 a.m.- 6:00 p.m. and Thursday, Sept. 21, 7:30 a.m.- 4:00 p.m. On Friday, Sept. 22, the voting delegate desk will be open at the General Assembly, starting at 7:30 a.m., but will be closed during roll calls and voting.

The voting procedures that will be used at the conference are attached to this memo.

Please share these procedures and this memo with your council and especially with the individuals that your council designates as your city’s voting delegate and alternates.

Once again, thank you for completing the voting delegate and alternate form and returning it to Cal Cities office by Monday, Aug. 28. If you have questions, please contact Zach Seals at [email protected].

30 Sixty days before the
Annual Conference and
Expo, Cal Cities members
may submit policy
proposals on issues of
importance to cities. The
resolution must have the concurrence
of at least five additional member cities
or individual members.

How it works: Cal Cities
Resolutions and the General Assembly
General Assembly
General Resolutions
Policy Committees
Developing League of California Cities policy is a dynamic process that engages a wide range of members to ensure that we are representing California cities with one voice. These policies directly guide Cal Cities advocacy to promote local decision-making, and lobby against statewide policy that erodes local control.

The resolutions process and General Assembly is one way that city officials can directly participate in the development of Cal Cities policy. If a resolution is approved at the General Assembly, it becomes official Cal Cities policy. Here’s how Resolutions and the General Assembly works.

The petitioned resolution
is an alternate method
to introduce policy
proposals during the
annual conference. The
petition must be signed by
voting delegates from 10% of member
cities, and submitted to the Cal Cities
President at least 24 hours before the
beginning of the General Assembly.

Petitioned Resolutions
The Cal Cities President
assigns general resolutions
to policy committees where
members review, debate,
and recommend positions for
each policy proposal. Recommendations are
forwarded to the Resolutions Committee.

Who’s who
The Resolutions
Committee includes
representatives from
each Cal Cities diversity
caucus, regional
division, municipal
department, policy
committee, as well as
individuals appointed by
the Cal Cities president.

Voting delegates
are appointed by each
member city; every city
has one voting delegate.

The General Assembly
is a meeting of the
collective body of
all voting delegates —
one from every
member city.

Seven Policy
Committees meet
throughout the year to
review and recommend
positions to take on
bills and regulatory
proposals. Policy
committees include
members from each Cal
Cities diversity caucus,
regional division,
municipal department,
as well as individuals
appointed by the Cal
Cities president.

During the General Assembly, voting delegates
debate and consider general and petitioned
resolutions forwarded by the Resolutions Committee.

Potential Cal Cities bylaws amendments are also
considered at this meeting.

Cal Cities policy
development is a
member-informed
process, grounded
in the voices and
experiences of city
officials throughout
the state.

Resolutions Committee
The Resolutions Committee
considers all resolutions.

General Resolutions approved1
by either a policy committee
or the Resolutions Committee
are next considered by the General
Assembly. General resolutions not approved,
or referred for further study by both a policy
committee and the Resolutions Committee
do not go the General Assembly. All
Petitioned Resolutions are considered by the
General Assembly, unless disqualified.2
• Voting delegates will receive increased communications to prepare them for their role during the General Assembly.
• The General Assembly will take place earlier to allow more time for debate and discussion.
• Improvements to the General Assembly process will make it easier for voting delegates to discuss and debate resolutions.

AGENDA ITEM 6.b
Meeting Date: August 14, 2023
SUBJECT: Discussion and possible action to Introduce for first reading by title only Ordinance No. 23-0368 adding Chapter 5 (Graffiti Abatement) to Title 5 (Public Health and Safety) of the Solvang Municipal Code and making a determination of exemption under the California Environmental Quality Act PREPARED BY: David Fleishman, City Attorney
Taylor Foland, Deputy City Attorney
DISCUSSION:

At its July 10 meeting, the City Council directed the City Attorney’s office to prepare an ordinance to address the abatement of graffiti on private property within the City, and to provide a mechanism to recover City expenses incurred in abating graffiti not otherwise addressed or removed by the private property owner.

The attached draft ordinance is modeled on a successful graffiti abatement ordinance from the City of Pismo Beach. The draft ordinance establishes a program to prevent and control the spread of graffiti within the City, and to assess and recover the costs of graffiti removal.

As part of the program, the city manager would be empowered to establish a comprehensive graffiti eradication program that among other actions could include proactive enforcement, apprehension and prosecution of persons who place graffiti on personal and real property of others, recovery of restitution from responsible parties, a graffiti hotline to report instances of graffiti defacement, and other approaches intended to quickly address and remove graffiti.

The program would also include notification procedures for private property owners who may not be aware of graffiti on their property, with an opportunity to remove the graffiti with their own resources, or with City resources subject to recovery of City expenses incurred in removing the graffiti. The City could also remove the graffiti in those instances where the property owner did not grant consent for the City to remove the graffiti. In the case of City abatement, the City would send an invoice to the property owner, which if unpaid would constitute a special assessment on the property that would be collected with the property taxes on the property.

The draft ordinance also provides specific guidance on how graffiti should be removed or covered to ensure that the solution does not become worse than the problem it is intended to address.

Finally, the program would allow the City to establish a reward program to offer cash rewards of up to five hundred dollars ($500.00) for information leading to the arrest and conviction of graffiti offenders.

ALTERNATIVES:

The Council could decline to introduce the ordinance and give staff alternative direction.

FISCAL IMPACT:

There is no fiscal impact associated with the introduction of the ordinance. Should the Council adopt the ordinance on second reading, minor codification expenses will be incurred that are within currently budgeted expenses. Additional cost of enforcement and abatement will depend on the severity of future instances of graffiti, but cost recovery is included within the ordinance and is expected to reduce the fiscal impact of abatement to approximately neutral.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SOLVANG, CALIFORNIA ADDING CHAPTER 5 (GRAFFITI ABATEMENT) TO TITLE 5 (PUBLIC HEALTH AND SAFETY) OF THE

SOLVANG MUNICIPAL CODE AND MAKING A DETERMINATION OF EXEMPTION UNDER THE

CALIFORNIA ENVIRONMENTAL QUALITY ACT
WHEREAS, the City Council of the City of Solvang recognizes that graffiti on private and public property in the City threatens public health, safety and welfare as graffiti negatively impacts property values and the quality of life in the community; and

C. An enforcement officer may apply to the juvenile court for the release of the names and addresses of responsible parties who are minors.
5-5-7 Recovery of graffiti eradication costs and expenses.

A. Any responsible party as defined in this chapter shall be liable to the city for all graffiti eradication costs and expenses.

B. All responsible parties shall be jointly and severally liable for the graffiti eradication costs and expenses on a particular property.

C. The enforcement officer shall cause to be sent an invoice for graffiti eradication costs and expenses to a responsible party. The invoice for graffiti eradication costs and expenses shall contain:

1. The address or location of the defaced real or personal property and the location and a description of the defaced personal property, sufficient to identify the property;

2. A summary of the graffiti eradication actions performed; 36 O 23-0368 Graffiti

3. An itemized list of the graffiti eradication costs and expenses incurred;

4. The identity of the responsible party and the basis of that determination;

5. A description of the payment process, including the time within which and the place to which the graffiti eradication costs and expenses shall be paid;

6. A statement advising that the graffiti eradication costs and expenses shall be a personal obligation of the party;

7. A statement advising that the city may pursue a special collection process for the graffiti eradication costs and expenses against real property owned by the responsible party; and

8. A description of the process by which a responsible party may protest the determination that he or she is a responsible party or the amount of the graffiti eradication costs and expenses. 5-5-8 Graffiti removal.

All persons who own real or personal property upon which graffiti has been placed shall cause the removal of such graffiti in accordance with this section within 48 hours after it is placed on the property.

If the owner fails to do so, the city may abate and remove the graffiti on public or private property in accordance with this Section.

A. Graffiti that is visible from any public right-of-way or public or private property shall be removed in accordance with the following provisions:

1. Removal by property owner. The property owner or other person in control of real property shall perform the removal with their own resources.

2. Removal by the city with consent of property owner. The city or its agents may remove graffiti upon satisfaction of the following conditions:
a. The property owner has shown that they are unable to remove the graffiti due to financial or physical reasons and has requested in writing that the city remove the graffiti; b. The city obtains the consent of the property owner to remove the graffiti; c. The property owner executes a release and right of entry form permitting such graffiti removal;
d. The city shall not paint or repair a more extensive area than is necessary to remove the graffiti, unless the city determines that a more extensive area needs repainting or repairing in order to avoid an aesthetic disfigurement to the neighborhood or community, or unless the property owner agrees to pay for the cost of repainting or repairing the more extensive areas; and, e. The owner provides paint of a specific color to match if they so desire or are able to. 37 O 23-0368 Graffiti

3. Removal by city without consent of property owner. An enforcement officer may order abatement of graffiti from real or personal property when the owner does not successfully remove the graffiti with his or her own resources, or satisfy the conditions of subsection (A)(2) of this Section.

B. Standards for graffiti removal. Graffiti shall be removed or completely covered in a manner that renders it inconspicuous. When graffiti is painted out, the color used to paint it out, to the extent available and practicable, shall match the original color of the surface, or the surface shall be completely repainted with a new color that is aesthetically compatible with existing colors and architecture. The removal shall not leave shadows and shall not follow the pattern of the graffiti such that the letters or similar shapes remain apparent on the surface after graffiti markings have been removed. If the area is heavily covered with graffiti, the entire surface shall be repainted. 5-5-9 Graffiti abatement and cost recovery proceedings.

Abatement of graffiti and assessment of graffiti abatement and/or eradication costs shall be in accordance with the following procedure:

A. Following a report of graffiti from any source, an enforcement officer shall issue a notice of intent to abate the graffiti as a public nuisance, and shall serve such notice to the owner or occupant of the premises. The notice shall be sent by certified mail, return receipt request.

B. The notice of intent shall be substantially in the following form:

NOTICE OF INTENT TO ABATE NUISANCE-GRAFFITI
(Name and address of person notified)
(Date)
NOTICE IS HEREBY GIVEN that you are required by Solvang Municipal Code Title 5, Chapter 5 to, at your sole expense, remove or paint over the graffiti in existence on the property located at (address), which is visible to public view, by (date). If you fail to do so, the City or its agents will enter your property and remove or paint over the graffiti. The cost of such removal and/or painting will be assessed against you and your property, and such costs will constitute a lien upon such property until paid.

You may request a hearing to contest this notice. To request a hearing, you must submit a written request to the City by (date). If a request is not received by this date by the City, the City shall have the authority to proceed with the abatement of the graffiti inscribed on your property without further notice or hearing, and at your expense.

Your presence is not required at the hearing. In lieu of attendance, you may submit a sworn written statement executed under penalty of perjury, as to why you are not responsible for the removal of the graffiti, and/or assessment of costs of removal and/or painting. If you do not appear in person at the hearing, your sworn written statement as described will be considered as your sole testimony. 38 O 23-0368 Graffiti
C. Upon receipt of a request for hearing to contest a notice of intent, the city shall set a date and time for the hearing and notify the person requesting the hearing of the date, time, and location of the hearing. All hearings under this chapter shall be held before the City Manager or his/her designee, who shall hear all facts and testimony he/she deems pertinent. Said facts and testimony may include testimony on the location of the graffiti and the circumstances concerning its placement on the real or personal property. The City Manager shall not be limited by the technical rules of evidence. After the hearing, the City Manager shall serve notice of his/her written decision to the person requesting the hearing, or other affected parties, within fifteen working days. 5-5-10 Assessment and payment of costs.

A. Following abatement, the city shall send an invoice to the owner of the real or personal property upon which graffiti has been abated by the city. The notice shall specify all graffiti abatement and eradication costs. The notice shall be given at the time of imposing the assessment and shall specify that the property may be sold after three years by the tax collector for unpaid delinquent assessments.

The notice shall be sent by certified mail to the property owner, if the property owner’s identity can be determined from the county assessor’s or county recorder’s records. If the owner of the property, after diligent search, cannot be found, the notice may be served by posting a copy of the notice upon the property in a conspicuous place, for a period of ten days. The notice shall also be published pursuant to Government Code Section 6062 in a newspaper of general circulation that is published in Santa Barbara County.

B. The total cost of graffiti abatement and eradication, including all administrative costs, shall be paid by the owner or other person in control of the real property or the owner of personal property upon which graffiti has been abated, within thirty calendar days after service of notice.

C. Pursuant to Government Code Section 38773.5, the total cost of abatement and eradication, including all administrative costs, shall constitute a special assessment against the property subject to the graffiti abatement, if not paid in full within thirty days after service of the invoice. After the assessment is made, it shall constitute a lien on the property subject to the graffiti abatement. Such special assessment shall be collected at the same time and in the same manner as ordinary municipal taxes are collected and shall be subject to the same penalties and the same procedures and sale in case of delinquency as provided for ordinary municipal taxes. However, if any real property to which a special assessment relates has been transferred or conveyed to a bona fide purchaser for value, or if a lien of a bona fide encumbrancer for value has been created and attaches thereon, prior to the date on which the first installment of taxes would become delinquent, then the special assessment shall not result in a lien against the real property but instead shall be transferred to the unsecured roll for collection.

D. Instead of making the cost of abating a nuisance a special assessment against the property subject to graffiti abatement, the city may make the cost the personal obligation of the property owner or other person creating, causing, committing, or maintaining the nuisance. In such a case, all of the procedures of this chapter apply except those specially related to assessment of the property. The property owner or person in control will remain responsible for all abatement and eradication costs until reimbursement is collected by the city from the person creating, causing or committing the nuisance. 5-5-11 Alternative means of enforcement.

Nothing in this chapter shall be deemed to prevent the City Council from authorizing the City Attorney to commence any other available civil or criminal proceedings to abate a public nuisance in addition to or 39 O 23-0368 Graffiti
alternative to proceedings set forth in this chapter. At the time the abatement action is filed, the City Attorney may elect to seek recovery of attorneys' fees incurred in a graffiti abatement action under this chapter. In a case where the City Attorney makes this election, the prevailing party shall be entitled to recover attorneys' fees. In no event shall the award of attorneys' fees to a prevailing party exceed the amount of reasonable attorneys' fees incurred by the city in the action. 5-5-12 Possession of graffiti implements.

A. It shall be unlawful for any person under the age of eighteen years of age to possess any graffiti implement while on any school property, grounds, facilities, buildings, or structures upon public or private property without the prior written consent of the owner or occupant of such private property. The provisions of this Section shall not apply to the possession of graffiti implements by a minor attending or traveling to or from a school at which the minor is enrolled if the minor is participating in a class or activity at the school that formally requires the possession of graffiti implements. The burden of proof in any prosecution for violation of this section shall be upon the minor student to establish the need to possess a graffiti implement.

B. It shall be unlawful for any person to possess any graffiti implement while in or upon any public facility, park, playground, recreational facility, or other public building or structure owned or operated by the city or while in or within fifty feet of an underpass, bridge abutment, storm drain, or similar types of infrastructure unless otherwise authorized by the city. 5-5-13 Reward for information.

A. Pursuant to Section 53069.5 of the Government Code, the city may offer a reward of up to five hundred dollars for any person or persons who furnish information to the city leading to the arrest and conviction, adjudication as a juvenile offender, or confession of any person for violation of Section 5-5-4 or California Penal Code Section 594. Such information may be furnished in whatever method that provides for adequate identification of the violator(s) which may include photo or video evidence. In the event of multiple contributors of information, the reward amount shall be divided by the city in the manner it shall deem appropriate. For the purposes of this section, diversion of the offending violator to a community service program, or a plea bargain to a lesser offense, may constitute a conviction.

B. Moneys collected from penalties shall be deposited into the city’s general fund, and those moneys may be utilized to pay for the monetary reward and graffiti control program.

C. Claims for rewards under this section shall be filed with the City Clerk. Each claim shall:

1. Specifically identify the date, location and kind of property damaged or destroyed;

2. Identify the person who was convicted of or who confessed to violating Section 5-5-4 or California Penal Code Section 594;

3. Identify the court and the date upon which the conviction occurred or the place and the date of the confession;

4. No claim for a reward shall be allowed unless an authorized representative of the city investigates and verifies the accuracy of the claim and recommends that it be allowed. The investigation must determine that the claimant’s information was relevant and directly responsible for the arrest and conviction of the suspect.
40 O 23-0368 Graffiti
5-5-14 Savings clause.

This chapter is not intended to conflict with California law, and shall be construed to avoid conflict with or preemption by California law. If any section, subsection, sentence, clause, phrase or portion of this chapter is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this chapter, and to this end the provisions of this chapter are severable. The City Council declares that it would have adopted each section, subsection, sentence, clause, phrase or portion thereof, irrespective of the fact that any one or more sections, subsections, clauses, phrases or portions be declared invalid or unconstitutional.

SECTION 2. This Ordinance has been reviewed for compliance with the California Environmental Quality Act (CEQA), the CEQA Guidelines (Title 14, Division 6, Chapter 3 of the California Code of Regulations), and the City’s environmental procedures. The City has determined that this Ordinance is exempt from CEQA pursuant to CEQA Guidelines Section 15061(b)(3) (general rule), because the City Council hereby finds with certainty that there is no possibility the passage of this Ordinance will have a significant effect on the environment.

SECTION 3. Solvang is a Charter City and has adopted its own rules for summarizing and posting ordinances once they are adopted. A summary of this ordinance will be prepared by the City Clerk. The summary will be posted in three locations after adoption as directed in the Solvang Municipal Code. A true and correct copy of the full ordinance together with a record of the vote of each council member shall be kept by the City Clerk.

42 CITY COUNCIL STAFF REPORT
AGENDA ITEM 6.e
Meeting Date: August 14, 2023
SUBJECT: Discussion and possible action regarding sale or exchange of up to 400 acre-feet (AF) of 2023 state water allocation
PREPARED BY: Randy Murphy, City Manager
DISCUSSION:

Staff has been approached by Ray Stokes, Executive Director of the Central Coast Water Authority (CCWA), who asked if we would be interested in selling or exchanging any of our water rights for the current year (2023 only). After some internal discussion, it was determined that we would not use at least 400 AF of water this year. Additional conversation with CCWA has provided tentative information that suggests we could exchange our 400 AF this year for 200 AF in a future year (probably 2024), or we could sell it for an amount significantly less than the $1300+/AF we paid for this year’s allocation. A third option would be to reject these offers and just retain our water rights for our own use or sale/exchange in a future year. However, this option comes with the risk that any future wet winter would flush our investment over the spillway and out to sea.

For those who are unaware, the State and/or Federal governments retain significant control over water banks and reservoirs. So much so that they only allocate a small portion of the overall percentage in any given reservoir to local agencies. Additionally, the first water that goes over the spillway in a wet year is proportionally reduced from any agency’s surplus water bank until their balance is zero and the state/feds have 100% of that capacity. With respect to the San Luis Reservoir near Gilroy, where much of the State Water Project water is stored, the reservoir does not actually spill in most years. DWR simply does not pump more water into the reservoir from the forebay. But the “spill” is a water accounting convention used to erase the surplus water held by various agencies in the reservoir. More accurately, DWR foregoes the opportunity to pump water into storage in the reservoir. Closer to Solvang, Lake Cachuma reached capacity earlier this year, causing federal authorities in control of the Bradbury Dam to release water from the lake to avoid spilling over the dam for the first time in over a decade.

Staff has queried prior Water Authority personnel regarding whether or not the lost value of the banked water has been included in any disaster declaration. That answer was that they hadn’t thought about that as an option, but they would explore it if an opportunity arose in the future.

ALTERNATIVES:

The Council could select from among the following options:

1. Agree to sell 400 AF through the CCWA contract; or

2. Exchange the 400 AF through the CCWA contract; or

3. Retain the rights to this year’s allocation; or

4. Another option of the Council’s choosing
FISCAL IMPACT:

Depending on the option selected, could be a loss of some or all of the $500K+ used to purchase the 400 AF of state allocated water

43 CITY COUNCIL STAFF REPORT
AGENDA ITEM 6d
Meeting Date: August 14, 2023
SUBJECT: Discussion and possible action to approve a deed restriction for the property located at Hans Christian Andersen Park located at 633 Chalk Hill Road in Solvang.

PREPARED BY: Rodger A. Olds PE, City Engineer
DISCUSSION:

The Parks and Water Bond Act of 2018, better known as Proposition 68 is a State of California grant program which provides funds to Cities for park improvements on a per capita basis. Based on the per capita calculation of the grant, the City was eligible for $177,952, subject to a 20% match by the City.

On May 10, 2021, Council approved Resolution 21-1140 approving the application for these grant funds for improvements to Hans Christian Andersen Park. The City subsequently applied for and received the grant funding. The City entered into a grant agreement on April 28, 2022, attached as Exhibit B of the Draft Deed Restriction, Attachment A. The improvements intended to be completed with these grant funds included the following:

1. New Park Furniture - Concrete Picnic Table Replacement

2. Pickleball Court Enhancements

3. Hiking and Bike Trail Expansion

4. New Bicycle Pump Track

5. Design for future Playground Expansion.

The City also added these projects to the Capital Improvement program for FY 2022/23 in the amount of $220,000. The New Park Furniture item has been recently completed, primarily for the picnic tables in Area D of the park. The cost for this replacement was $78,707.03. City staff has worked on the plans and development of the Pickleball Court enhancements; however, this project has evolved into the full replacement of the courts rather than enhancements. Unfortunately the cost of the pickleball court replacement will exhaust the remainder of the grant funds and the local funds required to complete the project will far exceed the required local match. This revised project will be brought to Council as part of the FY 2023/24 Capital Improvement Program at a future meeting.

The Prop. 68 grant agreement requires a deed restriction to be recorded on the park property for a period of 30-years. The deed restriction requires the City to maintain the improvements made by the City with the awarded grant funds. Hans Christian Andsersen Park is a 50.23 acre park property in the Center of Solvang. It is currently zoned Recreation, and the 2045 General Plan Update proposes the property to have a land use designation of Recreation/Open Space.

City staff is prepared to submit an invoice to the State for reimbursement for the grant work completed to date, totaling $78,707.02 for the picnic table replacements. The deed restriction must be approved and recorded before the invoice is approved by the State and grand funds dispersed to the City.

ALTERNATIVES:

City Council could refuse to approve the deed restriction on the Hans Christian Andersen Park property. This would eliminate the City’s ability to receive the grant reimbursement. 44 FISCAL IMPACT:

The impact to this action will allow the City to receive grant funds in the amount of $177,952. There may be a negligible cost for the final preparation of the document and subsequent recording with the Santa Barbara County Clerk Recorder.

DPR may pursue any and all available legal and/or 47 3
equitable remedies to enforce the terms and conditions of this Deed Restriction up to and including a lien sale of the property. In the event of a breach, any forbearance on the part of DPR to enforce the terms and provisions hereof shall not be deemed a waiver of enforcement rights regarding any subsequent breach.

5. SEVERABILITY. If any provision of these restrictions is held to be invalid, or for any reason becomes unenforceable, no other provision shall be affected or impaired.

AGENDA ITEM 6.e
Meeting Date: August 14, 2023
SUBJECT: Discussion and possible action regarding dissolution of the Solvang Tourism Advisory Committee (TAC)
PREPARED BY: Randy Murphy, City Manager
DISCUSSION:

The Council selected TJA to lead the City’s marketing effort as well as update the SolvangUSA website at its June 26 meeting. Part of the discussion included a question about whether to suspend or eliminate the TAC. That question was not answered, and staff is now at a crossroads regarding how to proceed with planning events like Julefest, which relied on input from the Committee in the past.

During the combined TAC and Council meeting on May 22, there were several comments that suggested the effectiveness of the TAC was limited by Brown Act rules. Subsequent discussion among staff revealed that the TAC was formed in large part due to the limitations of a prior City Manager.

Additionally, two of the TAC members have resigned their post over the past few months.

While the commitment and efforts of the TAC members is appreciated, the time for their service is at an end. Staff recommends that the TAC be dissolved, and the approvals/oversight given to it via Solvang’s Municipal Code be assigned to the City Manager or his/her designee. Staff further recommends that the Council include in their motion authorization for the City Manager to create a non-Brown Act committee if TJA finds that a TAC-like body would help in the administration of our marketing functions.

ALTERNATIVES:

The Council may choose to not dissolve the TAC and provide an alternative direction.

FISCAL IMPACT:

Potential cost savings due to the elimination of Islay Events needs to record and broadcast the meetings.
