This town is straight out of a storybook
Welcome to Solvang! This charming
town in California has captured my heart
and it's truly a magical place!
Solvang is known as the Danish Capital
of America due to the influence from the
Danish settlers who came here
hundreds of years ago.
There are so many fun things to do in
Solvang like shopping, wine tasting,
visiting its many bakeries, enjoying fine
dining, and simply strolling around town!

WRAITHS AMONG THE WINDMILLS: What are your utmost and ultimate Solvang pleasures? Is it all about strolling while snacking upon delicious butter cookies or rocking a pair of super-stylish clogs, the fabulous footwear long associated with the Santa Barbara County town? Do you dance at Danish Days or eat as many jam-topped a2bleskivers as possible? No matter what you adore doing around the windmill-laden town, you likely haven't spent a lot of time exploring the realm of the Great Beyond. But a new ghost tour is diving into the wine country hamlet's more ethereal side, one that is very much about the longtime Solvangians who chose to remain there ... forever. And we do understand the impulse: This is a vivacious village with charm to spare; staying forever might be our first choice, too.

SPYING THIS 1966 STAR CAR? You'll want to be in Buellton, Solvang, Santa Ynez, or at another spot along the route on Sept. 25. Why is this celebrated superhero vehicle, which was designed by George Barris, calling upon wine country on the first Monday of autumn? It's leading the Antique Automobile Club of America Western Divisional Tour, where plenty of snazzy show cars will be out gleaming in the sun and delighting waving fans. The procession will wrap at the Santa Ynez Carriage Museum at noon, and, for sure, that's where fans can get a bit closer to the Batmobile. "While George Barris passed in 2015, his daughter, Jaji Barris will be on hand to provide first-hand insights into the history and unique perspective of her father's legacy in automotive design," share the organizers.

Scarecrows and pumpkins: Solvang
0 Solvang I Road Trip
Though the Danish town of Solvang doesn't get a lol
of fall foliage, it goes big on other fall celebrations, like pumpkin patches and a townwide scarecrow
festival.
The Scarecrow Fest is a competition between
merchants in the Santa Ynez Valley. Each store can
put out a scarecrow and everyone is invited to vote
for their favorite creations. Last year there were
more than 40 businesses that participated with
some rather creative scarecrows, making a walk
around this fairy·tale·like town even more
entertaining than usual. Grab some treats at
Mill Bakery then in the evening, check out the brand
new Solvang ghost hunting tour for some
paranormal fun.
The Solvang Farmer Pumpkin Patch may not be the
biggest pumpkin patch in California, but it's known
for having some of the biggest pumpkins (one
weighed in at 700 pounds in 2021) and a 14-acre
corn maze.
A bunch of fun new places have opened in the area
recently, including boutique hotels with eclectic
interiors like The Winston and great Thai food al Na
Na Thai in neighboring Buellton.
Don't miss: Spend some time tasting the excellent
wines produced in the area. For a quieter afternoon,
head to Alma Rosa Winery tasting room in a semi·
hidden courtyard off of Mission Drive, where a
handful of other tasting rooms are also located.

Last year there were 6,701 visitors who received help from the Visitor Center. That is an increase of 487 visitors this year vs. last, indicating that at the Solvang Visitor Center numbers continue to be close to and consistent with 2022.
Solvang Visitor Center, September 2023
We noted the following Visitor Center numbers for Danish Days 2022 vs. 2023:2022Fri - 268 VisitorsSat - 441 VisitorsSun - 259 VisitorsTotal number of Visitors - 9682023Fri - 184 VisitorsSat - 508 VisitorsSun - 304 VisitorsTotal number of Visitors - 996 Visitor Center count:Sept 2022 - 6,701Sept 2023 - 7,188 Typically, Saturday is our busiest day during the Danish Days weekend and throughout the year. Friday of Danish Days can be a little slower and we think this is due to the set-up going on in the morning, and people arriving in town in the afternoon for the evening festivities. 33 Solvang Visitor Center, September 2023
Solvang Danish Days 2023 Visitor Center InvolvementIn September, the Visitor Center team assisted the Solvang Danish Days Foundation with this year’s Danish Days festivities. We were responsible for dispensing the “Dane For A Day” VIP packages to those who had pre-purchased them. To help make this a smooth operation, we volunteered to open our doors early at ~8:20 AM on the Saturday of Danish Days weekend (September 16, 2023). This allowed the VIP package holders to get in line for the Danish Days breakfast when the line opened at 8:30 AM.We also had an entry in the Saturday Danish Days parade, titled “Biking Vikings!”“Come together to the Visitor Center where the wheels of information are always spinning.”And, of course the Visitor Center was decked out in Danish flags in honor of the Danish Days celebration. 34 SOLVANG I Solvang Visitor Center, September 2023 I
As suggested in the previous City Council meeting by Council Member David Brown, as a team, we are currently working on a "10 things you should know about Solvang" list to possibly be added to the SolvangUSA.com website.
"Things you should know about Solvang" List
As the Visitor Center Team was discussing items to add to this list, we did note that the SolvangUSA website still has a nice 'frequently asked questions' page. But here are some ideas that have come from speaking with Solvang visitors and the questions and conversations that we have had with them:
• The correct visitor center information including what is offered in the visitor center; maps, visitor guide, answers to questions, and more. People are often surprised by all of the suggestions and information they receive at a visitor center. They tell us how glad they are that they came in to speak with us because they would not have known about all of the great things to see and do in town. • Solvang is bigger than you may think! There is room for shopping, dining, wine tasting, six Danish bakeries, five museums, eMoke vehicles to drive, Surrey bikes to ride, a Trolley tour, virtual reality adventures, all types of restaurants, special events, fun parks, and so much more! (Visitors often speak of how surprised they are by the size of Solvang and the scope of things there are to do. They often tell us they wished they had planned for more time in our village.)
35 SOLVANG I Solvang Visitor Center, September 2023 I
"Things you should know about Solvang" List (continued) • Solvang has some of the most authentic Danish Pastries outside of Denmark. People who visit Solvang quickly become foodies as they find out how fantastic our pastry is here. We are questioned each day about "Which one is the best bakery?" They soon find out that all of them are wonderful. • Solvang has FREE parking all day! (We get asked, "Is parking here free?" all of the time. People love this so much about Solvang. They tell us how wonderful and unique this is every day.) • Come see the windmills in Solvang! Yes, Denmark has windmills! (Many visitors ask why we have windmills in Solvang. They think that only the Dutch have windmills.) The visitors commonly ask us to point out all of the windmills in town for them because they want to see them all. • Solvang is friendly and welcoming to all! We have visitors from all over the country and even from all over the world, and we love to share our special town with everyone! Thank you for giving us the opportunity to serve so many wonderful people from all walks of life! 36 'IJ ;<Y/fl Solvang Danish Days 2023 /compiled October 2023) Online (Eventbrite) Aebleskiver Breakfast ticket and "VIP" package sales history from DD 2016 through this year (DD 2023):

WEEKEND
Things to do this weekend: Celebrate Hispanic Heritage Month Danish Days: Solvang's sizable September celebration is not just about the cebleskiver breakfast, though pastry-loving people do adore those, nor is it about the Viking beer garden, as popular as it is, and that charming LEGO contest? For sure, that is a major draw. Wait: It's about all of those things, and honoring the windmill-y village's back story. Slip on your lucky clogs and go Solvang on Sept. 15, 16, and 17; the LEGO building happens the last two days, as does the cebleskiver contests, mmm.

Fan favorites like JEbleskivers (the pastry round), story time sessions with Hans Christian Andersen, a Viking encampment and an Old World artisanal crafts marketplace will occur throughout the weekend. Plus, there's a twoday LEGO-building competition.

CITY COUNCIL STAFF REPORT
AGENDA ITEM 4d
Meeting Date: October 23, 2023
SUBJECT: Approve Amendment No. 1 to the Emergency Agreement with MNS Engineers for engineering support and environmental permitting, for the South Alisal emergency repair project, for the additional amount of $39,490 for a contract total not to exceed $187,168, and extend the term to June 30, 2024 and authorize the Mayor to execute on behalf of the City.
PREPARED BY: Rodger A. Olds, Director of Public Works/City Engineer DISCUSSION:
The State of California experienced a major storm event on January 9, 2023. As a result of the impact to the storm, the County of Santa Barbara declared a state of emergency on January 9th, and the Federal Government approved Santa Barbara County's inclusion in the Federal Major Disaster Declaration on January 17th.
In Solvang, storm flows in Alisal Creek damaged and washed out the slope that supports South Alisal Road. This partial washout compromised the roadway and justified an immediate response by the City.
In order to immediately reduce the risk to the road, the City established a partial lane closure of the shoulder and part of the northbound lane that is closest to the creek. City staff then contacted one of the on-call engineering firms, MNS Engineering, and a local contractor Hanly General Engineering Corp., to help assess the situation and formulate a plan to access the creek and properly rebuild the slope.
On February 13th City Council approved emergency contracts for the construction of the repairs as well as the engineering assistance from MNS. The contract with MNS Engineering included the scope below:
1. Initial project assessment and coordination of permitting.
2. Construction Environmental Monitoring - Biologist
3. Army Corps Permit compliance.
4. Design of Mitigation Plan
The initial construction work has been completed. The work was anticipated to take 20 working days.
Due to working conditions and rain delays the work took 44 working days to complete. This additional timeframe for construction and environmental oversite was accommodated within the overall original contract amount; however, this used up the planned contingency worked into the original contract as well as some of the anticipated budget for the Mitigation Plan design and approval process.
As directed by the California Office of Emergency Services (CaIOES), staff reached out to the Army Corps of Engineers to assist with the environmental permitting to allow access to the creek. The Army Corps coordinated with several federal and state permitting agencies and provided an emergency permit to allow creek access on February 7. The permit required environmental monitoring by an onsite biologist during construction, and the development of a post-construction mitigation “Remediation” plan to reestablish the creek bank to as close to a pre-event condition as possible.
The design of the mitigation plan has been completed. This was submitted to the Army Corps of Engineers, and much like the initial permit, was reviewed and coordinated with federal and state permitting agencies several. MNS and City staff negotiated with the permitting agencies to arrive at a 91 reasonable mitigation plan. The design and negotiation process required several submittal iterations with the permitting agencies prior to approval.
The scope of the remediation requirements was unknown at the time of the initial contract, and therefore the required oversite was not included in the scope of the original contract. Per the permit requirements and the remediation plan approved by permitting agencies, specialized plantings and oversight by a certified biologist are required.
MNS provided a proposed contract amendment to address to additional work necessary to coordinate the multiple submittals and negotiation with the permitting agencies that was beyond the original scope, additional construction administration and oversite necessary to complete the initial construction work as well as the oversite of the implementation of the remediation plan per the permit requirements. The proposal includes a not-to-exceed price of $39,490.
Staff has reviewed the proposal, feels that the proposed not to exceed amount will be more than enough to complete the requirements of the Army Corps permit, and will make every effort to employ cost controls to reduce the upcoming costs to deliver this project. The remediation work is anticipated to be completed before the end of the year. Staff recommends extending the contract term by an additional 6-months in order to allow for additional reporting submittals and coordination with the permitting agencies before closing out the permit.
ALTERNATIVES:
The City Council may decide not to approve the proposed contract amendment. This would require the City to find alternate means to provide the necessary oversite by a biologist, per the permit requirements
FISCAL IMPACT:
This additional expense will initially be incurred by the City; however, these expenses are eligible to be reimbursed in large part by the Federal Emergency Management Agency (FEMA) and CalOES, and have already been included in the application submitted to FEMA.

SUBJECT: Amendment #1 Request - Alisal Road Emergency Embankment Repair FEMA DR4683-CA
CISOL.200359.12
Dear Mr. Olds:
Thank you for the continued opportunity, supporting the City in the restoration of Alisal Road which was damaged during the recent winter storm damage. At this time an amendment is necessary to complete the work due to unanticipated changes during construction and additional work effort we have provided which was outside the original scope of work outlined in our February 8, 2023. As you know construction is complete, except for implementation of the required Mitigation Plan which is pending permitting agencies.
Original Scope of Work
MNS originally proposed to perform the following services for the City:
Provide Project Management Services, Office Assistance - Project Support, Construction Support, As Built Mapping and Environmental Services.
The original proposal included time for a Stormwater Lead to inspect the project during construction. That work was performed by the Construction Inspector so compensation included in the original proposal is shown in this amendment as a "Credit".
Unanticipated Scope Changes
Task #1 - Project Management Services: The original project schedule called for construction to be completed in approximately 20 working days, but due to additional work the construction took 44 working days plus an additional 17 rain days. Below is an estimate of additional hours:
Senior Project Manager: 42 hours
Principal in Charge: 2 hours
Task #2-Office Assistance: As part of these services, MNS provided additional services to obtain the project NOi and anticipates filling the NOT at project completion in support of the project that was not originally included in the scope of services. Below is an estimate of additional hours:
Office Administrator: 18 hours

Task #3 - Construction Support: With the increase in working days for construction, MNS provided additional inspection support onsite to track the Contractor's time and materials and ensure the additional work was performed in accordance with the Contract. Below is an estimate of additional hours:
Senior Construction Inspector: 190 hours
Task #5- Environmental Services: With the increase in construction working days, and the enhanced mitigation plan required by the resource agencies additional time is necessary for the Biologist to be present at a pre-construction kick off meeting for the Mitigation Plan work along with observation during the initial days of the work starting to ensure proper installation. Below is an estimate of additional hours:
Biologist: 16 hours
Compensation
Based on our understanding of the status of the project, we have estimated that the following additional fees will be required to complete the project scope MNS is working on. It should be noted that this is a preliminary opinion only and is provided on a time and materials basis. Below is an estimate of additional hours:

Additional Time and Materials (Not to Exceed)
Conclusion
$ 6,960
$39,490
We look forward to working with the City of Solovang to complete this project. Please feel free to contact Robert Newman with any questions you may have about our proposal at 661-510-0111 or [email protected] or me at 805.331.4848 or [email protected] Sincerely,

AGENDA ITEM 6.b
Meeting Date: October 23, 2023
SUBJECT: Discussion and Possible Action to Provide Direction to Staff Regarding City Position on Potential Mask and Vaccine Mandates
PREPARED BY: Randy Murphy, City Manager
DISCUSSION:
In light of the recent surge in Covid statistics, along with the fact that other jurisdictions have taken a stand against mask and vaccine mandates, there was Council consensus at a recent meeting to agendize this matter for discussion and possible action.
The attached resolution was approved by the Huntington Beach City Council at its October 3rd meeting.
It is provided as a possible template should your Council choose to adopt a similar position.
Staff requests direction from Council on how to proceed regarding this matter.
ALTERNATIVES:
Options include:
1. Direct staff to modify the attached resolution and bring it back for adoption at a future meeting; or
2. Direct staff to do additional research and bring the findings back to Council for continued discussion; or
3. Do nothing; or
4. Another option as directed by a Council majority.
FISCAL IMPACT:
There would be no immediate fiscal impact. However, there could be consequential effects directed by state or federal authorities for non-compliance with any related mandates that they might impose.

Caution! This message was sent from outside your organization.
Dear Council Members:
I would like to go on record in opposition to the proposal scheduled to be discussed at the October 23, 2023 Council meeting regarding mask and vaccine mandates. It would seem that certain city council members are creating issues that do not exist. Mask and vaccine mandates should be made in the context of a real present situation, not on some hypothetical or in speculation of some future issue. Moreover, such mandates should be made based on recommendations of health professionals; not the city council members who have no expertise in the area.
Furthermore, by raising this issue now, the council would appear to be casting aspersions on individuals who have made the personal decision based on their individual health to wear masks even if not mandated.
The City of Solvang has many other pressing needs and issues which should be the focus of the city council rather than some manufactured circumstance.
Sincerely,
Sandra Dunn

Dear Council Members
I would like to go on record as to strongly oppose any consideration of mask and vaccine mandates by the City Council for the residents of Solvang as scheduled to be discussed at the October 23, 2023 Council meeting.
Public health requirements to mandate the use of or restrictions of masks or vaccines for the citizens of the City of Solvang are the purview of the County Health Department and the CDC. These are personal decisions based on individual health needs and scientific research.
I will make my decisions based on consultation with my Doctor.
There is no question that the City should always insure the general health and safety of the residents of Solvang, but not mandate indivdual choices.
Sincerely,
Dick Barbar

CITY COUNCIL STAFF REPORT
AGENDA ITEM 6.c
Meeting Date: October 23, 2023
SUBJECT: Discussion and Possible Action to Provide Direction to Staff Regarding Improvement Projects in Hans Christian Andersen Park
PREPARED BY: Jenny McClurg, Parks and Recreation Director Rodger Olds, Public Works Director
DISCUSSION:
Staff seeks direction on the improvements at Hans Christian Andersen Park including the pickleball courts and other potential improvements throughout the park.
The pickleball courts were initially constructed by Solvang staff in November of 2020. The courts are on two concrete slabs that measure 60-feet by 30-feet. Each slab was constructed in a manner that is consistent with general concrete flatwork construction, which includes expansion joints every 10-feet in all directions. These expansion joints were filled with a flexible fill material and a hard colored surface was installed to create the court playing surface and boundaries.
The courts were officially opened after a ribbon cutting ceremony on May 27, 2021. In December of 2021, staff applied and received Prop 68 grant funding for a total of $177,952 to go toward park improvements. Part of that funding was to go to additional needs at the courts such as fencing, benches, hardscape and landscape. Staff developed a plan for the completion of the courts which included drainage improvements, fencing, and additional hard surface for spectators and those waiting to play.
Before construction of the planned improvements staff started getting complaints regarding the court surface at the expansion joints. After examination and research with industry professionals, it has been determined that the flexible expansion material and the expansion and contraction of the slabs is not compatible with the necessary hard surfacing needed for the pickleball playing surface. The solution is either a full replacement of the underlying concrete slabs or the construction of a new slab over the existing courts which would add 7-inches to the elevation of the existing courts.
On August 28, 2023, Council approved the FY 2023/24 Capital Improvement Program (CIP) which included $275,000 for the improvements to the pickleball courts. This included $99,000 of grant funding to be reimbursed to the City as well as $176,000 from the General Fund. The pickleball courts are heavily used in the mornings and late afternoon/evenings. The City recognizes that pickleball is the fastest growing sport.
As presented at the meeting, staff has analyzed options for the pickleball courts and is now seeking direction from Council before moving forward with the project. Staff seeks direction for the following three options:
Option 1 – Resurface Existing Courts
This option includes the installation of Post-tension concrete slab on top of the existing courts. This would raise the courts by 7-inches and provide two pickleball courts in the same position, add fencing, drainage improvements and hardscape/landscape. Temporary pickleball courts would be set up on the tennis courts. The estimated cost is $225,000. This option is shown on Attachment A.
Option 2 – Remove/Replace Existing Courts
This option includes the full removal of the existing slabs, grading, drainage, and improvements to install 2 or potentially 3 new courts, all facing the same direction, add fencing and 120
hardscape/landscape. Cost is estimated to be $275,000+/-. Use $99,000 from Prop 68 grant funding and remaining from general fund. Temporary pickleball courts would be set up on one tennis court. during construction. This option is schematically shown on Attachment B.
Option 3 – Convert 1-2 Tennis Courts to Pickleball Courts Convert one to two tennis courts to get four-eight pickleball courts. Cost $15,000 for re-painting, nets and signage. The remaining $84,000 of grant funding could be used on trail improvements, ADA access to courts, conversion of the existing pickleball slabs to workout areas or other or other listed improvements in the Prop. 68 grant application.
We do recognize that the City was gifted a large sum of money from the late Harry Stearns who was an avid tennis player for major repairs in 2020 to the current tennis courts and we want to keep this in mind.
It should also be considered that there are other recently identified needs in HCA Park that are not identified in the Prop. 68 grant and therefore are not eligible for grant reimbursement. The most pressing need is repairs to the Park Host home located on HCA Park that was recently vacated by the long time park host. These improvements would need to be funded through the general fund.
ALTERNATIVES:
Council can direct staff to pursue either of the 3 options presented or pursue other options. The grant funds must be expended by June 30, 2024.
FISCAL IMPACT:
None. Staff intends to work within the currently approved FY2023/24 CIP ATTACHMENTS:

Jenny,
I vote for option 2. If we have no noise complaints so far current location lets keep it same area but a big redo. I would love to see one of the tennis courts relined for pickleball and maybe shortterm mobile nets go up while the construction going on. One tennis court can be lined for 2 pickleball courts. When construction is over it can go back to tennis court.
Thanks Jenny

Dear Council Members,
• -l::ef
I just this moment found out that you were actually considering converting some, or one, of the 4 tennis courts at HCA to Pickle Ball. I STRONGLY and ABSOLUTELY PROTEST this idea! I have played tennis there for 26 years, or maybe more.
Harry Stern was a friend of mine and a player and supporter of those courts. He and many of our friends cleaned the courts, bought brooms, sweeping tools, rain water scrapers, and more, while supporting these courts .... FOR YEARS! Then, when Harry died, he donated a large portion of his estate to do a first-rate job of resurfacing these 4 TENNIS courts. I am sure you know that he was very specific in that this money was for TENNIS COURTS! I can tell you that over the 26 years of experience I have had playing at HCA there are of course brief periods where no one is on the court. BUT, there are just as many times where there is a waiting line; a queue. Sure, Pickle Ball is great, and it is quite popular now. There is a GOOD reason to build 2 more courts at the other end of the park. However, it is completely wrong and unfair to hear the voices of a few new people OVER the wishes of SO MANY tennis players, young new tennis players, and Harry Stern who paid so much for these courts. Please DO NOT convert these courts!! Thank you,
Verne Parmenter

To whom this may concern.
I play tennis, I played many years with my friend Harry." NO WAY IS IT OKAY FOR YOU TO CONVERT ANY OF THOSE FOUR HCA TENNIS COURTS TO PICKLEBALL." Our friend Harry Stern specifically donated part of his estate for these 4 tennis courts. Please do not convert them to pickle ball courts.
Any questions, feel free to contact me.

Dear Members of the Solvang City Council,
I hope this letter finds you in good health and high spirits. I am writing to you as a passionate tennis player to express my unequivocal support for Option 2: the replacement of the existing two pickle ball courts and the addition of a third, rather than replacing the two tennis courts.
There are a few salient reasons why I believe Option 2 is in the best interests of our community:
•
Qiverse Recreational Facilities: Solvang, being a vibrant community, thrives on diversity and inclusivity. By retaining our four tennis courts and expanding our pickle ball facilities, we are allowing for a wider range of recreational activities for residents of all ages. It is important to cater to the needs of both tennis and pickle ball enthusiasts.
Growing Popularity of Pickleball: Over recent years, pickleball has seen a significant surge in popularity. This easy tolearn sport is not only a great social activity but also offers a myriad of health benefits. By increasing our pickle ball facilities, we are recognizing and embracing this growing trend and ensuring that our recreational areas meet the demands of the community.
Preserving Tennis Heritage: Many of us have fond memories associated with the existing tennis courts. As a tennis player myself, I value the history and memories attached to these courts. Replacing them would mean disregarding our town's legacy in the sport.
While neither sport has a great many options of public places to play, the cost and land to build new tennis courts is simply far greater than building pickleball courts, making it more probable and easier for pickle ball courts to get built in the future. Replacing the few courts we have left will further the decline of the sport, and further limit the number of places tennis players can still play on public courts. Not only this, but HCA serves the Buellton population as well, as 1 there are ZERO public tennis courts in Buellton. This, in combination with other proposed pickle ball court projects, makes me firmly believe that we cannot lose any further tennis courts for our community.
In conclusion, Option 2 is not just a matter of favoring one sport over another. It's about recognizing the significance of both sports in our community and making informed decisions that will benefit the most significant number of residents.
I implore you to consider the merits of this option, and I am confident that in doing so, you will recognize its potential in enriching the recreational landscape of Solvang.
Thank you for your time and consideration. I am hopeful that the Solvang City Council will make a decision that resonates with the best interests of our beloved community.
Warm regards,
Erica Olesen

Hello!
Thank you so much for addressing the need for more pickleball courts in our valley. I am a frequent user of the Hans Christian Anderson Park pickle ball courts and YES we definitely would benefit from more courts. Pickleball is rapidly growing and it is here to stay. It is such a benefit to the community from a health and social perspective.
Looking at the 3 options for pickleball additions. I would support option number 3. It shows using 2 tennis courts to create 6 pickle ball courts. This is the correct ratio that would allow for fencing in between all courts and also space for a bench. This is very important to eliminate crowding of the courts. I support it as it is drawn on your agenda.
Thanks for your work on this important valley issue.

Sent from my iPhone I would vote to put Pickleball courts up above on a tennis court and see how it worked out if there was any conflict or problem, they could actually be moved fairly easily, plus with 6 courts . You could actually have tournaments. This morning there was 18 players trying to get a little playtime in and it's getting to be quite a wait . 1 From:

Greetings
. -±S±&--
My name is Joan Red en. I have been a pickleball player since Buellton Rec made the introduction n 1any years ago. As most people who learn this game, I became immediately hooked. I had previously played tennis for many years so this was similar in some ways but also different, and so much fun.
Several of us in a group collected donations amounting to almost$10,000. as the City of Solvang had requested of us, to put in PB courts at HCA, which subsequently was done incorrectly and needed to be somewhat resurfaced. We were grateful to have two courts but since then the need has grown and even 3 courts would not be enough with the locals and tourists.
I have also run a FaceBook page for Santa Ynez Pickleball, and I cannot tell you how many people over the years have contacted me about where to play pickleball in Solvang. Most PB travelers travel with their paddle! My peer, David Gay and I have given free clinics at HCA through Solvang Park & Rec. to introduce PB to the community and people were addicted immediately, and still play. So, more and more locals are joining the PB train.
I vote for option 3 because it gives us more courts, but in reality I am asking if the cun:ent courts can also be redone so we have a few more courts. The future of PB is here to stay and gi·o,ving more and more. This way, the city would be preparing sooner for the growth of the sport for years to come, without having to add more later.
We have a group of experienced and dedicated players that would be happy to meet with anyone to discuss tbis in depth.
Thank you,

Dear Council Members:
A5H8 -··er:·-:r:: + ,
There is only one solution to the pickleball courts at HANS and that is to remove the two existing courts, hopefully saving the nets, and replacing these with three new courts as shown on your design plans. That is, parallel and aligned with the tennis courts.
Raising the existing courts leaves them perpendicular which is a problem, and also doesn't allow for a third, necessary, court. There is also the elevation problem.
Leave the restriping of the tennis courts for the future, should more courts be needed.
Thank you for your consideration.

Hello,
Allow sender I Block sender
My name is Valerie Nelson. I am a Solvang resident (1562 Aalborg Court) and avid pickleball player.
I am writing to express my opinion on the proposed improvements at Hans Christian Anderson park -specifically regading the pickleball court options.
I believe Option 2 is the best IF the pickleball lines can be maintained on tennis courts after the new pickleball courts are built This will leave those courts open to both pickball and tennis players. I have seen shared courts work in other locations such as Evergreen Park in Goleta.
This option can provide enough pickleball courts so that Solvang can have a offer a real playing experience to locals and visitors. Having several courts c;1vailable offers the opportuinty to break into ability appropriate groups, scrambles, perhaps even leagues and tournaments. It would be great to eventually have a combanation of open and reserved times.
Visitors often seek pickleball courts while traveling. Plenty of proper courts is a tourist attraction.
While option 3 is the most economical, I think it would ostacize and anger the tennis community. Although the tennis courts are clearly underused, those players must be taken into consideration. However, if the lines cannot be kept after construc tion of the new courts, only option 3 will provide enough pickleball courts.
I have attached a video from the park on a Sunday earlier this month. It shows the full pickleball courts, all the players waiting to play and the empty tennis courts.
Thank you to all of you for your hard work for our City.
Best,
Valerie Nelson

CITY COUNCIL STAFF REPORT
AGENDA ITEM 6.d
Meeting Date: October 23, 2023
SUBJECT: Discussion and possible action to terminate remote public comment via Zoom during City meetings
PREPARED BY: Dave Fleishman, City Attorney
DISCUSSION:
At its October 9 meeting, the City Council meeting was subjected to a concerted effort by a number of anonymous individuals to voice antisemitic, racist and other inflammatory opinions and comments over Zoom during the public comment period. Fortunately, staff was able to mute and remove the individuals quickly and prevent the comments from being aired over the City’s other remote streaming channels and in the Council chambers.
This practice, known as “zoom bombing”, has been occurring on and off since public agencies started providing the opportunity to comment publicly via remote teleconference services such as Zoom, but in the past several weeks, multiple cities throughout the nation have been subjected to similar events.
Attached to this staff report are several news articles that describe the issue. As a result of these events, many cities are suspending the ability to comment during meetings via remote means, requiring those who wish to comment to attend the meetings in person, or to provide comments via written forms such as mail or email.
There is no legal requirement for the City to provide a remote meeting service for its Council meetings.
During the COVID-19 pandemic, many agencies transitioned to using remote meeting services to continue allowing public participation during a time when in-person meetings were either prohibited by health regulations, or were impractical due to social distancing requirements. Although COVID-19 remains prevalent in most communities, the urgency of limiting public gatherings no longer exists to the degree that remote meetings are the only practical substitute for in-person meetings.
Although there are certain restrictions under the Brown Act if the City allows one of its Council members to appear via remote teleconference, the Brown Act does not mandate that remote meetings be made available to the public. Thus, staff seeks Council direction on whether to continue allowing public comment via Zoom, or whether Council wishes to only allow public comment in the Council chambers or via written communication. The Council could continue broadcasting via local cable access television and YouTube as it does now without allowing remote public comment, so those unable to attend the meeting in person would still be able to observe the meetings. They just would not be able to comment.
Council could also direct staff to investigate alternatives that allow only invited persons such as consultants or other board members to comment remotely, which might involve pre-registration for the meeting in advance of the meeting.
ALTERNATIVES:
The Council could decline to terminate remote public participation in meetings and give staff alternative direction.
FISCAL IMPACT:
There is no fiscal impact associated with the termination of remote public comment. There may be cost savings from reducing the number of remote broadcast platforms on which the City Council meetings are streamed, but the amount is not expected to be significant.

Walnut Creek City Council ends
virtual public comments at meetings
due to hate speech
By Pete Suratos • Published October 4, 2023 • Updated on October 5, 2023 at 5:36 am
The city of Walnut Creek is ending virtual public comments during City Council meetings due to “Zoom-bombing” by anonymous users spewing hate speech.
One incident was caught on video from a Walnut Creek City Council meeting last June. That’s when an anonymous caller made some offensive remarks during a virtual public comment.
What was once a useful tool during the pandemic is quickly becoming a pulpit for hate speech. But it recently took a dark turn when a Zoom caller released some personal information about a councilmember. “They had gone to another level where they announced an address that was a private home,” said Walnut Creek Mayor Cindy Silva.
Silva says the City Council is ending virtual public comment during meetings due to the hate speech, and unfortunately, the city is not alone. “El Cerrito stands united against hate,” said El Cerrito Mayor Lisa Motoyama.
Motoyama announced during Tuesday night’s El Cerrito council meeting that the city is also ending virtual public comment after dealing with a similar experience.
Sonoma County’s Board of Supervisors is doing the same. The board released the following statement:
126
“The change is due to the escalating challenges of maintaining civility among those who participate in the public comment portion of the board meeting via Zoom.”
During Tuesday night’s Richmond City Council meeting, a Zoom caller used the virtual public comment to make offensive remarks about the LGBTQ community.
Cesar Zepeda, who is Richmond’s first openly gay man to serve on the council, says the city will now have to discuss the future of virtual public comment at its next meeting on Oct. 17.
“It sounds like they just have some kind of agenda where they probably want to go to every city council meeting and try to stir things up,” he said. 127

Area public meetings, are the
Zoombombers winning?
Facing a lack of options, some cities are cutting off
virtual public comment

Walnut Creek City Council meetings, administrators have few options but to sit in mortified silence as extremists and other online trolls spew hate speech, usually under the cover of anonymity.
These “Zoombombing” incidents are on the rise, and officials around the Bay Area are throwing up their hands in frustration — with many unplugging from remote comments altogether.
Last week, Walnut Creek became the latest city to announce that council and commission meetings will no longer be accessible via Zoom — joining a growing list of local governments that are able to legally make the change after California’s COVID-era emergency orders expired. Anti-hate groups are even considering proposing changes to California’s hallowed Brown Act, which guarantees public access to civic meetings, to try to deal with the problem.
Elected officials in Antioch, El Cerrito, Fremont, Modesto, Sacramento, Santa Rosa and Sonoma County have also decided to cut off virtual public comment.
While video conferencing platforms helped keep public meetings accessible during the pandemic, the technology has also allowed anonymous bigots and trolls to interject racist, anti-Semitic and homophobic messages into civic proceedings — even from thousands of miles away.
In Walnut Creek, Zoom comments will be phased out by Oct. 16. Community members will still be allowed to share their views in person at City Council and Commission meetings, or submit comments by email, phone call or snail mail. Meetings will still be available to watch through the city’s website, YouTube streams and cable television.
Walnut Creek City Councilmember Kevin Wilk, who has been personally targeted by anti-Semitic comments spewed through the council chambers’ speakers, said he supports the city’s decision.

“I can’t stress enough to how disappointing and unfortunate it is that we even have to be having these conversations,” Wilk said, adding that he recently joined more than 100 representatives from the California League of Cities in brainstorming ways to combat Zoombombing and other forms of hate speech. “(Zoom and other online platforms) are great tools of communication that we didn’t have 20 years ago. But unfortunately, we also have a segment of the population that will use that for hateful or nefarious means. All it takes is a few people to ruin it for everybody.” Betsy Burkhart, Walnut Creek’s communications manager, acknowledged that some people may feel public comments are more impactful when spoken directly to elected officials, even if written input technically carries the same weight. However, she said one of the biggest motivations for the change was reclaiming decorum since hateful comments can have a chilling effect on a city’s ability to govern effectively.
“What we’re trying to do is make sure that a council meeting is safe for all of the people that are there to do their business or have issues about what the city is doing,” Burkhart said. “That’s really what the focus is; it’s not just a forum, it’s an actual business meeting.”
Farther south in Santa Clara County, the Morgan Hill City Council was struck this week by four public commenters who read excerpts from a neo-Nazi text about ethnic and ideological cleansing, in addition to spouting antiSemitic, racist and homophobic rhetoric.
But they are taking a different tack with these incidents than officials in Walnut Creek.
“No matter how awful those grievances may be, or how reprehensible their comments are, they have the right to make them,” City Attorney Donald Larkin said between speakers. “But Morgan Hill (and) our City Council has constantly affirmed this city as an inclusive community, and one that welcomes people of all faiths and beliefs. The comments that we’re hearing 130
do not reflect the views of the city of Morgan Hill.”
The City Council and staff deliberated over the limitations of free speech between the comments, denouncing many of the statements as they came.
After the public comment period, Morgan Hill Mayor Mark Turner began his typical thanks to public commenters, then paused and said, “We appreciate you calling in. … Well actually, we don’t appreciate you calling in, I’ll just be honest with you. I think it’s disgusting.”
Though they may appear unconnected, incidents like the ones in Walnut Creek and Morgan Hill are part of a wider, coordinated effort that has taken place across California and the United States, according to August 2023 reporting by the Anti-Defamation League’s Center on Extremism. The efforts largely appear to be led by anti-Semitic and White supremacist groups, who organize attacks using social media and chat rooms, the report says.
Marc Levine, the ADL’s Regional Director for Northern California, said these groups have organized to use public comment periods, especially over Zoom, to take advantage of the First Amendment and California’s open meeting laws and spread their message to a captive audience.
After the public embraced virtual meetings as a convenient way to engage with local government during the pandemic, Levine said hateful antagonists are now “trying to take that space away.”
He said the ADL is currently working to draft legal strategies that could protect free speech while shielding public officials from hate speech. In particular, they are eyeing amendments to California’s Brown Act and Bagley-Keene Act, which together guarantee the right to attend and participate in public meetings of local government and public agencies.
In the meantime, these new procedural changes have sparked some questions about whether public access will be reduced too much, especially for people who are disabled or face other physical and social barriers to 131
attending meetings in person.
Kathi Pugh, a member of Berkeley’s Commission on Disability who is actively pushing for more flexible remote participation options, said Zoom introduced dramatically simpler options for community members to connect with their elected representatives, especially because many people find it easier to ramble on the phone or in front of a computer than write cohesive letters for submission. Additionally, she praised the accessibility that comes with the ability to stream a Zoom meeting from a computer or cell phone, especially when discussions are captioned with live transcripts.
Pugh was pleased to hear that options to share comments via phone, email or snail mail will continue. But she said she hopes that city councils, commissions and boards will be open-minded about potential accessibility concerns.
“It’s really a shame when some people’s speech or behavior cuts (access) off for so many other people,” Pugh said. “That does worry me, but I can sympathize, because I think they (local leaders) are in a tough place.” 132
