d. Discussion to provide direction to Staff regarding the termination of remote public comment via Zoom during City meetings.
8 City Attorney David Fleishman reported at the October 9, 2023 City Council meeting, there was a concerted effort to disrupt the meeting with antisemitic, racist and inflammatory statements; noted this is happening everywhere, across the nation and many public agencies are addressing the issue by removing the Zoom option; stated there is no legal requirements for the City Council to conduct meetings by Zoom and asked whether City Council wishes to continue having the Zoom option for meetings.
Discussion followed regarding other vendors with similar platforms and increased security, the ability to limit Zoom comments by having participants enter with a secure link, challenges with verifying that comments are legitimate, removing the public’s ability to comment, remotely, and the frequency of Zoom bombing incidents.
City Manager Murphy reported that Zoom bombing happens a lot and was the subject of a discussion at a recent League of California Cities meeting and commented on issues related to Microsoft Team.
Discussion followed regarding exploring whether Zoom has levels of access that can be controlled by meeting hosts, challenges in terms of gatekeeping, the importance of public participation in meetings and existing parliamentary procedures to run meetings effectively.
Mayor Infanti suggested making no changes for a few more meetings to determine if the problem persists and then consider limiting access.
Mayor pro tem Elizabeth Orona asked about how the presenter in the League of California Cities meeting addressed the issue and City Manager Murphy reported they decided to eliminate Zoom, altogether.
Councilmember Brown asked whether a Sergeant at Arms could be appointed, and City Attorney Fleishman responded affirmatively, but noted the Mayor is ultimately responsible for running a meeting.
City Attorney Fleishman talked about the issues that are confronting City Attorneys from a legal standpoint; stated the law has not been fully established and discussed consistency with the Brown Act and the First Amendment.

Peter Islinger, Aria Vue Daugherty advocated to continue to allow public comment via Zoom.
Jo Knatz, Pete Thomsen spoke for eliminating remote public participation.
Laser Freeman, Videographer, reported there were about twenty people that he removed from the meeting or did not allow in; stated he had been informed of the trend so he was not blindsided; noted there is an option where people may request to comment on meetings, 72 hours in advance and talked about a webinar being one-sided and redundant since the City uses Vimeo and YouTube.
There were no other public comments on this item.
Councilmember Clarke commented on how the City operated without Zoom; reported it is a casualty of COVID-19; stated he does not believe it is that big of a deal and suggested eliminating it.
Councilmember Claudia Orona felt that one day of being Zoom bombed should not cause the City to eliminate one more way the public can engage with their government and prevent people from participating from the comfort of their home; noted there are many reasons for people to participate remotely and indicated she would hate to see it go away.
Councilmember Brown talked about the importance and value of engaging in government as a First Amendment right; stated he would prefer keeping things the way they are with greater security or 9 RSVPs and believed that if the City reacts by eliminating Zoom, the thugs and racists win.
Mayor pro tem Elizabeth Orona stated she is up for that fight; concurred with Councilmembers Orona and Brown in terms of making sure the City provides ample access to two-way dialogue with the community and spoke about including governance, control and identification of who is participate in the two-way dialogue.
City Council offered direction to staff to continue providing access to meetings via Zoom and return to Council with security protocols and potential options for excluding participants who engage in bullying and/or inappropriate comments.
City Council returned to Item No. 6.a. and followed the remainder of the agenda, as presented a. Discussion to provide direction to Staff regarding Measure U Oversight Committee Appointment
Administrative Services Director Berry discussed the recruitment process; noted that there are no qualifications set in the Municipal Code for the Committee; reported the City began accruing funds in April 2023 and referenced the attached application and notice of publication. She addressed the purpose, duties and responsibilities of the Committee and reported Council appointments will take place on the January 8, 2024 City Council meeting.
City Manager Murphy added that since the Committee is appointed by City Council, it is subject to the Brown Act.
Discussion followed regarding requirements to meet at least twice a year.
There were no public comments on this item.
Councilmember Brown stated that in terms of qualifications, being a resident of the City would be important but questioned whether to include business owners as they are not voters.
Mayor Infanti supported including business owners in the qualifications.
Mayor pro tem Elizabeth Orona commented on a potential conflict in terms of benefiting the City or the business owner’s business.
Councilmember Claudia Orona reported this will be money to be spent in Solvang that will benefit the community as a whole, rather than bringing revenue to the City and felt it should benefit those who live in the City.
Discussion followed regarding omitting qualifications entirely and prioritizing having some ability to read a budget and understand typical expenditures.
City Manager Murphy reminded Council that business owners contribute sales taxes to the City, thereby contributing to Measure U funds and suggested limiting the number of business owners in the Committee.
City Attorney Fleishman noted potential challenges when each Councilmember appoints one Committee member.
Mayor pro tem Elizabeth Orona suggested adding a requirement within the application to disclose their financial background.

Motion by Mayor Infanti, to approve the recruitment and application process including requirements that an applicant must be a resident of Solvang or a business owner, seconded by Councilmember Clarke and carried 5-0.
b. Discussion to provide direction to Staff regarding City position on potential Mask and Vaccine Mandates

Councilmember Orona referenced the Huntington Beach resolution; noted that Solvang never had that mandate and wondered if this is what is needed to get Sacramento off the City’s backs.
City Attorney Fleishman stated the that Huntington Beach has taken an aggressive legal position that has been repeatedly spurned by the courts; noted the courts are the ultimate arbiter to determine what is and is not legal in Huntington Beach.
Councilmember Orona reported that during COVID, people were basically regulating themselves and felt it is not the City’s business to tell business owners how to conduct their business or how to keep themselves safe and did not feel the resolution is necessary as there are many more important things for the City to consider.
Councilmember Clarke spoke about other cities that are looking to do what Huntington Beach did; talked about the importance of sending a message to Sacramento to say Solvang will not go through this again; discussed the City’s reliance on tourism and impacts to businesses related to COVID and commented on industries that suffered losses.
Councilmember Brown talked about civil disobedience being an option of mandates are put in place.
Mayor pro tem Elizabeth Orona talked about how everyone suffered during COVID in various degrees and suggested the need to be compassionate; she discussed increases in the variant; noted there have been no mandates imposed; opposed creating a mandate to oppose other mandates and asserted this is not worth the risk of putting potential State funding at risk. She added that the City should take it on if and when it becomes an issue.
Mayor Infanti took a poll of Councilmembers and 4-1 agreed not to take any action on this matter, at this time, with Councilmember Clarke opposed.

Parks and Recreation Director McClurg commented on the possibility of putting a sports court over the existing tennis courts and related costs.

Discussion followed regarding opportunities for more space at Sunny Fields Park for pickleball, use of Prop 68 grant funds only for HCA Park, other areas at HCA for pickleball courts, the need to consider costs, making existing courts usable by installing a sports court over the existing tennis courts and timelines.
Public Works Director Olds spoke about utilizing the current resources to make it work best.
Mayor pro tem Elizabeth Orona spoke about increased demands for pickleball; noted it cannot be ignored that Mr. Sterns intended his donation to go towards preserving tennis; felt it would be good to know the demand versus use of tennis and pickleball courts; supported having multiuse on one of the tennis courts for pickleball as a trial to see if the two sports can coexist.
Councilmember Clarke felt that if changes are going to be made to the tennis courts, then the City should consider returning the money to the Sterns Trust.
City Attorney Fleishman reported that the bequest was expended for the purposes that it was granted and does not mean that Mr. Sterns controls City property in perpetuity.
Discussion followed regarding costs for resurfacing the courts, the balance of money in the grant, costs for fencing and considering options with the money the City currently has.
Councilmember Brown spoke about exploring a different site at HCA Park that is easier to grade for pickleball and leaving the existing pickleball courts as they are.
Mayor pro tem Elizabeth Orona suggested expanding the scope of the survey to determine if there are additional locations that could be assessed and requested additional information to see what can fit. 12 City Council concurred to direct staff to do the analysis to see what can be developed at the various locations and come up with accurate costs.

34 CITY COUNCIL STAFF REPORT
AGENDA ITEM 4.f
Meeting Date: November 13, 2023
SUBJECT: Discussion and possible action to adopt Resolution No. 23-1237 approving the First Amendment to the MOU among the Association of Monterey Bay Area Governments, Santa Barbara County Association of Governments and the City of Solvang to extend the term for REAP grant funding to March 2024
PREPARED BY: Randy Murphy, City Manager
A. Rafael Castillo, AICP, Planning Manager
DISCUSSION:
In September 2019, Assembly Bill 101 was adopted allocating $125 million in housing planning funds to regional entities throughout the state. The purpose of these Regional Early Action Planning (REAP) grants is to provide regions in California with one-time planning funding for the preparation, adoption, implementation of plans and processes that accelerate or increase housing supply and fulfill the 6th Cycle Regional Housing Needs Allocation (RHNA). The Association of Monterey Bay Area Governments (AMBAG) serves as the fiscal agent for the region that includes the Santa Barabra County Association of Governments (SBCAG), to which the City of Solvang is a member. In August 2020, the City Council authorized acceptance of funds for the REAP grant totaling $117,000 to assist the city in completing its Housing Element update and General Plan update. The MOU was executed by the City in March 2021.
The City began work on its General Plan in 2021. Since that time city staff and its consultants have been working on updating all the required elements of the General Plan. The General Plan update has experienced delays in processing due to a turnover in city staff, along with delays in completing the technical studies to release the General Plan Draft EIR. It is expected that the Draft EIR will be released to the public in early February 2024. The original deadline to expend all the grant funds by the Memorandum of Understanding (MOU) was November 1, 2023. City staff requests the Council authorize an amendment to the original MOU, extending approved expenditures for this effort until March 31,2024. City staff also request that any future amendments extending the MOU be authorized by the City Manager.
ALTERNATIVES:
Provide alternative direction to staff regarding REAP funding.
FISCAL IMPACT:
The City is authorized to receive $117,000 in REAP grant funds to assist in updating the Housing Element and General Plan updates that require revisions to accelerate housing production. The proposed amendment extends the city’s ability to draw down these funds that will otherwise require additional General Fund revenue to complete the required updates.

52 CITY COUNCIL STAFF REPORT
AGENDA ITEM 6.a
Meeting Date: November 13, 2023
SUBJECT: Discussion and possible action regarding extension of the Marketing Services Contracts with Tom Jones Associates, Islett Agency, and Stiletto Marketing
PREPARED BY: Randy Murphy, City Manager
DISCUSSION:
Solvang issued a Request for Proposal (RFP) for Tourism Marketing Managed Services in April 2022.
The solicitation said that the Agreement would be for two years with a possible two-year extension. The firm that received the initial contract did not work out and short-term contracts were issued to Islett and Stiletto in early 2023. Those contracts were extended in May to run through the end of the year and TJA (who finished second in the original solicitation) was hired to work cooperatively with Islett and Stiletto while providing overall marketing services and revitalizing the SolvangUSA website.
Since we are rapidly approaching the end of those contracts, staff seeks Council direction for the continuation of these marketing services. By all accounts, the current arrangement is working well, and all three contractors wish to continue to provide their services. Since all of the contracted parties have exceeded expectations and cooperate with one another, staff recommends that Council authorize the continuation of this three-party marketing team. Staff will return at a future meeting for Council approval of a job description for a new Marketing Coordinator position that would round out the team.
ALTERNATIVES:
Options include:
1. Direct staff to return at a future meeting with amended agreements for an 18-month extension for each contractor; or
2. Direct staff to return at a future meeting with amended agreements for a 6-month extension for each contractor; or
3. Another option as directed by a Council majority.
FISCAL IMPACT:
An 18-month extension for all three vendors would total approximately $536,500. A 6-month extension would total approximately $157,000. The difference of $379,500 would be budgeted in FY 24/25.

COMPENSATION FOR SERVICES
SOLVANG TOURISM MONTHLY RETAINER FEE – JANUARY 2024 THROUGH JUNE 2024:
● $3,150.00 per month (to include use of specific CISION components for media tasks**) ** CISION is an expensive investment, and the time it would take to set up a City-owned account would not be conducive to productivity given the short term of this contract.
Consultant’s plan is to utilize existing CISION subscription, but turn over to the City all data or reports specific to SolvangUSA work, upon project or contract termination.
RECOMMENDED MEDIA EXPENSE BUDGET – JANUARY 2024 THROUGH JUNE 2024:
● $10,000.00 (January 1, 2024 through June 30, 2024)
o Media hosting and/or wire services funds, which would allow for approximately $1,667.00 per month of any additional, agreed-upon expenses which might arise.
Any unused funds would roll over to the following month. Funds would be used for any travel or hosting expenses for specific media visits/contacts which Solvang might incur and/or need to reimburse (such as gas or airfare, Solvang hotel costs, meals, etc., when contact is not hosted by local hotels, restaurants, or other businesses or activities). Funds may also be used for additional wire services such as press release distribution via PR Newswire. 72 REVISED – TO REFLECT WORK JANUARY 1, 2024 THROUGH JUNE 30, 2025

78 CITY COUNCIL STAFF REPORT
AGENDA ITEM 6.b
Meeting Date: November 13, 2023
SUBJECT: Discussion and Possible Action to Provide Direction to Staff Regarding Donating $450,000 toward Construction of the New Solvang Senior Center PREPARED BY: Randy Murphy, City Manager
DISCUSSION:
The Solvang Senior Center has provided service to the residents of Solvang and the greater Santa Ynez Valley for decades. As further described in the attached PowerPoint slides (and accompanying presentation), the existing building has outlived its useful life and is in dire need of replacement. While the original construction estimate for the new and larger facility was $3.3M, the Center recently learned that their project is subject to prevailing wage rules that will increase the cost by almost $900,000.
Although the City has contributed operating funds of over $300,000 since FY20/21, to date we have not donated anything toward the building fund that has so far collected over $3.6M in gifts and pledges from the community, including almost $600,000 from its own Board and members of the fund-raising Steering Committee.
As seen in the attached letter, the Center has requested that the City contribute $450,000 to help close the gap. This amount can be allocated in a lump sum or pledged as a certain amount over a period of time. Staff recognizes that this request falls outside normal annual grant window. However, given that construction cannot begin until the funding is secure, and extended delays always result in additional costs, staff believes that the circumstances regarding the shortfall warrant Council consideration at this time instead of waiting until spring.
Staff requests direction from Council on how to proceed regarding this matter.
ALTERNATIVES:
Options include:
1. Direct staff to return at a future meeting with the requisite grant paperwork along with the necessary budget adjustment for Council approval of the requested amount in:
a. One-time lump sum; or
b. Smaller amounts divided over X number of years; or
2. Same as number one but for a lesser amount; or
3. Decline the request altogether; or
4. Another option as directed by a Council majority.
FISCAL IMPACT:
If Council approves this request, staff will return with a more detailed financial impact analysis and a recommendation of the funding source, which could include Measure U.

This issue was not raised by the County when we negotiated our new lease in 2018 - but that does not mean it can be waived or avoided. The SSC construction project is considered a public works proiect due to our below-market rent for using the land on which the modular building sits. When a group receives such a benefit, it is then considered a "public works project" for purposes of the application of prevailing wage regulations. Littler Mendelson PC (a global employment and labor law firm) confirmed that these rules apply to our project.
We now face substantially higher costs to complete the building as it is currently designed. Our options are to (1) raise more funds for construction or (2) substantially reduce the size of the building. The SSC believes that reducing the building size will defeat an important objective of the project - to create enough space to serve the growing population of active aging adults and the community at large for decades to come. Therefore, our objective must be to find the resources necessary to fund the increased costs.
The SSC Has Achieved Tremendous Results to Date
■ We have a building design to serve the community for decades to come. ■ We have received support from the County of SB and the City of Solvang. ■ We have kept our development and fund raising costs below 2.5%. ■ We expect our building permit will be issued within 30 to 45 days. ■ We have raised over $3,650,000 in pledges and donations through a groundswell of community support.
o Our Board of Directors and Steering Committee members have collectively donated $575,000 toward the capital campaign.
■ Prior to the prevailing wage issue, we were within 10% of raising all the funds needed to meet our full construction and equipment/furnishing costs.

Impact of Prevailing Wage on Construction Costs, Fund raising, and Construction Start Date The original project costs for construction were forecast to be $3,250,000 (excluding furniture and equipment). Prevailing wage regulations are currently expected to increase costs by more than $875,000. This results from higher labor costs along with increased overhead fees charged by the subcontractors, and some local subcontractors declining to bid due to prevailing wage.
We intend to raise $1,000,000 more to manage these increased costs. The SSC's lease with the County of Santa Barbara requires that we prove adequate funds are available to construct the building without any liens being placed on the building or the county land before we can begin construction. This can be accomplished through a combination of (1) available cash and (2) a shortterm "gap" loan from a bank - secured by our pledges. The loan will be paid down as pledges are received. Montecito Bank & Trust has indicated they are willing to make such a commitment.
City of Solvang Support
The SSC receives annual operating grants from the city. The city's support is essential and significant but is less than one-third of the total operating budget (over $200,000 per year).
The SSC delivers these essential services far more economically than if they were provided by a governmental agency. Solvang's current population over 65 is 29.8%, almost one-third of the residents. This is almost twice that of Buellton and Santa Barbara County, which are 15.6% and
16.7% respectively.
Previous city support related to the new construction included a one-time grant for transition operating expenses and the use of the Legion Wing for our programs during construction.
We respectfully request the City Council make an additional grant of $450,000 specifically toward the capital construction ($150,000 over three years or $225,000 over two years beginning in 2024).
The city's contribution represents a fraction of the total cost of construction but is a significant amount towards our financial needs. It is an excellent long-term investment by the city to ensure the new Center meets the needs of our community for generations to come.
We are confident that when we receive the City's commitment towards the capital project, we will be able to raise the remaining funds required to pay the cost increases resulting from the prevailing wage regulations. We intend to move swiftly so we can begin construction as soon as possible.
Thank you for considering this request. We are available for questions and to make a presentation to the City Council.

81 Who we are
Key facts
The Solvang Senior Center’s home is a 2,700 sq ft
single-story modular building located on Santa Barbara
County land in the heart of Solvang,
We provide comprehensive social, recreational, and
personal development opportunities for all seniors in
the Santa Ynez Valley.
It is a 501 ( c ) 3 non-profit.
Founded: 1984
Location: 1745 Mission Dr., Solvang, CA 93463

Attachment B
82 A look back
1978 – Ideas formulated by local valley seniors to create a permanent space for their fellow seniors. Existing meetings were held in various locations around the valley for several years.
1982 – The search continued with city and county support developing a space behind the Vets Hall.
1983 – Contributions totaling $100,000 +/- were donated from over 300 community members, groups, and foundations. The modular building became reality. A long-term ground lease provided free rent from SB County – we’ve been here ever since! 2018 – Fast forward, due to health and safety issues with the modular and increased repair costs, a Steering Committee was formed to explore the possibility of replacing our aging modular units with a much larger “brick and mortar” building…Our campaign had begun. 83 Why we’re here tonight
Demographic forecasts show a substantial increase in seniors over the next 35 years
The seniors have designed a building that will serve their needs AND provide new space for the entire community
The community has stepped up and provided their
financial support for the project
Our project now faces additional construction costs due to prevailing wage regulations
We need the City to be a partner through a capital grant to meet our new fundraising challenge
84 What we do today
We provide extensive programs and services to active aging adults Our services result in positive outcomes for our senior community • 650+/- members
• 20 + weekly activities (exercise, book club, ukulele class, and many more) • 8,000 annual meals served
• 400 annual free tax returns completed for locals
• 8,000 annual activity opportunities
Recent statistics – “by the numbers” –
85 Current modular building
86 Why do we need it now?
Our modular building has outlived its useful life and is too small for our current needs
The over sixty-five population in Solvang was 29.8% at the last census •This compares to Buellton at 15.6% and Santa Barbara County at 16.7% SBCAG 2017 study: the over-65 population will grow by over 100% by 2060
Solvang needs to prepare for this growth now to be ready for the future We’re creating a Center where active aging adults can find resources to be independent longer
87 Our future
88 What will the new Center do?

space for programs
and services

90 The
Challenge
of Prevailing
Wage
The County of Santa Barbara recently notified us our
construction is subject to California’s prevailing wage regulations
We are considered a “public works project” because we have enjoyed below-market rent on land owned by the
County
When a group receives such a benefit, it is then subject to the application of the prevailing wage regulations on
construction projects, increasing the minimum amount we must pay for all labor costs
We now face substantially higher construction costs to complete the building as it is currently designed
The increased cost of labor
The added costs from the subcontractors for both
additional overhead and profit charges to comply with
prevailing wage
The loss of some “low bid” subcontractors who are not interested in participating in prevailing wage projects Rough estimates are that it could add more than
$875,000 to the project costs
91 Our options
Raise more money OR Substantially reduce the size of the building Reducing the building size defeats an important objective of our project
The Center has concluded they must find the resources to fund the increased costs
Our goal is to raise at least $1.1 million to meet this challenge
92 Longstanding
partnership
with Solvang Transition
assistance
during
construction
One-time “transition” operational grant to assist with
relocation costs and office rental
Use of the Legion Wing for Center activities during
construction
Annual
Operating
Grants
The City’s reliable funding of our programs is significant It represents approximately one-third of our total annual operating budget
Our budget is now over $200,000 per year
We deliver essential services that promote and support
seniors to continue to live independently and vibrantly The Center delivers these services very economically
93 We need YOU now!
We have done the “heavy lifting” to raise more than
$3.65 million
We request Solvang join with individuals, businesses,
and foundations to build the Center
We are asking for $450,000 as a new grant -
specifically for the capital project
We have identified and are pursuing other potential
governmental grants for additional funding now

Our community needs this project today, and will only need it more in the decades to come
The Over-65 population is large now, and a growing fast Your financial participation is a long-term investment for Solvang’s future Your financial commitment will be a fraction of the total cost of the project
•Where else can you get such leverage for a new community building in your city? •Around 10% of the total costs?
96 In summary, cont.
We have a fully developed project
We must prove we have commitments for the
funds necessary to construct the project
We need to move quickly to secure funding so
we can break ground this spring

The Council provided feedback at this meeting that included the following:
• Provide options to permit outdoor dining.
• Concerns over wineries or alcohol only establishments with seating • Create a consistent permitting policy
During the time following this meeting, other businesses have inquired about establishing outdoor dining facilities adjacent to their businesses.
The Solvang Municipal Code (SMC) Section 11-7A-1.B allows outdoor dining or seating area of a restaurant, bar, cocktail lounge, or wine tasting establishment “may be permitted” without full development plan review, however provides no guidance on what permit type, standards or methods that should be utilized by the Planning Manager. Additionally, this code section pertains to private property use and does not provide provisions for use of city rights-of-way.
City staff has been directed to provide the City Council with options on establishing an outdoor dining permitting process. City staff analyzed other outdoor dining permitting programs in Santa Barbara, San Luis Obispo, and Paso Robles to better understand what other jurisdictions have completed.
Eligibility
Staff recommends that property owners/business of ground floor business owners be eligible for any such outdoor dining program. Property owners or business owners that occupy 2nd floor or higher would not be eligible for the proposed program. The Council may also opt to limit the location of any outdoor dining in the city rights-of-way. City staff recommends it be limited to the following street segments:
• Copenhagen Drive
• Atterdag Road between Molle Way and Fir Avenue
• 2nd Street Between Mission Drive and Oak Street
• 1st Street Mission Drive and Oak Street
• Alisal Road Between Oak Street and Maple
• 1st Place between Mission and Fir
• 4th Place south of Mission Road
The City Council may direct additional streets be added, however, it is recommended that outdoor dining on public rights-of-way be limited to streets within the Tourist Related Commercial (TRC) zone.
The Council may also, for ease of regulating, direct staff to include all streets directly within the TRC zone. Mission Drive has been omitted from this list due to it being a Caltrans maintained street frontage.
Sidewalk Tables / Permanent Structures
Sidewalk dining on public streets can be broken down into two categories: Tables and chairs and permanent structures.
100
The temporary placement of chairs and tables on the sidewalk, generally in conjunction with a restaurant or other food service. No physical barrier is installed, tables and chairs may not be left outdoors outside of operating hours. The majority of current outdoor dining operators that have existing encroachment permits are completing this.
A permanent structure would consist of sidewalk dining installation along the frontage of a restaurant, bakery or other eatery with installation of physical elements, such as barrier/railings to delineate the outdoor dining area. Often this includes more permanent elements, such as covered awnings, planter boxes, heaters, etc. Typically, a barrier is required for establishments serving any type of alcoholic beverages.
Tables and Chairs on Sidewalk to the left, and permanent structures to the right Previous comments provided by the Council include potentially limiting outdoor dining to omit alcoholic sales. The California Department of Alcohol Beverage Control (ABC) has standards to allow for these types of sales to occur based on submitted floor and site plans by a business. City staff recommends that alcohol sales not be limited in any proposed ordinance or policy and allow for ABC to dictate the requirements, as not all outdoor dining operations may qualify for an amendment to any existing permits for sales of alcoholic beverages.
Minimum Standards & Operating Standards
City staff is recommending the following minimum standards be addressed in any ordinance that is brought back to the City Council:
• Require that tables be located directly in front of a business. If the proposed dining is outside of the direct business frontage, both property owner and adjacent business owner permission is required.
• Require a minimum clearance of 4-feet, unobstructed access for sidewalks 8-feet or less. For sidewalks greater than 8-feet wide, unobstructed access to be a minimum clearance of 6-feet. • Provide a site plan indicating where proposed seating will go and provide a floor plan of existing indoor operations to ensure the proposed use meets any required California Building Code upgrades including bathroom and ADA accessibility requirements. • Require indemnification and liability release of agreement be signed by the business and property owner for outdoor dining.
• Provide standards for any barriers utilized for permanent outdoor seating. This includes place of measurements to ensure minimum clearances are met, minimum and maximum height of barriers and materials utilized. City staff should be directed to work with the Design Review Committee in establishing objective standards and remove any type of subjectivity to such standards.
• Issuance of an encroachment permit that would be renewed annually. 101
The City Council should provide direction on parking calculations The SMC currently allows for the Planning Manager to potentially “waive the requirement for up to two (2) parking spaces to accommodate the addition or enlargement of such an outdoor patio or seating area, and/or may allow for provision of all or some of the project parking to be addressed through payment of an in-lieu parking fee pursuant to section 11-11-9.” Additional tables at restaurants in city owned rights-of-way may create additional parking considerations. Potential direction may include the following:
• Reviewing parking calculations for all applications (1 space per 300 sf of devoted patrons, plus 1 space per 2 employees) and determine what additional parking requirements are not met through the in-lieu fee.
• The Planning Manager can authorize a waiver for up to two (2) parking spaces to accommodate sidewalk dining when only tables and chairs are provided after review of existing plus proposed patron areas.
• The Planning Manager will require parking in-lieu fee for permanent structures in the right-ofway. • Additional alternatives as discussed by the Council.
In discussions with the Public Works director, maintenance is a potential issue for allowing sidewalk dining on public streets. Because the sidewalk would no longer be used for pedestrians, but for commercial operation, the Council will need to provide direction to staff on how to treat on-going maintenance of the space. The City Council should provide direction on how to codify on-going maintenance of these space which may include the following:
• Require the business and/or property owner enter into an agreement with the City at the time of encroachment issuance that would require maintenance such as power washing, upkeep, and any required replacement costs be completed by the permittee. • Establish a per square feet “rental fee” that would go towards the maintenance of the space, to be completed by city staff. The City of San Luis Obispo has such a fee which is currently $1 per square foot, charged monthly. This would require a fee study and justification of fees charged.
Administrative versus Discretionary Process
The proposed ordinance may be developed through either a “discretionary process” (which would require typically a conditional use permit), that would be approved through a public hearing process that would involve the DRC and the Planning Commission, or through what is known as an “administrative process”, which would be a city staff review, and ultimately city staff approval. Should the applicant disagree with conditions placed by city staff, the applicant would have a right to appeal the decision to the Planning Commission in an administrative process.
Administrative processing tends to be more streamlined, if objective standards are in place that are clear and concise and allow staff to issue such permits at today’s business pace, versus discretionary actions, which can take 90 to 180 days to process, including the cost of such an action, public hearing notices, and meetings, which business owners may find difficult to attend. If the Council directs city staff to process these permits administratively, city staff will need to create such a process as it currently does not exist in the City’s Zoning Ordinance. Options to consider for the Council include:
• Establish a “temporary Use Permit” for sidewalk tables and chairs that is requested by an applicant for only a portion of the year. This would be considered an administrative process. • Establish a “Development Permit” for sidewalk tables and chairs that is requested by an applicant for the entire year or for permanent structures sidewalk dining. This would be considered an administrative process.
• Utilize a “Conditional Use Permit for sidewalk dining with permanent structures. This would be considered a discretionary action.

AGENDA ITEM 6.d
Meeting Date: November 13, 2023
SUBJECT: Discussion and Possible Action to Provide Direction to Staff Regarding a TOT Ballot Measure on the November 2024 General Election PREPARED BY: Randy Murphy, City Manager
DISCUSSION:
A one-cent sales tax measure was approved by Solvang voters in the November 2022 general election.
Measure U was projected to add $1.2M into the General Fund. Although the current projections suggest the increase may be closer to $1.5M, due to inflationary factors along with a 30% increase in our recently approved law enforcement contract, staff expects any budgetary relief provided by the additional funding to be short-lived. Consequently, staff requests Council direction regarding placing a Transient Occupancy Tax measure on the November 2024 ballot.
If Council directs staff to proceed, we intend to retain the team that did the research and aided in the passage of Measure U. Although the contract amounts for each contractor are within the City Manager’s spending authority, staff requests Council direction prior to proceeding.

CITY COUNCIL STAFF REPORT
AGENDA ITEM 6.e
Meeting Date: November 13, 2023
SUBJECT: Discussion and possible action to Adopt a Remote Public Comment and “Zoom Bombing” Policy
PREPARED BY: David Fleishman, City Attorney
Taylor Foland, Deputy City Attorney
DISCUSSION:
At its October 23 meeting, the City Council discussed possible termination of remote public participation options for its meetings in light of a recent uptick in “zoom bombing” over the past several weeks. “Zoom bombing” refers to concerted efforts by a number of typically anonymous individuals to voice anti-Semitic, racist, and other inflammatory opinions and comments over Zoom during the public comment period. The City Council ultimately determined that remote public commenting remains a valuable tool for public participation and expressed its desire to maintain remote comments on Zoom.
However, City Council directed staff to develop a policy to ensure that “zoom bombing” does not continue to disrupt meetings.
The City’s ability to monitor and restrict public comment is limited by the Brown Act and the First Amendment. The Brown Act requires an opportunity for public comment, but does not mandate that remotely held meetings be made available to the public. The First Amendment limits the City’s ability to restrict comments on the basis of their content. However, the City Council is permitted to limit public discussion to matters that are within the subject matter jurisdiction of the Council, 1 and certain state
laws expressly allow the City to remove individuals from meetings for continued disruptive behavior provided that the presiding member first issues a warning. 2 In accordance with these laws, the proposed Policy prescribes certain operational constraints for remote comments over Zoom aimed at curbing “zoom bombing” and establishes procedures to address suspected and actual “zoom bombing” during a meeting. The operational restrictions include limiting remote public commenters to oral comments only. Remote public commenters would not be permitted to appear by video, provide visual representations, or use the “share screen” function. In addition, the proposed Policy outlines the following process for remote public commenting: individuals desiring to submit remote public comment will join the meeting via a meeting link or meeting number provided on the agenda; all remote participants will remain muted for the duration of the meeting; remote participants must use the “raise hand” feature to indicate a desire to speak on an item; City staff will notify each remote public commenter orally when it is their turn to speak after which staff will unmute the individual allowing them to provide their comment.
The proposed Policy also establishes the following procedure to address suspected and actual “zoom bombing” should it occur during a meeting. Upon first utterance of a comment suspected to be “zoom bombing,” the City Attorney, City Manager, Mayor or other individual presiding over the meeting shall:
(1) interrupt the speaker; (2) issue a warning to stop uttering and using disruptive and offensive words; (3) inform them that their comments fall within one or more of the following categories listed below, and (4) instruct them to proceed respectfully on a matter with the City’s subject matter jurisdiction, or a specific agenda item if one is being discussed.
Categories of Disruptive and Offensive Speech:
1 See 78 Ops.Cal.Atty.Gen. 224 (1995) at 2 (citing Brooks v. State Personnel Bd. (1990) 222 Cal.App.3d 1068, 1072; B.W. v. Board of Medical Quality Assurance (1985) 169 Cal.App.3d 219, 233-234. 2 Gov. Code § 54957.95. 104
1. Comments that violate the City Council Protocols for the conduct of a City Council meeting, specifically those regarding disruptive, inappropriate and derogatory comments;
2. Comments that are not related to a matter within the subject matter jurisdiction of the City Council;
3. (if applicable) Comments that are not related to the agenda item being discussed; and
4. Comments that constitute a true threat of force as defined by Government Code Section 54957.95.3
If, after having received a first warning, the speaker continues the disruptive and offensive speech, the Mayor may direct the individual responsible for the technical management of the City’s Zoom software to immediately mute the speaker’s microphone and announce the name of the next speaker. The Mayor, or other individual presiding over the meeting, may eject a speaker from the Zoom altogether if both of the following occur: (1) the speaker actually disrupts the conduct of the meeting and (2) the speaker has received a warning and been muted during the meeting already.
The proposed Policy currently governs remote public commenting at City Council meetings only.
However, “zoom bombing” could occur at any noticed, public meeting that allows remote participation.
Thus, staff seeks Council direction on whether to extend the Policy to other legislative bodies in the City that may encounter “zoom bombing,” such as the Planning Commission.
Finally, since this issue has arisen in many other cities recently, staff received some materials compiling the responses other cities have taken with respect to zoom bombing. This document is provided only for Council’s information.
ALTERNATIVES:
The Council could decline to adopt the Policy and give staff alternative direction.
FISCAL IMPACT:
There is no fiscal impact associated with the adoption of the Policy. There may be costs associated with amending the City’s Zoom participation features, but the amount is not expected to be significant.
ATTACHMENTS:

Survey results of responses to Zoom Bombing in other cities 3 Government Code Section 54957.95(b)(2) defines “true threat of force” to mean “a threat that has sufficient indicia of intent and seriousness, that a reasonable observer would perceive it to be an actual threat to use of force by the person making the threat.”

CITY COUNCIL STAFF REPORT
AGENDA ITEM 6.f
Meeting Date: November 13, 2023
SUBJECT: Discussion and Possible Action to Authorize the City Manager to Execute a Cost-Sharing Agreement Among Members of the Eastern Management Area
PREPARED BY: Randy Murphy, City Manager
DISCUSSION:
The State requires the County to monitor its groundwater basins via legislation called the Groundwater Sustainability Act (GSA). Solvang is in the Eastern Management Area (EMA) of Santa Barbara County’s regional responsibility. The City currently shares in the oversight of the EMA via a Memorandum of Agreement (MOA) with three other governmental entities, Santa Barbara County Water Agency, Santa Ynez River Water Conservation District, and Irrigation District No. 1. The four entities have been working together over the past several months to create a Joint Powers Agreement (JPA) that would govern the EMA, with the ultimate goal to operate as a separate entity with representatives from each of the four current agencies along with the possibility for representation from a member of the agricultural industry.
Unfortunately, the MOA lacks specificity regarding the sharing of expenses that are required per terms of the GSA. Consequently, the attached cost-sharing agreement has been drafted to provide clarity regarding those charges, which clearly indicates that the necessary costs would be shared equally among the four agencies. Although previous expenses have been shared, there have been a few issues. The County has agreed to be the lead regarding contracting with vendors, but since the MOA isn’t clear on this matter, they require an agreement before moving forward. Time is of the essence so that this matter can be placed on the next Board of Supervisors agenda.
Staff requests that the Council authorize the City Manager to sign the Agreement.
ALTERNATIVES:
Authorize another signor.
FISCAL IMPACT:
Unknown. Most costs are expected to be reimbursed via grants and/or pumping charges that have yet to be levied.

INTERIM COST SHARING AGREEMENT
Santa Ynez River Valley Groundwater Basin - Eastern Management Area This Interim Cost Sharing Agreement (“Agreement”) is made as of November 15, 2023 by and among the Santa Barbara County Water Agency (“Water Agency”), Santa Ynez River Water Conservation District (“SYRWCD”), City of Solvang (“Solvang”), and Santa Ynez River Water Conservation District, Improvement District No.1 (“ID No.1”). The entities listed above may be referred to herein individually as a “Party” or jointly as the “Parties.” For purposes of this Agreement, the “Effective Date” shall be the date the last Party executes this Agreement.
RECITALS
A. Whereas, on or about April 27, 2017, the Parties entered into the “Memorandum of Agreement for Formation of a Groundwater Sustainability Agency for the Eastern Management Area in the Santa Ynez Valley Groundwater Basin under the Sustainable Groundwater Management Act” (the “2017 MOA”); and
B. Whereas, among the stated purposes of the 2017 MOA are to form a Groundwater Sustainability Agency (“GSA”) for the Eastern Management Area (“EMA”) of the Santa Ynez River Valley Groundwater Basin (“Basin”) under the Sustainable Groundwater Management Act (“SGMA”), and to develop and submit a Groundwater Sustainability Plan (“GSP”) for the EMA portion of the Basin; and
C. Whereas, the EMA is one of three Management Areas in the Basin, and pursuant to separate 2017 Memoranda of Understanding, the local public agencies in the Western Management Area (“WMA”) and Central Management Area (“CMA”), respectively, formed a WMA GSA and a CMA GSA; and
D. Whereas, in January 2022, the EMA GSA, the WMA GSA, and the CMA GSA each timely adopted and submitted to the California Department of Water Resources (“DWR”) its own GSP for its respective Management Area; and
E. Whereas, the EMA GSP identifies various Projects and Management Actions (“PMAs”) to be pursued in the EMA, some to be pursued in the initial years following adoption and submittal of the GSP, to help achieve sustainable groundwater management in accordance with SGMA and the GSP, where funding will be needed for the development and implementation of said PMAs; and
F. Whereas, SGMA and other applicable law authorize the imposition of fees and charges, including, but not limited to, permit fees and fees and charges on groundwater extraction or other regulated activity to fund, without limitation, the costs of a groundwater sustainability program and implementing a GSP in accordance with SGMA; and G. Whereas, to date, the EMA GSA has not imposed any fees or charges to generate funding needed for the development and implementation of PMAs identified in the EMA GSP; and H. Whereas, the Department of Water Resources (“DWR”) has awarded a grant to the three GSAs for certain PMAs (“DWR Grant Funds"); and
112
I. Whereas, the Parties to this Agreement are currently negotiating the formation of a new Joint Powers Agency (“JPA”) to serve as the EMA GSA, with authority under SGMA and other applicable law to adopt and impose fees and charges throughout the EMA to carry out sustainable groundwater management, including, but not limited to, the administration, development, and implementation of PMAs identified in the EMA GSP, the preparation and administration of reports and other documentation required for SGMA compliance, and the carrying out of other administrative functions for the EMA GSA; and J. Whereas, the Parties to this Agreement recognize that a source or sources of interim funding is needed to begin administration, development, and implementation of certain PMAs identified in the EMA GSP, to prepare reports and other documentation required for SGMA compliance, and to carry out other administrative functions for the EMA GSA, where such interim funding is needed prior to the receipt of DWR Grant Funds and/or prior to when the EMA JPA has developed its own funding sources; and K. Whereas, the purpose of this Agreement is to address interim cost sharing among the Parties as one source of funding to assist with initial efforts to administer, develop, and implement PMAs identified in the EMA GSP, prepare reports and other documentation required for SGMA compliance, and carry out other administrative functions for the EMA GSA prior to the receipt of DWR Grant Funds and/or prior to when the EMA JPA has developed its own funding sources, recognizing that the interim cost sharing arrangement set forth by this Agreement is specifically limited in term, function, and scope as set forth below.
NOW, THEREFORE, based on the Recitals set forth above, and on the terms and conditions set forth below, the Parties agree as follows:
AGREEMENT
1. Cost Sharing / Reimbursement. Upon execution of this Agreement, the Parties agree to share in expenses (“Shared Costs”) for certain initial efforts to help implement SGMA in the EMA, as further described in Sections 2 and 3, below. This initial cost sharing arrangement is being agreed to by each Party pursuant to the express understanding and condition that any amounts paid in accordance with this Agreement by any Party on or after the Effective Date, including but not limited to each Party’s proportionate share of Shared Costs, shall be reimbursed, without interest, by the EMA GSA (whether the future EMA JPA or the GSA established under the 2017 MOA and any amendment thereto) through grant funds received by or on behalf of the EMA GSA to the extent allowed by the terms of such grant(s), or through other funds generated, acquired, or otherwise held by or on behalf of the EMA GSA, including but not limited to SGMA-related fees, charges, loans, or other funding, to the extent such reimbursement is authorized by law. Such reimbursement will be made when the EMA GSA determines it has funds available for such reimbursement that may legally be used for that purpose and such reimbursement will be made no later than December 2026, unless such date is extended by written agreement by the Parties hereto.
113
2. Cost Share Activities. Subject to other terms and conditions of this Agreement, the Parties acknowledge and agree that EMA GSA activities for which Shared Costs may be needed under this Agreement may include, without limitation:
• Consultant/Contractor work to prepare and submit Annual Report(s) required by SGMA;
• Consultant/Contractor work to prepare and submit materials in response to comments or requests from DWR and/or the State Water Resources Control Board;
• Consultant/Contractor work in support of developing, adopting, and implementing fees and/or charges authorized by SGMA and other applicable law to implement the EMA GSP;
• Consultant/Contractor work in support of grant writing or other applications to secure funding to implement the EMA GSP;
• Consultant/Contractor work to assist with the administration of this Agreement and/or other administrative activities on behalf of the EMA GSA to comply with SGMA;
• Consultant/Contractor work in support of Group 1 PMAs set forth in the EMA GSP;
• Securing and maintaining applicable insurance coverage(s) to be held by the EMA GSA.
3. Approval of Shared Costs. Each separate and specific activity to be undertaken by or on behalf of the EMA GSA for which the Parties agree to contribute Shared Costs under this Agreement (individually, a “Cost Share Activity”), such as an activity identified in Section 2 above, shall be expressly described and set forth as a new and separate Task Order, where each Party will have an opportunity to review and determine whether to contribute its portion of Shared Costs for such Cost Share Activity. Each proposed Cost Share Activity set forth as a new Task Order shall include a not-to-exceed dollar amount for the work to be undertaken, plus a ten percent (10%) contingency, the total of which shall constitute the “Total Cost” of said Cost Share Activity. On each occasion where all Parties are presented with a proposed Cost Share Activity and corresponding Total Cost, the Parties collectively shall endeavor in good faith to reach unanimous agreement on whether the Total Cost is acceptable, and upon reaching such unanimity, as applicable, each Party shall endeavor in good faith to notify the other Parties in writing within three (3) business days regarding its agreement to cost share. On any occasion where all Parties are informed that the costs to complete a Cost Share Activity will exceed its corresponding Total Cost as originally approved by the Parties (individually, a “Total Cost Exceedance”), the Parties collectively shall endeavor in good faith to reach unanimous agreement on whether the amount of the Total Cost Exceedance is acceptable, and upon reaching such unanimity, as applicable, 114
each Party shall endeavor in good faith to notify the other Parties in writing within three (3) business days regarding its agreement to cost share.
No Party shall be responsible for a proportionate or any other share of Shared Costs in excess of the maximum limits established in this Agreement without the express written agreement of that Party.
4. Allocation of Shared Costs. The Shared Costs shall be allocated among the Parties as follows:
Water Agency: 25%
SYRWCD: 25%
Solvang: 25%
ID No.1: 25%
Total: 100.0%
5. Administrative Coordination. The Parties agree to cooperatively share in the administrative duties related to this Agreement, including but not limited to soliciting, entering into, and coordinating professional services agreement(s) for consultant work contemplated by this Agreement. The Parties agree that any work undertaken by any Party, including its elected officials, officers, managers, employees, consultants, attorneys, experts, or agents, shall be at that Party’s sole cost and expense and shall not become part of any Shared Costs incurred by or paid to any Party under this Agreement, except as otherwise expressly agreed upon in writing by all Parties to this Agreement.
6. Payments and Accounting. For each approved Task Order, the Parties agree to designate one Party, which designation must be unanimously agreed to by the Parties, for the purpose of administering payments and refunds of Shared Costs by and to the Parties, and administering expenses of Shared Costs for activities authorized by this Agreement. For each approved Total Cost or Total Cost Exceedance, each Party shall pay its proportionate share of Shared Costs on a lump sum basis. For each approved Task Order, to the extent that final actual costs are less than the corresponding Total Cost or Total Cost Exceedance as approved under this Agreement, the remaining Shared Costs shall be refunded to each contributing Party in proportion to its contribution of Shared Costs; provided, however, a Party may elect to carry forward any refund due under this Section as a credit of Shared Costs.
7. Term. This Agreement shall commence on the Effective Date and shall continue in effect for up to two (2) years unless extended, amended, or terminated by the Parties in accordance with Sections 9 or 10, below.
8. Extension or Amendment. The term of this Agreement may be extended by the Parties at any time prior to its expiration by unanimous written agreement of the Parties. The terms of this Agreement may be amended or modified only by the mutual written agreement of 115
the Parties. No extension, supplement, amendment, or modification of this Agreement shall be binding unless it is in writing and signed by all Parties.
9. Termination. This Agreement may be terminated, and such termination shall be effective immediately, upon unanimous written consent of all Parties.
10. Withdrawal. Any Party may unilaterally withdraw from this Agreement without causing or requiring termination of this Agreement, where such withdrawal shall be effective immediately upon written notice to the other Parties. Upon withdrawal of a Party, the remaining Parties may agree in writing to a different allocation of Shared Costs in accordance with Section 4.
11. Effect of Termination or Withdrawal. Upon termination of this Agreement or unilateral withdrawal of a Party, each Party, including a withdrawing Party, shall remain obligated to pay its entire share(s) and obligation(s) of Shared Costs pursuant to the terms of this Agreement, but only to the extent that such share(s) and obligation(s) of Shared Costs were approved by the obligated Party prior to the effective date of such termination or withdrawal. No termination of, or withdrawal from, this Agreement shall be construed as affecting any Party’s right to reimbursement from the EMA GSA (whether the future EMA JPA or the GSA established under the 2017 MOA and any amendment thereto) of any Shared Costs paid by said Party under this Agreement.
12. Relationship. Nothing in this Agreement creates an attorney-client relationship between any attorney and any Party that is not represented by that attorney as its legal counsel.

14. Conditional Approval of Shared Cost Contributions. The Parties agree that their contributions of Shared Costs under this Agreement are conditioned upon and subject to approvals by the EMA GSA (including the future EMA JPA and the GSA established under the 2017 MOA and any amendment thereto) to provide reimbursement to the Parties as provided in Section 1 of this Agreement.
15. Law Governing. This Agreement is made in and shall be construed in accordance with the laws of the State of California.
16. Section Headings. All section headings in this Agreement are for convenience of reference only and are not to be construed as modifying or governing the operative language of this Agreement or to define or limit the scope of any provision of this Agreement.

18. Construction of Agreement. Each Party acknowledges and agrees that said Party has had an informed and complete opportunity to participate in the negotiation and drafting of this Agreement and has had access to competent legal counsel to advise said Party concerning the terms and effects of this Agreement, and all Parties agree that no Party shall be deemed to be the drafting Party of this Agreement in any dispute involving construction of the terms of this Agreement.
