We are requesting a copy of Solvang's Employee Compensation Report for the 2023 calendar year under the provisions of California Gov. Code § 7920, the California Public Records Act. The purpose of this request is to obtain records which provide a complete and comprehensive account of Solvang's total costs associated with employee full names and compensation. Specifically, this request seeks an accounting, by full name and job title, of total gross wages paid to each employee and the total cost incurred separately by the employer for providing retirement and health benefits. Note that the State Controller’s “Government Compensation in California” report does not contain the names of employees and therefore does not satisfy this request. If your response is to send us a copy of that report, that will simply delay the process and take more of your time as we will reject it as insufficient to satisfy this request in full. As a reminder, per Gov. Code § 7922.585(a) “Nothing in this section is intended to affect the public record status of information merely because it is stored in a computer. Public records stored in a computer shall be disclosed as required by this chapter.” In an effort to standardize how this information is reported, please include the following categories in your response: Employee Name (full name, including first and last) Position/Job Title (“City Manager”, “Police Officer”, etc.) Annual Salary Minimum & Maximum Total Regular Pay Overtime Pay Other Pay (any additional forms of pay that are not reported in Regular Pay) Retirement Contribution Costs - All forms of employer-paid retirement contributions, deferred compensation, etc., including Unaccrued Actuarial Liability if applicable. Please split out per the standard State Controller’s Office categories. Healthcare Contribution Costs - All forms of employerpaid health and welfare benefits, such as health, dental and vision insurance benefits.

In the event Solvang is not in possession of a record of this nature, we request copies of any other record or records that contain information, even if only in part, that is responsive to the purpose of this request — employee name in conjunction with their compensation data for the period requested. Please provide the requested materials or, per Gov. Code § 7922.535(a), a timeline along which they will be made available by, no later than ten days from the date of this request. Per Gov. Code § 7922.570(a), we ask that you provide the records in an Excel spreadsheet format. You may provide this data to us by replying to this email and attaching your data file. There is no need to password-protect your responsive data, that data will be posted to a publicly-available 09/23/2024

I'm looking for a copy of the Notice or Certificate of Sufficiency or Insufficiency for the recall efforts in Solvang. I reached out to the County and they said I should contact you. The recall was Solvang Councilmember Chris Djernaes in 2020. It made the ballot. The document should list the number of signatures handed in for the recall, the number that were found valid and the number ruled invalid. It may also give details on why the signatures were invalid. It may have been included in the meeting's minutes. Appreciate anything you can offer. Here's some examples from other counties:

I have a solar company on hold (permits already issued) because pg&e doesn’t agree to do the switch until I provide this document. We request that your agency promptly provide a copy of all public records described below, in accordance with Cal. Gov’t Code § 7922.530(a): Your logs, electronic or otherwise, tracking all requests made of your agency pursuant to the California Public Records Act, between January 1, 2024 and June 30, 2024. These records should include, at a minimum, the identity and contact information of each requestor (to the extent that information was provider) along with the text of their request(s). For every responsive record you hold in an electronic format, we specifically request a copy of that record in its native format. Cal Gov’t Code § 7922.570(b) This request includes “any writing containing information relating to the conduct of the public's business prepared, owned, used, or retained [by your agency] regardless of physical form or characteristics.” Cal. Gov’t Code § 7920.530(a) We respectfully remind you that you are required to respond with the results of your search for these records within 10 calendar days, in all but “unusual” circumstances. That determination, in turn, must include an estimate of the date and time when the records will be made available to us. Cal. Gov’t Code § 7922.535 In every case, you must produce responsive records promptly, without delay or obstruction. Cal. Gov’t Code §§ 7922.530(a) and 7922.500 If you believe the above request does not reasonably describe an identifiable record or records, we request that you assist us in making a focused and effective request. This assistance must include your description of information technology and physical locations of actually and potentially responsive records, and you must provide us with suggestions for overcoming any practical basis for denying access to the records or information sought. Cal. Gov’t Code § 7922.600(a)(1)-(3) Although we are not required to, we are providing you with the underlying purpose for our request, in order to assist you with your obligation to help us make a focused and effective request: We want to document the nature and extent of all PRA requests to your agency during the six month period identified. The content of the request is more central to our inquiry than the status of your response, but we appreciate receiving both items wherever possible. If you believe that some of the records we are requesting fall within a legal exception to their production, we request that you redact the information you are choosing to withhold while releasing “[a]ny reasonably segregable portion” of the record. Cal. Gov’t Code § 7922.525(b) Of course, should you choose to redact or withhold any part of the records we have requested, we expect you to explain, in 07/16/2024

In the Staff Report to the Solvang City Council dated February 10, 2020, in the agenda materials, it is mentioned that Specific Plan No. 2 (“SP2”) was adopted by a City Council ordinance (91-122) on August 26, 1991, and subsequently was ratified by the voters of the City in a referendum held on February 4, 1992. SP2 is the document that provided for the establishment, development, and design of The Village Collection residential neighborhood (“VC”; in SP2 called Village Estates), so it is important to us residents of the VC, and we need to know more about its background and history in order to deal with various pending issues that our HOA is facing. Therefore, we request: 1. All documents from before or after August 26, 1991, relating to the decision to put up SC2 for the referendum, including the decision itself, and any document indicating whether a referendum was contemplated as of August 26, 1991, or whether this idea arose later. 2. All documents involved in the process of holding the referendum, including but not limited to its preparation, the ballot itself, voting instructions, internal or public opinions voiced on the referendum measure, documents concerning the results of the voting, and any post-referendum documents concerning the implementation of the results of the referendum. 3. Any documents in referendumrelated materials pertaining to how the result of the referendum, or SP2 itself, could be amended or repealed, including what body would have authority to do so (e.g., by the voters in another referendum, City Council vote, etc.). 4. A companion to SP2 at the time was Specific Plan No. 1, which would govern the establishment and development of new commercial zones adjacent to the VC (e.g., what is now the WorldMark condo timeshare building, and Solvang Village Square where the motorcycle museum is located). We do not know whether it was eventually adopted, but if it was, we request a copy of it and of the ordinance (or referendum measure?) by which it was adopted.

Please contact me if you have any questions about this request. Thank you in advance for your efforts to help us. Sincerely, Arthur George on behalf of the Board of Directors of the Village Collection Owners' Association 07/02/2024

CITY COUNCIL STAFF REPORT
AGENDA ITEM 8.a
Meeting Date: October 14, 2024
SUBJECT: Discussion and Possible Action to Authorize the Mayor to Sign a Letter in Support of HR 7944 – Water Systems PFAS Liability Protection Act PREPARED BY: Randy Murphy, City Manager
DISCUSSION:

Council recently approved a Legislative Platform that allows the City to take a position without specific Council action on important matters being heard before State and Federal elected bodies in order to inform our representatives on how a particular bill may affect the City of Solvang. Two examples of this process were included in the Consent Calendar of the last Council meeting.

Although we have an existing Platform, Solvang’s legal counsel indicated that this particular topic did not fit within the prescribed parameters and suggested that it come before your Council in order to receive the necessary authorization to submit it to our Congressional representative.

As further described in the attached letter, House of Representatives Bill 7944 (HR 7944) has bipartisan support and is intended to ensure that local jurisdictions are insulated from potential damage claims brought by litigants seeking restitution for a problem beyond local jurisdictions’ control.

Staff requests the Council to approve this request.

ALTERNATIVES:

A. Letter to Congressman Carbajal
129
October 14, 2024
The Honorable Salud Carbajal
Congressman, CA D24
2331 Rayburn House Office Building
Washington, DC 20515
RE: Support H.R. 7944 – Water Systems PFAS Liability Protection Act Dear Congressman Carbajal:

As a water utility striving to provide a safe, affordable, public service to our ratepayers, we are concerned that the recent designations of perfluorooctanoic acid (PFOA) and perfluorooctane sulfonate (PFOS) as hazardous substances under Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA) will cause water systems and our ratepayers – rather than polluters – to incur environmental cleanup liability that should be faced by entities responsible for that pollution. We, therefore, ask you to support statutory protections for water systems from liability under CERCLA for Per- and Polyfluoroalkyl Substances (PFAS) to help ensure that manufacturers and users of PFAS, not the public, pay for PFAS cleanup.

From the start, CERCLA was built on a laudable “polluter pays” principle, aimed at ensuring that companies which produced and profited from hazardous substances discharged into the environment are held responsible for their cleanup. Unfortunately, the recent designation of PFOA and PFOS – nondegradable “forever chemicals,” which are now ubiquitous in the environment – as hazardous substances means that drinking water and wastewater systems that passively receive these substances into their systems could face CERCLA cleanup liability simply because an upstream polluter deposited the chemicals in their water supplies.

Due to the U.S. Environmental Protection Agency’s (EPA) CERCLA designation for PFAS – which took effect on July 8, 2024 – drinking water and wastewater utilities like ours are now vulnerable to potential “cost-share” litigation from those who introduced PFAS into the environment. PFAS users and producers can abuse litigation to reduce their own clean-up costs and increase costs on water utilities – costs that are ultimately borne by those utilities’ customers. Even when water systems are able to successfully defend themselves in court against CERCLA claims, the cost of that litigation alone could contribute to the ongoing water affordability challenge.

CERCLA liability will be an additional burden on top of the significant treatment costs utilities are already incurring to meet Safe Drinking Water Act and Clean Water Act PFAS regulations.

CERLCA would unjustly make ratepayers pay yet again, now for the environmental remediation that should be borne by the companies that produced and profited from PFAS for decades and continue to do so.
130
With the final rule now in effect, it is critical that Congress move quickly to ensure that water systems and their ratepayers are not unfairly punished for PFAS contamination for which they bear zero responsibility or blame. I therefore urge you to support bipartisan legislation, H.R. 7944, the Water Systems PFAS Liability Protection Act, introduced by Rep. John Curtis (R-Utah) and Rep. Marie Gluesenkamp-Perez (D-Washington). This bill would protect the “polluter pays” principle under CERCLA and ensure that water utilities can continue to focus their efforts on maintaining water quality.

Although existing litigation against 3M and DuPont will provide some funding, any potential settlement that the City may receive will not provide anywhere near enough capital to pay for the necessary equipment to remediate our impacted wells, let alone pay damages for a problem that we did not create. As a small water utility of just over 2100 connections, any increase in costs will create a disproportionate impact on our residents. Consequently, the City of Solvang requests your support of H.R. 7944. If you have any questions, do not hesitate to contact our City Manager, Randy Murphy, at [email protected] or 805.688.5575 x204.

Mark Infanti

CITY COUNCIL STAFF REPORT
AGENDA ITEM 8.b
Meeting Date: October 14, 2024
SUBJECT: Discussion and Possible action to provide direction regarding the newsracks located in downtown Solvang
PREPARED BY: Rodger A. Olds P.E., Public Works Director/City Engineer DISCUSSION:

Newsracks are regulated by a permitting process established by Ordnance 98-193 and documented in Section 8-5 of the Solvang Municipal Code. Per Section 8-5, a permit is required for each newsrack.

Permits are valid for five years. Given that the most recent newsrack permit was issued in 2017, there are no currently permitted newsracks in the City of Solvang.

This issue has come to the attention of City Staff. We have surveyed the downtown area and developed a current inventory of publications occupying the existing newsracks. Staff has made an effort to contact each of the sixteen different publications. Thirteen have responded to the City and provided updated contact information. Only six of the sixteen of these publications were previously permitted by the City based the previous inventory from 2018.

Currently the newsracks are in four locations throughout downtown, which include one on Mission Drive near City Parking Lot No. 3, one on Copenhagen near City Parking Lot 2, and two on Alisal Road one near City Parking Lot 1 and one at the post office. Additionally unpermitted newsracks have been dropped off and installed at the Solvang Visitors Center. Section 8-5 currently does not restrict newsracks to these four locations.

The newsracks have not been well maintained. Many are covered in graffiti and stickers and the banks of newsracks are a collection site for trash and debris. It is the opinion of staff that all of the newsracks must be renewed in order to meet the permit requirements of the code which states “Each newsrack shall be maintained in clean and neat condition and in good repair at all times.” Consultation with the City Attorney’s office determined that the modification of the ordinance to eliminate the newsrack program is not recommended. Therefore, staff will be initiating enforcement of the newsracks as soon as possible. The process for this is as follows:

1. Written notice to each newsrack owner

2. Require a new permit and replacement of the existing newsracks with new or at a minimum a clean and well maintained newsrack.

3. 30-day courtesy compliance period.

4. Removal and storage of non-complaint racks for 30 days.

5. Disposal after 30 days
Moving forward staff will be performing quarterly inspections of the newly permitted racks to ensure compliance with City code in regard to their maintenance and utilization.

Additionally, staff is seeking direction from Council on potential modifications to the newsrack ordinance and program. While prohibition of newsracks is not recommended the City may place specific and narrowly tailored restrictions as long as a finding can be made that the restrictions serve a legitimate government interest, such as safety or aesthetics. These modifications could include but would not be limited to formally designating locations and zoning restrictions, revising the fee for each five-year permit to adequately cover City costs. Staff will bring a revised ordinance back to City Council at a later 132
date with recommended changes based on council direction and further review of the existing ordinance.

ALTERNATIVES:

Provide staff with comments and direction regarding potential changes to the newsrack ordinance.

Council may also revise current staff plans to renew the newsrack program to bring as many current publications as possible under permit.

FISCAL IMPACT:

There is no direct fiscal impact to this item.
