Summary
Note: On January 12, 2021, the Council adopted on a 3-1-1 vote a Resolution to Suspend the Rule to Reconsider a Matter Only at the Meeting Where the Item was First Voted Upon or at the Very Next Meeting of the Council. Under Rosenberg’s rule of order, where, as here, the Council has not adopted a rule on how to count abstentions, a vote of three “yes,” one “no” and one “abstain” results in passage of the motion because the abstention is counted only for the purpose of determining quorum, but on the actual vote on the motion, it is as if the abstention vote never existed — so an effective 3-1 vote is a two-thirds majority vote.

The Council has not formally adopted rules that count votes of “those present”. As a result, the general rule of thumb (and default rule) is that you count all votes that are “present and voting.”
Accordingly, under the “present and voting” system, you would NOT count abstention votes on the motion. Members who abstain are counted for purposes of determining quorum (they are “present”), but you treat the abstention votes on the motion as if they did not exist (they are not “voting”). On the other hand, if the rules of the body specifically say that you count votes of those “present” then you DO count abstention votes both in establishing the quorum and on the motion. In this event, the abstention votes act just like “no” votes. As mentioned above, the Council has not specifically adopted such an abstention-counting rule

Summary
Given that the motion to suspend Rosenberg's rules has passed, a motion can now be made to reconsider the restriping matter. However, the motion to reconsider can only be made by a member who voted in the majority on the original motion, but the motion only requires a majority vote to pass. If the motion to reconsider passes, then the original matter is back before the Council and the matter may be discussed and considered as if it were before the Council for the first time.

The matter in question is the Broadway Restriping project. Specifically, a councilmember who voted in the majority on August 2, 2021, to approve Option B- protected bike lane along Broadway between Napa St. and MacArthur St. (i.e., bike lane adjacent to the curb) would like the Council to reconsider its decision. As stated above, to do this, the Council must suspend the reconsideration rule and make a motion to reconsider.

On August 2, 2021, the Council considered restriping options for Broadway between MacArthur and Napa streets. Specifically, the Council approved a lane configuration that reduced the travel lanes on Broadway from MacArthur Street to Napa Street from five (5) travel lanes- two lanes in each direction plus a two-way left hand turn lane- to three (3) travel lanes. Broadway between McDonell Street and Napa Street would have two northbound lanes and one southbound lane.

On Broadway from McDonell to MacArthur would have one travel lane in each direction with a two-way left hand turn lane. The goal of the restriping was to reduce the pedestrian crossing distances on Broadway between MacArthur and Napa streets which would enhance pedestrian safety.

With this lane configuration, the Council considered two options for a bike lane:

Option A - Buffered bike lane which keeps the parking adjacent to the curb with a bike lane between the travel lane and parking.

Option B - Protected bike lane which places the bike lane adjacent to the curb with parking next to the travel lane.

On a 3 (Ding, Agrimonti, Felder) to 1 vote (Barnett), the Council approved Option B.

Reconsideration
Should the Council take the required actions needed to reconsider this matter, then the original matter is back before the Council and the matter may be discussed and considered as if it were before the Council for the first time.

For your reference, below is a link to the August 2, 2021, staff report. https://sonomacity.civicweb.net/document/46131
The Broadway restriping options are as follows:

1. Retain the current striping configuration, prior to repaving, which is five travel lanes: two lanes in each direction plus a two-way left hand turn lane. The Broadway/Napa intersection has two lanes in each direction.

2. Approve lane configuration of Broadway between MacArthur and Napa streets as previously approved. On Broadway from McDonell to Napa Street there would be two Agenda Item #3.1:

Page 4 of 25 ends

northbound lanes and one southbound lane. On Broadway from McDonell to MacArthur would have one travel lane in each direction with a two-way left hand turn lane. Under this lane configuration, the Council would need to select one of two bike lane configurations:

Option A - Buffered bike lane which keeps the parking adjacent to the curb with a bike lane between the travel lane and parking.

Option B - Protected bike lane which places the bike lane adjacent to the curb with parking next to the travel lane.

City Staff, the City’s traffic engineer, Caltrans, and Sonoma County Transportation Authority (SCTA) all prefer a bike lane configuration for Broadway. Staff originally recommended Option A at the August 2, 2021, Council meeting to originally consider the matter. Since that time, a significant amount of effort was needed to get Caltrans to approve Option B, including the effort by Caltrans to issue change orders for the project. But for the weather, Broadway would have been restriped by now.

However, staff has been in discussions with Caltrans staff who indicate if they receive a Council decision by Tuesday, 1/18/22, they will endeavor to work with us to implement the plan. The City’s traffic engineer will identify the potential costs of Option A as well all the actions needed to implement the plan.

Possible Financial Impacts
After the Council’s decision on August 2, 2021, staff and its engineering firm has been working diligently with Caltrans and its contractor to work out the cost and schedule for the Broadway restriping. While Caltrans has approved the restriping plan, the restriping of Broadway was delayed due to the inclement weather. However, Caltrans was planning to cat track (preliminary mark) and restripe Broadway within the next two weeks because of the good weather. Staff has informed Caltrans of the Council’s potential reconsideration of the restriping plan and need to delay the restriping until the Council can hold this meeting.

Depending on the Council’s action there may be a significant increase in project costs in the restriping of Broadway. The City’s engineering firm, GHD, is currently working to try to quantify these costs and will be able discuss in more detail at the Council meeting. At the August 2, 2021, meeting, the Council allocated $45,000 for the selected restriping plan. Staff is recommending the Council increase this amount to $60,000 should the Council select Option A, but that still may be inadequate for the project. GHD will also provide more detail on both bike lane striping plans at the meeting.
