Adopt a Resolution Implementing a Policy by Which Council Members Can Decline their Monthly Stipend and Direct it to a Restricted or Special Fund Summary
City Council Members receive a monthly stipend of $300.00 to serve on the Council. At times, there is a desire to decline the stipend and have it directed to another city fund, for example, the Housing Trust Fund. Typically, the declined stipend funds are returned to the General Fund.

Currently there is not a mechanism or policy in place that enables this to be completed. The transfer would not have any tax impacts to the requesting Council Member since they are not receiving it, only redirecting the stipend amount from the General Fund to a different fund.

If the Council wishes to make this an available option, adopting the attached Resolution will accomplish this.

Recommended Council Action
Adopt the resolution.

Alternative Actions
Council discretion.

Financial Impact
There is no additional financial impact as the council stipends are annually budgeted.

Adopt a Resolution Extending the City of Sonoma Temporary Administrative Policy 2021-5 – Covid-19 Supplemental Paid Sick Leave (“SPSL”)
Summary
On March 19, 2021, California Governor Newsom signed Senate Bill (“SB”) 95 into law, codifying at Labor Code § 248.2 certain paid sick leave entitlements for employees who were unable to work or telework due to specifically enumerated qualifying reasons related to COVID-19 Supplemental Paid Sick Leave (“SPSL”). The City of Sonoma adopted this policy in order to provide qualified employees the SPSL to which they were entitled and otherwise comply with all relevant and applicable requirements provided under Labor Code § 248.2. (A copy of the City of Sonoma Temporary Administrative Policy 2021-5 – Covid-19 Supplemental Paid Sick Leave (“SPSL”) Under Labor Code Section 248.2 is attached as Exhibit A.) The policy clarified that SPSL would be in addition to any other statutory and/or contractual leave to which the employee was otherwise entitled. It also outlined the qualifying reasons for SPSL, the amount of leave to be provided to both full-time employees (80 hours) and parttime employees (various based on the number of hours worked and schedules), and the way the leave could be utilized.

The policy became effective on January 1, 2021, and expired on September 30, 2021, as the underlying law was not extended by the State of California.

If exposed to or diagnosed with COVID-19, the minimum amount of time an employee needs to be off work for quarantining is 5 days, but this could more likely be 10 days if testing is not available or symptoms do not resolve at the end of five days. The amount of time off required by Covid-19 protocols could substantially reduce the amount of sick time an employee has available and might induce a sick employee to come to work potentially exposing other employees.

As COVID case rates are once again soaring in Sonoma County and given that Sonoma County hospitalizations are also currently climbing at a rate greater than any other time during the pandemic, staff is recommending that the original amount of SPSL that each employee had in their SPSL accruals when it expired on September 30, 2021, be reinstated, and extended until June 30, 2022. In addition, any time off taken by employees between September 30, 2021, and January 19, 2022, due to Covid-19 related reasons may retroactively be converted to SPSL instead of sick leave. Please note that this does not provide any additional SPSL hours but only extends the original 80 hours for full-time employees and various amounts for part-time employees. All other requirements for the use of SPSL in the original City of Sonoma Temporary Administrative Policy 2021-5 – Covid-19 Supplemental Paid Sick Leave (“SPSL”) policy would remain the same.

Agenda Item #4.4:

Page 21 of 63 ends

If SPSL is still needed after June 30, 2022, due to continued high COVID-19 case rates, staff is also recommending that the City Manager be given authority to extend the policy for six to twelve months or as needed following that date.

Recommended Council Action
Adopt a resolution of the City Council of the City of Sonoma extending the City of Sonoma Temporary Administrative Policy 2021-5 – Covid-19 Supplemental Paid Sick Leave (“SPSL”) Alternative Actions
Council Discretion
Financial Impact
Based on the current COVID-19 surge in cases, this extension of SPSL is prudent financially.

Having too many of our employees exposed to or diagnosed with COVID-19 at one time could be devastating to our work force and could result in a substantial reduction in City services and responsiveness to City residents.

APRIL 5, 2020
3 1. The employee is subject to a quarantine or isolation period related to COVID-19 as defined by an order or guidelines of the State Department of Public Health (“CDPH”), the federal Centers for Disease Control and Prevention (“CDC”), or a local health officer who has jurisdiction over the workplace;1

2. The employee has been advised by a health care provider to self-quarantine due to concerns related to COVID-19;

3. The employee is experiencing symptoms of COVID-19 and is seeking a medical diagnosis;

4. The employee is caring for a Family Member who is subject to a quarantine or isolation order or guidelines described above, or who has been advised to self-quarantine by a health care provider;

5. If the employee is caring for a Child, whose school or place of care is closed due to COVID-19. This qualifying reason also applies if the employee is caring for a Child whose school or place of care is otherwise unavailable for reasons related to COVID-19 on the premises;

6. The employee is attending an appointment to receive a vaccine for protection against contracting COVID-19; or

7. The employee is experiencing symptoms related to a COVID-19 vaccine that prevent the employee from being able to work or telework.

8. The employee is excluded from the workplace as a result of a “close contact” exposure, as defined by the Centers for Disease Control and Prevention (“CDC”), pursuant to Cal/OSHA’s COVID-19 emergency temporary regulations.

1 If an employee is subject to multiple applicable quarantine or self-isolation orders from the CDC, CDPH, or local health officers, “the covered employee shall be permitted to use COVID-19 supplemental paid sick leave for the minimum quarantine or isolation period under the order or guidelines that provides for the longest such minimum period.” (Labor Code § 248.2 (b)(1)(A).)

4 3. Part-time Covered Employees are entitled to SPSL in the following amounts:
a. If the part-time Covered Employee has a normal weekly schedule, the total number of hours the Covered Employee is normally scheduled to work for the City of Sonoma over two weeks; or
b. If the part-time Covered Employee works a variable number of hours, the Covered Employee is entitled to 14 times the average number of hours the Covered Employee worked each day for the City of Sonoma in the six (6) months preceding the date the Covered Employee took SPSL. If the Covered Employee has worked for the City of Sonoma over a period of fewer than six (6) months but more than 14 days, this calculation shall instead be made over the entire period the Covered Employee has worked for the City of Sonoma.

Covered Employees may determine how many hours of SPSL to use based upon a qualifying reason, up to the total number of hours to which the Covered Employee is entitled under the above.

The City of Sonoma is not required to provide a Covered Employee more than the total number of hours of SPSL to which the Covered Employee is entitled to under sections 2 through 4 above.

Covered Employees that request retroactive SPSL will be required to sign a “COVID-19 Supplemental Paid Sick Leave Acknowledgment,” acknowledging the accuracy of the amount of leave designated retroactively.

The City of Sonoma provided a Covered Employee with EPSL(?) (define what this means) and FFCRA (define)for leave taken on or after January 1, 2021 per City of Sonoma Resolution #_____, that was payable for the same qualifying reasons enumerated above and compensated in an amount equal or greater to the amount enumerated below. The City of Sonoma will count such supplemental benefit against the employee’s SPSL entitlement.

Compensation While on SPSL:

Covered Employees are entitled to compensation for SPSL at their regular rate of pay, including pursuant to any applicable collective bargaining agreement, subject to a cap of $511 per day and $5,110 in the aggregate.

Employee Status While on Leave:

The City of Sonoma will compensate Covered Employees who use SPSL according to the manner described in this policy and will otherwise treat Covered Employees who use COVID-19 Supplemental Paid Sick as if they are on using paid sick leave according to the City of Sonoma’s Memorandum of Understanding Between the City of Sonoma and the City of Sonoma Employees’ Association SEIU 1021 July 1, 2019 Through June 30, 2022.

Employee Obligations for Requesting Retroactive Payments for Prior Leave that Qualified as SPSL:

Employees are entitled to SPSL retroactive to January 1, 2021.

If the City of Sonoma did not compensate the employee for leave that would otherwise have qualified as SPSL between January 1, 2021 and the effective date of this policy, in an amount equal or greater to what the employee would have been entitled to under this policy, the employee is eligible for a retroactive payment from the City of Sonoma for such leave.

In order to receive payment for such leave, employees must make an oral or written request to be paid for such leave to the City of Sonoma’s Human Resources Department.

For any such retroactive payment, the number of hours of leave corresponding to the amount of the retroactive payment shall count towards the total number of hours of SPSL that the employer is required to provide to the Covered Employee.

Adopt a Resolution of the City Council of Sonoma as Successor Agency Approving the FY 22-23 Recognized Obligation Payment Schedule [ROPS] for the period July 1, 2022, through June 30, 2023
Summary
As required by legislation AB126 and subsequent legislation with the dissolution of redevelopment, the Recognized Obligation Schedule [ROPS] must be prepared and approved annually. The ROPS is a permanent schedule of obligations that must be approved by the Successor Agency, Oversight Board, and the State Department of Finance. After approval by the Department of Finance, the County Auditor-Controller will allocate property tax increment (RPTTF – Redevelopment Property Tax Trust Fund) to successor agencies to pay debts listed on the ROPS and the remaining is distributed to the appropriate property tax agencies in the county.

The ROPS under consideration covers the period July 1, 2022, through June 30, 2023 (FY 22/23) and contains updates to all previously approved projects and expenditures. The FY 22/23 ROPS also includes new principal and interest payments on the 2021 Tax Allocation Refunding Bonds, the proceeds of which were used to redeem and defease the 2010 Refunding Tax Allocation Bonds (“2010 Bonds”) and the 2011 Tax Allocation Bonds (“2011 Bonds”), in order to provide significant savings to the Successor Agency on the total interest cost to maturity. The final net present value savings on the bonds will be $7.76 million, higher than the original forecasted $7.28 million. This was due to very favorable interest rates at the time the bonds were sold.

Once the ROPS is approved by the City Council as the Successor Agency, it will be presented to the Sonoma County Consolidated Oversight Board (Oversight Board) on January 28,2022.

Once approved by the Oversight Board, it is submitted to Department of Finance, the State Controller’s office, and the County Auditor-Controller by February 1.

Sonoma has had its own Oversight Board historically, but based on State law, all oversight boards within each county were consolidated effective January 1, 2019. On January 28, 2022, the Sonoma County Consolidated Oversight Board will convene to hear an overview of all prior redevelopment matters of business for 2022. For most individual Successor Agencies, this will entail Recognized Obligation Payments Schedules (ROPS) and any other subjects that will need Oversight Board approval for reporting to the California Department of Finance by February 1, 2022.

Recommended Council Action
Acting as the Successor Agency, adopt SA Resolution #__-2022 approving the ROPS for the period July 1, 2022, through June 30, 2023, for presentation to the Sonoma County Agenda Item #4.5:

ALCALDE SELECTION PROCESS, ROLES & RESPONSIBILITIES
City Council Approved 11/5/2018
Each year, the City Council of the City of Sonoma selects a citizen of the year who is called the honorary Alcalde. This policy outlines the selection, criteria, and role of the honored person.

ORIGIN OF ALCALDES
Alcaldes in California came about through the rise of the pueblo system and the establishment of town councils (called ayuntamientos). The councils were headed by mayors (called alcaldes), and together they provided a semblance of government, hearing a wide range of issues from land disputes to criminal matters.

The annually elected alcalde was not only the chief local law practitioner, but judge, justice of the peace (if no one else filled that function), notary public, recorder, escrow agent in land transactions, boss of the town Council, and was probably the town's most useful citizen. He often had to rule on disputes over cattle, horses, branding irons, hides, horse race wagers, bankruptcy, adoption, promissory notes, barrels of wine, and vacant lands.

Alcaldes were the recorders of mortgages, wills, and conveyances, and also had to deal with criminal activity including murder.

The Alcalde's position and importance did not end with Mexican Rule. In his speech following the raising of the American Flag over Monterey on July 7, 1846, Commodore John Sloat restated the importance of alcaldes and invited them to continue to execute their duties. The function of alcaldes did not legally change until after the state Constitution was adopted, and duties previously performed by one person were separated into several positions. Today the Spanish word “alcalde” literally means Mayor.

In 1975, the City of Sonoma decided to once again find "the town's most useful citizen" and bestow upon them the title Honorary Alcalde. August Pinelli, the first to be honored, began his year January 1, 1976. The Council has voted for an “honorary Alcalde” every year since.

The honoree is given a silver-headed cane as a symbol of the honor and appears in parades and at grand openings. The honoree is also recognized with a reception hosted by the City with help from the past Alcaldes where their contributions are celebrated.

CRITERIA FOR SELECTION
The Nominee shall have accomplished several of the following:
 Participated in a broad spectrum of voluntary community service to Sonoma Valley;  Served in a leadership role in at least one non-profit organization;  Spearheaded at least one community-serving project without compensation;  Be well-known for consistent behind-the-scenes good deeds;  Does not seek public accolades or recognition for work done; and,  Adheres to a high standard of moral and ethical values.

Other Criteria:
 Nominee must reside in the City of Sonoma or Sonoma Valley.  Nominees may be either an individual or a couple.

SELECTION PROCESS

1. Nomination Period & Outreach – In late October or early November, a press release will be sent to newspapers announcing the nomination period for Honorary Alcalde of the City of Sonoma. A summary of the criteria shall also be published with a submission deadline no later than mid-December and preferably December 1. City staff will also promote the Alcalde nomination process through other marketing and social media outlets and distribution to the Non-Profit Executive Director Roundtable and other Sonoma groups.

2. Nomination Protocols -- Persons submitting a nomination will do so in a letter or email format, addressing as many of the criteria as possible, and sending the nomination to the City Manager. In order to demonstrate broad support for the nominee, it is recommended that in addition to the nomination letter that a minimum of three letters of recommendation be submitted.

3. Nomination and Ratification Process -- Early in January, the City Manager will convene a Nominating Committee. Historically, this committee has been comprised of the three most immediate past alcaldes available, the Mayor, and the City Manager.

No more than five days before the meeting, the nominee’s names and nomination packets will be released to the committee members only for discussion at the meeting. In the instance that a nominee has been recommended previously, the Nominating Committee will be supplied the prior nomination packets going back two years. This Committee will review the nominations and will select three candidates for consideration.

The Mayor will then make the final nomination and the Council will vote to ratify at the first available Council meeting following the committee nominations, but in no case later than the first meeting in February.

Discussion, Consideration and Possible Action on Council comments Regarding the Alternatives Report for the Sonoma Development Center Specific Plan and Provide Direction to Staff
Summary
On December 1, 2021, the Council received a presentation from County staff regarding the Alternatives Report for the Sonoma Development Center (SDC) Specific Plan. After receiving numerous public comments, the Council requested staff to schedule a workshop at this meeting to have a more focused community discussion on the matter. Specifically, the Council wanted to hold a workshop to provide an opportunity for the community to ask questions of County representatives regarding the SDC Plan. The Council indicated that County staff would not need to make a presentation at the workshop, but rather just be available for a community Q &A session.

The Council conducted its workshop on December 15th as part of the regular Council meeting.

At the meeting, staff recommended we return to Council at this meeting with the summary of the Council’s comments from the December 15th meeting. This would provide an opportunity for the Council to review/edit/revise/add any comments before staff transmits the comments to the Board of Supervisors.

SDC Summary
Agenda Item #6.2:

Page 47 of 63 ends

Summary of Council comments from December 15, 2021, Meeting regarding the SDC (not in order of priority)
• The three alternatives do not adequately address the needs of the City of Sonoma or Sonoma Valley.
• A new alternative should be developed.
• Hotel should not be the primary economic driver/use for the SDC. • A boutique hotel may be appropriate for the project if it serves a complimentary use to the primary economic uses for the SDC.
• The primary economic uses to be consider should be office complexes, R&D and/or high-tech campuses, green/climate related industries, medical campuses/offices, and/or education hubs. • Consider private/public partnership to encourage/facilitate the development of the desired economic engines for the SDC.
• The SDC Plan should benefit California.
• Respect the natural environment and wildlife corridors; limit intrusion/encroachment into those protected area (i.e., limit impact to natural environment). • Create a range of affordable housing opportunities.
• Consider higher densities to allow for more open space. • Focus on the creation of jobs with living wages.
• Enhance recreational opportunities.
• Consider other development proposals/plans/analysis prepared by other third parties. • Respect/appreciate/acknowledge the heritage and architectural character of SDC. • Plan should maintain a housing/jobs balance (i.e., link jobs to housing) whereby housing opportunities reflect the range of jobs (i.e., wages) created to reduce climate impacts. • Make adaptive reuse of facilities a priority.
• Provide/retain more resources to assist in the development of the SDC plan. • Ensure traffic analysis to address the potential impact to the City of Sonoma’s roadway infrastructure and level of service.
• Encourage the commitment of financial resources from state and federal agencies to address the deferred maintenance and infrastructure needs of SDC which would provide for more flexibility in developing a plan for SDC.
• Request more time for the community to provide input into an acceptable plan. • Please request staff and professional consulting firms to watch the video from the City Council’s December 1 and 15th, 2021 meeting to discuss the SDC Plan.

Discuss, Consider, and Take Possible Action on Introduction and Adoption of an Urgency Ordinance Amending the Sonoma Municipal Code to Add Section 19.50.140 – Timeshares – and Finding the Ordinance exempt from the California Environmental Quality Act (CEQA) under the general rule pursuant to Guidelines Section 15061(b)(3) because CEQA only applies to projects that have the potential for causing a significant effect on the environment and the Ordinance does not involve a commitment to any specific project that may result in a potentially significant physical effect on the environment.

Summary
Currently, the Municipal Code does not contain any regulation governing the use of properties as time-shares, meaning that, as a non-enumerated use, time-shares currently are prohibited throughout the City. However, due to the rise in fractional home ownership, there may be ambiguity regarding whether fractional home ownership uses constitutes a prohibited timeshare or an allowed residential use. The urgency ordinance is intended to define time-shares broad enough to encompass fractional home ownership and ensure that their essentially commercial use is confined to those parts of the City that are planned for commercial uses.

This will avoid losing valuable land zoned for residential purposes from being usurped by fractional home ownership and time-share uses. The proposed urgency ordinance thus continues the prohibition on time-shares in all residential zones and as the residential component of a Commercial or Mixed Use development. The following findings can be made by the City Council to support the adoption of the Urgency Ordinance:

1. A severe housing crisis exists in the state with the demand for housing outpacing the supply;

2. The City of Sonoma is particularly experiencing a housing emergency due to its relative isolation, limited housing supply, and desirable location;

3. Time-share uses threaten to reduce the housing supply in the City by turning longterm housing in the City into vacation rentals and reducing the affordable housing stock in the City;

4. Time-shares increase traffic and noise impacts and have the same character as commercial hotels, motels, and other transient occupancy uses due to their transient nature making them inappropriate for residential zones;

5. California Government Code Sections 36934 and 36937 authorizes the City of Sonoma to adopt an urgency ordinance by a four-fifths vote (4/5ths) necessary to protect the public peace, health, or safety;

6. An urgency ordinance adopted pursuant to Government Code Sections 36934 and 36937 is warranted on an urgency basis to allow regulations to govern how time-share are regulated. Without such ordinance, the issues raised above pose a significant threat to the public peace, health and safety.

The attached Urgency Ordinance will add Section 19.50.140 – Timeshares into Title 19 and will be effective upon adoption. The attached Urgency Ordinance was presented to the Agenda Item #6.3:

Page 49 of 63 ends

Planning Commission on January 13th, 2022, for comment and direction to staff, which will be reported to the City Council at the meeting.

It is anticipated that the Planning Commission will review a regular ordinance at its meeting on February 10th, 2022, that will be later introduced to the City Council on February 23rd, 2022, and adopted by the City Council on March 2, 2022 to supersede the Urgency Ordinance; however the Urgency Ordinance would be in effect until a regular ordinance becomes effective.

The attached Urgency Ordinance creates provisions for allowing timeshares with the approval of a Use Permit as part of the commercial component in a Commercial zoning district as defined in Section 19.10.020(B) or as a part of the commercial component in a Mixed Use zoning district as defined in Section 19.10.020(C).

Recommended Council Action
Introduce and adopt an Urgency Ordinance entitled “AN URGENCY ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SONOMA ADDING TITLE 19, SECTION 19.50.140 (TIMESHARES) TO THE CITY OF SONOMA MUNICIPAL CODE.” Note: A 4/5 vote of the City Council is required to adopt an urgency ordinance and it takes effect immediately
Alternative Actions

1. Take no action

2. Direct staff to amend urgency ordinance to only allow time-shares in commercial zones, but not as part of the residential component (i.e., also prohibiting them as part of the commercial component in MX)

3. Direct staff to amend urgency ordinance to prohibit time-shares in all zones in the City.

Financial Impact

DRAFT ORDINANCE #_____ -2022

AN URGENCY ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SONOMA ADDING TITLE 19, SECTION 19.50.140 (TIME-SHARES) TO THE CITY OF SONOMA MUNICIPAL CODE
WHEREAS, the City has recently become aware of time-share companies operating in the City; and
WHEREAS, this Ordinance is adopted as an urgency ordinance pursuant to Government Code Sections 36934 and 36937. The facts constituting the urgency are as follows:
a) A severe housing crisis exists in the state with the demand for housing outpacing the supply;
b) The City of Sonoma is particularly experiencing a housing emergency due to its relative isolation, limited housing supply, and desirable location; c) Time-share uses threaten to reduce the housing supply in the City by turning longterm housing in the City into vacation rentals and reducing the affordable housing stock in the City;
d) Time-shares increase traffic and noise impacts and have the same character as commercial hotels, motels, and other transient occupancy uses due to their transient nature making them inappropriate for residential zones; e) California Government Code Sections 36934 and 36937 authorizes the City of Sonoma to adopt an urgency ordinance by a four-fifths vote (4/5ths) vote where necessary to protect the public peace, health, or safety; f) An urgency ordinance adopted pursuant to Government Code Sections 36934 and 36937 is warranted on an urgency basis to allow regulations to govern how timeshare are regulated. Without such ordinance, the issues raised above pose a significant threat to the public peace, health and safety.

272104.2
SECTION 1. RECITALS.

The above set forth recitals and findings are true and correct and incorporated herein by reference, as if set forth herein in full.

SECTION 2. URGENCY ORDINANCE.

The urgency ordinance is necessary for the immediate preservation of the public peace, health, and safety because the operation of time-share companies in the City threatens to reduce the supply of affordable and market-rate housing in the City, increase site development conflicts and incompatibilities related to public safety, visual, privacy, and aesthetic impacts which would negatively impact the public welfare and the unique quality and character of the City of Sonoma.

SECTION 3. MUNICIPAL CODE AMENDMENTS.

Section 19.50.140 of the Sonoma Municipal Code is added to read as follows:

19.50.140 Time-Shares.

This section sets forth requirements for the establishment and operation of time-share uses.

A. Definitions.

1. “Accommodation” means any dwelling unit, multifamily dwelling, apartment, condominium or cooperative unit, cabin, lodge, hotel or motel room, or other private or commercial structure containing toilet facilities therein that is designed and available, pursuant to applicable law, for use and occupancy as a residence by one or more individuals.

b. The right to exclusively occupy a time-share property for a period of time on a recurring basis pursuant to a time-share plan, which right is neither coupled with a freehold interest, nor coupled with an estate for years with a future interest, in a time-share property or a specified portion thereof.

Agenda Item #6.3:

Page 53 of 63 ends

272104.2

6. “Time-share plan” means any arrangement, plan, scheme, or similar device, whether by membership agreement, sale, lease, deed, license, right to use agreement, or by any other means, whereby a purchaser, in exchange for consideration, receives the right to exclusive use of an accommodation or accommodations, whether through the granting of ownership rights, possessory rights or otherwise, for a period of time less than a full year during any given year, on a recurring basis for more than one year, but not necessarily for consecutive years.

B. Permitted zones. A time-share use shall only be permitted as part of the commercial component in a Commercial Zoning District, as defined by SMC § 19.10.020(B), or as part of the commercial component in a Mixed Use Zoning District, as defined by SMC § 19.10.020(C).

C. Use Permit Required. The establishment and operation of a time-share use shall require the approval of a conditional use permit in compliance with SMC § 19.54.040.

D. Violations, Enforcement and Civil Penalties

1. Any responsible person, including but not limited to an owner of a time-share interest, management entity, agent, or broker who uses, or allows the use of, or advertises or causes to be printed, published, advertised or disseminated in any way and through any medium, the availability for sale or use of an accommodation in violation of this section is guilty of a misdemeanor for each day in which such accommodation is used, allowed to be used, or advertised for sale or use in violation of this chapter. Such violation shall be punishable pursuant to Chapter 1.12 (General Penalty).

2. Any responsible person, including by not limited to an owner of a time-share interest, management entity, agent, or broker who uses, or allows the use of, or advertises or causes to be printed, published advertised or disseminated in any way and through any medium, the availability for sale or use of an accommodation in violation of this section is subject to administrative fines and/or penalties as set forth in Chapter 1.28 (Administrative Citations).

3. Time-share use, and/or advertisement for time-share use, of an accommodation in violation of this section is a threat to public health, safety or welfare and is thus declared to be unlawful and a public nuisance and may be abated pursuant to Chapter

Agenda Item #6.3:

Page 54 of 63 ends

272104.2
SECTION 4. CEQA.

This Ordinance has been assessed in accordance with the authority and criteria contained in the California Environmental Quality Act (CEQA), the State CEQA Guidelines, and the environmental regulations of the city. City Planning Staff has determined that the adoption and implementation of the Ordinance is exempt from further environmental review under the general rule in California Environmental Quality Act (CEQA) Guidelines Section 15061(b)(3) that CEQA only applies to projects that have the potential for causing a significant effect on the environment. As a text amendment and addition without any physical project being approved, it can be seen with certainty that there is no possibility that the Ordinance will have a significant effect on the environment. The proposed Ordinance is therefore exempt from the provisions of CEQA because it does not involve a commitment to any specific project that may result in a potentially significant physical impact on the environment. The City Council concurs in these findings and adopts them as its own. The City Council, therefore, directs that a Notice of Exemption be filed with the County Clerk of the County of Sonoma in accordance with CEQA Guidelines.

SECTION 5. SEVERABILITY.

If any section, subsection, subdivision, sentence, clause, phrase, or portion of this Ordinance for any reason is held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this Ordinance.

The City Council hereby declares that it would have adopted this Ordinance, and each section, subsection, subdivision, sentence, clause, phrase, or portion thereof, irrespective of the fact that any one or more sections, subsections, subdivisions, sentences, clauses, phrases, or portions thereof be declared invalid or unconstitutional.

SECTION 6. EFFECTIVE DATE.

This Ordinance is an urgency ordinance enacted under California Government Sections 36934 and 36937, subdivision (b). The urgency ordinance is effective upon adoption by a 4/5 vote of the Sonoma City Council, and shall take effect immediately upon its adoption.

SECTION 7. PUBLICATION.

This ordinance shall be published in accordance with the provisions of Government Code Section 36933(c)(1).

SECTION 8. THIS ORDINANCE PREVAILS WHERE THERE IS CONFLICT.

To the extent that this Ordinance conflicts with any other provision in the Sonoma Municipal Code or city ordinance (urgency or otherwise), policy or regulation, this Ordinance will control.

Discussion, Consideration and Possible Action Regarding the Mayor's Assignment of Council Members to Various Boards and Committees and Council Ratification of the Mayor’s Assignments and Council Assignments to City Council Ad Hoc Sub-Committees Summary
Council members are assigned to represent the City on various boards and committees on an annual basis. They also serve on internal Ad Hoc Sub-Committees to address local issues of concern. The attached worksheets reflect the list of boards, committees and commissions to which Council members were assigned at the last review. Typically, this review and assignment of Councilmembers happens at one of the Council’s January meetings. However, given the appointment of new Councilmembers during 2021, the Council had to consider new assignments during the year.

Some committee appointees are pre-designated and are not discretionary; for example, the Joint & Mutual Fire Protection and Emergency Medical Services Agreement with the Valley of the Moon Fire Protection District designates the Mayor and Vice Mayor as the appointees to the Sonoma Valley Fire & Rescue Authority Oversight Committee.

One additional appointment has been added for Council consideration. The Sonoma County Continuum of Care (CoC) Board is the governing body that determines policy and acts as the CoC's decision-making group. Mandated by HUD's Continuum of Care Program, the board is responsible for oversight of funds designated to the Continuum of Care and regional planning/policy development for addressing homelessness. The Board consists of local elected officials, nonprofit representatives, subject matter experts, and individuals with lived homeless experience. Recently, the CoC revised its Governance Charter. As such, it has reconfigured the CoC Board Composition to better reflect the geography of Sonoma County. As such, there are assigned seats for Santa Rosa and Petaluma, along with four more regional seats (North, Central, West, and East).

The Sonoma Valley/East Region’s seat is to be appointed by the City Council of Sonoma. The City Council may appoint one member to the CoC Board to fill the Sonoma Valley Region’s seat. At this time it appears it would be a two-year assignment, with Board meetings held once a month, and the specific date and time of the month subject to a Board consensus early in the term. Board members may volunteer to serve on one or more subcommittee meetings. The seat can be held by a City elected official, a staff member, or a community member.

It should be noted that the process for Council assignments to Boards, Committees, and Commissions is slightly different from the process to assign members to Ad-Hoc SubCommittees. Specifically, the Mayor makes the appointments to the Council Board/Committee/Commissions subject to ratification by the Council. Assignments to the Ad Hoc Council Sub-Committees are approved by the entire Council. In October 2021, the Council Agenda Item #6.4:

assigned members to the various Ad-Hoc Sub-Committee. Given there is a newly elected Councilmember, the Council may want to reconsider assignments to the Ad-Hoc SubCommittees.
