Before any law enforcement action is taken because of an ALPR alert, the alert will be verified through a CLETS inquiry via MDC or through Dispatch. Members will not take any enforcement action that restricts the freedom of any individual based solely on an ALPR alert unless it has been validated. Because the ALPR alert may relate to a vehicle and may not relate to the person operating the vehicle, deputies are reminded that they need to have reasonable suspicion and/or probable cause to make an enforcement stop of any vehicle. should attempt to visually match the driver to the description of the wanted subject prior to making the stop or should have another legal basis for making the stop.) (g) Hot Lists. Designation of hot lists to be utilized by the ALPR system shall be made by the ALPR Administrator or his/her designee. Hot lists shall be obtained or compiled from sources as may be consistent with the purposes of the ALPR system set forth in this Policy. Hot lists utilized by the Office's LPR system may be updated by agency sources more frequently than the Office may be uploading them and thus the Office's LPR system will not have access to real time data. Occasionally, there may be errors in the LPR system's read of a license plate. Therefore, an alert alone shall not be a basis for police action (other than following the vehicle of interest). Prior to initiation of a stop of a vehicle or other intervention based on an alert, Office members shall undertake the following:
1. Verification of status on a Hot List A deputy must receive confirmation, from a Sonoma County Sheriff's Office Communications Dispatcher or other office computer device, that the license plate is still stolen, wanted, or otherwise of interest before proceeding (absent exigent circumstances).
2. Visual verification of license plate number. Deputies shall visually verify that the license plate of interest matches identically with the image of the license plate number captured (read) by the LPR, including both the alphanumeric characters of the license plate, state of issue, and vehicle descriptors before proceeding.
Office members alerted to the fact tha an observed motor vehicle's license plate is entered as a Hot Plate (hit) in a specific BOLO (be on the lookout) list are required to make a reasonable effort to confirm that a wanted person is actually in the vehicle and/or that a reasonable basis exists before an office member would have a lawful basis to stop the vehicle.
3. Office members will clear all stops from hot list alerts by indicating the positive ALPR Hit, i.e., with an arrest or other enforcement action. If it is not obvious in the text of the call as to the correlation of the ALPR Hit and the arrest, then the Office member shall update with the Communications Dispatcher and original person and/or a crime analyst inputting the vehicle in the hot list (hit).
4. General Hot Lists (SVS, SFR, and SLR) will be automatically downloaded into the ALPR system a minimum of once a day with the most current data overwriting the old data.

Agenda Item Title
Adopt a Resolution Authorizing the City Manager to Execute a Contract with Portola for $194,091.20 for Facility Security Upgrades (CIP BF-11), Authorizing $19,409.12 (10%) in Contingency, and Authorizing a Budget Amendment for $74,250.32 in Additional Expenditures from the Long-Term Building Maintenance Fund Summary
During the 25-26 Budget Cycle, City Council approved a new Capital Improvement Project for Facility Security Upgrades (CIP BF-11). This was approved with $150,000 budget transfer from the Long-Term Building Maintenance Fund (Fund 610) to Fund 304 (Parks and Facilities CIP).
This has been a priority as all of the City-owned facilities do not have additional security measures beyond a traditional key-lock.
After the adoption of the 25-26 Budget, City staff started the process of developing a project for facility upgrades to address security. This included discussions with Sonoma Police Department and Sonoma Valley Unified School District (SVUSD), as they had just completed a large security upgrade project. SVUSD utilized Verkada cameras, and the Sonoma Police Department (staffed by Sonoma County Sheriffs) has access to SVUSD's security system.
SVUSD and Sonoma Police Department both noted that Verkada had competitive pricing, their systems were very effective, and were relatively easy to use.
City staff-initiated conversations with Verkada. Verkada also has a contract through the California Multiple Award Schedules (CMAS), which functions as a cooperative purchasing entity. Cooperative purchasing is an allowable means of procuring equipment under the City's purchasing policy. It helps streamline procurement processes for agencies and alleviates the need for a competitive bidding process. In return for utilizing this procurement process, agencies are eligible for significant discounts off the manufacturer's suggested retail price (estimated at 12-15%). CMAS prequalifies contractors based on best value for goods and services. This determination offers agencies a streamlined approach to procurement.
Verkada's CMAS contract number, which is referenced on Public Works Purchase Order, is 3- 25-06-1033. Items eligible for CMAS procurement and discount include the cameras, licensing, and Portola Systems' installation. Items that are not included under CMAS are door lock materials and switch gear installation materials and labor, which are relatively minor parts of this procurement.
Verkada is the camera/software vendor, but the installation work will be done by Portola Systems through CMAS. Portola Systems will be providing the Verkada technology, various parts and materials needed to support the installation of the cameras and door key card systems, as well as the labor for the installation. In order to ensure that Portola Systems had enough information to provide a detailed scope of work and fee schedule, as well as being able to adequately prepare for conditions on site, staff authorized Portola Systems to conduct a very detailed site walk for a fee. This will ensure that Portola Systems and their staff are adequately prepared to take on this project with minimal involvement from City Staff, and will be a true Agenda Item #9.2:
turnkey project.
Portola Systems will be installing cameras and key card readers for security access at City Hall, Carnegie Building, City Council Chambers, and the Public Works Corporation Yard. Regarding both City Hall and Carnegie, considerations have been made for the historic nature of these buildings, so all cameras will be mounted to the eaves of the buildings. This project will significantly improve the safety of all City staff and visitors of these four facilities. In addition, all labor will be paid at prevailing wage rate, as required by Department of Industrial Relations.
The cost through CMAS also includes a 10-year Verkada software license that includes data/content access, download/export options, storage duration, and retention controls for all cameras. Verkada's software will allow the City's authorized administrators to access video footage, archives, and system data through the Verkada Command platform based on their assigned permissions. Verkada also provides the ability to export certain data, including video archives and audit logs, for the City's own records.
Project Budget
The City originally approved a budget of $150,000.00 for this project. After staff started discussions with Verkada, quotes showed that a system of this nature (cameras and key card readers), would be more than this original estimate. After working with Portola Systems, and completing a comprehensive scope based on the authorized site walk, there is still a funding gap. Items in the project budget are below:
Item Amount
Portola Systems Quote (includes cameras, installation, access control, and 10- year software license) $194,091.20
EDesignC - Task Order for Electrical Support if needed $8,750.00 Site Walk - Authorized for Scoping Project $2,000.00
Contingency - 10% of total contract cost $19,409.12
Total project cost: $224,250.32.
This represents a funding gap of $74,250.32. Staff recommends adopting a budget amendment to appropriate the required funds from the Long Term Building Maintenance Fund, which the project was initially funded out of.
Recommended Council Action
Adopt a Resolution of the City of Sonoma City Council Authorizing the City Manager to Execute a Contract with Portola for $194,091.20 for Facility Security Upgrades (CIP BF-11), Authorizing $19,409.12 (10%) in Contingency, and Authorizing a Budget Amendment for $74,250.32 in Additional Expenditures from the Long-Term Building Maintenance Fund.
Alternative Actions
Council discretion.
Financial Impact
In order for this project to move forward, additional funding is needed for all elements of this project to be fully funded. Staff has recommended that the $74,250.32 short fall be funded by the Long-Term Building Maintenance Fund, as the project was originally funded from this fund with the 25-26 Budget Approval. The Long-Term Building Maintenance has sufficient funding Agenda Item #9.2:
to support these additional expenditures. Staff recommend approving a budget adjustment to increase expenditures for this project.

A. The City Council may from time to time fix other terms and conditions of employment relating to the performance of Employee, provided such terms and conditions are not inconsistent with or in conflict with the provision of this Agreement, the Sonoma Municipal Code, or other applicable law.
A. The provisions of City’s Personnel Rules and Regulations (“Rules”) shall apply to Employee to the extent they explicitly apply to the position of City Manager, except that if the specific provisions of this Agreement conflict with the Rules, the terms of this Agreement shall prevail. Without limiting the generality of the exception noted in the previous sentence, however, no provision of the Rules or this Agreement shall confer upon Employee a property right in her employment or a right to be discharged only upon cause. Employee is an at-will employee serving at the pleasure of the City Council and may be dismissed at any time with or without cause, subject only to the provisions of this Agreement.

B. Employee shall be exempt from paid overtime compensation and from Social Security taxes other than the mandatory Medicare portion of such taxes.
10. Termination
Employee understands and agrees that she has no constitutionally-protected property or other interest in her employment with City. Employee understands and agrees that she works at the will and pleasure of the City Council, and that she may be terminated, or asked to resign, at any time, with or without cause, by a majority vote of the City Council. Employee shall not be entitled to any severance pay upon termination, but shall be entitled to payment in full for consideration during her service. As an Interim City Manager, Employee understands that the provisions of Sonoma Municipal Code sections 2.08.060 (Removal of city manager) and 2.08.070 (Limitations on removal) do not apply to Employee’s position and Employee specifically waives any rights provided therein.
11. Voluntary Termination; Death
A. Employee may voluntarily terminate her employment, by resignation or retirement, at any time during the term of this Agreement, subject to at least thirty days’ written notice by Employee to City, unless the City Council and Employee agree otherwise. Employee shall not be entitled to any severance pay upon voluntary termination, but shall be entitled to payment in full for consideration during her service.
B. In the event Employee dies while employed by City, her beneficiaries or those entitled to her estate shall be paid any earned salary at Employee’s pay rate on the date of death.
12. Residency
The City Council hereby waives the requirements of Sonoma Municipal Code section 2.08.020 in light of Employee’s long-term residence outside of 10 road miles from the City of Sonoma.
13. Compliance With Law
A. This Agreement is subject to all applicable provisions of State and Federal law, the provisions of the Sonoma Municipal Code, and to any other ordinances, rules, regulations, and policies of City applicable to Employee and the Interim City Manager position.

B. Employee shall not engage in any business or transaction nor have a financial or other personal interest or association, direct or indirect, which is in conflict with the proper discharge of official duties or would tend to impair independence of judgment or action in the performance of official duties. Personal as distinguished from financial interest includes an interest arising from blood or marriage relationships or close business, personal, or political associations. Employee shall also be subject to the conflict of interest provisions of the California Government Code and any conflict of interest code applicable to Employee’s City employment. Employee is responsible for submitting to the City Clerk the appropriate Conflict of Interest Statements at the time of appointment, annually thereafter, and at the time of separation from the position.
Employee shall not engage in any employment, activity, consulting service, or other enterprise, for compensation or otherwise, which is actually or potentially in conflict with, or which interferes with the performance of Employee’s duties. Further, Employee shall not, during the term of this Agreement, individually, as a partner, joint venture, officer, or shareholder, invest or participate in any business venture conducting business in the corporate limits of the City of Sonoma (except for stock ownership in any company whose capital stock is publicly held and regularly traded) without prior approval of the City Council. For and during the term of this Agreement, Employee further agrees, except for a personal residence or residential property acquired or held for future use as Employee’s personal residence, not to invest in any other real estate property improvements within the corporate limits of City without the prior consent of the City Council.
14. General Provisions
A. This Agreement constitutes the entire agreement between the parties. City and Employee hereby acknowledge that they have neither made nor accepted any other promise or obligation with respect to the subject matter of this Agreement.
B. If any provision or any portion of this Agreement is held to be unconstitutional, invalid, or unenforceable, the remainder of the Agreement shall be deemed severable and shall not be affected and shall remain in full force and effect.
