BACKGROUND:

The Administrative Services Department manages the payment processing for all City disbursements. The City has three main types of payments which includes the following:

SERVICE, INNOVATION, INTEGRITY, COLLABORATION, RESPECT, LEADERSHIP DATE: September 8, 2026
TO: Honorable Mayor and Members of the City Council
FROM: Brittan Gregory, Fire Chief
SUBJECT: Consider Approval of the Memorandum of Agreement Between the City of Sonora and the Twain Harte Community Services District, the Mi-Wuk Sugar Pine Fire Protection District, the Tuolumne County Fire Department, and the Tuolumne Band of Me-Wuk Indians Pertaining to Assistance Under the California Fire and Rescue Mutual Aid System for the Dove Fire, and Authorize the City Administrator to Execute the Agreement.

RECOMMENDATION:

Consider Approval of the Memorandum of Agreement Between the City of Sonora and the Twain Harte Community Services District, the Mi-Wuk Sugar Pine Fire Protection District, the Tuolumne County Fire Department, and the Tuolumne Band of Me-Wuk Indians Pertaining to Assistance Under the California Fire and Rescue Mutual Aid System for the Dove Fire, and Authorize the City Administrator to Execute the Agreement.

BACKGROUND:

On July 26, 2026, extreme fire conditions, including strong winds and low humidity, contributed to a fire that swept through the region, referred to as the "Dove Fire." On that same day, a Presidential Declaration of Emergency (FEMA-5652-FM-CA) was issued in connection with the fire. Pursuant to the California Fire and Rescue Mutual Aid System, the Fire Chief of the City of Sonora, serving as the Operational Area Fire and Rescue Mutual Aid Coordinator, requested mutual aid assistance from the Twain Harte Community Services District, the Mi-Wuk Sugar Pine Fire Protection District, the Tuolumne County Fire Department, and the Tuolumne Band of Me-Wuk Indians.

These agencies provided fire personnel, equipment, and materials from July 28, 2026 through August 1, 2026, to assist with fire suppression and emergency protective services in connection with the Dove Fire.

DISCUSSION / ANALYSIS:

The California Fire and Rescue Mutual Aid System is issued and revised under the authority of Sections 8550, 8569, 8615 through 8619, and 8668 of the California Government Code, the California Emergency Plan, and the California Disaster and Civil Defense Master Mutual Aid Agreement. It establishes the standard procedures used to request and coordinate fire service mutual aid resources when an emergency cannot be resolved by a single fire agency within an Operational Area.

The attached Memorandum of Agreement formalizes the mutual aid assistance provided during the Dove Fire and obligates the City of Sonora to reimburse the Twain Harte Community Services District, the Mi-Wuk Sugar Pine Fire Protection District, the Tuolumne County Fire Department, and the Tuolumne Band of Me-Wuk Indians 18 Item C.

SERVICE, INNOVATION, INTEGRITY, COLLABORATION, RESPECT, LEADERSHIP for all reasonable costs associated with their fire service mutual aid assistance. Each participating agency has agreed to document its respective costs and submit them to the City as attachments to the Agreement.

Staff recommend that the City Council approve the Agreement and authorize the City Administrator to execute it on behalf of the City. Approval of the Agreement ensures the City honors its mutual aid obligations, supports continued regional cooperation among fire service partners, and allows the participating agencies to be reimbursed for the resources they committed during the Dove Fire.

FISCAL IMPACT:

The total reimbursement cost to the City is not yet determined and will be based on the documented mutual aid assistance costs submitted by the Twain Harte Community Services District, the Mi-Wuk Sugar Pine Fire Protection District, the Tuolumne County Fire Department, and the Tuolumne Band of Me-Wuk Indians. Because the Dove Fire was covered by a Presidential Declaration of Emergency (FEMA-5652-FM-CA), a Fire Management Assistance Grant (FMAG) has been approved for the fire, and the City intends to pursue reimbursement of these costs through that grant and other applicable state and federal disaster assistance programs.

SUBJECT: Consider Authorization for the Mayor to Sign a Letter in Support of the Tuolumne County Veteran’s Service Office Glory Garden project.

RECOMMENDATION:

Consider Authorization for the Mayor to Sign a Letter in Support of the Tuolumne County Veteran’s Service Office Glory Garden project.

BACKGROUND:

The City of Sonora has expressed its support for the proposed Glory Garden, a project intended to provide a place of respite, healing, and serenity for Veterans and the broader community. In correspondence from Mayor Ann Segerstrom on behalf of the Sonora City Council, the Council unanimously endorsed the project and recognized the importance of honoring Veterans and their contributions to the nation’s well-being and safety.

The City of Sonora has identified the value of green spaces and plantings in enhancing the community’s appearance and quality of life. The Glory Garden is viewed as an opportunity to create an attractive and welcoming space that promotes healing and serenity for residents while providing opportunities for community involvement at various levels.

The proposed garden is also anticipated to serve as a notable enhancement to the South Washington corridor, which functions as a major gateway into the City of Sonora. The City has indicated its willingness to remain informed regarding the project’s progress and to assist in supporting its successful completion.

The proposed Glory Garden therefore represents an opportunity to recognize and honor local Veterans while creating a meaningful community gathering space and enhancing the appearance and character of an important corridor within the City.

SUBJECT: Review Appeal Submitted by Use Permit Applicant Fred and Rhonda Buess for Additional Activities Including Lunch/Brunch and Special Events at 253 Knowles Hill Drive (Bed and Breakfast) and Schedule a Date for the Public Hearing.

RECOMMENDATION:

Consider Acceptance of the Appeal Filed for the Planning Commission Decision on August 20, 2026, and Schedule the Appeal Hearing for October 19, 2026. Giving Staff Sufficient Time to Publish the Public Notice and Prepare the Appeal Hearing Documents.

BACKGROUND:

The Inn at Knowles Hill Property was rezoned from Residential, Single-Family (R-1) to Planned Development (PD) in 1983 to allow for use as a bed and breakfast. Although approvals for operation were in place, the bed and breakfast did not open at this time. The estate was purchased by the Herriage’s circa 1998 and the required guardrail and reflectors originally conditioned with the Bed and Breakfast were installed in 1999. The Herriage’s opened the Bed and Breakfast later this same year. The property was purchased by the Applicants around 2005.

According to City records it appears the Bed and Breakfast re-opened under its current name of the Inn at Knowles Hill in 2012. The property has been used in this manner without interruption since this time. In addition to the Bed and Breakfast use, the applicant has held periodic private Special Events and Brunch/Lunch by reservation only since 2012. The Inn on Knowles Hill is a boutique hotel set on a little over two (2) acres, featuring gardens and sweeping views of downtown Sonora looking to the East. Locally, the mansion is referred to as the “Big House” encompassing approximately 12,500 square feet. The property consists of eight unique suites within the mansion.

Rooms range from ±210 square feet to ±425 square feet. The legal occupancy of the property based on the size of the home is 62 people (per table 1004.5 of the California Building Code).

The Use permit was first scheduled for a Planning Commission hearing on June 22, 2026. Due to the number of comment letters received from the neighborhood, the meeting was continued to July 27. The July meeting was continued due to evacuation warnings in place for the Dove Fire. The item was finally heard by the Planning Commission on August 20, 2026. The Use Permit was denied on 4-1 vote by the Commission. 25 Item A.

SUBJECT: Consider Approval and Award the Parking Lots Improvement Project Construction Contract to Taylor Backhoe Service, Inc. (TBS) Based on their Submittal of the Lowest Responsive Base Bid for Construction. Additional elements Include Approval of the Bid Alternative to Include Solar Street Lighting in the Project.

Consider Approval of Task Order 26-08 Contract Amendment #2 to Dewberry Engineers Inc. (Dewberry) for Associated Construction Management, Engineering Support, and Inspection Costs Associated with the Parking Lots Improvement Project.

Grant City Administrator Authority to Approve Construction Change Orders up to a Combined Total of 15% of the Construction Contract.

RECOMMENDATION:

1. Consider Approval and Award the FY 25/26 Parking Lots Improvement Project Construction Contract to Taylor Backhoe Service, Inc. (TBS) Based on the Lowest Responsive Base Bid for Construction in the Amount of $703,221.71; and

2. Consider Approval of Task Order 26-08 Contract Amendment #2 to Dewberry Engineers Inc. for Associated Construction Management, Engineering Support, and Inspection Costs in the Amount of $149,344.76; and

3. Consider Approval of the Bid Alternative to Include Solar Street Lighting in the Project in the Amount of $105,000; and

4. Consider Authorization for City Administrator to Approve Construction Change Orders up to a Combined Total of 15% of the Construction Contract.

BACKGROUND:

The City of Sonora solicited bids for the construction of the FY 25/26 Parking Lots Improvement Project, including the reconstruction of two (2) parking lots, Lyons and Stewart Street, Church and Stewart Street and associated improvements. The bids were opened on Friday, August 28 at 11:00 AM. There was a total of six (6) bids submitted. 28 Item B.

CITY OF SONORA 94 N. WASHINGTON STREET, SONORA, CA 95370 P: (209) 532-4541

SERVICE, INNOVATION, INTEGRITY, COLLABORATION, RESPECT, LEADERSHIP The City received the following bids:

1. KW Emerson $1,165,843

2. Dirt Dynasty $887,238

3. TBS $703,221.71

4. United Pavement Maintenance $978,879.11

5. BZ Construction $1,145,708

6. Mission Construction $ $898,000
The approved construction budget for the FY 25/26 Parking Lots Improvement Project is $1.14M.

The estimated construction duration is 40 working days (approx. 8 weeks).

The Dewberry team was previously tasked with partial Construction Management in the original 26-08 Task Order, but those services were removed from the scope of work at the August 3rd City Council meeting when budget was shifted to finalize the project documents and include improvements to Bradford Street. Now that bidding is complete, construction management, inspection, and construction engineering support services will need to be added back into the scope of Task Order 26-08 through a contract amendment.

During project design, Alley Tree and Landscape Inc. provided a certified arborist report to inform the construction documents and to make sure the existing trees are properly protected. The certified arborist report highly advises having an arborist on-site when construction begins to provide guidance and recommendations to save the existing trees.

DISCUSSION:

City staff recommend contract award to TBS since they are the lowest responsible bidder, measured by base bid, with a base bid of $703,221.71. City staff also recommend authorizing the bid alternative to add solar lighting improvements at TBS’s bid price of $105,000.00. The total construction contract amount awarded to TBS would be $808,221.71. City staff recommend granting City Administrator authority to approve change orders up to a combined total of 15% of the construction contract, up to $121,233.26.

TBS’s licenses are all current and have licenses for the work associated with this project. All their sub-contractors have current licenses as well. However, one of the subcontractor Equal Employment Opportunity forms was missing from the original bid submission. City staff has consulted the City’s legal team and considers this a minor bid irregularity that does not affect the underlying bid documentation and substantive bid terms. The missing form was provided by TBS after bid opening.

The Dewberry team will provide construction management, full-time inspection, and construction engineering support for the FY 25/26 Parking Lots Improvement Project. Dewberry will administer the contract and work closely with the contractor to construct the project on schedule, within budget, and to keep the public notified and safe during construction. Any deviations from the contract documents will be coordinated with engineering 29 Item B.

SERVICE, INNOVATION, INTEGRITY, COLLABORATION, RESPECT, LEADERSHIP and the City. Construction Engineering Support includes review of submittals, request for information, design changes, record drawings, and additional design support as needed to complete the project.

The draft construction contract is attached as part of the item. The document is currently being reviewed by the City’s legal team and the contractor for the project. Upon agreement by all parties the contract will be executed, and the work scheduled.

A certified arborist will be on-site during demolition and reconstruction activities to review compliance with work around existing trees. During construction activities they will provide recommendations if needed while working around the critical root zone.

The costs associated with approval for all four (4) agenda items are as follows:

1. Construction- Base Bid $703, 221.71

2. Construction- Addition, Solar Lighting $105,000

3. Construction Contingency, 15% $121, 233.26

4. Construction Management, Inspection and Engineering Support $149,344.76 Total Cost $1, 078,799.73
Measure Y:

This project is funded by Measure Y, the City’s voter-approved 1% sales tax measure. The City extends its appreciation to the residents of Sonora for their support of Measure Y, which has provided the funding necessary to complete important local infrastructure improvements such as this project. Without Measure Y funding, the City would not have had the financial resources available to undertake these parking lot improvements. As part of the project, signage will be installed recognizing that the improvements to the LyonsStewart and Church-Stewart parking lots were funded by Measure Y.

FISCAL IMPACT:

The FY 2025/26 Parking Lot Project, which includes improvements to the Lyons-Stewart Parking Lot and ChurchStewart Parking Lot, was originally budgeted at $1,311,400, inclusive of Plans, Specifications, and Estimates (PS&E) and construction costs. After expenditures associated with project development and PS&E, $1,248,540 remained available and was encumbered in FY 2026/27 for completion of the project.

The current total project cost is $1,078,799.73, including a recommended 15% project contingency to address unforeseen conditions, quantity adjustments, or other necessary changes that may arise during construction.

Including the contingency, the maximum authorized project amount would be $1,078,800. 30 Item B.

SERVICE, INNOVATION, INTEGRITY, COLLABORATION, RESPECT, LEADERSHIP The total authorized amount, including contingency, remains $169,740 below the $1,248,540 encumbered for the project. Sufficient funds are therefore available within the previously approved project budget, and no additional appropriation is required.

Any remaining project funds and associated budget authority following completion of the project will be reprogrammed as part of the FY 2026/27 Mid-Year Budget Update.

Contractor and City acknowledge and agree that the sum per hour specified above is a reasonable estimate of the damage that the City will suffer in the event of such a delay. The time for such liquidated damage shall commence from the first minute of the first hour after the required maximum response time has passed. Contractor and City agree that the city may deduct any liquidated damages due to the amounts otherwise due Contractor. The number of liquidated damages is not intended to, nor does the amount include, any damages incurred by City for reasons other than Contractor's delay in accomplishing Emergency Maintenance Extra Work.

City shall be entitled to claim against and recover or deduct from sums otherwise due Contractor its actual damages arising out of such other reasons. Assessment of liquidated damages shall not preclude the City from pursuing recovery of any additional actual damages arising from Contractor’s failure to perform obligations unrelated to emergency response times. (a) Chronic Performance Issues – Repeated failure to meet required response times or performance standards may constitute a materials breach of this Agreement and may result in termination for default.

City reserves the right to inspect all maintenance records, inventory records, controller cabinet logs, testing documentation, and maintenance reports maintained by Contractor during normal business hours.

Section 10. Assignment Prohibited. No Party to this Agreement may assign any right or obligation pursuant to this Agreement. Any attempt or purported assignment of any right or obligation pursuant to this Agreement shall be void and of no effect. 107

City shall be the owner of and shall be entitled to immediate possession of accurate reproducible copies of any design computations, plans, specifications, copies of correspondence, maps, maintenance reports, inventory databases, electronic files, controller timing files, GIS information, inspection reports, photographs, electronic records or other pertinent data and information gathered or computed by Contractor ("Work Product") in the performance of and prior to termination of this Agreement by City or upon completion of the work pursuant to this Agreement. Contractor may retain copies of the above-described documents but agrees not to disclose or discuss any information gathered, discovered, or generated in any way through this Agreement without the express written permission of City, during the Term of this Agreement and for a period of one hundred eighty (180) days following expiration of the Term of the Agreement.

All materials shall be returned in the same condition as received.

Section 12. Termination and Termination by Default.

Either party may terminate this Agreement for convenience upon thirty (30) calendar days' written notice to the other party. If the Defaulting Party does not correct such deficiency, the other Party may immediately terminate this Agreement by giving written notice of such termination, stating the reason for such termination. In such event, Contractor shall be entitled to receive payment for all Services satisfactorily rendered, provided, however, there shall be deducted from such amount the amount of damage, if any, sustained by virtue of any breach of this Agreement by Contractor. If payment under this Agreement is based upon a lump sum in total or by individual task, payment for Services satisfactorily rendered shall be an amount which bears the same ratio to the total fees, specified in the Agreement asthe Services satisfactorily rendered hereunder by Contractor, and bears to the total Services otherwise required to be performed for such total fee, provided, however, that there shall be deducted from such amount the amount of damage, if any, sustained by City by virtue of any breach of this Agreement by Contractor.

Contractor shall deliver copies of all Work Products prepared by it pursuant to this Agreement.

If City terminates this Agreement before City issues the Notice to Proceed to Contractor or before Contractor commences any Services hereunder, whichever last occurs, City shall not be obligated to make any payment to Contractor. If City terminates this Agreement after City has issued the Notice to Proceed to Contractor and after Contractor has commenced performance under this Agreement, City shall pay Contractor the reasonable value of the Services rendered by Contractor pursuant to this Agreement prior to termination of this Agreement. City shall not in any manner be liable for Contractor's actual or projected lost profits had Contractor completed the Services.

Contractor shall furnish to City such financial information, as in the judgment of the City Administrator, is necessary to determine the reasonable value of the Services rendered by Contractor prior to termination.

Except as provided in this Agreement, in no event shall City be liable for costs incurred by or on behalf of Contractor after the date of the notice of termination. Upon termination, Contractor shall cooperate with the /city and any successor contractor to ensure an orderly transition of services, including delivery of records, inventories, passwords, software files, controller timing information and maintenance histories
