City Council Agenda Report
Agenda Item No. 11.a.

DATE: October 25, 2022
TO: Honorable Mayor and Members of the City Council
APPROVED BY: Rene Salas, Interim City Manager
SUBMITTED BY: Colby Cataldi, Community Development Director SUBJECT: FEE WAIVER REQUEST BY JEFF ORTIZ ("APPLICANT") FOR

A PERMIT EXTENSION
SUMMARY: Jeff Ortiz ("Applicant") requests a waiver of the extension fee in the amount of $965.49 for a permit on file. Mr. Ortiz applied for a permit to make certain improvements to a residential property and has put the project on hold for an indeterminate period of time. Building permits have an expiration date, which can cause applicants to file for a request to extend the permit timeframe. The permit extension requests are subject to a permit extension fee as identified in the City's Municipal Code and/or Fee Ordinance. Mr. Ortiz is requesting the permit extension and the fee waiver be granted in full.

RECOMMENDED ACTION: For City Council's discussion and consideration of the permit extension fee waiver in the amount of $965.49.

FISCAL IMPACT: Any reduction to building permit fees collected will be a decrease in general fund revenue, but will not require a budget amendment.

The Impact Fee Waiver request would have a fiscal impact as follows:
% Fee Waiver/Reduction Reduced Revenue
100% complete waiver of a 25%
reduced fee
$965.49
DISCUSSION: Staff received a letter dated October 18, 2022 from the Applicant requesting a waiver of the extension fee due to (1) insufficient funds to cover the fee; (2) increased costs of construction materials due to the COVID-19 pandemic and supply shortages; and (3) has already paid the required permit plan check fees for the project.

Re: Home Remodel Permit Extension Fee Waiver Request
From: Jeff Ortiz (Resident)
10325 Broadmead St.

South El Monte, CA 91733
Dear Mayor Olmos,
Per your request for me to submit a summarization of the situation involving my remodel and why I am requesting the city’s help and consideration for a full waiver of my permit extension fee of $965.49 (25% of the permit fee of $3,861.96). Please allow me to briefly describe the timeline of events, which have led me to still not have started any of the scheduled remodel work and ending with my permits expiring during this COVID pandemic.

My plans were initially approved on 11-14-20 and expired on 3-31-21; As you are all aware, this time frame was directly in the middle of the pandemic, which led to the series of problems that I encountered. The two major issues I had, were the lack of workers available and the quick rise in costs for building materials. When I finally did find workers, I’d come to find my quotes to be almost doubled in price, compared to my original (pre-pandemic) estimates. At this point I had to concede in breaking my project into two phases, just to get some of the project started, but I then found that my permits had expired.

So as of today, I still haven’t started my project and have been asking the city’s help in waiving the additional costs for well over a year now. I am already close to $10,000 in fees for permits, processing and plan checks, without even having started the project. This is extremely frustrating! I’m not even sure when I’ll be able to complete the future second phase, but I anticipate I’ll need to resubmit my plans for approval again and be required to pay even more fees at that time. With all this in mind, I’m asking the city for any help or any direction they can offer. All these high permit fees are very excessive for our residents who want to improve their homes and improve the community… but that is an issue in itself.

In researching the average building costs increases in America during the COVID pandemic, I found the following information: Building materials prices increased 20.4% year over year and have risen 33% since the start of the pandemic. Services prices are now also 39% higher [see accompanying graph]. (Source: National Association of Home Builders 4/22)

Page 199 of 205 ends

Lastly, I need to express my intention of pointing out the question: If the higher costs of permit fees are appropriate for our residents? I feel this will discourage people from improving their homes and in turn not helping to improve our aging neighborhoods. I know these fees were recently raised a few years ago in order to keep us better in line with other cities, but did we consider the city size and economic demographic? We are a small low to medium-income city and I don’t think the increase was appropriate. This increase seems appropriate for business and industry, but somehow needs to be adjusted for residents; especially those that are planning to settle into the city long-term. In order for this to properly work, we’d need to weed out investors and house flippers, by enforcing a requirement to live in the residence for a minimum of 10 years to qualify for the “Resident Rates.” I feel this is a good solution to continue helping to make our city a wonderful place to live.

Thank you for your time and consideration, I am hoping a decision can be made soon.

I appreciate the help to resolve this problem.

Best regards,
Jeff Ortiz
