City Council Agenda Report
Agenda Item No. 8.a.
DATE: December 12, 2023
TO: Honorable Mayor and Members of the City Council
APPROVED BY: Rene Salas, City Manager
SUBMITTED BY: Masami Higa, Director of Finance
SUBJECT: CONSIDERATION AND APPROVAL OF RESOLUTION NO.
23-122, AUTHORIZING THE REPROGRAMMING AND
PROGRAMMING OF COMMUNITY DEVELOPMENT BLOCK
GRANT (CDBG) FUNDS FOR FISCAL YEARS (FY) 2023-24
AND 2024-25
SUMMARY: Provide City Council with the recommendation to reprogram the FY2023-24 CDBG funds, and to program the FY2024-25 CDBG funds, in order to meet CDBG drawdown requirements.
RECOMMENDED ACTION: Staff recommends City Council:
1. Conduct a public hearing;
2. Take public testimony; and
3. Adopt Resolution No. 23-122, allowing the City to revise its CDBG Consolidated Action Plan, and reprogram the use of CDBG funds for FY2023-24, and program the use of CDBG funds for FY2024-25; and
4. Allow the City Manager to adjust the CDBG Program budgets as necessary throughout FY2023-24 and FY2024-25, for the timely expenditure of CDBG funds according to the CDBG drawdown guideline.
ENVIRONMENTAL ANALYSIS: The action proposed herein is not a project subject to the California Environmental Quality Act (CEQA) in accordance with Section 21065 of CEQA and State CEQA Guidelines Sections 15060(c)(2), 15060(c)(3), and 15378.
Revising the allocation of federal funds is an administrative action that would not cause either a direct physical change in the environment or a reasonably foreseeable indirect physical change in the environment. Therefore, the proposed action is not a “project” subject to CEQA, as defined in Section 21065 of CEQA and Section 15378 of the State CEQA Guidelines. Since the action is not a project subject to CEQA, no environmental document is required.
FISCAL/FINANCIAL IMPACT: The fiscal impact is to reprogram $294,464 programmed for the City-Wide Pavement Project towards the Pool Replastering Project for FY2023- 24, and to program $236,207 for Code Enforcement and Civic Center Dog Park for FY2024-25. The total recommended reprogramming and programming is $530,671 over two fiscal years.
DISCUSSION: Staff is recommending to revise the FY2023-24 CDBG Consolidated Action Plan to meet the Los Angeles County Development Authority’s (LACDA) Annual Drawdown Requirement. FY2023-24's drawdown requirement is $363,344, and needs to be liquidated by March 31, 2024. The City is in jeopardy of having these funds recaptured unless the funds are expended by March 31, 2024, or the City transfers the funds into a Revolving Grant Fund to be used in FY2024-25. Due to the delays in implementing the City Hall Restroom and City-Wide Pavement Rehab Project, staff believes the City will not be able to meet the FY2023-24 drawdown requirement by March 31, 2024, and recommends reprogramming them towards shovel ready projects (See Exhibit A).
Additionally, Staff is recommending to program the FY2024-25 CDBG funding allocation towards Code Enforcement and Civic Center Dog Park Project. The Dog Park Project was originally budgeted in FY2023-24 with Per Capita funds, but due to the agency’s deed restriction, the City was unable to utilize Per Capita funds, and hence is recommending to use CDBG funds (Exhibit A).
Staff report prepared by Irma Peniche, Grant Coordinator.
