7.e. CONSIDERATION AND APPROVAL OF RESOLUTION NO. 24-230,

AUTHORIZING THE CITY MANAGER OR HIS DESIGNEE TO EXECUTE

AN AGREEMENT WITH MOBILITY DEVELOPMENT OPERATIONS, LLC
(MDO) TO ALLOW THEM TO USE SIX DESIGNATED ELECTRIC

VEHICLE CHARGING PARKING SPACES FOR THE OPERATION OF

AN ELECTRIC VEHICLE CAR SHARING PROGRAM
Councilmember Acosta expressed support for this program which is designed for individuals to rent electric vehicles and return to the charging spaces.

Councilmember Delgado expressed concern on the weekly cost of the carsharing program, the agreement term length of the car spaces being used indefinitely, use of the charging facilities by anyone with electric vehicles causing wear and tear on City property, and that despite grant funding, the City is losing control over the ability to control renovate, redevelop, or redesign future parking lot projects.

Other discussion topics included: concurring with Councilmember Delgado’s concerns on the term length of the six spaces, grant funding requirements and what happens to the program when grant funding expires, similar projects in the past with E-Bikes that went bankrupt during Covid, and further questions on the agreement terms.

Motion by Councilmember Delgado, seconded by Mayor Pro Tem Bojorquez, to continue this item, providing direction to staff to explore agreement options, and for staff to provide further clarification on questions raised on the agreement terms related to outside electric vehicle users and revenue sharing options. Motion passed 5-0, by the following vote:

AYES: Councilmember(s): Acosta, Angel, Delgado, Mayor Pro Tem Bojorquez, and Mayor Olmos

Mayor Olmos introduced Rene Salas, City Manager, who introduced Masami Higa, Director of Finance, who provided a presentation on potential recommendations to modernize outdated ordinances within Title 3 of the Municipal Code. Staff recommendations include no changes to Chapters 3.04 through 3.12, to modernize parts of Chapter 3.16, such as updating the City Manager’s approval threshold to a fixed target instead of a CPI-based moving target, to modernize parts of Chapter 3.18 adopting the State’s Public Contract Code instead of adoption by ordinance, to repeal Chapters 3.20 through 3.36 because they are no longer legally required in accounting rules or the funds no longer exist, and to make no changes to Chapter 3.40.

Mayor and City Council expressed support in modernizing Title 3 of the South El Monte Municipal Code, asked for clarification on the purchasing policy and the current City Manager’s approval threshold, requested a recommendation on the suggested new approval threshold amount, and provided direction to staff to bring back the recommended changes for approval.

SUBMITTED BY: Sabrina Muhne, Deputy City Clerk
SUBJECT: APPROVAL OF PROPOSED DARK CITY COUNCIL MEETING

DATES AND CLOSURE OF CITY HALL FOR HOLIDAYS
SUMMARY: Each year staff requests City Council consider “going dark” on the second Tuesday in November and December due to the Thanksgiving and Christmas holidays.

RECOMMENDED ACTION: Staff recommends City Council:

1. Approve going dark on Tuesday, November 26, 2024, and Tuesday, December 24, 2024, due to the Thanksgiving and Christmas holidays.

This year, the second Tuesday in November falls during the same week as Thanksgiving, and the second Tuesday in December falls on Christmas Eve.

Due to the weekdays the December holiday dates occur on this year, a City Hall closure is recommended from Monday, December 23, 2024, through Thursday, January 2, 2025.

City employees would use up to six days of personal time during this period or may opt to work at City Hall during the closure.

City Council Agenda Report
Agenda Item No. 9.c.

DATE: October 22, 2024
TO: Honorable Mayor and Members of the City Council
APPROVED BY: Rene Salas, City Manager
SUBMITTED BY: John Poehler, Director of Public Works
SUBJECT: CONSIDERATION AND APPROVAL OF RESOLUTION NO.
24-233 DESIGNATING THE CITY MANAGER AS THE

SIGNATURE AUTHORITY FOR GRANT-RELATED
DOCUMENTS AND FOR IMPLEMENTATION AND CLOSEOUT OF THE GRANT SUMMARY: On January 4, 2022, the Department of Resources Recycling and Recovery CalRecycle) published a Notice of Funding Availability for the SB 1383 Local Assistance Grant Program ("Grant Program"). CalRecycle requires the City to designate and authorize the City Manager or his designee to execute all grant documents, including but not limited to, applications, agreements, amendments and requests for payment.

RECOMMENDED ACTION: Staff recommends City Council adopt Resolution No. 24- 233, authorizing the City Manager or designee to execute all grant documents, including but not limited to, applications, agreements, amendments and requests for payment.

FISCAL/FINANCIAL IMPACT: The City of South El Monte was awarded $31,042 through CalRecycle’s SB 1383 Local Assistance Grant Program, which does not require a local General Fund match.

DISCUSSION: California Senate Bill (SB) 1383 was enacted in 2016 and established methane emissions reduction targets in a statewide effort to reduce emissions of shortlived climate pollutants. This bill required the California Department of Resources Recycling and 2 8 3 4 Recovery (CalRecycle) to adopt regulations to achieve the targeted goals for reducing organic waste disposal in landfills. The established SB 1383 regulations are wide-ranging, imposing multiple requirements on local jurisdictions, haulers, waste generators, landfill operators, and recycling facility operators.

In January 2022, CalRecycle announced a one-time grant program to assist jurisdictions in implementing SB 1383 regulations. The grant term runs from April 2022 through December 2024. The City of South El Monte was awarded $30,042 to assist with the implementation of SB 1383 regulations. These funds can be used for tasks and programs such as:

Page 38 of 47 ends

• Capacity Planning
• Collection
• Edible Food Recovery
• Education and outreach (this includes organic waste & edible food recovery) • Enforcement and Inspection
• Program Evaluation/Gap Analysis
• Procurement Requirements
• Record Keeping
The City Council previously authorized the application for CalRecycle’s SB 1383 Local Assistance Grant Program by adopting Resolution No. 22-10 at the February 8, 2022, City Council meeting. This resolution allowed the City to apply for “any and all payment programs offered” by CalRecycle. It also authorized the City Manager or designee to serve as the Signature Authority to execute all necessary documents for implementation and payment.

The City of South El Monte was awarded funding through CalRecycle’s SB 1383 Local Assistance Grant Program, which has been allocated to several project activities. These include administrative expenses, project management services, and education and outreach efforts. The funds will also be used for compliance, inspection, and enforcement tasks, such as identifying Tier 1 and Tier 2 Edible Food Generators, conducting inspections, and ensuring regulatory compliance. Additionally, the grant will support the preparation and submission of final reports, which will include an analysis of food recovery agencies, results from the education and outreach initiatives, and recommendations for future actions.

To continue facilitating this and future CalRecycle grant applications, the City must adopt a new resolution re-authorizing the City Manager or designee to execute all grant documents, including but not limited to applications, agreements, amendments, and requests for payment. CalRecycle encourages a time period of five (5) years during which the City Manager’s authorizations are valid.

Staff recommends that City Council adopt Resolution No. 24-233, authorizing the City Manager or designee to execute all grant documents, including but not limited to applications, agreements, amendments, and requests for payment.

Staff report prepared by Andrés González, Senior Public Works Analyst.
