Agenda Item No. 7.d.
DATE: March 3, 2026
TO: Honorable Mayor and Members of the City Council
APPROVED BY: Rene Salas, City Manager
SUBMITTED BY: Gerardo Marquez, Director of Community Development & Public Works
SUBJECT: CONSIDERATION AND APPROVAL OF RESOLUTION NO.
26-012, REPEALING RESOLUTION NO. 26-006 AND
APPROVING A FIRST AMENDMENT TO THE CONTRACT
SERVICES AGREEMENT WITH COUNCIL FOR WATERSHED
HEALTH FOR THE MERCED AVENUE GREENWAY PHASE II
DESIGN PROJECT
SUMMARY: While the City Council approved this item at the February 3, 2026 City Council meeting, the contract compensation amount needs to be revised to reflect the Council’s intent that was submitted at the February 3, 2026 Council meeting.
RECOMMENDED ACTION: Staff recommends City Council:
1. Approve Resolution No. 26-012, approving a First Amendment to the Contract Services Agreement with Council for Watershed Health (CWH), dated July 25, 2024, to increase the not-to-exceed contract sum in the amount of Two Hundred Nineteen Thousand Five Hundred Four Dollars ($219,504), for a new total not-toexceed sum of Nine Hundred Seventy Six Thousand Nineteen Dollars ($976,019), and to extend the term of the agreement by one (1) year; and
2. Authorize the City Manager or designee to negotiate and execute the amendment, approved as to form by the City Attorney.
FISCAL/FINANCIAL IMPACT:
The proposed additional contract services of $219,504 will be funded from the following sources:
Measure M Funds $219,504.00
Total Funds $219,504.00
DISCUSSION: In 2017, the conceptualization of the Merced Avenue Greenway was undertaken through a grant from the California Coastal Conservancy. During this initial
planning and design phase, the projected cost to implement the full extent of the Greenway was assessed and the project was split into two phases - Phase I (southern residential end) and Phase II (northern business end).
Since that time, CWH has been an instrumental partner in applying for grants and assisting the City in securing implementation funding for both phases of construction.
This includes $11.9M for Phase I South and another $8.7M (secured to date) for Phase II North construction.
As such, Phase I of the 1.1-mile Merced Avenue Greenway completed construction activities in January 2026, to implement the southern .65-mile segment of the project between Rush Street and Lerma Road.
While $8.7 million has been secured to date for Phase II North, the project remains partially funded, and full construction funding has not yet been obtained. City staff continues to actively pursue additional grant opportunities and external funding sources to close the remaining funding gap and advance Phase II North through full implementation.
In May 2024, the City Council approved an amended and restated agreement with Council for Watershed Health to continue design services for Phase II North. Since that approval, the City has been awarded $2.6 million in Active Transportation Program (ATP) Cycle 6 funds as part of the $8.7 million secured to date for Phase II North. These ATP Cycle 6 funds are designated for construction; however, additional design work is required to incorporate the ATP-funded improvements into the Phase II North plans and specifications.
The ATP Cycle 6 improvements include the construction of Class II bicycle lanes, installation of crosswalks, sidewalks, ADA-compliant curb ramps, and landscaping, all intended to enhance pedestrian and bicyclist safety along Merced Avenue from Garvey Avenue to Fern Street within the City of El Monte, and from Fern Street to Rush Street within the City of South El Monte.
Staff therefore recommends approval of an amendment to the existing contract with Council for Watershed Health to complete the additional design work required to incorporate the ATP Cycle 6 scope into Phase II North, in the amount of $219,504.

TO: Honorable Mayor and Members of the City Council
APPROVED BY: Rene Salas, City Manager
SUBMITTED BY: Susie Altamirano, City Attorney
SUBJECT: A PUBLIC HEARING TO CONSIDER AND APPROVE
RESOLUTION NO. 26-013 OF THE CITY OF SOUTH EL
MONTE CENSURING MAYOR GLORIA OLMOS
SUMMARY: The City of South El Monte (“City”) has completed an independent investigation initiated by members of the South El Monte City Council (the “City Council”) into allegations of improper disclosure of confidential closed session information by Mayor Gloria Olmos (“Mayor Olmos”).
The investigation examined three allegations concerning potential violations of the Ralph M. Brown Act (the “Brown Act”) (Government Code section 54950 et seq.). The investigator sustained one allegation, concluding that Mayor Olmos shared privileged information and materials obtained in closed session to an outside third-party unaffiliated with the City. Based on this finding, the City Council is considering a resolution censuring Mayor Olmos.
RECOMMENDED ACTION: It is recommended that the City Council:
1. Conduct a public hearing;
2. Take public testimony; and
3. Consider adopting Resolution No. 26-013, provide alternative direction, or take no action.
FISCAL/FINANCIAL IMPACT: There is no fiscal impact associated with the proposed action.
DISCUSSION:
Starting on June 17, 2025 and followed by a series of events that occurred during or in connection with several closed session meetings of the City Council, members of the City Council raised concerns that confidential information relating to three closed session matters may have been disclosed to third parties in violation of Brown Act
prohibitions against the sharing of privileged information obtained in closed session.
Following a closed session discussion on the matter, the City Council, with the Mayor not participating, directed staff to retain an independent third-party investigator to conduct an attorney-client privileged investigation into three allegations and report back on its findings.
The allegations investigated were as follows:
1. Did Mayor Gloria Olmos engage in a conversation with an outside third-party regarding confidential closed session discussions of the South El Monte City Council that had taken place on April 1, 2025?
2. Did Mayor Gloria Olmos engage in a conversation and/or forward information to an outside third-party regarding an item that had been placed on the closed session agenda of a special city council meeting scheduled for June 26, 2025?
3. Did Mayor Gloria Olmos engage in a conversation with the owners of a business in the City regarding confidential closed session discussions of the South El Monte City Council that had taken place on September 2, 2025? The City retained independent attorney-investigator Jeff Love of JL Group, LLC (the “investigator”) to conduct the investigation. The investigation included a review of relevant documents and interviews with multiple witnesses including Mayor Olmos.
Upon completion of the investigation, one allegation (Allegation No. 2) was sustained.
The investigator determined there was sufficient evidence to clearly prove that Mayor Olmos engaged in a conversation and/or forwarded information to an outside third-party regarding an item placed on the closed session agenda for the June 26, 2025 Special City Council meeting. The remaining two allegations were not sustained due to insufficient evidence to either prove or disprove the claims. The content of the investigation remains a confidential matter and will not be disclosed.
After the report was complete, the City Council, with the Mayor not participating, reconvened into closed session to discuss the findings of the investigator. The City Council directed the City Attorney to prepare a Resolution No. XX to consider censuring Mayor Olmos based on the investigation’s sustained finding and place the matter on the agenda. The City Council also directed the City Attorney to prepare the Resolution No.
XX to consider imposing potential sanctions upon Mayor Olmos based on the investigation’s sustained finding and place the matter on the agenda. Imposition of sanctions will be considered as a separate agenda item.
LEGAL CONSIDERATIONS
The unauthorized or unpermitted disclosure of confidential information received in closed session poses legal risks to the City, undermines public trust, and compromises the integrity of the City Council’s deliberative process. The Brown Act provides specific remedies for unauthorized disclosure of confidential information from closed session.
Similarly, the City's Code of Ethics provides for sanctions for violations of the Code.
1. Government Code § 54963
Government Code § 54963 strictly prohibits the unauthorized disclosure of confidential information obtained in closed session, unless the legislative body—here the City Council—formally authorizes such disclosure. Confidential information includes any communication made in closed session that specifically relates to the basis for the Council to meet lawfully in closed session.
Pursuant to § 54963(c), the City Council may enforce this prohibition against a councilmember by seeking a court injunction to prevent disclosure of confidential closed session information, or a referral of the offending councilmember to the grand jury for an examination of whether the official should be removed from office.[1] These remedies are not exclusive. The City Council may also take additional action within its authority including the adoption of a resolution of censure.
Government Code § 54963 provides as follows:
(a) A person may not disclose confidential information that has been acquired by being present in a closed session authorized by Section 54956.7, 54956.8, 54956.86, 54956.87, 54956.9, 54957, 54957.6, 54957.8, or 54957.10 to a person not entitled to receive it, unless the legislative body authorizes disclosure of that confidential information.
(b) For purposes of this section, “confidential information” means a communication made in closed session that is specifically related to the basis for the legislative body of a local agency to meet lawfully in closed session under this chapter. (c) Violation of this section may be addressed by the use of such remedies as are currently available by law, including, but not limited to:
1. Injunctive relief to prevent the disclosure of confidential information prohibited by this section.
2. Disciplinary action against an employee who has willfully disclosed confidential information in violation of this section.
3. Referral of a member of a legislative body who has willfully disclosed confidential information in violation of this section to the grand jury.
2. South El Monte Code of Ethics: Resolution 70-1304
South El Monte Resolution 70-1304, Section 1 Responsibilities of Public Office, establishes a Code of Ethics for public officials and provides in part:
"Public officials… are bound to observe in their official acts the highest standards of morality and to discharge faithfully the duties of their office regardless of personal considerations, recognizing that the public interest must be their primary concern.” Section 4(a) Conflict of Interest - Disclosure of Confidential Information, of the same Resolution further provides:
“No councilman or other official or employee shall, without proper legal authorization,
disclose confidential information concerning the property, government, or affairs of the city. Nor shall [he/she] use such information to advance the financial or other private interest of himself or others.”
Section 6 Sanctions of the Code of Ethics also allows for the Council to impose censure or disciplinary action, stating:
“Violation of any provision of this code should raise conscientious questions for the councilman or other official or employee concerned as to whether voluntary resignation or other action is indicated to promote the best interest of the city. Violation of any provision of this code may constitute a cause for censure, disciplinary action or removal from office or employment in any manner prescribed by law.” The City Council does not have authority to remove any of its members from office, as only the electorate may do so.[2]
The City Council expects all of its members to comply strictly with the Brown Act and the City’s Code of Ethics. These provisions establish a clear ethical obligation for members of the City Council to safeguard confidential information obtained in the course of their official duties.
3. Censure
Censure is a formal and public expression of disapproval, often used by legislative bodies to reprimand an individual for conduct considered inappropriate or harmful, or violations of State law or City Policies. Black’s Law Dictionary defines censure as “[a]n official reprimand or condemnation; an authoritative expression of disapproval or blame…”[3] It does not remove the individual from their positions but serves a public rebuke.
A censure is distinct from any civil or criminal liability that may arise from the councilmembers conduct.[4] It is a constitutionally protected act of expression by a legislative body and Courts have recognized that elected officials, such as councilmembers, have a First Amendment right to express their views through censure resolutions.[5] A censure hearing is not a judicial proceeding and is not subject to judicial rules of evidence, cross-examination, or admissibility of evidence.
The censure may also be a written reprimand and may impose limited disciplinary actions, known as sanctions, so long as they do not prevent the elected official from performing the core functions of office or restrict the member’s opportunities to speak, such as his/her opportunity to deliberate on the dais and/or speak to the public.[6] This agenda item is to discuss and consider whether to censure Mayor Olmos only.
Imposition of sanctions will be considered in a separate agenda item.
Due Process
Absent specific City policies and procedures governing censure, as is the case with the City of South El Monte, general due process principles apply. At minimum, due process requires notice and an opportunity to refute the charges.[7] Before a censure can be formally adopted by resolution, the City Council is required to
give notice to the affected mayor or councilmember of the allegations made against him/her and the date of the public hearing. The City Council will then hold a public hearing in open session where the accused councilmember will have an opportunity to be heard, present evidence and respond to the charges against him/her.
Consistent with these requirements, Mayor Olmos was provided notice of the allegations on December 2, 2025, January 20, 2026, January 21, 2026, February 20, 2026, February 27, 2026, and is being afforded an opportunity to be heard and refute any charges at this duly noticed public hearing. Notice of this public hearing was also provided on February 20, 2026. Pursuant to the City’s Municipal Code Section 2.04.040, the provisions of “Robert’s Rules of Order,” shall govern all proceedings of the council.
To ensure the Mayor is afforded due process, this procedure is recommended for the public hearing:
• The presiding officer will open the hearing.
• Special Legal Counsel will provide a staff report on the matter and outline due processes procedures.
• Mayor Olmos will be invited to present oral and/or written evidence in response to the censure request. This presentation shall not exceed ten (10) minutes. • The presiding officer will invite members of the public to speak. The public will be provided with five (5) minutes to each speaker, unless the presiding officer establishes different time period.
• Any Councilmember may then ask questions.
• Mayor Olmos will be invited to make final comments. Final comments shall not exceed five (5) minutes.
• The presiding officer will close the public hearing. No additional evidence may be presented after the close of the hearing, unless the presiding officer reopens the public hearing.
• The City Council may discuss the matter.
At this point, any Councilmember who wishes to make a motion may do so. The primary options for a motion include (a) take no action, (b) decline to impose a censure, or (c) impose a censure. If the City Council desires to take other actions to impose sanctions and discipline within its power, it may do so in the subsequent agenda item.
Subject to a second, any motion made should be deliberated and, upon the completion of deliberations, a vote should be taken. The City’s Special Legal Counsel on this matter has recommended that Mayor Olmos abstain from the discussion and any Council decision because of the legal principle that no person may serve as a judge in their own case.[8]

26-014 OF THE CITY OF SOUTH EL MONTE IMPOSING
SANCTIONS ON MAYOR GLORIA OLMOS
Based on this finding, the City Council considered a resolution censuring Mayor Olmos.
The City Council may additionally impose limited disciplinary actions or sanctions that do not interfere with the Mayor’s ability to perform the core functions of her elected office or restricting her opportunities to speak, such as her opportunity to deliberate on the dais and/or speak to the public. This item is to consider the imposing of sanctions against Mayor Olmos.
RECOMMENDED ACTION: It is recommended that the City Council consider adopting Resolution No. 26-014, provide alternative direction, or take no action.
After the report was completed, the City Council, with the Mayor not participating, reconvened into closed session to discuss the findings of the investigator. The City Council directed the City Attorney to prepare Resolution No. 26-013 to consider censuring Mayor Olmos based on the investigation’s sustained finding and place the matter on the agenda.
The City Council also directed the City Attorney to prepare the attached Resolution No. 26-014 to consider imposing potential sanctions upon Mayor Olmos based on the investigation’s sustained finding and place the matter on the agenda. Potential sanctions for consideration include removal from mayor’s office space; removal from internal committees for the remainder of her term; suspend travel budget for the remainder of her term; and request a retaking of AB 1234 ethics training. The City Council may also seek a Writ of Mandamus to compel the Mayor to follow and abide by the Brown Act.
LEGAL CONSIDERATIONS
The unauthorized or unpermitted disclosure of confidential information received in closed session poses legal risks to the City, undermines public trust, and compromises the integrity of the City Council’s deliberative process. The Brown Act provides specific
remedies for unauthorized disclosure of confidential information from closed session.
1. A person may not disclose confidential information that has been acquired by being present in a closed session authorized by Section 54956.7, 54956.8, 54956.86, 54956.87, 54956.9, 54957, 54957.6, 54957.8, or 54957.10 to a person not entitled to receive it, unless the legislative body authorizes disclosure of that confidential information.
2. For purposes of this section, “confidential information” means a communication made in closed session that is specifically related to the basis for the legislative body of a local agency to meet lawfully in closed session under this chapter.
3. Violation of this section may be addressed by the use of such remedies as are currently available by law, including, but not limited to:
4. Injunctive relief to prevent the disclosure of confidential information prohibited by this section.
5. Disciplinary action against an employee who has willfully disclosed confidential information in violation of this section.
“No councilman or other official or employee shall, without proper legal authorization, disclose confidential information concerning the property, government, or affairs of the city.
Violation of any provision of this code may constitute a cause for censure, disciplinary action or removal from office or employment in any manner prescribed by law.” The City Council does not have authority to remove any of its members from office, as only the electorate may do so.[2]
The City Council expects all of its members to comply strictly with the Brown Act and the City’s Code of Ethics These provisions establish a clear ethical obligation for members of the City Council to safeguard confidential information obtained in the course of their official duties.
3. Censure and Sanctions
A censure is distinct from any civil or criminal liability that may arise from the councilmembers conduct.[4] It is a constitutionally protected act of expression by a legislative body and Courts have recognized that elected officials, such as councilmembers, have a First Amendment right to express their views through censure resolutions.[5] A censure is not a judicial proceeding and is not subject to judicial rules of evidence, cross-examination, or admissibility of evidence.
Sanctions that May Accompany Censure
A censure may be a written reprimand and may impose limited disciplinary actions, so long as the sanctions do not prevent the elected official from performing the core functions of office or restrict the member’s opportunities to speak, such as his/her opportunity to deliberate on the dais and/or speak to the public.[6] Commonly imposed consequences from other legislative bodies that have been upheld have included:
1. Removal from external boards or commissions;[7]
2. Removal from internal committees;
3. Revocation of special privileges, such as suspending official travel or access to public funds.
When considering penalties, it is critical to avoid infringing upon a councilmember’s First Amendment rights or interfering with duties or authority granted to them by virtue of their elected office. The Ninth Circuit has indicated that sanctions that deprive an elected official from performing their duties or of the authority enjoyed by virtue of popular election will generally rise to the requisite level of materiality to constitute an infringement on speech.[8]
Due Process
Before sanctions can be formally adopted by resolution, the City Council is required to give notice to the affected mayor or councilmember of the allegations made against him/her and the date of the public meeting. A Councilmember or Mayor who is the subject of a censure, including the imposition of sanctions, is entitled to due process, with notice and an opportunity to respond and provide a defense.
Consistent with these requirements, Mayor Olmos was provided notice of the allegations on December 2, 2025, January 20, 2026, January 21, 2026, February 27, 2026, and is being afforded an opportunity to be heard and refute any charges at this public meeting. Pursuant to the City’s Municipal Code Section 2.04.040, the provisions of “Robert’s Rules of Order,” shall govern all proceedings of the council.
To ensure the Mayor is afforded due process, the presiding officer will introduce the item. The City's Special Legal Counsel will provide a presentation of the item. Then, Mayor Olmos will be invited to present oral and/or written evidence in response to the sanction(s). This presentation shall not exceed ten (10) minutes.
The City’s Special Legal Counsel on this matter has recommended that Mayor Olmos abstain from the discussion and any Council decision because of the legal principle that no person may serve as a judge in their own case.[9]
4. Writ of Mandamus
The City Council may also seek a Writ of Mandamus to compel the Mayor to follow and abide by the Brown Act. Pursuant to Government Code § 549630(a), the district attorney or any interested person may commence an action by mandamus, injunction or declaratory relief to stop or prevent violations or threatened violations of the Brown Act by members of the legislative body.
A writ of mandamus (also known as a writ of mandate) would ask a court to compel the councilmember to perform duties they have failed to perform. If the councilmember fails to comply, he/she can be held in contempt of court, fined or jailed.[10] This agenda item is to discuss and consider whether to impose sanctions against Mayor Olmos only.

Wilson (2022) 595 U.S. 468, the United States Supreme Court held that censure is a form of constitutionally-protected speech that may be used by elected bodies to reprimand the conduct of one of its members; and WHEREAS, the United States Supreme Court long recognized the practice of censuring legislative body members, including verbal and nonverbal censures, which has been more commonly observed at the state and local level, as early as 1833 (Houston Community College System v. Wilson (2022) 595 U.S. 468); and
WHEREAS, public officials have the authority to censure an individual member of a legislative body (Braun v. City of Taft (1984) 154 Cal.App.3d 332, 347-348); and WHEREAS, following a series of behaviors, the City Council decided that further investigation was necessary and retained the services of an independent third-party investigator, JL Group, LLC, to conduct an independent attorney-client confidential investigation of three allegations regarding Mayor Gloria Olmos; and
WHEREAS, following the independent third-party investigation, one allegation was sustained; and
WHEREAS, the investigator determined that the investigation of the sustained allegation disclosed sufficient evidence to clearly prove that Mayor Gloria Olmos engaged in a conversation and/or forwarded information to an outside third-party regarding an item that had been placed on the closed session agenda of a special city council meeting scheduled for June 26, 2025; and WHEREAS, after receiving these findings the City Council finds it necessary to protect the City, limit the legal liability of the City, and officially reprimand Mayor Olmos for her actions; and
WHEREAS, pursuant to the Ralph M. Brown Act (Government Code section 54950 et seq.), the City Council may convene in closed session for purposes expressly authorized by law, and members of the City Council are obligated to maintain the confidentiality of information lawfully received in closed session or in connection with closed session in order to protect privileged, litigation, and other confidential matters; and
WHEREAS, the City Council expects all its members, including the Mayor, to abide by the requirements of the Brown Act; and
WHEREAS, pursuant to the Code of Ethics established by Resolution No. 70-1304, no councilmember is allowed to disclose confidential information concerning the government or affairs of the City without proper legal authorization, nor shall a councilmember use such information to advance the financial or other private interest of themselves or others. (City of South El Monte Resolution No.70-1304 (1971)); and
WHEREAS, the City Council finds that such behavior not only poses immediate legal risks but also has the potential to compromise the City’s strategic objectives and the business of the people; and
WHEREAS, the City Council finds that such actions are inconsistent with the City’s Code of Ethics, including provisions related to the responsibilities of public office and adherence to conflict-of-interest principles established therein; and WHEREAS, a resolution of censure must be considered by the legislative body at an open public meeting and the subject member, Mayor Gloria Olmos, given notice of the censure; and WHEREAS, sanctions may accompany censure, so long as the sanctions does not prevent the elected official from performing core functions of office or restrict the member’s opportunity to speak, such as his/her opportunity to deliberate on the dais and/or speak to the public; and WHEREAS, Mayor Gloria Olmos has been provided with notice and with information related to the alleged conduct giving rise to sanctions; and WHEREAS, at the City Council’s regular meeting held on March 3, 2026, the City Council received information related to conduct attributable to Mayor Gloria Olmos and provided the opportunity to be heard; and
WHEREAS, on the findings set forth in this Resolution and all information in the records of the City Council’s proceedings, the City Council determines that imposition of sanctions of the Mayor is appropriate.
