The Wellness Center will assist the City to provide community education about the dangers of tobacco use and youth access to tobacco products.

City Council Agenda Report
Agenda Item No. 7.b.
DATE: October 20, 2026
TO: Honorable Mayor and Members of the City Council
APPROVED BY: Rene Salas, City Manager
SUBMITTED BY: Eric Diaz, Senior Executive Assistant
SUBJECT: CONSIDERATION AND APPROVAL OF RESOLUTION 26-073,
AWARDING A PROFESSIONAL SERVICES AGREEMENT
(PSA) WITH THE LA GENERAL MEDICAL CENTER
FOUNDATION INC. (THE WELLNESS CENTER)
SUMMARY: Staff is seeking approval from the City Council of a Professional Services Agreement (PSA) with The Wellness Center to assist the City of South El Monte with administering the State of California’s Department of Justice (DOJ) for the Tobacco Grant Program (DOJ-PROP56-2025-26-1-057). The Wellness Center will assist the City to provide community education about the dangers of tobacco use and youth access to tobacco products. Outreach efforts will include social media, press releases, and direct retailer’s members engagement, consistent with grant guidelines. This initiative aims to increase community awareness and ensure that both retailers and residents understand the legal and health impacts associated with underage tobacco use.
RECOMMENDED ACTION: It is recommended that the City Council:
1. Adopt Resolution No. 26-073, awarding a Professional Service Agreement with The Wellness Center in the amount of $187,200; and
2. Authorize the City Manager and the City Clerk to execute the Agreement for the Tobacco Grant Program for a three-year term (Fiscal Years 2025/2026 through 2028/29) between the Wellness Center and the City of South El Monte FISCAL/FINANCIAL IMPACT: There is no impact to the General Fund. The Tobacco Grant Program will provide funding in the amount of $291,235 on a reimbursement basis.
DISCUSSION: The City intends to use the grant funding to implement an effective, comprehensive outreach program for reducing underage consumption of tobacco and tobacco products and encourage responsible retail service within the City’s licensed establishments. This initiative is critical given the rising concerns about the health risks associated with early tobacco use, which significantly contributes to long-term addiction and chronic diseases. By targeting underage consumption, the program aims to mitigate these public health risks, reduce healthcare costs in the long term, and promote a healthier future for our youth.
The City will contract with the LA General Medical Center Foundation/Wellness Center to provide community education about the dangers of tobacco use and youth access to tobacco products. Outreach will be conducted through social media, press releases, and direct engagement with members, in alignment with grant guidelines. This educational initiative is intended to promote community-wide awareness and engagement, ensuring that both retailers and residents understand the legal and health implications of underage tobacco use. Grant-allowable activities under this initiative, but are not limited to, the following:
• Conduct retailer compliance checks to ensure tobacco vendors don’t sell to minors • Educating businesses on lawful sales practices through retailer training programs • Public education outreach to raise awareness about tobacco and nicotine’s health risks • Facilitating parent engagement and education to support youth prevention at home and in schools
• Enforcing tobacco business license compliance to meet local regulatory requirements Grant funds will support a multi-departmental coordinated strategy with education, training, and enforcement to reduce underage tobacco use and ensure retailer compliance. Specifically, the funds will be used to train Code Enforcement personnel in public outreach efforts to increase awareness of tobacco risks and provide educational support to local retailers on lawful sales practices. Engagement efforts will promote responsible retail behavior and deter youth access to tobacco products. All activities will be supervised by the Code Enforcement Department and aligned with the grant’s scope and timeline, contributing to a safer, healthier environment for South El Monte's youth.

3.3 Force Majeure. The time period(s) specified in the Schedule of Performance for performance of the services rendered pursuant to this Agreement shall be extended because of any delays due to unforeseeable causes beyond the control and without the fault or negligence of the Consultant, including, but not restricted to, acts of God or of the public enemy, unusually severe weather, fires, earthquakes, floods, epidemics, quarantine restrictions, riots, strikes, freight embargoes, wars, litigation, and/or acts of any governmental agency, including the City, if the Consultant shall within ten (10) days of the commencement of such delay notify the Contract Officer in writing of the causes of the delay. The Contract Officer shall ascertain the facts and the extent of delay, and extend the time for performing the services for the period of the enforced delay when and if in the judgment of the Contract Officer such delay is justified. The Contract Officer’s determination shall be final and conclusive upon the parties to this Agreement. In no event shall Consultant be entitled to recover damages against the City for any delay in the performance of this Agreement, however caused, Consultant’s sole remedy is limited to an extension of time pursuant to this Section.

The limits of insurance required herein may be satisfied by a combination of primary and umbrella or excess insurance. All insurance coverage maintained or procured pursuant to this agreement shall be endorsed to waive subrogation against City, its elected or appointed officers, agents, officials, employees, and volunteers or shall specifically allow Consultant or others providing insurance evidence in compliance with these specifications to waive their right of recovery prior to a loss. 6 01257.0001/868101.2
recovery against City and shall require similar written express waivers and insurance clauses from each of its subconsultants.
(g) Enforcement Of Contract Provisions (Non-Estoppel). Consultant acknowledges and agrees that any actual or alleged failure on the part of the City to inform Consultant of non-compliance with any requirement imposes no additional obligations on the City nor does it waive any rights hereunder.
(h) Requirements Not Limiting. Requirements of specific coverage features or limits contained in this section are not intended as a limitation on coverage, limits, or other requirements, or a waiver of any coverage normally provided by any insurance. Specific reference to a given coverage feature is for purposes of clarification only as it pertains to a given issue and is not intended by any party or insured to be all inclusive, or to the exclusion of other coverage, or a waiver of any type. If the Consultant maintains higher limits than the minimums shown above, the City requires and shall be entitled to coverage for the higher limits maintained by the Consultant. Any available insurance proceeds in excess of the specified minimum limits of insurance and coverage shall be available to the City. (i) Notice Of Cancellation. Consultant agrees to oblige its insurance agent or broker and insurers to provide to City with a thirty (30) day advance notice of cancellation (except for nonpayment for which a ten (10) day notice is required) or nonrenewal of coverage for each required coverage.
(j) Additional Insured Status. General liability policies shall provide or be endorsed to provide that City and its officers, officials, employees, agents, and volunteers shall be additional insureds under such policies. This provision shall also apply to any excess or umbrella liability policies.
(k) Prohibition Of Undisclosed Coverage Limitations. None of the coverages required herein will be in compliance with these requirements if they include any limiting endorsement of any kind that has not been first submitted to City and approved of in writing.
(l) Separation Of Insureds. A severability of interests provision must apply for all additional insureds ensuring that Consultant’s insurance shall apply separately to each insured against whom a claim is made or suit is brought, except with respect to the insurer’s limits of liability. The policy(ies) shall not contain any cross-liability exclusions. (m) Pass Through Clause. Consultant agrees to ensure that its subconsultants, subcontractors, and any other party involved with the project who is brought onto or involved in the project by Consultant, provide the same minimum insurance coverage and endorsements required of Consultant. Consultant agrees to monitor and review all such coverage and assumes all responsibility for ensuring that such coverage is provided in conformity with the requirements of this section. Consultant agrees that upon request, all agreements with consultants, subcontractors, and others engaged in the project will be submitted to City for review.
(n) Agency’s Right To Revise Specifications. The City reserves the right at any time during the term of the contract to change the amounts and types of insurance

Instead, the City may give notice to Consultant of the default and the reasons for the default. The notice shall include the timeframe in which Consultant may cure the default. This timeframe is presumptively thirty (30) days, but may be extended, if circumstances warrant. During the period of time that Consultant is in default, the City shall hold all invoices and shall, when the default is cured, proceed with payment on the invoices. In addition, the Consultant reserves the right to terminate this Contract at any time, with or without cause, upon sixty (60) days’ written notice to City, except that where termination is due to the fault of the City, the period of notice may be shorter at the discretion of the Consultant. Upon receipt of any notice of termination, Consultant shall immediately cease all services hereunder except such as may be specifically approved by the Contract Officer. In the event of termination without cause pursuant to this Section, the terminating party need not provide the non-terminating party with the opportunity to cure pursuant to Section 7.2.
7.5 Termination for Default of Consultant. If termination is due to the failure of the Consultant to fulfill its obligations under this Agreement, City may, after compliance with the provisions of Section 7.2, take over the work and prosecute the same to completion by contract or otherwise, and the Consultant shall be liable to the extent that the total
10 01257.0001/868101.2

writing and shall not be a waiver of any other default concerning the same or any other provision of this Agreement.

City Council Agenda Report
Agenda Item No. 7.c.
DATE: October 20, 2026
TO: Honorable Mayor and Members of the City Council
APPROVED BY: Rene Salas, City Manager
SUBMITTED BY: Adrian Garcia, MMC, City Clerk
SUBJECT: CONSIDERATION AND APPROVAL OF RESOLUTION 26-074, REPEALING RESOLUTION NO. 24-123 AND AMENDING THE
CITY OF SOUTH EL MONTE'S CONFLICT OF INTEREST
CODE
SUMMARY: This agenda item intends to complete the Code Review of the City of South El Monte Conflict of Interest (COI) code. The last time the City of South El Monte (“City”) revised its COI Code was on February 2024. Since that time, there have been several new designated positions added. This change required the amendment of the City’s COI Code.
RECOMMENDED ACTION: Staff recommends City Council proceed with the completion of the Code Review for the City and consider adopting Resolution No. 26-074, repealing Resolution No. 24-123 and amending the City's Conflict of Interest Code which formally codifies the revisions to the Code for the City.
FISCAL/FINANCIAL IMPACT: There is no fiscal impact.
DISCUSSION: Under the Political Reform Act (the “Act”), all public agencies are required to adopt a Conflict of Interest (“COI”) Code and to periodically review and update the same. COI Codes designate positions required to file Statements of Economic Interests (Fair Political Practices Commission Form 700), and assigns disclosure categories specifying the types of interests be reported. Form 700s are public records intended to alert public officials and members of the public to the financial interests of the filers.
The COI Code for the City must specifically list positions that make or participate in making decisions. Typically, positions that involve voting on matters, negotiating contracts, or making recommendations on purchases without substantive review must be included in COI Codes. Positions listed in Government Code section 87200 (i.e., Mayor, Members of City Council, City Manager, City Attorney, City Treasurer and Members of Planning Commission, etc.) are not required to be included because these positions are required to file Form 700s by state statute.
The primary purpose of the COI code is to require disclosure of those types of investments, interests in real property, sources of income and business positions that designated positions may affect in their decision-making. Cities are allowed to create particular categories that are unique to their special needs in order to allow for full disclosure and transparency within the city and its agencies. Consistent with the above, attached to this staff report is the COI Code for the City, which contains designated positions that have been determined to require disclosure of financial interests through the filing of a Form 700. The job classifications of the new, designated positions have been presented to City Council and are pending the review and approval of City Council.
The amended COI Code shall be adopted subject to completion of meet and confer and/or impasse procedures with any affected employee organization.
No COI code shall be effective until it has been approved by the code reviewing body (Government Code Section 87303). The code reviewing body for the City is the City Council. As its own reviewing body, the City Council must first give notice of its intent to review and amend the conflict of interest code and afford a comment period. The notice and copy of proposed code were posted on October 8, 2026, at City Hall, Senior Center, the Community Center and the City's website for review by community members and City employees/officers affected by the proposed revisions.

City Council Agenda Report
Agenda Item No. 9.a.
DATE: October 20, 2026
TO: Honorable Mayor and Members of the City Council
APPROVED BY: Rene Salas, City Manager
SUBMITTED BY: Gerardo Marquez, Director of Community Development & Public Works
SUBJECT: AN INTERIM URGENCY ORDINANCE OF THE CITY OF
SOUTH EL MONTE, CALIFORNIA, CONTINUING A
TEMPORARY CITYWIDE MORATORIUM PROHIBITING
APPROVAL AND ACCEPTANCE OF NEW DATA CENTER
LAND USE APPLICATIONS FOR AN ADDITIONAL TEN (10)
MONTHS AND FIFTEEN (15) DAYS PURSUANT TO
GOVERNMENT CODE SECTION 65858
SUMMARY: The proposed interim urgency ordinance would extend the existing 45-day moratorium on the approval and acceptance of new Data Center land use applications for an additional ten (10) months and fifteen (15) days while the City continues to evaluate appropriate land use classifications, zoning regulations, and development standards. The extension would provide additional time for the City to address potential impacts associated with Data Center development, including intensive energy and water demands, infrastructure capacity limitations, noise, air quality, and public health and safety concerns.
RECOMMENDED ACTION: Staff recommends the City Council:
1. Determine that Urgency Ordinance No. 1301-U is categorically exempt from the California Environmental Quality Act (CEQA) pursuant to State CEQA Guidelines Section 15061 (b)(3) (Common Sense Exemption); and
2. Introduce by title only, and waive further reading of, Urgency Ordinance No. 1301- U extending Interim Urgency Ordinance No. 1299-U and the temporary citywide moratorium on the approval and acceptance of new Data Center land use applications for an additional ten (10) months and fifteen (15) days.
FISCAL/FINANCIAL IMPACT: No Anticipated Fiscal Impact
DISCUSSION: Background and Initial Moratorium
Communities throughout the state and country have experienced detrimental effects of Data Center land uses, including but not limited to intensive energy and water use, noise, crime and security issues, air quality, water and noise pollution, aesthetic impacts; and other related effects on property values and quality of life to surrounding neighborhoods.
Data Center land uses often necessitate unique and/or abnormally large utility infrastructure connections to electrical, water, and sewage systems; where existing infrastructure is unable to support such land use nor load intensity of demand.
The South El Monte Municipal Code (“SEMMC”) does not adequately regulate Data Center land uses, including location, size and scope, and other development standards in its Zoning Ordinance. Data Centers are currently undefined in the SEMMC.
On October 6, 2026, the City Council adopted Interim Urgency Ordinance No. 1299-U by a four-fifths (4/5) vote, establishing a temporary 45-day citywide moratorium on the approval and acceptance of new Data Center land use applications. The moratorium was intended to provide City staff with sufficient time to evaluate the potential impacts of Data Center development, review regulatory approaches adopted by other jurisdictions, and develop appropriate zoning regulations and development standards for City Council consideration.
Actions by the State of California and Other Local Jurisdictions In recent months, the State of California and numerous local jurisdictions have taken legislative and regulatory action to address the potential impacts associated with Data Center development. These actions reflect growing attention to the unique infrastructure demands, environmental considerations, and land use compatibility issues associated with such facilities. The following summarizes relevant developments at the state and local levels.
State of California Legislation. In 2025, SB 57 (Padilla) was signed into law, requiring the California Public Utilities Commission (CPUC) to report on the potential cost-shifting impacts of data center electricity demand by January 1, 2027. Although Governor Newsom vetoed other proposed legislation concerning data center water and electricity usage in 2025, on September 21, 2026, he signed seven additional bills establishing new requirements for data center development, environmental review, water consumption, energy reporting, and utility infrastructure costs. Most of these laws take effect January 1, 2027, with certain requirements taking effect in subsequent years.
Among the new laws, SB 887 generally prohibits the use of categorical exemptions under the California Environmental Quality Act (CEQA) for discretionary approvals of data center projects beginning January 1, 2027, while providing an expedited judicial review process for qualifying projects meeting specified environmental and infrastructure requirements. AB 2469 establishes water-related requirements for permits involving the construction or expansion of data centers that increase peak water consumption, including water supply assessments, projected water usage disclosures, and applicant responsibility for necessary water infrastructure improvements. Beginning January 1, 2028, qualifying applicants must also provide water scarcity plans. AB 2619 requires data center operators to disclose anticipated water consumption when applying for business licenses or comparable permits and to provide updated water usage information upon renewal. Additionally, AB 1577 establishes energy reporting requirements for data centers with electrical capacities of 10 megawatts or greater, including disclosure of projected energy consumption, on-site generation, and anticipated noise levels to local
permitting agencies.
The remaining legislation addresses electricity infrastructure and ratepayer protections.
AB 2383 and SB 886 establish a framework for developing specialized utility tariffs and assigning certain electricity infrastructure and interconnection costs to data center operators, with additional requirements scheduled for implementation by January 1, 2028. SB 1168 directs the CPUC to examine data center electricity rate structures and associated cost-allocation issues. Collectively, these laws impose additional requirements on data center development and provide local agencies with information relevant to evaluating potential impacts on water resources, electrical infrastructure, surrounding land uses, and public health and safety.
Monterey Park (Los Angeles County). On January 21, 2026, the Monterey Park City Council adopted an urgency ordinance establishing a 45-day moratorium on data center development. On March 4, 2026, the Council extended the moratorium for an additional 10 months and 15 days, through January 21, 2027. On April 20, 2026, the Council adopted an urgency ordinance prohibiting data centers citywide. The Council subsequently adopted Ordinance Nos. 2278 and 2279 on May 6, 2026, establishing a citywide prohibition and implementing Measure NDC. On June 2, 2026, Monterey Park voters approved Measure NDC, establishing a voter-approved citywide prohibition on data centers.
Montebello (Los Angeles County). On February 11, 2026, the Montebello City Council adopted Urgency Ordinance No. 2491, establishing a 45-day moratorium on data centers, including artificial intelligence (AI) facilities, while City staff evaluated their potential impacts and developed permanent zoning standards. The moratorium was enacted in response to concerns regarding infrastructure capacity, electricity and water consumption, and compatibility with surrounding land uses.
Oakley (Contra Costa County). On April 14, 2026, the City of Oakley adopted an urgency ordinance establishing a 45-day moratorium prohibiting the acceptance, processing, or approval of data center land use applications while the City evaluated potential regulatory standards. On May 12, 2026, the Council extended the moratorium for an additional 10 months and 15 days.
Calipatria (Imperial County). On July 14, 2026, the Council voted 3–2 to advance a proposed permanent prohibition on large-scale data centers.
El Monte (Los Angeles County). On March 18, 2026, the El Monte City Council adopted Interim Urgency Ordinance No. 3063, establishing a 45-day moratorium prohibiting the processing, approval, and acceptance of new data center land use applications. The ordinance was intended to provide City staff with time to evaluate potential impacts and develop appropriate zoning regulations. On April 22, 2026, the Council unanimously adopted Interim Urgency Ordinance No. 3065, extending the moratorium for an additional 10 months and 15 days.
Baldwin Park (Los Angeles County). On March 4, 2026, the Baldwin Park City Council adopted an urgency ordinance establishing a 45-day moratorium on the approval, establishment, or operation of data centers. The ordinance was intended to allow City staff to evaluate potential impacts and recommend appropriate regulatory standards. On April 15, 2026, the Council extended the moratorium for an additional 10 months and 15 days while the City continued evaluating permanent land use regulations.
Imperial (Imperial County). On June 3, 2026, the Imperial City Council unanimously approved a 45-day temporary moratorium on certain high-energy industrial and technology uses, including data centers, battery energy storage systems, and similar utility-intensive facilities. On July 15, 2026, the Council unanimously adopted Ordinance No. 835, extending the temporary moratorium to allow City staff additional time to evaluate zoning regulations, infrastructure impacts, and potential development standards.
Los Angeles County. On April 14, 2026, the Los Angeles County Board of Supervisors adopted a motion directing the Department of Regional Planning, Department of Public Health, and other departments to study the potential health, environmental, and safety impacts of data centers, including impacts on electricity and water resources, and to evaluate regulatory approaches adopted by other jurisdictions. On August 17, 2026, the County published its report evaluating data center development and potential regulatory approaches. Subsequently, on September 17, 2026, the Director of the Department of Regional Planning issued a memorandum establishing an immediate administrative prohibition on the development of large-scale AI data centers across all zoning districts in unincorporated areas of the County. The directive serves as an interim measure while the County develops a proposed ordinance to permanently prohibit such facilities through its zoning regulations.
Measures Taken Since Adoption of the Interim Urgency Ordinance Since adoption of Interim Urgency Ordinance No. 1299-U, City staff has undertaken the following efforts to evaluate the conditions that necessitated the moratorium: (1) Conducted a comprehensive review of South El Monte’s Municipal Code to identify existing regulatory provisions and potential deficiencies concerning Data Center land uses; (2) Researched regulatory frameworks used by other California cities to mitigate the impact of Data Centers; (3) Analyzed zoning strategies to best regulate the presence of Data Canters within the city; and (4) Coordinated with the City Attorney’s Office to ensure any proposed regulations are legally defensible and consistent with state law.
Although these efforts have commenced, additional analysis and coordination are necessary to determine the appropriate regulatory framework for Data Center land uses and to ensure that any proposed amendments adequately address the City's land use, infrastructure, and public health and safety concerns.
Need for Extension of the Interim Urgency Ordinance
Notwithstanding the measures undertaken since adoption of the initial moratorium, the City has not yet completed its evaluation of Data Center land uses or established permanent zoning regulations addressing their potential impacts. The absence of specific development standards continues to raise concerns regarding the City's ability to adequately evaluate and regulate such facilities under its existing Municipal Code.
Additional time is therefore necessary to complete the City's analysis, develop appropriate zoning regulations, and provide for consideration of any proposed amendments through the applicable public hearing and adoption processes.
Government Code Section 65858 authorizes the City Council, following a noticed public hearing and upon a four-fifths (4/5) vote, to extend an initial 45-day interim urgency ordinance for an additional 10 months and 15 days. Accordingly, staff recommends that the City Council adopt the proposed Interim Urgency Ordinance extending the temporary
citywide moratorium on the approval and acceptance of new Data Center land use applications for an additional 10 months and 15 days, thereby allowing staff to continue evaluating and developing appropriate permanent land use regulations. Per direction provided by City Council and feedback from the community, staff will be preparing materials for a Zone Text Amendment to recognize the use and prohibit it within the City of South El Monte.
ENVIRONMENTAL REVIEW ANALYSIS/DETERMINATION:
Pursuant to the California Environmental Quality Act (“CEQA”) (Pub. Res. Code § 21000 et seq.) under the common sense exemption set forth in California Code of Regulations, Title 14, § 15061(b)(3) (“CEQA Guidelines”), projects that do not result in direct, or reasonably foreseeable indirect, physical changes in the environment are not subject to CEQA review. The adoption of this Interim Urgency Ordinance would prohibit the approval and acceptance of new Data Center land use applications; thus, it can be seen with certainty that prohibiting the approval and acceptance of new Data Center land use applications would not cause a direct or indirect impact on the environment.
Although these efforts have commenced, additional analysis and coordination are necessary to determine the appropriate regulatory framework for Data Center land uses and to ensure that any proposed amendments adequately address the City's land use, infrastructure, and public health and safety concerns.

SECTION 1. Recitals.
The above recitals are true and correct and incorporated herein by reference.
SECTION 2. Continued Urgency Findings.
The City Council finds, based upon the Recitals above, the October 20, 2026 Agenda Staff Report, and all oral and written testimony and evidence presented at the duly noticed public hearing, that the conditions that led to the adoption of Interim Urgency Ordinance No. 1299-U continue to exist; that there remains a current and immediate threat to the public health, safety, and welfare; and that the approval of Data Center land use applications before completion of the City's study would result in harm to the public health, safety, and welfare.
SECTION 3. Extension of Moratorium.
Pursuant to Government Code section 65858(a) and based on the findings set forth above and all oral and written testimony and reports presented by members of the public and City staff to the City Council on October 20, 2026, the moratorium established under Interim Urgency Ordinance No. 1299-U is hereby extended for an additional ten (10) months and fifteen (15) days or until the effectuation of any regulation(s), ordinance(s), or other action deemed appropriate by the City Council to address the threats to public health, safety, and welfare posed by Data Centers. Except as expressly provided herein, all provisions, definitions, prohibitions, exemptions, findings, and other terms of Interim Urgency Ordinance No. 1299-U shall remain unchanged and in full force and effect during the extension period
SECTION 4. CEQA.
This Interim Urgency Ordinance is exempt from the California Environmental Quality Act ("CEQA") based on the following:
A. Pursuant to the California Environmental Quality Act ("CEQA") (Pub. Res.
Code § 21000 et seq.) and CEQA Guidelines (Cal. Code Regs., tit. 14, § 15000 et seq.), there is no possibility that the adoption of this Interim Urgency Ordinance and continuance of a moratorium, hereby, may have a significant effect on the environment, because the moratorium will maintain the current environmental conditions arising from the current land use regulatory structure and is therefore exempt from CEQA pursuant to CEQA Guidelines Section 15061(b)(3).
SECTION 5. Severability.
If any section, subsection, subdivision, paragraph, sentence, clause or phrase of this Interim Urgency Ordinance, or any part thereof is for any reason held to be invalid or unconstitutional by a decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this Interim Urgency Ordinance or any part thereof. The City Council hereby declares that it would have passed each section, subsection, subdivision, paragraph, sentence, clause or phrase thereof, irrespective of the fact that any one or more section, subsection, subdivision, paragraph, sentence, clause or phrase would be subsequently declared invalid or unconstitutional.
SECTION 6. Effective Date and Duration.
If adopted by at least four-fifths vote of the City Council, this Interim Urgency
Ordinance shall be effective commencing immediately pursuant to Government Code Sections 36934, 36937, and 65858. If adopted, pursuant to Government Code section 65858(a), Interim Urgency Ordinance No. 1299-U shall be extended for an additional ten (10) months and fifteen (15) days following expiration of its initial forty-five (45)-day term, unless sooner terminated or superseded by permanent regulations adopted by the City Council. Agenda Item No. 9.b.
DATE: October 20, 2026
TO: Honorable Mayor and Members of the City Council
APPROVED BY: Rene Salas, City Manager
SUBMITTED BY: Gerardo Marquez, Director of Community Development & Public Works
SUBJECT: AN INTERIM URGENCY ORDINANCE OF THE CITY OF
SOUTH EL MONTE IMPOSING A TEMPORARY
MORATORIUM PROHIBITING APPROVAL AND
ACCEPTANCE OF NEW BATTERY ENERGY STORAGE
SYSTEM LAND USE APPLICATIONS FOR AN ADDITIONAL
TEN (10) MONTHS AND FIFTEEN (15) DAYS PURSUANT TO
GOVERNMENT CODE SECTION 65858
SUMMARY: The proposed interim urgency ordinance would extend the existing 45-day moratorium on the approval and acceptance of new Battery Energy Storage System (“BESS”) land use applications for an additional ten (10) months and fifteen (15) days while the City continues to evaluate appropriate land use classifications, zoning regulations, and development standards. The extension would provide additional time for the City to address potential impacts associated with BESS development, including fire and explosion hazards, hazardous material releases, emergency response challenges, infrastructure requirements, and public health and safety concerns.
RECOMMENDED ACTION: Staff recommends the City Council:
1. Determine that Urgency Ordinance No. 1302-U is categorically exempt from the California Environmental Quality Act (CEQA) pursuant to State CEQA Guidelines Section 15061 (b)(3) (Common Sense Exemption); and
2. Introduce by title only, and waive further reading of, Urgency Ordinance No. 1302- U extending Interim Urgency Ordinance No. 1300-U and the temporary citywide moratorium on the approval and acceptance of new Battery Energy Storage System land use applications for an additional ten (10) months and fifteen (15) days.
FISCAL/FINANCIAL IMPACT: No fiscal impact.
DISCUSSION: Background and Initial Moratorium
Battery Energy Storage System (“BESS”) facilities contain large concentrations of batteries and associated electrical equipment that, if damaged, defective, or otherwise compromised, may experience thermal runaway, fire, explosion, or the release of toxic or flammable gases and other hazardous materials. These incidents can present particular challenges for emergency responders because battery fires may persist for extended periods, require specialized response measures, and create potential off-site impacts.
A recent BESS fire in the City of La Verne illustrates these concerns. On September 22, 2026, a fire believed to have resulted from a lithium-battery explosion occurred at a BESS located at a water treatment facility. The incident resulted in evacuation orders for surrounding residences while emergency personnel worked to contain and monitor the affected battery systems. Although the initial fire was contained, an adjacent BESS was damaged and continued to present a potential hazard, requiring firefighters and technical experts to monitor the site for several days. This recent incident demonstrates that a BESS emergency may have consequences extending beyond the boundaries of the facility and may require substantial and prolonged emergency response resources.
BESS facilities also necessitate specialized electrical infrastructure to receive, store, and subsequently discharge significant quantities of electricity. Depending on the size and location of a proposed facility, development may require connections to substations or transmission and distribution facilities, transformers, utility lines, interconnection equipment, and upgrades to existing electrical infrastructure.
The South El Monte Municipal Code (“SEMMC”) does not, at present, adequately regulate Battery Energy Storage System land uses, including their siting and interconnection needs, proximity to sensitive uses, emergency access and response requirements, and potential fire and environmental hazards in its Zoning Ordinance.
Battery Energy Storage Systems are currently undefined in the SEMMC.
On October 6, 2026, the City Council adopted Interim Urgency Ordinance No. 1300-U, establishing a temporary 45-day citywide moratorium on the approval and acceptance of new BESS land use applications. The moratorium was intended to provide City staff with time to evaluate potential safety and infrastructure impacts, review regulatory approaches adopted by other jurisdictions, and develop appropriate zoning regulations and development standards for City Council consideration. The ordinance excludes qualifying residential-scale BESS installed and maintained exclusively for onsite use, subject to applicable California Fire Code requirements. Per direction provided by City Council and feedback from the community, staff will be preparing materials for a Zone Text Amendment to recognize the use and prohibit it within the City of South El Monte. Staff will distinguish between grid-scale facilities and behind-the-meter systems intended for onsite energy storage, with the prohibition applying only to front-of-the-meter facilities.
Actions by the State of California and Other Local Jurisdictions The State of California and numerous local jurisdictions have adopted legislation and regulatory measures addressing BESS development, including facility safety, emergency response, siting, and permitting requirements. These measures recognize the role of energy storage in supporting electrical grid reliability while addressing the potential impacts associated with large-scale BESS facilities. The following summarizes relevant developments at the state and local levels.
State of California Legislation and Regulations. California has established a regulatory framework governing the development, operation, and safety of BESS facilities. In March 2025, the California Public Utilities Commission (CPUC) adopted additional safety requirements under General Order 167, strengthening maintenance and operational standards for BESS facilities and oversight of emergency response plans.
More recently, SB 283 (2025), known as the Clean Energy Safety Act of 2025, established additional safety requirements for energy storage facilities, including requirements relating to National Fire Protection Association 855 standards, consultation with local fire authorities, and facility inspection and emergency response considerations.
Effective January 1, 2026, the legislation strengthens coordination between BESS developers and local fire officials during the permitting and development process.
Vacaville (Solano County). On May 14, 2024, the Vacaville City Council adopted an interim urgency ordinance prohibiting the acceptance, approval, establishment, operation, relocation, or expansion of grid-scale BESS facilities within the City. On June 24, 2024, the Council extended the moratorium. The Council adopted Ordinance No. 2015 on March 24, 2026, establishing permanent BESS regulations. The ordinance prohibits certain large-scale BESS facilities utilizing lithium-ion batteries or other technologies with documented thermal runaway incidents, while establishing siting, permitting, and operational standards for other qualifying BESS facilities.
San Juan Capistrano (Orange County). On April 2, 2024, the San Juan Capistrano City Council adopted a 45-day moratorium on new commercial BESS facilities while the City evaluated potential zoning controls, safety standards, and environmental safeguards. On May 7, 2024, the Council adopted Urgency Ordinance No. 1119, extending the moratorium for an additional 10 months and 15 days. Subsequently, on March 18, 2025, the Council adopted a second extension for an additional year to allow staff to continue evaluating potential public health and safety impacts and developing appropriate land use regulations. The City cited concerns regarding facility siting, proximity to sensitive uses, fire hazards, and emergency response capabilities.
Morro Bay (San Luis Obispo County). On January 28, 2025, the Morro Bay City Council adopted Urgency Ordinance No. 668, establishing a 45-day moratorium on gridscale Battery Energy Storage System (BESS) facilities within City limits. On February 25, 2025, the Council adopted Urgency Ordinance No. 670, extending the moratorium through January 2027 to allow additional time to evaluate safety concerns and develop permanent land use regulations. On August 18, 2026, the Planning Commission recommended that the City Council adopt permanent zoning amendments prohibiting front-of-the-meter BESS facilities in all zoning districts. The proposed amendments would distinguish between grid-scale facilities and behind-the-meter systems intended for onsite energy storage, with the prohibition applying only to front-of-the-meter facilities. The proposed permanent prohibition remains pending City Council consideration.
Measures Taken Since Adoption of the Interim Urgency Ordinance Since adoption of Interim Urgency Ordinance No. 1300-U, City staff has undertaken the following efforts to evaluate the conditions that necessitated the moratorium: (1) Conducted a comprehensive review of South El Monte’s Municipal Code to identify existing regulatory provisions and potential deficiencies concerning BESS land uses; (2) Researched regulatory frameworks used by other California cities to mitigate the impact of BESS facilities; (3) Analyzed zoning strategies to best regulate the presence of BESS facilities within the city; and (4) Coordinated with the City Attorney’s Office to ensure any proposed regulations are legally defensible and consistent with state law.
Although these efforts have commenced, additional analysis and coordination are necessary to determine the appropriate regulatory framework for BESS land uses and to ensure that any proposed amendments adequately address the City's land use, infrastructure, and public health and safety concerns.
Need for Extension of the Interim Urgency Ordinance
Notwithstanding the measures undertaken since adoption of the initial moratorium, the City has not yet completed its evaluation of BESS land uses or established permanent zoning regulations addressing their potential impacts.
Accordingly, staff recommends that the City Council adopt the proposed Interim Urgency Ordinance extending the temporary citywide moratorium on the approval and acceptance of new BESS land use applications for an additional 10 months and 15 days, thereby allowing staff to continue evaluating and developing appropriate permanent land use regulations.
The adoption of this Interim Urgency Ordinance would prohibit the approval and acceptance of new Battery Energy Storage System land use applications; thus, it can be seen with certainty that prohibiting the approval, and acceptance of new Battery Energy Storage System land use applications would not cause a direct or indirect impact on the environment.

SECTION 5. Severability.
If any section, subsection, subdivision, paragraph, sentence, clause or phrase of this Interim Urgency Ordinance, or any part thereof is for any reason held to be invalid or unconstitutional by a decision of any court of competent jurisdiction, such decision shall
not affect the validity of the remaining portions of this Interim Urgency Ordinance or any part thereof.
If adopted by at least four-fifths vote of the City Council, this Interim Urgency Ordinance shall be effective commencing immediately pursuant to Government Code Sections 36934, 36937, and 65858. If adopted, pursuant to Government Code section 65858(a), Interim Urgency Ordinance No. 1300-U shall be extended for an additional ten (10) months and fifteen (15) days following expiration of its initial forty-five (45)-day term, unless sooner terminated or superseded by permanent regulations adopted by the City Council. Except as expressly provided herein, all provisions, definitions, prohibitions, exemptions, findings, and other terms of Interim Urgency Ordinance No. 1300-U shall remain unchanged and in full force and effect during the extension period.
