CONFERENCE WITH LEGAL COUNSEL - PENDING

LITIGATION
Pursuant to Government Code Section 54956.9(a),
54954.9(b)(3)(C)
a. Gabina Galaz v. City of South Gate, County of Los Angeles, et al. b. Konoike-Pacific California v. LACMTA
Item 1(a) is a personal injury claim made against the city based on a fall that someone suffered allegedly on a city sidewalk. There was a report given by the City Attorney in closed session and following that report on a motion made by Council Member Avalos and seconded by Mayor Hurtado and on a vote of 5-0, the Council approved the City Attorney's defense of that action.

On item 1(b), the City Council received a report by the City Attorney concerning a lawsuit filed by that establishment, known as KPAC, which is a storage facility in the City of South Gate alleging that the MTA failed to comply with the CEQA statute and failed to give proper notice to the business. The City of South Gate received notice of this because the lawsuit involves a business operating within the jurisdiction of the city.

However, the City of South Gate is not a party in action and the action is not directed against the city itself. There was no reportable action taken upon completion of that report
