CITY COUNCIL
AGENDA BULL
Department Head:
Darren Arakawa Rob Houston
SUBJECT: RESOLUTION ADOPTING THE UPDATED LOCAL HAZARD MITIGATION PLAN
PURPOSE: Consider the Emergency Services Manager's recomtnendation to adopt the updated Local Hazard Mitigation Plan ("LHMP").
RECOMMENDED ACTION: Following the conclusion of the Public Hearing, the City Council will consider adopting a Resolution adopting the updated Local Hazard Mitigation Plan describing the City's effoits to prepare for and respond to emergencies.
FISCAL IMPACT: There is no direct fiscal impact to the City. Failure to adopt the Resolution could affect the City's eligibility for Federal Emergency Management Agency ("FEMA") disaster mitigation funding.
ENVIRONMENTAL EVALUATION: The foregoing is exempt from the California Environmental Quality Act ("CEQA") under section 15061(b)(3) of the CEQA Guidelines, which provides that CEQA only applies to projects that have the potential for causing a significant effect on the environi'nent. Where, as here, it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environi'nent, the activity is not subject to CEQA.
NOTICING REQUIREMENTS: Advertising and notification of the public hearing for this item was conducted in compliance with Chapter 11.50 (Administration), Title 11 (Zoning) of the South Gate Municipal Code. Notice of hearing was originally posted and published in the Los Angeles Wave newspaper on September 19, 2024.
ANALYSIS: The purpose of a Hazard Mitigation Plan is to reduce or eliminate long-term risk to people and property from natural hazards and their effects on the City. An updated and adopted plan is required not only to reduce risk to the corni'nunity, but to maintain eligibility for disaster mitigation funding from FEMA under the Disaster Mitigation Act of 2000 ("DMA2K"). This plan was last adopted by City Council on June 26, 2018, and is pending approval by FEMA upon adoption by City Council. Per FEMA, the plan must be updated evei'y 5 years, so the current plan expired on June 26, 2023. 1 8
Federal and State Requirements:
The Federal Disaster Management Act of 2000 ("DMA 2000"), Section 322 (a-d), requires that any local governi'nent wishing to receive federal disaster mitigation funds liave a mitigation plan that acco'i'nplislies tlie following:
* Describes the process for identifying hazards, iisks, and vulnerabilities in the coi'nununity @ Identifies and prioritizes hazard mitigation activities * Encourages the development of local mitigation actions * Provides technical support for hazard mitigation efforts This plan meets the requirements identified in DMA 2000 and is consistent with current FEMA hazard mitigation requirements and guidance.
Califoniia Governinent Code Section 8685.9 (also added by AB 2140) provides for additional disaster funding if a jurisdiction has an adopted mitigation plan as part of its General Plan.
This plan is consistent with sections 65302.6 and 8685.9, as it is integrated witli the Safety Element of the General Plan.
FEMA Review: The Robert T. Stafford Disaster Relief and Emergency assistance Act ("Stafford Act"), as amended by the DMA 2000, provides the legal basis for state, tribal, and local governinents to undertake risk-based approaches to reducing natural hazard risks through mitigation plai'ining. Specifically, tlie Stafford Act requires state, tribal, and local governi'nents to develop and adopt FEMA-approved hazard mitigation plans as a condition for receiving certain types of non-emergency disaster assistance. FEMA lias reviewed tlie proposed Local Hazard Mitigation Plan and determined that the plan is eligible for final approval pending its fonnal adoption by the City.
Public Engagement and Participation: As part of a comprehensive outreach process, steering corni'nittee meetings were conducted with members of Finance, Police, Public Works, Community Development, and Parks and Recreation Department Staff, the Los Angeles County Fire Department, as well as non-profit organizations and schools during November 2023 :
@ South Gate City Staff - November 27"'
@ Nonprofits Organizations, Schools - November 28I'l @ County, Neighboring Cities - November 29"1
* Utilities, Public Safety Agencies - November 30"1 In accordance and compliance with FEMA requirements, online surveys of the public were conducted in the month of February 2024, as well as public presence at City events such as the fan'ner's market at South Gate Park to gather public comi'nent, concern, and to educate the public about the Local Hazard Mitigation Plan. These concerns were later addressed by key City stakeholders in a series of meetings in the month ofApril.
The Local Hazard Mitigation Plan was reviewed CalOES and FEMA and both have deteri'nined that the plan is eligible for final approval pending its adoption by the City. 2 9
BACKGROUND: A natural hazard is a naturally occurring event, such as an earthquake or flood that could harm human life and property. Natural hazards pose severe risks, and may cause injuries or deaths, and damage or destroy buildings and infrastructure. People may be displaced from their homes, key services can be disrupted, and the local economy may be affected. While a community cannot fully protect against every potential impact of every hazard, such impacts can be reduced or mitigated. This Local Hazard Mitigation Plan identifies opportunities to mitigate these impacts and improve resiliency to natural liazards in the City of South Gate.

CITY COUNCIL
ACENJA B3J[LL
Department Director:
For the Regular Meeting of: October 8, 2024
g Dep : Public Works
3 cityyanager:
turo Cervante,i Rob Houston
SUBJECT: RESOLUTION DECLARING A CONTINUED EMERGENCY AND
AUTHORIZING REPAIR, REPLACEMENT OR MAINTENANCE ACTIVITIES OF
PUBLIC FACILITIES RELATED TO THE URBAN ORCHARD, CITY PROJECT NO, 539-Pa WITHOUT PUBLIC BIDDING, PURSUANT TO THE EMERGENCY
CONTRACTING PROCEDURES OF THE SOUTH GATE MUNICIP AL CODE AND
THE CALIFORNIA PUBLIC CONTRACT CODE
PURPOSE: To declare an emergency still exists and to authorize the repair, replacement or maintenance activities of public facilities related to the Urban Orchard Project without public bidding. The Los Angeles County Department of Public Health, Solid Waste Division ("County") issued a Corrective Action Order requiring construction to stop on the project. The declaration of emergency is necessary to streamline the process to procure a replacement contractor to provide maintenance activities to preserve the site in a safe condition until the County authorizes consti'uction work on the project to resume.
RECOMMENDED ACTIONS: The City Council will consider making a finding and adopting Resolution declaring an emergency still exists and authorizing repair, replacement or maintenance activities of public facilities related to the Urban Orchard, City Project No. 539- PRK, without public bidding, pursuant to the emergency contracting procedures of the South Gate Municipal Code and the California Public Contract Code.
FISCAL IMPACT: There is no impact to the General Fund. The Urban Orchard Project ("Project") has received a total of $30.5 million in grant and other funds for design, construction, operations, and maintenance, as suinmarized below.
ANALYSIS: The Project was under construction and approximately 90% of construction work has been completed. On December 29, 2022, the City received a Corrective Action Order ("Order") from the County. The Order required the City to stop all construction activities until such a time as a Post Closure Land Use Plan ("PCLUP") for the Project site was approved by the County. Given the PCLUP approval process and input received to date, it will take at least several months, possibly six or more, to obtain approval.
To avoid the significant delay damages that would be payable by the City to the general contractor during a prolonged suspension of the project pending approval of the PCLUP, tlie City 1 15
Council ten'ninated tlie general contractor's agreement at a Special City Council meeting on February 6, 2023. Sucl'i ten'nination provided both immediate and long-tenn cost savings to the City but also created an itni'nediate x'ieed for tlie City to retain an inteiim contractor to perfori'n ceitain ongoing mainteiiance and safety activities; a need wliich must be met sooner than the time necessary to engage in normal public bidding procedures.
The proposed Resolution declares a continued emergency exists pursuant to the authority granted by Soutli Gate Municipal Code § l.54.470 and California Public Contract Code § 22050. Those Code Sections allow cities, by resotution, to approve the City's entry into contracts without engaging in public bidding where certain emergency conditions are found to have occurred. Staff continues to believe that the County's Order directing all construction work to be ceased on the Project, constitutes such an emergency due to the public's safety with an unfinished construction site and the need to respond accordingly to additional directives given by the County related to ensuring public safety. Staff are recoininending that tlie City Council adopt tlie proposed Resolution so that the City can avail itself of the accelerated contracting procedures authorized by those Code Sections. The Resolution, (1) declares an emergency, (2) authorizes the City Manager to take such actions deemed necessary to cause the maintenance activities to be perfon'ned and to procure the necessary equipment, services, and supplies all without giving notice for bids for contracts, (3) requires that at each regularly scheduled City Council Meeting, tlie City Manager present to the Council the reasons justifying why the emergency will not peri'nit a delay resulting from a competitive solicitation for bids, why that action is necessary to respond to the emergency, and tliat the City Council review the emergency action to deten'nine, by a four-fifth's vote, that tliere is a need to continue the emergency action until the emergency action is terminated.
The City is working diligently to secure the PCLUP approval. Since the original Resolution declaring an emergency was approved by tlie City Council on February 6, 2023, tlie following contracts, expendihires, and milestones have been undertaken:
1. NR Development Inc., was infori'ned that Contract No. 2021-66-CC was teri'ninated by the City Council effective February 13, 2023, except for maintenance activities. As of February 16, 2023, NR Development Inc., is no longer providing any project services or maintenance activities, with the exception of those required in the settlement agreement.
2. Approved a funding increase for TPL in the amount of $50,000. On January 24, 2023, the City Council approved a $250,000 budget for Ai'nendment No. 6 to Contract No. 3352 with TPL; however, Ai'nendment No. 6 had a budget requirement of $300,000. A budget increase of $50,000 was administratively approved to align the amount of the budget authority with the $300,000 budget requirement for Ainendment No. 6, which provides funding for the technical services required to comply with requirements from the LEA.
3. The LEA has approved the Summary of Investigations Report, Workplan of Interim Control Measures ("WICM"), Supplemental WICM and Phase II Workplan. The WICM safety measures were completed May of 2023. 2 16
4. Tlie City coordinated with tlie Trust for Public Land ("TPL") to procure a replacement contractor: LA Engineering to complete the construction of maintenance activities in tlie WICM approved by tlie LEA for the Urban Orcliard Project. A construction contract in tl'ie amount of $2,919,248 was executed administratively under the autliority granted by the subject resolution (Contract No. 2023-93-CC). Work was completed as of April 2024, including tlie following: backfill of overflow stnicture at the south wetland, north wetland slope stabilization, backfill of the reservoir, installation of three vaults adjacent to the Bandini Channel, construction of the easement road, electiical on-site lighting.
5. Methane gas monitoring was completed in December 2023 and low traces of methane were detected at one probe; however, tl'ie amount is below regulatory requirements.
6. The LEA approved tlie Report of Finding of the Phase II Work Plan, witli contingencies. Tl'ie Post Closure Land Use Plan ("PCLUP") lias been prepared and submitted to the County.
7. A contract was awarded to Executive Management Security Inc., in the amount of $214,995 to continue the security services on the Urban Orchard Project until June 30, 2024.
8. NR Development, Inc. completed importing 9,300 cubic yards of clean soil and storing it on tlie UWS property.
9. A contract witli W.A. Rasic in the amount of $141,985 for soil maintenance and management is in the process of being administratively approved, which was needed to oversee the import of 9,300 cubic yards of soil. 1 0. Amendment No. 7 to Contract No. 3352 with the Trust for Public Land was approved administratively in the amount of $522,072. Tlie scope of service includes, (a) Program Management, (b) design services to revise the design plans to rebid construction, (c) construction support, (d) additional methane monitoring required by Los Angeles County Department of Public Health Solid Waste Division, (e) preparing the Post Closure Land Use Plan required by Los Angeles County Department of Public Health Solid Waste Division, and (f) extending the contract teri'n to December 31, 2024.
11. Plans and specifications were completed, and the project was be advertised for construction in August 2024. The bids close on October 10, 2024.
BACKGROUND: The Project is a part of the FY 2022/23 Capital Improvement Program. The Project is located between the Los Angeles River, Firestone Boulevard, tlie Thunderbird Villa Mobile Home Park, and the I-710 Freeway. The two primary purposes of the Project are to divert and treat ston'n water run-off from the Los Angeles River and to install a new park to provide riverfront recreational opportunities.
The Project is being constructed on a property that was used as an unpermitted landfill until 1949 by an entity laiown as Southeastern Disposal and By-Products. The property site is identified in CalRecycle's Solid Waste Information System ("SWIS") as an Unpermitted Closed Solid Waste Disposal Site and SWIS No. 19-AA-5545. In 1984, the State of California Department of Health 3 17
Services, Toxic Substances Control Division concluded that the clean-up work completed effectively mitigated waste constituents to proceed with the Lewis Homes residential development project. The requirements of tl'ie PCLUP came into effect in 1988. As such, the project site is subject to State solid waste regulations tliat require the PCLUP before any change to the cuirent land use, construction, or land preparation can occur.
The Los Angeles County Department of Public Health, Solid Waste Management Program, acts as the LEA for the State of California's Department of Resources Recycling and Recovery ("CalRecycle"). The County is autl'iorized by Division 30 of the Public Resources Code ("PRC"), Section 43209 and 45000, Title 14 and 27 of tlie California Code of Regulations (14 CCR & 27 CCR), to enforce applicable solid waste regulations and to ensure solid waste sites meet the state minimum standards within the County of Los Angeles. As such, the City is working with the LEA to obtain approval of the PCLUP.
Construction is currently at the 90% completion stage. Improvements that have been substantially completed include, but are not limited to, rough grading, drop inlet for storm water diversion structures in the Bandini Channel, a wetland overlook area, the stream adjacent to the education/flexible space building and wetland, south bio swale, construction of 18 raised planters, planting of 75 trees, installation of the prefabricated education center and the restroom/maintenance building, two shade structures, a water element at the playground, installation of multi-use walking and bicycle pathways, exercise equipment located at various stages along tlie walking and bicycle paths, benches, picnic tables, drinking fountains, trash cans, and patliway lighting. Construction of the project will resume after the County approves the CPLUP.

CITY COUNCIL
A(GENDA BT[LL
For the Regular Meeting of: October 8, 2024
Originating Department: Human Resources
Human Resources Director:
n amilton Rob Houston
SUBJECT: RESOLUTION 0 APPROVE THE RETITLING OF THE WATER
DISTRIBUTION FOREMAN TO WATER DISTRIBUTION SUPERVISOR IN THE
PUBLIC WORKS DEPARTMENT, AND TO UPDATE THE CONSOLIDATED SALARY
SCHEDULE FOR THE POSITION OF WATER DISTRIBUTION SUPERVISOR PURPOSE: To consider retitling the job classification of Water Distribution Foreman to Water Distribution Supervisor in the Public Works Department and updating the consolidated salary schedule for the position of Water Distribution Supervisor RECOMMENDED ACTION: The City Council will consider adopting a Resolution to approve:
1. Retitling the job classification of Water Distribution Foreman to Water Distribution Supervisor in the Public Works Department; and
2. Updating the consolidated salary schedule to replace the position of Water Distribution Foreman with Water Distribution Supervisor
FISCAL IMPACT: This position is funded through the Water Fund. The retitling of the Water Distribution Foreman to Water Distribution Supervisor will bring its pay into parity with the Water Operations Supervisor resulting in an increase of approximately $3,807 for the remaining periods in FY 2024-25.
ANALYSIS: The requested change in the position's name from Water Distribution Foreman to Water Distribution Supervisor is to modernize the title, and the increase in pay is to ensure the position remains competitive within the market and its pay remains in parity with its historical counterpart, the Water Operations Supervisor.
BACKGROUND: The City must, from time to time, add, remove, reclassify, or otherwise adjust job classifications, job specifications and/or compensation in the Salary Resolution and Position Classification Plan in order to satisfy the changing needs and demands of the City's workforce. In response to these changing needs and demands, job classification specifications must be amended to more closely match the tasks which need to be performed by employees in the City's various departments.
l
22 The proposed cliange to the position title is to ensure that a gender-neutral title provides for inclusivity for any incumbent who may occupy it. On March 26, 2024, the City Council approved changing the title of the Water Operations Fon'nan to Water Operations Supervisor for the same reason and, historically, the Water Operations Forinai'i/Supervisor and Water Distribution Forman/Supervisor are considered equal counterparts to one another.
Additionally, on March 26, 2024, the City Council authorized an increase the base wages for the position by 5 percent to ensure that the position remains competitive in the market based on a market analysis to deten'nine what a competitive wage would be for this position. At the time, it was determined that the position's base pay was about 11 percent behind its peers; however, when -- -ac-co-unting for the City's generous benefits -an 6mployee receives, the position was -about -4.7 percent behind its peers in "total compensation." In an effort to keep the position competitive and ensure that its wages meet the median for "total compensation," the City Council authorized an increase the Water Operations Supervisor salary by 5 percent. Unfortunately, although the Water Operations Supervisor and the Water Distribution Supervisor have been historical equals and paid at the identical rate, the Water Distribution Supervisor was inadvertently and unintentionally not included in that March 26, 2024, City Council action.
In an effort to ensure that the historical pay parity continues to exist between these two positions, that the increase is also warranted based on the same market analysis, and to ensure the City makes proper efforts to retain is highly qualified water staff, authorization is requested to update the Consolidated Salary Schedule as follows:
Water Distribution Supervisor A B c D E
Current 6,965 7,313 7,679 8.063 8,466
Proposed 7,313 7,679 8.063 8,466 8,889
Human Resources staff worked with the Public Works Department and with the Miscellaneous Employees' Association (MEA) Board Members regarding the retitling of the position from Water Distribution Foreman to Water Distribution Supervisor, and the proposed pay in its pay.

The City is the 12th largest city in California and has a population of 308,511 citizens in an area of about 80 square miles. The City is unique from many cities in California, as it has its own publicly owned utility (electricity and water) and operates a regional water quality control plant.
Municipal services provided by the City include police, fire, roads, parks, museums, libraries, development services, an airport, and internal service functions in support of operational departments. The City has an elected Mayor, seven Councilmembers elected bywards and is a charter city with a Council-Manager form of government. Mr. Barber's responsibilities and accomplishments include:

Lead the educational outreach for two citywide ballot measures reauthorizing a parcel tax for library services (Measure l), along with the reauthorization of a transfer of water utility revenue to the General Fund of 56.7 million annually (Measure A). Both measures passed by more than sixty-six percent (66%).
Revised the City's Economic Development Action Plan, embedding in the plan the principles of Riverside "Seizing Our Destiny," which is a community-based movement driving the City's economic future. The result was an annual increase in local jobs of 3,200 private sector, along with 12,000 construction-related positions associated with various local and state transportation projects.

City of Riverside, CA. Community Development Department Director. Mr. Barber served as the Community Development Director for the Department, which was formed during Fiscal Year 2005-06 by combining the Planning and Building and Safety Department with the Code Enforcement Division of the Public Works Department. AGENDA IBNLL

For the R ar M a of: October 8, 2024
Dep ent: Public Works
antes Rob
SUBJECT: AMENDMENT TO THE FISCAL YEAR 2024/25 CAPITAI, IMPROVEMENT PROGRAM Al)DING THE STATE STREET COMPLETE STREETS
PROJECT AND FUNDING APPROPRIATION
PURPOSE: To amend the Fiscal Year 2024/25 Capital Improvement Program to add the State Street Complete Streets Project and to appropriate funding for it.
RECOMMENDED ACTION: The City Council will consider:
(a) Amending the Fiscal Year 2024/25 Capital hnprovement Program ("CIP") to add the State Street Complete Streets, City Project No. 729-ST. (b) Appropriating $50,000 in Prop C Funds to the State Street Complete Streets, City Project No. 729-ST, to fund project management to initiate the design phase. (c) Appropriating $1,197,204 in Surface Transportation Program - Local ("STPL") Funds to the State Street Complete Streets, City Project No. 729-ST, to partially fund the construction phase.
FISCAL IMPACT: There is no impact on the General Fund. The amount of the appropriation is $1, 247,204, which is proposed to be funded by $50,000 in Proposition C Funds and $1,197,204 in STPL Funds. Additional funding will be required at a future time to fully fund the design and construction phases.
ANALYSIS: The City's Fiscal Year 2024/25 CIP contains the City's active and fi.inded capital improvement projects. A total of $1,197,204 in STPL Funds has become available for CIP. Staff is recommending that the funds be used to make repairs and improvements to the State Street Complete Street Project ("Project"). This can be accomplished by amending the FY 2024/25 to add the project and appropriating the STPL funds for it.
State Street repairs should be given priority for these funds. The City Council's adopted Strategic Plan includes a goal to pursue grant funding for it. Staff has submitted grant applications to the Highway Safety Improvement Program and the Active Transportation Program, thus the STPL Funds will supplement that effort. The funds will address issues that the corridor is experiencing.
Its current condition no longer meets today's pedestrian, bicyclist, motorist and public transit user's transportation needs. Using STPL Funds, however, will help the vision of the General Plan, Mobility Elements which aims to provide "Transportation Choices: We will enhance mobility by creating a balanced transportation system that creates safe and attractive streets and promotes 1 56
walking, bicycling and transit use." State Street, which was constructed many years ago, and is in need of sidewalk and roadway repair. The traffic signal systems, while functional, are aged and have dated designs. The State Street Complete Streets Project aims to address these issues by improving traffic circulation and safety, and by creating a more comfortable environment for active transportation.
With the City Council's approval, staff can initiate the design phase, which is plaru'ied for completion within 18 months.
BACKGROUND: The Project is an infrastructure initiative aimed at transforming State Street into a safer, more accessible route. State Street runs from Tweedy Boulevard at the City's southern boundary to Santa Aria Street at the northern boundary. Serving pedestrians, cyclists, motorists and transit users, this corridor coru'iects residents to important community hubs, such as schools, local businesses, residential neighborhoods and parks.
The need for this Project is especially pronounced due to the high rate of active commuting in the area. Approximately 9% of households within the Project area do not own a car, and 9.43% of workers over the age of 16 coinmute by bus, foot, or bike. However, State Street's current configuration prioritizes vehicular traffic. The corridor experiences high vehicle speeds, and a lackofpedestrianandbike-friendlyamenities,suchasshelteredbusstopsandbikeparking. These factors disproportionately impact the area, where 83% of residents do not participate in leisure time physical activities, making safe street infrastructure essential for encouraging physical activity and transit usage.
The Project will address these issues by implementing a series of improvements designed to calm traffic and enhance pedestrian and cyclist safety. The Project will include the installation of 35 high-visibility crosswalks, 18 curb extensions (bulb-outs), seven signal modifications (including Accessible Pedestrian Signals and Leading Pedestrian Intervals), six bicycle racks, and four new bus shelters. These improvements are aimed at improving safety and creating a welcoming environment for residents to walk, bike, and use public transit.
In addition, the Project will close several critical gaps in the City's active transportation network.
For example, the upgrade of crosswalks at key intersections, such as State Street and Southern Avenue, and State Street and Illinois Avenue, will make crossing the street safer for pedestrians and cyclists, especially near schools and parks. Another significant improvement will be the plaru'ied used of pedestrian-activated HAWK signal systems, which provide a safer transportation environment.
Through these enhancements, the State Street Complete Streets Project will improve the quality of life for South Gate residents and businesses, by ensuring safer, more accessible streets for all.
