TUESDAY, DECEMBER 10, 2024
CALL TO ORJ)ER Gil Hurtado, Mayor called a Special City Council Meeting to order at 5:00 p.m.

PRESENT Mayor Gil Hurtado, Vice Mayor Maria Davila, Council Member Maria del Pilar Avalos, Council Member Joshua Barron and Council Member Al Rios; City Treasurer Jose De La Paz, City Manager Rob Houston, City Attorney Rail F. Salinas
WASTEWATER MGMT The City Council unanimously approved items A, B, C, D, E, F & G by motion of Vice Mayor Davila and seconded by Council Member Rios.
ROLL CALL: Council Member Avalos, yes; Council Member Rios, yes; Vice Mayor Davila, yes; Council Member Barron, recused; Mayor Hurtado, recused.
a. Agreement (Contract No. 2024-100-CC) with Sancon Technologies Inc., for the construction of the Sewer Pipeline Lining Improvements, City Project No. 709-SWR, in an amount not-to-exceed $2,143,727; b. Authorized the City Manager to administratively approve contract change orders up to a cumulative amount of $250,000 to avoid delaying construction when change order work is needed, which will be funded from project contingency funds;
c. Approved Change Order No. I to reduce the scope of work and $502,368 in cost, which cost reduction is in accordance with unit bid pricing, as necessary to complete the project within budget; d. Authorized the City Manager to approve pre-payments of construction progress payments to comply with State legislation that requires making payments within 30 days from receipt of an invoice; e. Approved Notice of Exemption for the Sewer Pipeline Lining and Improvements, City Project No. 709-SWR, pursuant to Title 14 of the California Code of Regulations, Section 15301 Class I of the California Environmental Quality Act ("CEQA");
f. Approved filing a Categorical Exclusion Checklist with the appropriate federal agency for the Sewer Pipeline Lining and Improvements, City Project No. 709-SWR, pursuant to the requirements of the National Environmental Policy Act ("NEPA"); and SPECIAL CITY COUNCIL MEETING MINUTES OF DECEMBER 10, 2024 g. Authorized the Mayor to execute the Agreement in a form acceptable to the City Attorney. r--
CLOSED SESSION The Council Members recessed into Closed Session at 5:22 p.m. and reconvened at 6:31 p.m. with all Members of Council present. City Attorney Salinas reported the following:
1. CONFERENCE WITH LEGAL COUNSEL - PENDING
LITIGATION
Pursuant to Government Code Section 54956.9(a),
54954.9(b)(3)(C)
a. Rosa Marquez v. City of South Gate, et al.
Item 1(a) is a new lawsuit. There was a presentation made by the City Attorney and upon completion of that presentation, there was a motion made by Vice Mayor Davila and seconded by Mayor Hurtado and on a vote of 5-0, authorized the City Attorney to represent the city in that matter.
2. CONSIDER THE EVALUATION OF PERFORMANCE OF A
PUBLIC EMPLOYEE
Pursuant to Government Code Section 54957 and 54957.6 a. City Manager

On item 2(a), the City Council received a presentation by the City Manager and at the end of that presentation there was no action taken by the City Council.
ADJOURNMENT Vice Mayor Davila unanimously adjourned the meeting at 6:34 p.m. and seconded by Council Member Avalos.
