CITY COUNCIL

For the Special Meeting of: January 28, 2025
Originating Department: Human Resources
Department Director:
on Hamilton o Houston
SUBJECT: CONSIDER ADOPTION OF RESOLUTION MAKING CERTAIN FINDINGS FOR AN EXCEPTION TO THE 180-DAY WAIT PERIOD PURSUANT TO CALIFORNIA GOVERNMENT CODE SECTIONS 7522.56 AND 21221
PURPOSE: The Pension Reform Act of 2012 prohibits employers from hiring retired aru'iuitants within 180 days of their retirement. However, subsequent legislation provides for an exception to the 180-day wait period under specific conditions, i.e., the California Public Employees' Retirement System (CalPERS) requires the City Council adopt a resolution to allow for an exception to the 180- day wait period to hire a retired employee for temporary, part-time employment during the wait period.
RECOMMENDED ACTION: The City Council is requested to consider adoption of a Resolution making certain findings that allow a recently retired Director of Finance to be hired for temporary, part-time employment with the City of South Gate cornmencing within the 1 80-day wait period from his retirement from tlie City of South Pasadena.
FISCAL IMPACT: The making of certain findings for an exception to the 180-day wait period will require no additional appropriations for Fiscal Year 2023/24 due to salai'y savings from the Director of Administrative Services and Deputy Director of Finance position being vacant in the Administrative Services Department. Tliese savings will be used to cover the salary cost for this retired aru'iuitant position.
ANALYSIS: None.
BACKGROUND: Certified Public Accountant John Downs (hereinafter "Downs") retired from the City of South Pasadena as its Director of Finance effective December 31, 2024, with approximately 30 years of experience in finance and accounting. He has extensive experience in municipal accounting and financing, as well as budget preparation and oversight.
On or aborit January 21, 2025, the City's Deputy Director of Finance announced her resignation to return to her previous employer and, on January 27, 2025, the City's Director of Administrative Services announced her resignation to pursue an opportunity elsewhere. As a result of these two resignations and tlie vacancy of the Budget & Finance Manager position, the Administrative Services Department will not have a functional manager. Accordingly, the City must hire retired annuitant Mr.
Downs as soon as possible into an Interim Director of Administrative Services to lead the 1 23
Administrative Services Department as the City recruits for a regular, peri'nanent Director of Administrative Services.
In addition to Mr. Downs functioning as the department's interim head and under the direction of the City Manager, he will also be assigned to chair the City's budget preparation for Fiscal Year 2025/26, which will include revenue projections and deteri'nination of fund balances for general and special funds. The budget process takes approximately four months to complete and will begin in March 2025.
While the City will be actively recruiting for the regular, perinanent Director of Administrative Services, Mr. Downs' experience as a finance director and his skills in SQL and Crystal Reports will greatly lielp in expediting the budget process and avoid the manual processes previously employed.
The budget document is handled by a manager or director, who also ensures the adopted document aligns with the organizational goals.
Mr. Downs has previous experience with the City of South Gate when he worked as a consultant approximately 10 years ago. At that time, Mr. Downs served as the functional Deputy Finance Director for almost four years, wherein he became familiar with the City's budgets, spending patterns, forecasting needs, and can identify cost-saving opportunities unique to the City. Because of his experience, he has the expertise prioritizing how resources and personnel should be allocated across different departments, projects, and/or initiatives. During the City's upcoming budget preparation cycle, it is crucial to have an individual with the skillset that Mr. Downs possesses to prioritize risk, discover efficiencies, and maintain open communication with the budget staff in finance, department heads, and other managers. Mr. Downs' leadership and technical ability will enable him to effectively manage the workload and processes of the Administrative Services Department staff in the final preparation of the budget.
As a result of the loss of two key persoru'iel due to resignation since January 21, 2025, who have been integral in the Administrative Service Department's budget preparation process, it is necessary to iminediately hire Mr. Downs as a retired annuitant in the position of Interim Director of Administrative Services to lead the department during the recruitment of the regular, pen'nanent Director of Administrative Services, and to perform special projects and work related to this budgetary process and other responsibilities of the department.
Pursuant to California Governtnent Code Fp 7522.56(b), "[a] retired person shall not serve, be employed by, or be employed through a contract directly by a public employer in the same public retirement system from which the retiree received the benefit without reinstatement from retirement, except as permitted by this section." California Government Code Fp 7522.56(c), then provides the following exception: "A retired person may serve without reinstatement or loss, or interniption of benefits provided by [CalPERS] upon appointment by the appointing power of a public employer either during an emergency to prevent stoppage of public business or because the retired person has specialized skills needed in performing work of a limited duration." California Government Code Fp 7522.56(f)(1) provides: "A retired person shall not be eligible to be employed pursuant to this section for a period of 180 days following the date of retirement unless... [t]he employer certifies the nature of the employment and the appointment is necessary to fill a critically needed position before 180 days have passed and the appointment has been approved by the governing body of the employer in a public meeting. The appointment may not be placed on the consent calendar." The City is currently recruiting to fill the Director of Administrative Service vacancy; however, Mr. Downs specialized skills are critically needed lead the Administrative Services Department and to prepare the budget in time for the next fiscal year and before 180 days have passed since his retirement from the City of South Pasadena. 2 24
His 30-year depth of knowledge and his personal contacts with all public agency and private entity stakeholders are vital and essential to the continued financial success. Additionally, Mr. Downs has not accepted a retirement incentive upon his retirement, which worild make him ineligible for this consideration as outlined in California Governrnent Code §7522.56(g).
Mr. Downs employment will be on a temporary, part-time basis and will remain at or below the 960 permitted hours per fiscal year a retired annuitant may work pursuant to Califoniia Goven'unent Code e) 7522.56(d). His specialized skills are needed to ensure there is no backlog of work as the budgetary process is completed and that any current special projects to which he can be assigned remain on schedule and without interniption. Once the City has hired a permanent incumbent to fill the vacant Director of Administrative Services position and Mr. Downs has been able to pass along any skills and/or knowledge necessary to transition all his duties to the new employee, his employment as a retired annuitant will no longer be necessary. It is anticipated that this process will last the duration of the current fiscal year and possibly continue into the 2025-2026 fiscal year.
Also, pursuant to Califoinia Government Code F> 7522.56(d), Mr. Downs pay may not exceed the maximum monthly base salary paid to other employees performing comparable duties as listed on a publicly available pay schedule equal to the hourly rate. The maximum base salary for the Director of Administrative Services is $18,765 and the hourly equivalent is $108.26. Therefore, Mr. Downs will be paid at the rate of $108.26/hour for duties performed as a retired annuitant in the capacity of the Interim Director of Administrative Services. The Department of Human Resources will add to the City's Salary Schedule the Interim Director of Administrative Services position paid at the hourly rate of the full-time equivalent position.
Accordingly, staff recoinmends the City Council adopt a Resolution making certain findings for an exception to the 180-day wait period pursuant to California Government Code 6§ 7522.56 & 21221.
