AGENDA BULL
SUBJECT: DISCUSSION OF REMOTE PARTICIPATION OPTIONS FOR CITY
COUNCIL AND COMMISSION MEETINGS
PURPOSE: This item was continued from January 28, 2025, City Council meeting. To present the City Council with information on virtual platform options for public participation at City Council and Commission meetings, including the costs involved and factors weighing in favor and against such use.
RECOMMENDED ACTION: Receive report and provide direction.
FISCAL IMPACT: Preliminary cost estimates for additional staffing are $12,180 per year with an annual Zoom subscription costing approximately $7,000 per year.
BACKGROUND: The City Council directed the City Manager to provide information detailing the costs and impacts of bringing back a call-in or virtual participation platform feature at City Council and Commission meetings.
Cornmencing in March 2020, amid implementation of COVID-19 restrictions, the Governor issued various executive orders relaxing in-person participation requirements under the Brown Act and permitting cities in California to provide remote features such as Zoom for public access and participation at public meetings. These temporary remote features were used by both members of the public and elected and appointed officials to attend meetings remotely. As COVID-19 restrictions were relaxed and eventually lifted, the Governor's executive orders ended, requiring cities to comply with pre-COVID-19 Brown Act requirements. Thus, the use of remote public participation platforms at public agency meetings became voluntary rather than mandatory, and somewhat extinct. In fact, most cities in the region have discontinued remote access and moved back to in person meetings like they existed prior to March 2020. In a review of Gateway Cities in our region, 28 of the 32 cities had returned to in-person public participation attendance. Only 4 have retained remote/zoom call-in features.
Anecdotally, there are several varied reasons why cities may have eliminated remote public participation platforms from public meetings. Among those reasons are cost related issues. Virtual 1 8
meetings, in wliich members of the public are in person and appear remotely, tend to consume more time. While there is a clear benefit to a coini'nunity member being able to participate remotely at apublic meeting, there is also a risk of abuse of technology platfon'ns by those wishing to disrupt or delay public agency proceedings. It is difficult to deteri'nine or limit a public speaker, having already coini'nented once, from subsequently calling back in under a different alias to provide additional coinrnents.
Other cities have simply balanced the interest of encouraging public participation by in person attendance against more anonymous and perhaps less transparent and respectful call-in or virtual attendance. Tliere are also balances that have compared the ease of participation against the added impact of requiring staff members to attend longer meetings, only to be expected to return the next day at 7 am to complete a 10-hour workday. Certainly, tlie trend among cities appears to be to return to pre-COVID 19 requirements under the Brown Act. Indeed, while the Legislature recently amended the Brown Act, those amendments did not require cities to continue providing remote access at public meetings.
As a furtlier sign of backing away from remote participation, recent amendments to the Brown Act under Assembly Bill 2302 have limited the ability of elected officials to attend city council meetings remotely. AB 2302 limits the use of remote features for City Council members to only certain circumstances, mostly health related, thus predominantly mandating in person attendance except in rare circumstances. For cities that meet two times per month City Council members shall not attend in a remote fashion more than a maximum of 5 times per year, The only exception is for emergencies. The Brown Act does not place similar restrictions on remote access as it pertains to the public.
Tlie City Council received information last year on retaining remote call-in features and deteimined they would cease providing remote access for comment. Instead, they invested in video equipment and added the live video feature to Council and Coininission meetings. Now that video equipment is installed, all City Council and Commission meetings are viewable online, both live and in recorded form.
A benefit of remote access for public comment using a Zoom or similar platform is that it provides a way for coinments to be received from public members who are not physically present or able to attend meetings. Currently, those who are unable to attend in person can still participate by sending corm'nents ahead of the meeting to be read into the record during tlie meeting. In this fashion, those not in attendance are treated in a material similar fashion as is they were in person.
As stated above, drawbacks of providing a Zoom or call-in feature include the cost of additional staffing that would need to be added to handle the calls or Zoom requests as the Clerk and Comi'nission assistants currently are fully tasked with existing duties that include supporting the meeting, timing comments, reading email comments, ensuring the video feed is operating correctly, and handling presentations. An estimate of additional labor costs is $12,180 for staffing to cover all Council and Comt'nission meetings. An additional cost if Zoom was to be used for remote access is the approximately $7,000 cost for a City Zoom license. 2 9
An additional drawback is due to problems that can occur with connectivity for either Zoom or a call-in feature if tlie system disconnects as l'ias happened numerous times when the City did use Zoom duiing the implementation of COVID 19 restrictions. If the system disconnects or audio issues occur this could constitute a situation where it could require the meeting to be stopped and possibly canceled ifthe public lost their ability to coi'nunentremotely, or if a public member feigned that tlie coini'nunication was lost.
Staff maintains that the current approach at the City strikes a sufficient balance between the need to conduct the city's business while still allowing for public comment. In fact, the City provides far more opportunity for the public to corni'nent on both agenda and non-agenda items that what is required under the Brown Act, or is pennitted in many other facilities. For example, the City does not limit the number of speakers or the aggregate time allocated for public cominent. It also does not require tlie public to fill out a card identifying the agenda item in advance upon which tlie public member wishes to comi'nent.
Staff seeks 'further guidance from the City Council on which direction to consider, namely whether to implement a remote participation option, or to keep its current practice in place without further change.

SUBJECT: PUBLIC HEARING TO RECEIVE PUBLIC INPUT ON COMMUNITY NEEDS AND GOALS FOR THE 2025-2029 COMMUNITY DEVELOPMENT BLOCK GRANT
CONSOLIDATED PLAN
PURPOSE: The United States Department of Housing and Urban Development ("HUD") requires that entitlement jurisdictions submit a Five-Year Consolidated Plan to HUD which outlines a five year plan for the use of Coinmunity Development Block Grant ("CDBG") and HOME Investment Partnership ("HOME") funds, an Annual Action Plan, which describes the annual goals and objectives to be met in a program year in relation to the Five-Year Consolidated Plan and a Consolidated Annual Perfornnance Evaluation Report ("CAPER"), which reports on the goals that were accomplished during the program year within the Consolidated Plan year.
RECOMMENDED ACTIONS: Conduct a public hearing to receive public input on community needs and potential goals for consideration as part of tlie development of the 2025-2029 Five-Year Consolidated Plan.
FISCAL IMPACT: The U.S. Department of Housing and Urban Development ("HUD") has not yet aru'iounced allocations for local jurisdictions. It is anticipated that the City of South Gate ("City") will receive approximately $6.2 million in CDBG entitlement funds, and approximately $2.8 million in HOME entitlement funds, from HUD for FY 2025-2029. The CDBG and HOME activities and some administrative costs will be funded solely by grant funds and will not impact on the General Fund.
NOTICING REQUIREMENT: Advertising and notification of the Public Hearing was conducted in compliance with Municipal Code Section 11.50.020 (Public Hearing Notification) and was published in The South Gate Press newspaper on January 30, 2025.
ANALYSIS: The Five-year Consolidated Plan ("CONPLAN") is a HUD required plan assessing affordable housing and community development needs for the next five-year 2025-2029 period. The CONPLAN determines how funds received from HUD will be used.

BACKGROUND: The City is considered an entitlement jurisdiction and receives an annual allocation from HUD for tl'ie operations of its CDBG and HOME programs. The funding is deten'nined by a formula calculated by HUD based on population, age of the city, poverty levels, etc. The City's allocation can fluctuate year-to-year causing funding to increase or decrease in various programs.
As a recipient of the federal funds, the City is required to submit a five-year Consolidated Plan, an Aru'iual Action Plan, and monitor its progress, outcomes, and expenditures through the Consolidated Annual Perfon'nance and Evaluation Report ("CAPER").
The purpose of the CONPLAN is to identify the City's housing and c.ommrinity development needs, priorities, goals, and strategies and to stipulate how funds will be allocated to housing and comi'nunity development activities over the next five (5) years. The CDBG Program provides Federal funds for local improvement projects and programs. Activities assisted with CDBG funds must meet one of the three (3) national objectives:
Benefit low and moderate-income persons; or
Aid in the elimination of slum and blight; or
Meet a particular urgent community need because existing conditions pose a serious threat, and no other source of funds is available. This national objective is rare and is designated only for activities that alleviate emergency conditions, e.g., fire, flood, earthquake.
The HOME program provides formula grants, o'Jien in partnership with local nonprofit groups, to fund a wide range of activities including building, buying, and/or rehabilitating affordable housing or providing direct rental assistance to low-income persons. HOME is the largest Federal Block Grant to State and Local Governinents designed exclusively to create affordable housing for low-income households.
2 15
NEXT STEPS IN THE PROCESS: HUD requires two public hearings during the development of the Consolidated Plan. The first public hearing taking place today will receive input from the public on coininunity needs and potential goals for consideration in the development of the five-year Consolidated Plan. After receiving input, the drafts of the Consolidated Plans and Annual Action Plan will be finalized for review. The City is required to conduct a 30-day coiuinent period and hold a second public hearing to adopt the five-year Consolidated Plan and additional reports. FY 2025/2026 Ai'inual Action Plan will be considered as part of the CONPLAN. Following City Council adoption, the five-year Consolidated Plan, 2025/2026 Ai'inual Action Plan will be submitted to HUD.

CITY COUNCIL
AGENDA BI[LL
For the Regular Meeting o'f: February 11, 2025
Originating Department: Human Resources
Humatx Resources Director:
Hamilton Rob Houston
SUBJECT: RESOLUTION TO APPROVE AND ADOPT AN UPDATED
CONSOLIDATED SALARY SCHEDULE FOR ALL FULL-TIME EMPLOYEES, PART -
TIME EMPLOYEES, AND ELECTED OFFICIALS WITHIN CALPERS GUIDELINES PURPOSE: To approve and adopt an updated consolidated pay schedule for all full-time, part- time, and elected officials within the California Public Employee Retirement System (CalPERS) guidelines.
RECOMMENDED ACTION: The City Council will consider adopting a Resolution approving and adopting an updated consolidated pay schedule for all full-time, part-time, and elected officials within the CalPERS guidelines.
FISCAL IMPACT: There is no fiscal impact to the Fiscal Year 2024-2025 Adopted Budget.
ANALYSIS: None,
BACKGROUND: During the course of the current fiscal year, there have been several pay adjustments resulting from labor agreements, state law mandates, contract negotiations, and reevaluations of pay, the latest of which was the finalization of the City Manager's contract and the addition of hourly wage rates for the two interim director positions. The attached consolidated salary schedule reflects all changes made to employees' salaries and wages since the begii'ining of Fiscal Year 2024/25.
Furtlier, CalPERS, pursuant to its interpretation of the California Code of Regulations Fp 570.5 of the Public Employees' Retirement Law (PERL), as outlined in its January 8, 2020 Circular Letter, recommends that all CalPERS employers maintain their compensation levels in one publicly available document, approved and adopted by the governing body, which must meet all of the following criteria:
1) Hasbeendulyapprovedandadoptedbytheemployer'sgoverningbodyinaccordancewith the requirements of applicable public meetings laws; 2) Identifies the position title for every employee position; 3) Shows the pay rate for each identified position, which may be stated as a single amount or 1 23
as multiple amounts within a range;
4) Indicates the time base, including, but not limited to, whether tlie time base is hourly, daily, bi-weekly, monthly, bi-monthly, or aru'iually;
5) Is posted at the office of the employer or iininediately accessible and available for public review from the employer during normal business hours or posed on the employer's internet website;
6) Indicates an effective date and date of any revisions; 7) Is retained by the employer and available for public inspection for not less than five years; and
8) Does not reference another document in lieu of disclosing the pay rate.
Under the PERL and the Public Employees' Pension Reform Act of 2013 (PEPRA), compensation earnable and pensionable compensation are determined in accordance with the amounts identified on a publicly available pay schedule as adopted and approved by the City Council. If an employer were to fail to meet with requirements of Section 570.5 as stated above, the CalPERS Board may determine at its sole discretion an amount that will be considered as a pay rate in determining what a retiree's earnable income will be, which will never be higher than the amount stated on the comprehensive salary schedule. As a result, publicly available pay schedules are required by CalPERS and are a critical component to verify all members' pay rates when calculating members' retirement benefits. Finally, maintaining a compliant publicly available pay schedule will support transparency and expedite CalPERS' review process. Failure to provide CalPERS with a compliant publicly available pay schedule may result in a retirement benefit being delayed and/or reduced.
Therefore, the purpose of approving this resolution is to update the current Consolidated Salary Schedule to reflect the changes as authorized by the City Council in this agenda item and to comply with the PERL.

PURPOSE: To award an agreement to Golden Coast Construction, Inc., ("Golden Coast") for the construction of 9923 San Luis Avenue Parking Lot Improvements ("Project").

BACKGROUND: The City of South Gate ("City") operates public parking lots that serve the Tweedy Mile District. One of these parking lots is located at 9923 San Luis Ave, behind the Ziegler Property. The parking lot has been providing parking for the general public for many years. However, the City recently discovered that part of this parking lot is situated on private property. As part of a settlement agreement with Ziegler, the City is required to convert this portion of the public parking lot into a private parking lot.
The project aims to construct a private parking lot, including the removal of the existing landscaped island, relocation of parking lot lights, and installation of fencing, signage, and striping, ensuring the necessary improvements to properly provide a functional and well- designed parking lot for the property owner.
In December 2024, staff advertised the Notice Inviting Bids for construction in the Daily Journal and on Planet bids. On January 9, 2025, the City held a bid opening in the City Clerk's Office.
Twelve (12) bids were received ranging from $105,168 to $312,825.

SUBJECT: APPROVAL OF ARTICLES OF AGREEMENT, CALIFORNIA WATER/WASTEWATER AGENCY RESPONSE NETWORK WARN 2007 0MNIBUS MUTUAL ASSISTANCE AGREEMENT (CalWARN) FOR MUTUAL AID
ASSIST ANCE DURING AN EMERGENCY
PURPOSE: To enter into the CalWARN 2007 0mnibus Mutual Assistance Agreement, enabling the City of South Gate ("City") to join a statewide mutual aid network for assistance during water system emergencies.
RECOMMENDED ACTIONS: The City Council will consider:
a. Approving the Articles of Agreement for the California Water/Wastewater Agency Response Network (CalWARN) 2007 0mnibus Mutual Assistance Agreement to participate in mutual aid support during emergency situations affecting the City's water system; and
b. Authorizing the Mayor to execute the Agreement in a form acceptable to the City Attorney.
FISCAL IMPACT: There is no fiscal impact to the General Fund. Joining CalWARN is free of charge with no annual membership fees. All costs incurred in providing or receiving assistance will be reimbursed by the requesting party.
ANALYSIS: By participating in CalWARN, the City will strengthen its ability to manage unexpected events and improve the resilience of its water system. The CalWARN Agreement creates a standardized, cooperative mechanism for water and wastewater utilities to share resources, personnel, equipment, and expertise during emergencies. Membership in CalWARN means committing to provide mutual aid on a voluntary basis, adhering to established protocols and reimbursement processes. The mutual aid framework ensures reimbursement for any support the City provides, while the City covers the costs when requesting assistance.
CalWARN has a membership of over 500 water and wastewater utilities across California.
Surrounding the City, several member agencies participate in CalWARN, including the Los Angeles County Public Works Water District, Los Angeles Department of Water and Power, and cities such as Downey, Vernon, Whittier and Lakewood. These nearby participants enhance the I
68 City's ability to secure rapid and coordinated support in the event of a water-related emergency, ensuring access to critical resources and expertise within the immediate region.
BACKGROUND: The City of South Gate operates a reliable and extensive water system serving approximately ninety percent of the City's residential, commercial, and industrial properties. The system includes multiple wells, storage tanks, and a network of distribution pipes. As part of our proactive approach, the City evaluates potential risks and vulnerabilities to the water system to ensure it is prepared for any emergencies that may arise. In 2020, the Public Works Department conducted a risk and resilience assessment of the water systems to meet the America's Water Infrastructure Act (AWIA) requirement. To be better prepared in an emergency, one of the recornrnendations from the assessment was for the City to 3oin CalWARN.
CalWARN was formed to support public and private water and wastewater utilities, facilitate statewide emergency preparedness, disaster response, and mutual assistance processes. By joining CalWARN, the City will gain access to a robust network of utilities ready to provide resources such as personnel, equipment, and materials in the event of an emergency. CalWARN provides members with the following:
* Emergency Resource Sharing: A standardized agreement that allows utilities to share resources, including persoru'iel and equipment, during emergencies. @ Statewide Network: Provides access to mutual aid from a wide network of utilities, including those in Los Angeles County (Attachment C), enhancing the City's emergency capabilities.
* Reimbursement and Legal Protections: Includes provisions for indemnification, workers' compensation, and cost reimbursement, ensuring protection and financial accountability for participating utilities.
@ Compliance with SEMS and NIMS: Aligns with California's Standardized Emergency Management System (SEMS) and National Incident Management System (NIMS), ensuring smooth integration with other emergency management programs and FEMA reimbursement eligibility.
* Networking and Preparedness: Facilitates ongoing relationships and preparedness through a centralized forum of emergency contacts, resources, and best practices from prior disasters.
Given the benefits, including enhanced emergency preparedness, resource sharing, and financial protections, staff recommend that the City Council approve the CalWARN Agreement.

WHEREAS, the CALIFORNIA WATER/WASTEWATER AGENCY RESPONSE NETWORK ("CalWARN") 2007 0MNIBUS MUTUAL ASSISTANCE AGREEMENT is a continuation of the WARN 1996 0MNIBUS MUTUAL AID and 2001 0MNIBUS MUTUAL AID AGREEMENT and sets forth the mutual covenants and agreements for water and wastewater agencies to provide mutual assistance to one another in times of emergency; and
WHEREAS, State OES regulates the SEMS program, and this agreement is consistent with SEMS, and that it is necessary to have a mutual assistance agreement in place to support requests to FEMA for costs of using assistance during an emergency, and WHEREAS, the water or wastewater agency hereto has determined that it would be in its best interests to enter into an agreement that implements that plan and sets forth procedures and the responsibilities of the agency whenever emergency personnel, equipment and facility assistance are provided from one agency to the other; and
WHEREAS, no water or wastewater agency should be in a position of unreasonably using its own resources, facilities, or services providing such mutual assistance; and WHEREAS, it is the intent of WARN to revise this agreement as necessary and to annually publish a list of all water and wastewater agencies participating in this agreement, as posted on www.calwarn.org; and WHEREAS, such an agreement is in accord with the California Emergency Services Act set forth in Title 2, Division 1, Chapter 7 (Section 8550 et seq.) of the Government Code and specifically with Articles 14 and 17 (Section 8630 et seq.) of the Act.
[The remainder of this page leff blank intentionally] 79 NOW, THEREFORE, in consideration of the conditions and covenants contained therein, the (Utility)
