SUBJECT: CONSTRUCTION OF A 150-FOOT-HIGH FLAGPOLE AT 2323

FIRESTONE BOULEVARD AND FINDING THAT THIS IS NOT SUBJECT TO THE CALIFORNIA ENVIRONMENT AL QUALITY ACT (PL25-0292)

PROJECT PROPOSAL/REQUEST
Request to construct a 150-foot-high flagpole displaying a 30-foot-high by 50-foot-wide United States flag in the front portion of a property located at 2323 Firestone Boulevard. The property is zoned Industrial Flex ("IF") and developed as a campus containing the corporate office and sales center for Frameless Hardware Company ("FHC").

Property Owner: 2323 Firestone Holdings LLC
Agent/Representative: Chris Hanstad
General Plan Designation: Industrial; South Gate College District, Subarea 1 Proiect Location: 2323 Firestone Boulevard
Assessor's Parcel Numbers: 6204-034-002
Lot Size: 19.32 acres
RECOMMENDED ACTION: The City Council will consider:
a. Adopting a Resolution approving a 150-foot-high flagpole at 2323 Firestone Boulevard; and
b. Finding the project categorically exempt from California Environmental Quality Act ("CEQA") review under Section 15311 (Class 11) of the CEQA Guidelines because the project is for the placement of an accessory structure such as a flagpole on an existing industrial facility.

ENVIRONMENT AL ANALYSIS
The project is categorically exempt from CEQA under Section 15311 (Class 11) of the CEQA Guidelines because the project is for the placement of an accessory structure such as a flagpole at a developed industrial property.
1 8

BACKGROUND
In December 2024, the Community Development Department approved tenant improvement plans for new office space, landscaping, parking configuration, and other site improvements for use by FHC as its corporate office and sales center. In July 2025, the City of South Gate ("City") issued a certificate of occupancy for the main building. Accessory structures in the rear are pending street improvements and other conditions.

Project Overview
c. SiteCharacteristics:Thesubjectpropertyisl9.32acresandcomprisedofoneirregular-shaped parcel having frontage on Firestone Boulevard to the south. The property is developed with several industrial buildings. The main building is located in front of the property (southern portion of the property) with office spaces fronting the street. There is a parking lot in front of the building and a block and wrought-iron fence along the street. d. Surroundings: Surrounding properties include a rail line owned by Southern Pacific Transportation Company to the north and west, and further northwest is Alameda Engle Properties. The East Los Angeles College ("ELAC") campus is to the east. The Alarneda Corridor is to the southwest (properties owned by the cities of Los Angeles and Long Beach), and further west is Alameda Street. To the south, across Firestone Boulevard, is the Westbrook Academy operated by LA Promise Fund.
2 9
e. ProposedProiect:Theapplicantproposesal50-foot-highflagpoleinthefrontwesterncorner of the property. The proposed flagpole is identical to the flagpole at Shultz Steel Co. located three miles east at 5321 Firestone Boulevard near the I-710 Freeway.

The footing will be four feet in diameter, and the above-ground base will be two feet in diameter. The pole becomes thinner toward the top where it will be approximately six inches in diameter. Only a 30-foot-tall by 50-foot-long USA flag will be flown.

The proposed flagpole is meant to be a landmark on the western side of the City similar to the Shultz Steel Co. flagpole to the east. According to the applicant, the Shultz flagpole is 150 feet tall. The proposed flagpole will take up two parking spaces and be located in a new landscaped area. The flagpole will be behind the existing fence and located 17 feet from the edge of the public sidewalk to the south, and 13 feet from the western property line.

The proposed flagpole will not interfere with the Americans with Disabilities Act ("ADA") path-of-travel located in the area. The landscaped area will be irrigated and maintained, and no trees will be removed. There is an abandoned water well in the area, but it will not be disturbed during installation of the flagpole.

ANALYSIS
The proposed flagpole was presented to staff a'Jter tenant improvements were approved for the new office space, landscaping, parking configuration, and other site improvements. The applicant is 4 11
currently working on street improvements and other conditions to finalize the remaining buildings in the rear of the property. The proposed flagpole will require removal of two approved parking spaces that will need to be relocated. However, when the City approved the parking configuration in December 2024, the property was required to have 725 parking spaces and provided 735 spaces.

Thus, there are 10 additional spaces provided, andthe loss oftwo spaces will not cause a significant impact. Striping of the parking spaces is about 90 percent complete.

Currently, FHC is not operating at :tull capacity and expects to expand business operations in the fiiture. Thus, the parking currently provided is more than adequate for existing operations.

Ultimate buildout of the parking configuration as shown on the approved site plan will occur as needed.

Development Standards:

Proposals for flagpoles over 100 feet high are unique and not covered in the Zoning Code.

Although the proposed project is subject to the development and design standards of Section

11.22.060, Table 11.22-IF, there are no specific standards for flagpoles. As such, the Community Development Director may use discretion in interpreting standards or deferring the action to the Planning Commission or City Council.

Rear Yard N/A
Side Yard, Interior 0 ft. 13 ft.

Height/Stories 55 'Ji./5 stories 150 ft. Height meant for buildings Development and design standards are intended to promote quality and orderly development in the City. Per Section 11.30.030 of the South Gate Municipal Code, standards may be adjusted by the Community Development Director as an administrative modification. At the Director's discretion, a modification deemed to be significant or major may be recommended to the Planning Cornrnission or City Council for review and action. The proposed 150-foot-high flagpole is a unique request meant to be a landmark in the City. Since it will be a prominent structure affecting the appearance of the community, it is appropriate for the City Council to take action.

CONCLUSION
Based on the above analysis, staff recommends City Council consider the design, height, and location and approve the flagpole as proposed.

PROGRAM
PURPOSE: To approve Amendment No. l to Contract No. 2022-63-CC ("Amendment No. 1") with John L. Hunter and Associates, Inc., to extend management services for the National Pollutant Discharge Elimination System Program, from August 8, 2025, through August 7, 2026.

RECOMMENDED ACTIONS: The City Council will consider:

Authorizing the Mayor to execute Amendment No. 1 in a form acceptable to the City Attorney.

FISCALIMPACT: John L. Hunter and Associates, Inc., provides specialty management services of the NPDES Program under Contract No. 2022-63-CC. The Department of Public Works manages this program with technical support from John L.

Hunter and Associates, a firm with the expertise needed to meet the permit's complex compliance requirements. Their continued assistance is critical to maintaining compliance and protecting local waterways.

SUBJECT: AMENDMENT N0. 1 TO CONTRACT N0. 2023-125-CC WITH Z&K CONSULTANTS, INC., TO EXTEND CONSTRUCTION MANAGEMENT AND

INSPECTION SERVICES FOR THE CIRCLE PARK IMPROVEMENT, CITY PROJECT NO. 609-PRK
PURPOSE: To approve Amendment No. 1 to Contract No. 2023-125-CC ("Amendment No. 1") with Z&K Consultants, Inc., to provide additional construction management and inspection services for the Circle Park Improvement Project, and extending the contract term through September 30, 2025, through construction completion.

RECOMMENDED ACTIONS: The City Council will consider:
a. Approving Amendment No. 1 to Contract No. 2023-125-CC with Z&K Consultants, Inc. ("Agreement"), to extend the contract term through September 30, 2025, in order to provide construction management and inspection services through construction completion of the Circle Park Improvement, City Project No. 609-PRK, in an amount not to exceed $99,875; and
b. Authorizing the Mayor to execute Amendment No. 1 in a form acceptable to the City Attorney.

FISCAIi IMPACT: There is no fiscal impact to the General Fund. Amendment No. 1 to the Agreement is in the amount of $99,875, and it will be funded with Rendon Funds/Natural Resources Agency Grant Funds ("Rendon Funds"), as summarized below.

Total Costs $150,000 $377,675 $30,006 $99,875 $657,556 *LACRPOSD (Los Angeles County legional Park and Open Space District) ANALYSIS: Construction of the Circle Park Improvement Project ("Project") is ongoing and is now anticipated to reach final completion in September 2025. The work is administered under the Agreement with Z&K Consultants, Inc., approved on August 22, 2023, in the amount of $557,681 1 42
to provide construction management, inspection, and related support services. At that time, project completion was estimated forMarch 31, 2025, in alignment with the construction contract awarded on August 13, 2024. The construction contract included both a 132-day early completion incentive (March 31, 2025) and a 165-working-day schedule with a final completion date ofMay 15, 2025.

Construction coinrnenced on September 16, 2024; however, the contractor was unable to meet either the original or accelerated schedule due to performance issues and required coordination with utility companies. The schedule was further extended by the City of South Gate ("City") to address unforeseen site conditions and additional work. Project completion is now anticipated by September 30, 2025.

These delays and schedule extensions significantly increased the demand on Z&K Consultants for construction management, office engineering, labor compliance, NPDES compliance, and material testing. Additional services included responding to RFIs, reviewing submittals, revising plans, managing material delays, and accommodating City-directed changes. As a result, the original contract budget was fully expended by June 30, 2025, after 198 working days, although services are still required through project closeout.

To maintain construction oversight through September 30, 2025, Amendment No. 1 to the Agreement provides an additional $99,875 to fund continued construction management and inspection services for approximately 64 working days.

It is noted that construction delays caused by the contractor are subject to liquidated damages. The contract includes provisions that allow the City to charge the contractor a set amount per day of delay to recover City-incurred costs, including additional construction management and inspection services. On July 17, 2025, staff has formally placed the contractor on notice regarding the City's intent to enforce liquidated damages. The final amount of damages will be determined upon completion of the construction. To reiterate, Z&K Consultants is the City's consultant responsible for overseeing the project and enforcing the construction contract, however, they are not the construction contractor.

BACKGROUND: The Circle Park Improvement Project is part of the City's Capital Improvement Program ("CIP") and is designed to modernize the park with new recreational amenities, expand community activities, and improve residents' quality of life. Planned improvements include a new playground, synthetic turf, sand and water play area, basketball, Pickleball, and Futsal courts, shade structures, new irrigation and landscaping, decomposed granite walkways, permeable pavers, park benches and picnic tables, safety lighting, and other park features.

On August 22, 2023, the City Council approved the Agreement with Z&K Consultants, Inc., for $557,681 to provide constniction management and inspection services. Construction began on September 16, 2024, with an anticipated completion date of March 31, 2025.

Due to contractor delays, unforeseen site conditions, and City-authorized additional work, the project schedule has been extended, and final completion is now anticipated by September 30, 2 43
2025. The original contract funding was fully expended by June 30, 2025, after 198 working days, primarily due to the increased demand for construction management, inspection, labor compliance, and administrative support.

Amendment No. I to the Agreement provides an additional $99,875 to fund 64 additional working days of services necessary to oversee construction through construction completion anticipated completion date of September 31, 2025, and project closeout.

AGENDA BULL
Department Director:

For the Regular Meeting of August 12, 2025
Department: Public Works
e-rvantes
J21UA
Rob Houston
SUBJECT: AMENDMENT NO. l TO CONTRACT N0. 2024-57-CC WITH GANNETT FLEMING, INC., FOR CONSTRUCTION MANAGEMENT AND INSPECTION

SERVICES FOR THE CONSTRUCTION OF THE TWEEDY MILE COMPLETE STREETS PROJECT, CITY PROJECT NO. 614-ST, FEDERAL PROJECT NO. ATPL- 5257 (039)
PURPOSE: To approve Amendment No. 1 to Contract No. 2024-57-CC ("Amendment No. 1") with Gannett Fleming, Inc. ("Gannett Fleming") to provide additional construction management and inspection services for the Tweedy Mile Complete Streets Project, extending services through the anticipated construction completion in September 2025.

RECOMMENDED ACTIONS: The City Council will consider:
a. Approving Amendment No. 1 to Contract No. 2024-57-CC with Gannett Fleming, Inc. ("Agreement"), to provide 20 days of additional construction management and inspection services through the completion of construction for the Tweedy Mile Complete Streets Project, City Project No. 614-ST, Federal Project No. ATPL-5257(039), in an amount not to exceed $69,155; and
b. Authorizing the Mayor to execute Amendment No. I in a form acceptable to the City Attorney.

FISCAL IMPACT: There is no fiscal impact to the General Fund. Amendment No. 1 to the Agreement is in the amount of $69,155. It will be funded in Prop C Funds. The revised contract amount is $621,055.

ANALYSIS: Construction of the Tweedy Mile Complete Streets Project ("Project") is now substantially complete and progressing toward full closeout, anticipated in September 2025. Under the Agreement, Gannett Fleming was authorized to provide construction management and inspection services based on a 180-working-day schedule. However, as the project advanced, unforeseen site conditions and added construction activities required an additional 20 working days of oversight beyond the original scope.

The schedule extension is supported by key scope changes, including: (a) removal of additional concrete adjacent to gutters to properly install new asphalt pavement; (b) removal of decorative 1 49
pavers at all crosswalks and replacement with asphalt pavement; and (c) redesign and restriping of crosswalks from standard to high-visibility markings. These changes increased the level of inspection, coordination, and administration needed through project completion.

To accomt'nodate the extended construction schedule, Amendment No. I to the Agreement provides an additional $69,155 for 20 additional working days of construction management, inspection, administration, and labor compliance services, extending the total contract duration to 200 working days. This amendment funds continued oversight of remaining project activities through final closeout in September 2025.

BACKGRO{JND: The Project was designed to improve safety, traffic circulation, landscaping, greening, and beautification along Tweedy Boulevard, 'from Dearbom Avenue to Dorothy Avenue.

Construction is now substantially complete, with the improvements delivering enhanced safety, better access to public transit and bicycle facilities, deferred maintenance upgrades, and overall quality of life enhancements. Key project elements include roadway pavement rehabilitation; sidewalk and ADA ramp improvements; enhanced crosswalks, including four with flashing lights; traffic calming features such as curb extensions, mid-block bulbouts, and upgraded signage; as well as new street furniture, upgraded bus stops, landscaping, sharrows, bike racks, and bollards.

On July 9, 2024, the City Council approved the Agreement with Gannett Fleming for construction management and inspection services related to the Project. The approved contract amount was $551,900, based on a construction schedule of 180 working days.

Following the start of construction activities, additional work was required to complete the Project.

This included unforeseen removals, the construction of additional asphalt concrete pavement, and the restriping of all crosswalks with a high-visibility design. These changes were outside the original project scope and beyond the control of Gannett Fleming, whose role was to administer the construction contract, not to perform the construction work itself.

As a result of the added scope, the construction schedule was extended by 20 working days, increasing the total duration from the original 180 working days to 200 working days. These additional days were not accounted for in the original construction management contract. As such, Amendment No. 1 to the Agreement provides an additional $69,155 to cover the extended 20 working days of services.

Construction began on August 26, 2024, and is scheduled for final completion in September 2025.

Construction Agreement - $100,860
Change Order No. l $31,732
Change Order No. 2 $49,722
Total $182,314
ANALYSIS: Pursuant to the California Public Contract Code, the City of South Gate ("City") must comply with specific requirements before issuing final payment on a construction contract.

In accordance with Section 7107 of the Public Contract Code, the City must first formally accept the completed work and issue a Notice of Completion before releasing the final retention payment.

The Notice of Completion serves as a formal declaration that all work under the contract has been completed. It also initiates the statutory period during which subcontractors, suppliers, and other interested parties may assert any remaining lien claims against the project. During this '- period, the City retains the right to withhold all or a portion of the retention payment to satisfy 1 55
any valid claims.

With construction now complete, staff recommends that the City Council approve the Notice of Completion, thereby initiating the process to release the final payment in accordance with applicable law.

BACKGROUND: The City's roadway network includes over 125 miles of streets, many of which feature pavement legends and crosswalks installed using thermoplastic material. To improve visibility and enhance pedestrian safety, particularly near schools, the City recently completed construction of the subject Project to restripe yellow crosswalks and pavement markings adjacent to school sites.

On May 23, 2023, the City Council approved Contract No. 2023-66-CC with the Contractor in the amount of $100,860 for the construction of the Project. After construction was completed, on September 28, 2023, Change Order No. l was administratively approved to adjust contract quantities and fund the actual work performed in the field. This action was taken in accordance with South Gate Municipal Code Section 1.54.610 (Approval of Modifications and Change Orders), Chapter 1.54 (Purchasing System and Bidding Rules), Title 1 (Administration and Personnel).

Construction of the initial phase began on July 31, 2023, and was completed on August 24, 2023.

Due to cost savings realized during this phase, a second change order was proposed to extend striping improvements to additional school-adjacent streets. On May 27, 2025, the City Council approved Change Order No. 2 to utilize the remaining project funds for tis purpose. The additional work included the restriping of crosswalks and pavement markings along State Street, California Avenue, and Southern Avenue. This work was completed between June 5 and June 9, 2025.

With construction now complete, refreshed pavement markings and enhanced safety measures have been implemented in school zones throughout the City. The final construction contract amount, inclusive of Change Orders No. l and No. 2, is $182,314.

Work was performed in accordance with the approved specifications with acceptable quality and workmanship within budget and time. The contractor has met all the contract obligations.

The City Council may now accept the Project as complete. The Notice of Completion can now be filed with the Los Angeles County Registrar Recorder's Office.

CITY COUNCIL
AG-ENJDA JBT[LL
Department Head:

Rob Houston
For the Regular Meeting ofi August 12, 2025
Originating Department: Parks & Recreation
/21
SUBJECT: ALLOCATE FUNDING FROM THE PARK ENHANCEMENT FUND FOR

REPAIRS TO CITY-OWNED BATTING CAGES
PURPOSE: To allocate funding for batting cage repairs at South Gate Park RECOMMENDED ACTION: The City Council will consider allocating funding in the amount of $22,500 from the Park Enhancement Fund Account No. 271-490-61-0000 for the repairs to the batting cages located at South Gate Park.

FISCAL IMPACT: Funding for these repairs was not allocated in the FY 25/26 budget, so staff is requesting the funds come from the Park Enhancement Fund Account No. 271-490-61-0000. This fund was initially set up for these types of repairs.

ANALYSIS: The City of South Gate ("City") has a Management Agreement with SoFive Soccer Center to operate the batting cages at South Gate Park. From time-to-time major repairs are needed at the facility and the City and Sofive split the cost accordingly. Overall cost for the current repairs is $76,995.21. The City's cost is just $22,500. This allocation will cover our portion of the repairs.

BACKGROUND: The Parks & Recreation Department and SoFive ("Goals") have been in a Public/Private partnership for over 15+ years that has truly benefited the residents of South Gate.

While providing a much-needed resource for the residents of 12 five a side or seven a side fields that are heavily used by the residents of the community, they have also been a good community partner with the department, providing soccer clinics to the youth, allowing Special Olympics athletes to use the fields for tournaments and assisting with sponsorship for several events.

In addition to operating the soccer center, SoFive also manages the City's batting cages at the park, this added benefit allows us to provide a practice facility that would have cost us thousands of dollars in general funds to maintain and operate. Recently, the operation has received several upgrades including a phone-based app to operate the cages along with new netting, work on the pitching machines and other maintenance needs. All this at a cost of over $76,995 to Goals with the City just paying a little over $22,500

SUBJECT: CITY'S LEGISLATIVE PLATFORM FOR 2025
PURPOSE: To review and approve the City's Legislative Platform for 2025.

RECOMMENDED ACTION: The City Council will consider adopting the City's 2025 Legislative Platform containing the City's state and federal legislative priorities.

FISCAL IMPACT: None.

ANALYSIS: The purpose of the Legislative Platform is to provide a means for surnmarizing the City of South Gate's ("City") core legislative principles for the purpose of advocacy efforts at the regional, state, and federal levels. The 2025 Legislative Platform was developed using the goals and objectives of the City Council, a review of legislative priorities from the League of California Cities and California Contract Cities Association, and input from the City Manager. Many of the priorities included in the Legislative Platform are continued from previous years.

New items added for 2025 include: 1.) Supporting legislation for water quality improvements through the development and implementation of projects and programs that help mitigate PFAS in the groundwater and 2.) Seek funding for PFAS Removal Treatment Systems to ensure safe drinking water and compliance with emerging regulations.

BACKGROUND: The 2025 Legislative Platform sets forth the City's legislative priorities for the 2025 legislative session and provides direction for the City's state and federal lobbyists. The City recognizes the need for an active state and federal legislative program to protect the City's interests in Sacramento and Washington, D.C. As a result, the City contracts a state and a federal lobbyist firm, Joe A. Gonsalves & Son and Kiley and Associates, LLC, respectively, to provide their expertise in state and federal legislative advocacy analyses. They both help the City monitor and track state and federal grants; lobby the various legislative and administrative departments within the state and federal governance on the City's priorities; prepare and secure letters of support; identify oppo rtunities to showcase the City's achievements and challenges before state and federal jurisdictional bodies; provide legislative updates and a variety of resources and assistance.

Approval of the 2025 Legislative Platform also streamlines the City's process and allows City 'staff to effectively respond and take immediate action on pressing legislation under City Council direction. 1 75

CITY COUNCIL
AGENDA BaILL
For the Regular Meeting of: August 12, 2025
Originating Department: Community Development
Item No. 8
Department Director: Ciff Manager:

Rob Houston
SUBJECT: APPROPRIATE GRANT

BLOCK GRANT FOR PUBLIC

REVITALIZATION PROGRAM

FUNDING FROM COMMUNITY DEVELOPMENT

SERVICE GRANTS AND NEIGHBORHOOD
PURPOSE: To appropriate grant funding from Community Development Block Grant ("CDBG") Program for Public Service Grants and Neighborhood Revitalization Grant Program.

RECOMMENDED ACTIONS: The City Council will consider appropriating grant funds in the amount of $333,057 from Community Development Block Grant ("CDBG") to fund the Public Service Grants and Neighborhood Revitalization Grant Program.

FISCAl IMPACT: At the April 25, 2023, City Council meeting, Council approved, through Resolution, the adoption of the FY 2023-2024 Annual Action Plan for the CDBG Program funding for the Neighborhood Revitalization Grant Program, (Acct.:243-634-49-6648) needs to be appropriated for FY 2024-2025. At the April 9, 2024, City Council meeting, Council approved, through Resolution, the adoption of the FY 2024-2025 Annual Action Plan for the CDBG Program funding for Public Service Grants, (Acct.:243-634-49-6677) funds were not appropriated at the time. This action allocates funds for the Public Service Grants and there is no fiscal impact on the City of South Gate's ("City") General Fund.

ANALYSIS: Per H{JD regulations, the City is required to carry out its CDBG program in a timely manner.

As required by 24 CFR 570.902 of the CDBG regulations, H'[JD reviews the City for compliance with these requirements, staffproposes to appropriate $21,343 of CDBG funds to meet its obligations and issue payments to the approved non-profit organization funded under Public Service Grants activities and to appropriate $311,714 to issue payment to the contractors for the projects completed under the Neighborhood Revitalization Program.

BACKGROUND: The City of South Gate has been a recipient of CDBG funds annually since the enactment of the Housing and Community Development Act of 1974. The City is deemed as an "entitlement" jurisdiction because it maintains a population above 50,000 and meets certain other demographic criteria. CDBG 'funding can be used for a variety of projects and programs primarily benefiting persons of low-and moderate-income.
