Because no detailed inspection was made, and because such knowledge goes beyond the scope of this appraisal, any comments on observed conditions given in this appraisal report should not be taken as a guarantee that a problem does not exist. Specifically, no guarantee is given as to the adequacy or condition of the foundation, roof, exterior walls, interior walls, floors, heating systems, air conditioning systems, plumbing, electrical service, insulation, or any other detailed construction matters. If any interested party is concerned about the existence, condition, or adequacy of any particular item, we would strongly suggest that a mechanical and/or structural inspection be made by a qualified and licensed contractor, a civil or structural engineer, an architect or other experts. This appraisal report is based on the assumption that there are no hidden, unapparent or apparent conditions on the property or improvements which would materially alter the value as reported. No responsibility is assumed for any such conditions or for any expertise or engineering to discover them. All mechanical components are assumed to be in operable condition and standard for the properties of the subject type.

Conditions of heating, cooling, ventilating, electrical and plumbing equipment are considered to be commensurate with the condition of the balance of the improvements unless otherwise stated.

No judgment is made in the appraisal as to the adequacy of insulation, the type of insulation, or the energy efficiency of the improvements or equipment which is assumed to be standard for the subject's age, type and condition.

TOXIC MATERIALS AND HAZARDS
Unless otherwise stated in the appraisal report, no attempt has been made to identify or report the presence of any potentially toxic materials and/or condition such as asbestos, urea formaldehyde foam insulation, PCBs, any form of toxic waste, polychlorinated biphenyl, pesticides, lead-based paints or soils or ground water contamination on any land or improvements described in the appraisal report. Before committing funds to any property, it is strongly advised that appropriate experts be employed to inspect both land and improvements for the existence of such potentially toxic materials and/or conditions. If any potentially toxic materials and/or conditions are present on the property, the value of the property may be adversely affected and a reappraisal at an additional cost may be necessary to estimate the effects of such circumstances.

SOILS, SUB-SOILS, AND POTENTIAL HAZARDS
It is assumed that there are no hidden or unapparent conditions of the soils or subsoil which would render the subject property more or less valuable than reported in the appraisal. No engineering or percolation tests were made and no liability is assumed for soil conditions. Unless otherwise noted, the land and the soil in the area being appraised appeared to be firm, but no investigation has been made to determine whether or not any detrimental sub-soil conditions exist. Neither the appraiser(s) nor the appraisal firm is liable for any problems arising from soil conditions. These appraisers strongly advise that, before any funds are committed to a property, the advice of appropriate experts be sought.

An Agent for the Federal Flood Insurance Program should be contacted to determine the actual need for flood hazard insurance.

DOLLAR VALUES AND PURCHASING POWER
The estimated market value set forth in the appraisal report and any cost figures utilized are applicable only as of the date of valuation of the appraisal report. All dollar amounts are based on the purchasing power and price of the dollar as of the date of value estimates.

ROUNDING
Some figures presented in this report were generated using computer models that make calculations based on numbers carried out to three or more decimal places. In the interest of simplicity, most numbers have been rounded. Thus, these figures may be subject to small rounding errors.

QUANTITATIVE ANALYSIS
Although this analysis employs various mathematical calculations to provide value indications, the final estimate is subjective and may be influenced by my experience and other factors not specifically set forth in this report.

VALUE CHANGE, DYNAMIC MARKET, ALTERATION OF ESTIMATE BY

APPRAISER
All values shown in the appraisal report are projections based on my analysis as of the date of valuation of the appraisal. These values may not be valid in other time periods or as conditions change. Projected mathematical models set forth in the appraisal are based on estimates and assumptions which are inherently subject to uncertainty and variations related to exposure, time, promotional effort, terms, motivation, and other conditions. The appraiser(s) does not represent these models as indicative of results that will actually be achieved. The value estimates consider the productivity and relative attractiveness of a property only as of the date of valuation set forth in the report.

In cases of appraisals involving the capitalization of income benefits, the estimate of market value, investment value or value in use is a reflection of such benefits and of the appraiser's interpretation of income, yields and other factors derived from general and specific client and market information. Such estimates are as of the date of valuation of the report, and are subject to change as market conditions change.

This appraisal is an estimate of value based on analysis of information known to us at the time the appraisal was made. The appraiser(s) does not assume any responsibility for incorrect analysis because of incorrect or incomplete information. If new information of significance comes to light, the value given in this report is subject to change without notice. The appraisal report itself and the value estimates set forth therein are subject to change if either the physical or legal entity or the terms of financing are different from what is set forth in the report. 339

In the case of proposed construction, the appraisal is subject to change upon inspection of the property after construction is completed. Unless otherwise stated, the assumption is made that all improvements and/or repairs have been completed according to the plans and that the property is operating at levels projected in the report.

MANAGEMENT OF PROPERTY

Council Agenda Report May 20, 2025 Page 1 of 4
City of South Lake Tahoe
Report to City Council
Meeting Date: May 20, 2025
Title: Contract Award with All-American Construction, South Tahoe Public Utility District Funding Acceptance for In-Lieu Fee Reimbursements and the 2025 Road Rehabilitation and Drainage Replacement Project, and Amendment No. 1 to Agreement with Lumos and Associates
Location: Citywide
Responsible Staff Members: Stephen Anderjack, Project Manager, and Brianna Greenlaw, Associate Civil Engineer
Background: The Public Works Department assembles an annual paving project to maintain the City’s roadway network. The 2025 Road Rehabilitation project will be in the Herbert/Walkup neighborhood to repair the streets trenched by STPUD’s water and sewer replacements. Public Works staff assessed the storm drain infrastructure on the streets to be paved and found repairs needed before paving. Repairs to stormwater infrastructure need to be completed before paving to avoid excavation after paving, so all necessary stormwater infrastructure repairs have been included in the bid package for the contractor to complete before paving.

The drainage items (besides Aloha Basin) incorporated into the project were designed by Lumos and Associates.

In addition, a portion of the Upper Bijou Park Creek Project, Aloha Basin, has been incorporated into this project because it would involve trenching across Herbert Ave, a street to be paved on this project.

The inclusion of this project will remove the need to trench Herbert Ave in the future.

Issue and Discussion: On March 31, 2025, the Public Works Department advertised the 2025 Road Rehabilitation and Drainage Replacement Project bid on the City PlanetBids website. The Project Notice to Bidders was also advertised in the Tahoe Daily Tribune per Public Contract Code requirements and the City’s Main Website.
408 bidders were notified on PlanetBids and 12 prospective bidders downloaded the documents. The Project bidding period closed on April 22, 2025 at 1:00 pm.

Public Works received four sealed bids, which were publicly opened and read aloud at the scheduled bid opening at the City Public Works Building. All-American Construction, Inc. was determined to be the lowest responsible and responsive bidder, with a Total Bid (Base Bid + bid alts 1-7) of $5,165,471.00. The Engineer’s Estimate for the bid was $7,261,523.95.

The bid results are as follows (Base Bid Amounts):
349
Council Agenda Report May 20, 2025 Page 2 of 4

Qual-Con $5,531,856.00
Steimpel-Wiebelhaus Associates, Inc. $7,978,269.00
The apparent low bidder, All American Construction, Inc’s Base Bid and Bid Alt Pricing is Shown in the table below:

Description Price
Base Bid Paving and Drainage Items – Walkup Rd., Herbert Ave. (South), Red Lake Rd., Aloha Rd., Hobart Rd.
$2,400,696.25

The Public Works Department is recommending to award the Base Bid, and Bid Alts 1, 2, 6, and 7. Bid Alt 1 consists of full depth paving and drainage items on Woodland Rd. Bid Alt 2 consists of full depth paving and drainage items on North Herbert Ave. Bid Alt 6 consists of full depth paving and drainage items on Warr Rd. Bid Alt 7 consists of the construction of the Aloha Basin, a portion of the Upper Bijou Park Creek Project. The paving items on the contract will be funded by the Road Maintenance and Rehabilitation Account (RMRA SB-1), City Measure S Funds, and Utility In Lieu Fees. The drainage items of work will be funded from the Drainage Pipe Replacement account.

In addition to the 2025 Road Rehabilitation Project, the Public Works Department is continuing to fund the Tahoe Valley Stormwater and Greenbelt Improvement Project, Phase I, and the Pioneer Trail Pedestrian Improvement Project, Phase II. These funds have been approved as part of a separate Council actions on April 22, 2025 and May 6, 2025 respectively.

This paving portion of this project and has been designed by Easten Sierra Engineering and will include a 4” Asphalt section on top of 8” of Aggregate Base. This will provide a new wearing course as well as rebuild the structural integrity of each of the roadways. The city will also utilize a polymer modified binder oil in our asphalt, which provides additional flexibility and resiliency in harsh mountain climates.

The Public Works Department is also recommending the award of Amendment 1 (C-XXX-2025) to Lumos PSA for design services (C-004-2025). The construction assistance scope of this amendment covers submittal review, RFI review, CCO reviews, and record drawings. The total (not to exceed) cost of this amendment is $7,480, which brings the total contract value to $67,330. These services will be paid from the Drainage Pipe Replacement Account.

Financial Implications: The lowest responsive, responsible bid received for this project is AllAmerican Construction, Inc., with a Base Bid of $2,400,696.25. With Bid Alt 1, 2, 6, and 7 included, the total contract value will be $4,033,731.00.

The total expected expense for this project is listed in the table below:

Expense Description Amount
All-American Construction, Inc. (Base Bid + Bid Alt 1, 2, 6, 7) $4,033,731.00
10% Construction Contingency $403,373.10
On Site Construction Inspecting $65,000.00
Materials Testing $40,000.00
Labor Compliance Oversite $4,000.00
TOTAL ANTICIPATED EXPENSES $4,546,104.10
The City has on-call contracts with Black Eagle Consulting, Inc. for On Site Inspecting and Material Testing, and Willdan Engineering for Labor compliance services.

The currently available budget in the Street Overlay Program Account (301-50005-48030) is $4,128,208.10.

STPUD has also approved two reimbursement agreements to supplement the funding of this project.

The Herbert/Walkup In Lieu Fee Reimbursement is the STPUD’s payment to the City in lieu of paving the roads affected by utility trenching on their project. The total reimbursement for this work is $319,416.00. The second reimbursement agreement for this project is the 2025 Road Rehabilitation Reimbursement Agreement. This reimbursement agreement compensates the City for the STPUD utility access adjustments that are needed during paving. The 2025 Road Rehab Reimbursement Agreement is valued at $137,250 but may be less due to final payment quantities. The Public Works Department is recommending acceptance of both STPUD Reimbursements for this project.

The Aloha Basin items and other road related drainage items incorporated into the project will be paid from the Drainage Pipe Replacement Account 301-40049-48030. The anticipated drainage item cost total is $395,411.50.

The additional amount of $7,480 for Amendment 1 to Lumos PSA will be paid from the Drainage Pipe Replacement Account (301-40049-48030).

Environmental Considerations: This project is considered roadway rehabilitation and will not extend the boundaries of the existing roadways. As such, the project is exempt from Tahoe Regional Planning Agency (TRPA) permits and the California Environmental Quality Act (CEQA) under CEQA Guidelines section 15301(c) (Existing Facilities). All applicable best management practices will be utilized to protect air and water quality during construction.

The Planning Commission adopted the Initial Study/Mitigated Negative Declaration for the Upper Bijou Park Creek Project on November 19, 2020, and on May 16, 2024, the Planning Commission adopted 351
Council Agenda Report May 20, 2025 Page 4 of 4
an addendum to the CEQA Initial Study/Mitigated Negative Declaration. This action does not require additional review under CEQA Guidelines section 15162.

Policy Implications: The City Council has included Street Rehabilitation as one of their Strategic Priorities and Goals in their 2021-2026 Strategic Plan. This project will help accomplish the City Council’s objective as well as provide adequate roadways for all to use. 352

____________________________________________________________________________ ____________________________________________________________________________ pursuant to the said Agreement dated __________________,20__, and all of the documents attached thereto and incorporated by reference, becoming a part of said Agreement, are hereby referred to and made a part hereof; and,
WHEREAS, said Principal is required according to the terms of said Agreement and applicable California State law, to furnish a Bond for the faithful Performance of said Agreement.

NOW, THEREFORE, we, the Principal and ____________________________________ as Surety, are held and firmly bound unto the City of South Lake Tahoe in the penal sum of:
___________________________Dollars ($________________), lawful money of the United States of America, for the payment of which sum well and truly to be made, we bind ourselves, our heirs, executors, administrators, successors and assigns, jointly and severally, firmly by these presents.

THE CONDITION OF THIS OBLIGATION IS SUCH, that if the above bounden Principal, Principal’s heirs, executors, administrators, successors or assigns, shall in all things stand to and abide by, and well and truly keep and faithfully perform the covenants, conditions and agreements in the said Agreement and any alterations made as therein provided, on the Principal’s part, to be kept and performed at the time and in the manner therein specified, and in all respects according to their true intent and meaning, and shall indemnify and save harmless the City of South Lake Tahoe, its employees, council members and agents, as therein stipulated, then this obligation shall be null and void; otherwise it shall be and remain in full force and effect.

If the City of South Lake Tahoe shall provide notice that it considers the Principal to be in default, Surety, upon receipt of such written notice, shall, within thirty (30) days, conduct any and all investigations that it deems necessary and appropriate to perform. Surety agrees to do so in order to be in a position to respond timely and efficiently, with the best interests of the overall completion of the Project as the primary goal, and without detriment to the Project or the City of South Lake Tahoe, should the City of South Lake Tahoe elect to exercise its right to terminate the Principal’s right to proceed due to default. 372

Page 69 ends

If the City of South Lake Tahoe issues a written notice of termination for default, Surety shall, within fifteen (15) calendar days, tender a written program to City of South Lake Tahoe which comprehensively details Surety’s proposed completing contractor, its personnel and the manner in which the Surety will immediately honor its performance bond obligations. The time for completion of the Project shall not be extended as a result of the notice to the Surety, the election by City of South Lake Tahoe to terminate Principal’s right to proceed for default, and/or the time it takes Surety to act as required hereunder.

Surety agrees that in responding to any such notice of default of its Principal, Surety shall not be entitled to tender as its completion contractor the Principal or any entity owned, controlled or affiliated with Principal. The response by Surety to City of South Lake Tahoe shall include whether the Surety intends to use the key project personnel of Principal as part of the staff of the Completing Contractor, and the consent by City of South Lake Tahoe of the right to use some, any or all of those proposed individuals shall be at the sole and absolute discretion of the City of South Lake Tahoe. No claim shall be made arising from the good faith exercise by City of South Lake Tahoe of the discretion denying any such request.

As a condition precedent to the satisfactory completion of the said Agreement, the above obligation shall hold good for the maximum period of time allowed by applicable law (including all statutes of limitation or repose) and commensurate with the obligations owed by the Principal to the City of South Lake Tahoe, during which time, if the Principal, Principal’s heirs, executors, administrators, successors or assigns shall fail to make full, complete and satisfactory repair and replacements or totally protect the City of South Lake Tahoe from loss or damage made evident during said period, the above obligation shall be and remain in full force and effect.

The terms and conditions of the Agreement between the Principal and the City of South Lake Tahoe are expressly incorporated into this Performance Bond as though set forth in full.
