Regular-Unfinished Business
Requested Action / Suggested Motions: Pass a Resolution authorizing exchange and bargain sale agreement and joint escrow instructions with the California Tahoe Conservancy, to exchange 180.5 acres of City-owned property adjacent to Trout Creek and Cold Creek and on Link Road (APNs 025-061-037, 025-081-013, 025-091-012, 080-010-013, 080020-008, 031-030-020, and 031-030- 039) for 7.1 acres of Conservancy-owned property near El Dorado Beach, various City water quality projects, Al Tahoe Pioneer Cemetery, Lake Tahoe Airport, and Tahoe Island Drive (APNs 027-010- 016, -024, and -029, 027-073-005, 027-074-006, 027-112013, -014, -015, -016, -017, and -024, 027-134-022, 027-053-014, 031-173-002, and -004, 026-065016, 032-090-013, and 023-686-016).
CEQA Determination: The proposed exchange of land does not constitute an approval of a project pursuant to CEQA Guidelines Sections 15004 and 15352 because it does not commit the agency to a definite course of action regarding a project to be carried out. The exchange of land does not involve a change to, or an intensification of, the existing use or purpose, and is not a project defined by CEQA Section 15378[a].

Requested Action / Suggested Motions: Staff recommend the City Council pass a Motion directing staff to 1. Add the demolition of the former Recreation and Swim Complex to the Capital Improvement Program project list for FY2026-27 at an estimated cost of $2.1 million; and 2. Enter into discussions with El Dorado County, TRPA and the South Lake Tahoe Boys and Girls Club about possible new construction of an indoor athletic complex on the 56-acre parcel site.
CEQA Determination: Maintaining the former Recreation and Swim Complex in operation in the short term is categorically exempt from the California Environmental Quality Act (“CEQAâ€) under CEQA Guidelines 15301 (Existing Facilities). However, keeping it in operation indefinitely likely would require an update to the Mitigated Negative Declaration for the 56 Acres Master Plan, adopted by City Council on January 18, 2022. Demolition of the former Recreation and Swim Complex is exempt from the California Environmental Quality Act (“CEQAâ€) because it is considered a ministerial act requiring a City issued permit. If a new recreational facility were to be constructed at the former site of the Former Recreation and Swim Complex, it would be subject to an environmental review under the California Environmental Quality Act (“CEQAâ€).

CEQA Determination: The proposed Housing Element is consistent with the 2030 General Plan and directly implements several of the General Plan policies and the proposed ordinance is consistent with and implements the 2022 – 2027 Housing Element, which is an integral part of the General Plan. The 2030 General Plan EIR adequately addresses the potential environmental impacts of the proposed Housing Element. The General Plan EIR is available on the City website at:
