CITY OF ST. HELENA
RESOLUTION NO. 2023-
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ST.

HELENA ADOPTING THE COMPREHENSIVE USER FEE STUDY

REPORT AND ADOPTING A COMPREHENSIVE MASTER FEE

SCHEDULE ESTABLISHING AND AMENDING CERTAIN USER
FEES FOR CITY SERVICES.

RECITALS
A. State law permits the City to impose service fees for certain City services, as long as those fees do not exceed the estimated reasonable costs of providing the service for which the fee was intended; and
B. The City entered into a Professional Services Agreement with Willdan Financial Services to determine the full costs incurred by the City to support the various activities for which the City charges user fees (“User Fee Study”); and
C. The results of the study helped the City to better understand the true costs associated with the services provided and served as a basis for making informed policy decisions regarding recommendations for appropriate fees; and
D. Based on the User Fee Study, Willdan Financial Services and City staff developed a proposed City of St. Helena User Fee Schedule (“Master Fee Schedule”); and
E. Pursuant to Government Code Section 66016 the specific fees to be charged for services must be adopted by the City Council by Resolution, after providing notice and holding a public hearing; and
F. A public notice was published on October 7, 2023 in the Napa Valley Register. The proposed fee schedule, data indicating the amount of cost, or estimated cost, required to provide the service for which the fee or service charges are levied was made available for public review; and G. Pursuant to California Government Code Section 6062, a general explanation of the hereinafter contained schedule of fees and charges has been published as required; and
H. All requirements of California Government Code Section 66016 are hereby found to have been complied with.

City of St Helena
Comprehensive User Fee Study
October 24, 2023
Agenda Item #11.2.

Page 1124 of 1137 ends

2 What are User Fees?
 User Fees fund programs and services that
provide private benefit to individuals
requesting them, with limited or no
benefit to the community as
a whole
 State Law requires that 1) individual use of
the service must be voluntary, and 2) fees
must reasonably relate to the services
provided
Agenda Item #11.2.

Page 1125 of 1137 ends

3 What is
a User Fee Study?
 Primary goal of
a User Fee Study is to determine the
“reasonable” full cost of providing services
 Each fee or service’s cost is calculated individually Develop fully burdened hourly rates for personnel • Salary
& Benefit cost divided by billable hours
• Layer on direct and indirect overhead as applicable to the position’s department and services provided
 Up to 100% of the full cost may be recovered The City may decide to set fees lower than full cost Agenda Item #11.2.

Page 1126 of 1137 ends

4 Objectives of User Fee Study
 Develop
a rational basis for setting fees
 Understand total costs of providing services Identify subsidy amounts, if applicable Identify appropriate fee adjustments that enhance fairness and equity
 Maintain consistency with local policy and
objectives, and compliance with state law
 Develop updatable, comprehensive list of fees
Agenda Item #11.2.

11 Building Permit Fee Program
 The City currently uses valuation to
determine the cost of permits.
 Current cost recovery is at 52.4%
A suggested fee increase of 50% would bring
the cost recovery to 78.6%

13 Policy Considerations
 General standard: individuals or groups who receive private benefit from service should pay 100% of reasonable cost  In certain situations, subsidization is an effective public policy tool:
• Encourage participation
• Ensure compliance when cost is prohibitive to residents • Allow access to services
 Recommended that City include an annual inflation factor which will allow City Council by resolution to annually adjust fees based on CPI or another factor
