REIMBURSEMENT – TRAVEL EXPENSES
A-35 California Fire and Rescue Mutual Aid System Agencies seeking reimbursement for travel expenses such as fuel, food/meals, per diem, or lodging responding to, during, or returning from a State of California or Federal Fire Agency incident will be at the per diem and lodging rates specified in Exhibits “H” and “G”.

Travel arrangements and reimbursement, including travel for relieving personnel and backfill, will only be made from the Fire Department/Agency location or residence, whichever is closest to the incident or reporting location (such as staging).

REIMBURSEMENT – PERSONNEL ROTATION
A-36 When California Fire and Rescue Mutual Aid System Agency personnel are committed to extended assignments under this Agreement, there may be a need to rotate and replace personnel.

Personnel under this Agreement are expected to be available a minimum of seven (7) days (elapsed time) excluding travel before needing replacement, regardless of the number of assignments from original dispatch.

A-37 Expenses that are reimbursable are limited to personnel costs and transportation costs.

Reimbursement for personnel will be in accordance with general personnel reimbursement provisions of this Agreement. Specific personnel rotation procedures are outlined in Exhibit “C”.

INCIDENT OFF-SHIFT REST AND SLEEPING ACCOMODATIONS
A-38 The responsible State of California or Federal Fire Agency will provide, when practical, sanitary, shaded, and/or climatically maintained accommodations for off-shift sleeping, rest, and recuperation for local jurisdiction resources confined to the incident base. If the incident command finds it operationally feasible (e.g., strike team remains available) to place local jurisdiction resourcesin a commercial sleeping accommodation, it may be provided.

REIMBURSEMENT – STATE OF CALIFORNIA, FEDERAL, DOD,

AND TRIBAL FIRE DEPARTMENTS

Tribal Fire Departments that have a compacted or contracted wildland fire program with BIA will respond through the federal dispatching system and not through the California Fire and Rescue Mutual Aid System.

Reimbursement of Federal Fire Departments, DOD, and Tribal Fire Departments that respond to CAL FIRE, local government, and Cal OES incidents will be in accordance with the Agreement reimbursement provisions.

Reimbursement of Federal Fire Departments, DOD, and Tribal Fire Departments that respond to Federal Fire Agency fires are governed by other federal agreements. In these cases, Cal OES will not produce or process reimbursement invoices for Federal Fire Departments and DOD. Federal Fire Departments and DOD Fire Departments ordered through other agreements will invoice the supported Federal Fire Agency directly in accordance with existing federal and local agreements.

Reimbursement of Tribal Fire Departments that respond to a Federal Fire Agencies order and request through this Agreement and have a current Cooperative Agreement with BIA will be in accordance with the CFAA reimbursement provisions. Cal OES will generate an invoice based on the federal order and request. Once the Tribal Fire Department reviews, signs and returns the invoice to Cal OES, Cal OES will process to BIA for payment.

Federal Fire Agencies will not reimburse Federal Fire Departments and DOD under this Agreement.

REQUESTING REIMBURSEMENT
A-40 The Mutual Aid Reimbursement System (MARS) provides a web-based application that will be managed by Cal OES and utilized by all fire agencies that respond under the California Mutual Aid System. The intent of the program is to make reimbursement under this Agreement housed under one platform that is easily accessible to Cal OES, the paying entities, and the local government agencies. All pertinent documents should be submitted through MARS. For further instruction on how to use MARS, visit the Cal OES webpage.

A-41 California Fire and Rescue Mutual Aid System Agencies will prepare an OES F-42 and supporting documentation at the incident, which is the basis for reimbursement due and invoice preparation. A web-based application to complete these electronic forms is provided by Cal OES Fire and Rescue Division. The OES F-42 must be signed by a responsible officer of the jurisdiction seeking reimbursement and by the State of California or Federal Fire Agency Incident Command to verify that the resources requested on the OES F-42 were authorized by the ordering agency and is the initial step for invoice processing. The completed OES F-42 is forwarded to Cal OES Fire and Rescue Division Headquarters for processing. The OES F-42 should be reviewed and/or submitted to the Cal OES Fire Agency Representative at the incident, if assigned.

The OES F-42 should be SUBMITTED DIRECTLY TO THE CAL OES FIRE AND

RESCUE DIVISION BY THE CALIFORNIA FIRE AND RESCUE MUTUAL AID

SYSTEM AGENCY AT THE TIME OF RELEASE FROM THE INCIDENT. IF NOT SUBMITTED AT THE INCIDENT THROUGH MARS, THE OES F-42 MUST BE SUBMITTED WITHIN THIRTY (30) CALENDAR DAYS OF RELEASE FROM THE INCIDENT OR PAYMENT WILL BE DELAYED.

A-42 Within sixty (60) calendar days of receipt of the OES F-42, Cal OES Fire and Rescue Division will process the OES F-42 data into an invoice(s) (F-142) and return to the California Fire and Rescue Mutual Aid System Agency for verification of billing amounts and signature. THERE WILL BE A DELAY IN PAYMENT FOR INVOICES (F-142) NOT RETURNED TO CAL OES FIRE AND RESCUE DIVISION WITHIN THIRTY (30) CALENDAR DAYS OF RECEIPT FOR VERIFICATION OF BILLING AMOUNTS AND SIGNATURE.

A-43 Upon return receipt and verification of the invoice (F-142) by the California Fire and Rescue Mutual Aid System Agency, the Cal OES Fire and Rescue Division will forward the CFAA Reimbursement Invoice (OES F-142) to the appropriate State of California or Federal Fire Agency within thirty (30) calendar days, along with a copy of the OES F-42 as the source document. Inquiries from the State of California and Federal Fire Agencies regarding amounts billed will first be addressed to Cal OES Fire and Rescue Division as soon as possible, as the first step in a joint resolution process.

A-44 The State of California or Federal Fire Agency will remit payment to the California Fire and Rescue Mutual Aid System Agency within sixty (60) calendar days of receipt of the OES F-142 from Cal OES.

A-45 In the event that CAL FIRE or a Federal Fire Agency identifies a discrepancy with an OES F-142, Cal OES will provide the California Fire and Rescue Mutual Aid System Agency a new invoice with the corrected invoice amount and the reason for the change. Cal OES has thirty (30) calendar days to make the change and provide a corrected invoice to the California Fire and Rescue Mutual Aid System Agency and either CAL FIRE or the appropriate Federal Fire Agency.

A-46 CAL FIRE and the Federal Fire Agencies will provide copies of payment schedules to Cal OES every thirty (30) days for invoices paid to the California Fire and Rescue Mutual Aid System Agencies. Cal OES Fire and Rescue Division will reconcile the payment schedules against outstanding OES F-142(s) on a monthly basis.

A-47 Cal OES will form and chair working groups with membership from the Committee to develop methodologies to streamline the reimbursement process.

The State of California and Federal Fire Agencies will work on procedures to improve reimbursement efficiencies and timelines. These activities will be documented and shared with the California Fire and Rescue Mutual Aid System Agencies.

A-48 The Terms and Conditions and Exhibits in this Agreement may necessitate new methods of reporting and invoicing. All proposed changes to this Agreement, or associated business processes shall be approved by the State of California and Federal Fire Agencies that are partiesto this Agreement.

A-49 Reimbursement for emergency apparatus and personnel shall be made directly to the California Fire and Rescue Mutual Aid Agency providing the resource, and NOT to individuals.

A-50 The OES F-42 shall be used as the basis for personnel and equipment calculations. The resource order form of record shall not be used for reimbursing personnel and equipment costs.

Federal Fire Agency Electronic Fund Transfer
A-51 Federal Fire Agencies require the following for reimbursement to California Fire and Rescue Mutual Aid System Agencies:

1. Taxpayer Identification Number (TIN). This number is applied for and issued by the Internal Revenue Service (IRS). Contact the IRS at www.irs.gov or (800) 772-1213.

2. Electronic Funds Transfer (EFT). The cooperator shall designate a financial institution or an authorized payment agent through which a federal payment may be made in accordance with US Treasury Regulations, Money, and Finance at 31 CFR 208, which requires that federal payments are to be made by EFT to the maximum extent possible. A waiver may be requested, and payments received by check by certifying in writing that one of the following situations apply:
a. The payment recipient does not have an account at a financial institution. b. EFT creates a financial hardship because direct deposit will cost the payment recipient more than receiving the check.
c. The payment recipient has a physical or mental disability, or a geographic language or literacy barrier.

In order to receive EFT payments, the recipient/cooperator shall register in the System for Award Management (SAM).

3. Unique Entity Identifier (UEI). The cooperator shall obtain a Unique Entity Identifier (UEI).

This is a requirement for registering in SAM. The UEI replaces the DUNS number but does not replace existing numbers, such as Employer Identification Number (EIN), the Tax Identification Number (TIN), and State Application Identifier (SAI) numbers that are required by statute, Executive Order, or regulation. You may obtain a free UEI number via the web at

Clauses A-36 and A-37 authorize the reimbursement of personnel and transportation costs incurred to replace California Fire and Rescue Mutual Aid System Agency personnel committed to extended assignments under this Agreement. Personnel under this Agreement are to be available a minimum of seven (7) days excluding travel (portal-to-portal) before needing replacement, regardless of the number of assignments. This exhibit lists the procedures necessary for a local jurisdiction to follow before reimbursement for their costs will be processed for rotation of their personnel. These procedures only apply when the emergency apparatus remains assigned to the incident, but the personnel are rotated. The procedures are:

C-1 The Incident Commander (IC) or Mobilization (MOB) center manager to which the resources are assigned must approve the personnel rotation and method of transportation. Such approval should not be denied without substantial cause (e.g., imminent planned release (24 – 36 hours) of the resources) or a negotiated extension through the Cal OES Fire Agency Representative. The personnel rotation and transportation plan must be coordinated through the incident, the ordering point, agency representative, and/or the overhead responsible for the personnel to be rotated.

C-2 The approved personnel rotation will be documented in:

C-2.1 The approved automated resource ordering system of record. The resource order will be annotated in the documentation section by the incident indicating the date and time of personnel rotation approval. Subsequently the home unit/filling command center will add documentation to include the following information:

C-2.1.1 Method/Mode, date and time of transportation.

C-2.1.2 An ICS General Message Form-213/Rotation Job Aid Template designed specifically for personnel rotation must be signed by the IC or MOB center manager approving the rotation. This form shall be attached to the respective OES F-42 associated with the rotation vehicle and overlapping time of personnel.

C-2.2 OES F-42
C-2.2.1 Box 12 of the OES F-42 will document any personnel rotation with the date and time of the rotation for all individuals whether or not the personnel rotation will be reimbursed.

C-2.2.2 ONLY when a fire agency is requesting reimbursement for an approved personnel rotation that includes transportation cost will it be required to document the rotation in an OES FEXHIBIT “C”

D-1 It shall be the responsibility of the agency sending mutual aid resources to ensure that those resources have adequate communications capabilities. Adequate communications capability is defined as VHF Highband radios with a minimum of 240 channels and pre-programmed with the most current FIRESCOPE STATEWIDE FREQUENCY CHANNEL PLAN. Effective January 1, 2024, radios will be required to have a minimum capacity of 400 channels with a recommended minimum of 500 channels.

D-2 Emergency apparatus used for mutual aid will have a mobile VHF Highband radio (powered by the emergency apparatus battery and connected to an external antenna) and a minimum of one portable VHF Highband radio. The VHF Highband portable radio should be capable of being operated by alkaline batteries.

D-3 Strike Team/Task Force Leaders: In addition to the communications capability required for emergency apparatus, line personnel are encouraged to respond with a conventional 800 MHz radio pre-programmed with the 800 MHz mutual aid channels as identified in FIRESCOPE STATEWIDE FREQUENCY CHANNEL PLAN.

D-4 For Narrowband Radios: On January 1, 2013, all public safety and business industrial land mobile radio systems operating in the 150-512 MHz radio bands must cease operating using 25 kHz efficiency technology and begin operating using at least 12.5 kHz efficiency technology. This deadline is the result of an FCC effort that began almost two decades ago to ensure more efficient use of the spectrum and greater spectrum access for public safety and non-public safety users.

Migration to 12.5 kHz efficiency technology (once referred to as Refarming, but now referred to as Narrowbanding) will allow the creation of additional channel capacity within the same radio spectrum and support more users.

Agenda Report to the City Council
Agenda Section: PUBLIC HEARINGS
Department: Public Works Department
DATE: September 22, 2026
FROM: Mario Traverso, Project Manager
SUBJECT: Approval of a Reimbursement Agreement with Nicca Holding for the Sulphur Springs Sewer Extension.

RECOMMENDED
ACTION:

Approve the Resolution

PREVIOUS COUNCIL
ACTION:

None

STATEMENT OF THE
PURPOSE:

The purpose of this request is to consider a Resolution approving a Reimbursement Agreement with the Financing Parties for the extension of sanitary sewer service on Sulphur Springs Avenue in accordance with the provisions of SHMC section 13.20.050.

FINANCIAL IMPACT: None
CEQA DETERMINATION: Statutory Exemption; Installation of a new pipeline, less than 1 mile in length in public right-of-way.

BACKGROUND:

Currently, City of St. Helena sewer infrastructure and sewer service is only available on Sulphur Springs Avenue between Highway 29 and Rosebud Lane, which is approximately 357' of the 2600' length of Sulphur Springs Avenue from Highway 29 and South Crane Avenue. All parcels west of Rosebud Lane utilize onsite wastewater treatment systems (e.g. septic tank/leach field sytem) to manage and treat wastewater. Many current development projects on Sulphur Springs Avenue are dependent on the future availability of municipal sewer service and have proceeded with a privately financed initiative to extend the sewer infrastructure and service from Rosebud Lane to 1766 Sulphur Springs Avenue, or roughly 2000' from its current location.

DISCUSSION:

The provisions for sewer extensions and an associated reimbursement agreement are detailed in Section 13.20.050 "Special Extension Prorate Charge" of the St. Helena Municipal Code.

Under this provision, the financing party of a sewer extension enters into an agreement with the City who collects a prorated fee from benefited properties as they connect to the new

Page 190 of 242 ends

sewer facility and then distributes the prorated fee to the financing party. The fee is determined by a depreciating calculation of the overall project cost and the linear footage of the frontage of the benefited property. The benefited properties that will be subject to the prorated fee are described in Attachment A in the attached agreement packet. The final project cost and resulting prorated fee will be finalized prior to agreement execution. A notice was sent to the proposed affected properties in November 2025, which detailed the developers' intent to install new sewer and the implications for the benefited properties. A second notice was sent 30 days prior to the Public Hearing in conformance with Section

13.20.050. The Public Works Department and City Staff have worked closely with the developer throughout the process and approved the project plans, the projected costs and the list of benefited properties.

THIS REIMBURSEMENT AGREEMENT (the “Agreement”) is made and entered into this ______day of ______________, 2026, by and between NICCA HOLDINGS LLC (“NH”),

MING HING KWOK, SZEKAY SHING, THE JAVE FAMILY LIMITED PARTNERSHIP (collectively the “Financing Parties”), at 60 Hunter Ranch Rd, Napa, CA 94558, and the CITY OF ST. HELENA, a California Municipal Corporation (“City” and collectively with “Financing Parties,” the “Parties”).

RECITALS
A. NH is the owner of real property in the City, located at 1516 Sulphur Springs Ave., City of St. Helena, Napa County, Assessor’s Parcels Number 009-362-018. NH is the also owner of 1766 Sulphur Springs Ave., City of St. Helena, Napa County, Assessor’s Parcels Number 009- 350-024, more particularly described in Exhibit A attached hereto (the “NH Property”).

B. MING HING KWOK, SZEKAY SHING, and THE JAVE FAMILY LIMITED PARTNERSHIP, collectively, are the owners of real property in the City, located adjacent to the NICCA Property, in the City of St. Helena, identified as Assessor’s Parcel Numbers 009-362-028, 009-362-029, 009-362-030, and 009-362-031, as more particularly described in Exhibit B attached hereto (the “Kwok et al Properties”).

C. Page 199 of 242 ends

Reimbursement Agreement
Sulphur Springs Avenue Sewer Extension Page 2 of 12
D. A plan for the extension of the municipal sewer system from its existing terminus on Sulphur Springs Avenue to the NH Property was submitted to the City on behalf of NH (the “Plan”). The Plan, prepared by licensed civil engineers at no cost to the City, includes detailed drawings for the Sulphur Springs Avenue Sewer Extension and for connecting the NH Property to the Sulphur Springs Avenue Sewer Extension. The City is prepared to consider and approve the Plan following approval and execution of this Agreement.

E.. NH has submitted documents to the City which show that the total engineering, design and construction costs of the Sulphur Springs Avenue Sewer Extension and connection of the NH Property are estimated to be _________________________ Dollars ($________________), with the specific amount to be negotiated and agreed). The Financing Parties have agreed to fund the Sulphur Springs Avenue Sewer Extension.

F. The City's Director of Public Works has evaluated the feasibility of additional property owners connecting to the Sulphur Springs Avenue Sewer Extension without having to construct additional public facilities. Based on that evaluation, the Director has determined that the Sulphur Springs Avenue Sewer Extension has been designed and constructed with sufficient capacity to serve additional residential properties.

G. On ___________________, 2026, and pursuant to Section 13.20.050, the City Council held a noticed public hearing and adopted Resolution No.______________, in which the City Council found that: (1) the Sulphur Springs Avenue Sewer Extension is a public improvement which will, upon completion, be accepted by the City; (2) the Sulphur Springs Avenue Sewer Extension has the capacity and capability of serving and is designed to serve additional properties not within the proposed development due to the supplemental size and capacity of the improvement; (3) the proposed benefit district represents a geographical area of property which will benefit directly and substantially by the public improvement; and (4) the method of determining contribution and the amount of contribution is fair and reasonable to the Financing Parties and the benefited property owners and fairly distributes the charge among all subject parcels in proportion to the estimated benefit each will receive from the proposed improvement.

A map showing the benefited properties and a list of each property by County Assessor parcel number (each “Benefited Property” and collectively the “Benefited Properties”) is attached hereto as Exhibit B.

H. The Sulphur Springs Avenue Sewer Extension is located as shown on the map attached hereto as Exhibit C. The City has determined that the Sulphur Springs Avenue Sewer Extension has been designed and constructed to enable connection and service to properties not owned by the Parties to this Agreement but lying within an area that could be served by the Sulphur Springs Avenue Sewer Extension.

Page 200 of 242 ends

Reimbursement Agreement
Sulphur Springs Avenue Sewer Extension Page 3 of 12
I. The City has concluded that it would be fair and reasonable for the Financing Parties, to be reimbursed a total sum of up to _________________________ Dollars and 00 Cents ($___________________), which sum represents the estimated cost allocated to the Sulphur Springs Avenue Sewer Extension, less the portion allocated to the properties owned by Financing Parties, which is reflected on Exhibit D.

J. In the event that the cost of the Sulphur Springs Avenue Sewer Extension exceeds ________________________ Dollars and 00/Cents ($_______________1) the excess cost would be divided between the Financing Parties, with 50% allocated to NH, and the remaining three Financing Parties allocated at 16.66% each, consistent with the Allocations of Reimbursement Payments reflected in Exhibit D.

K. This Agreement is entered into pursuant to the authority of Chapter 13.20.050 of the St. Helena Municipal Code relating to a special extension prorate charge and is intended to ensure that NH is reimbursed the amounts to which it is entitled from the owners or developers of the Benefited Properties, insofar as they become connected to the City's sewer system via the Sulphur Springs Avenue Sewer Extension subsequent to the execution of this Agreement.

NOW THEREFORE, FOR VALUABLE CONSIDERATION, the Parties hereto agree as follows:

AGREEMENT

Agenda Report to the City Council
Agenda Section: OLD BUSINESS
Department: Admin
DATE: September 22, 2026
FROM: James McCann, Interim City Manager
SUBJECT: Consideration of an Ongoing Discolored Water Incident Credit Policy

RECOMMENDED
ACTION:

Adopt Resolution approving:

1. The establishment of an ongoing reporting-based Water Credit Policy for active customers who log verified discolored water incidents on the "St. Helena Grapevine" online portal or via direct phone call to City Staff.

2. Authorization for the City Manager and Director of Finance to establish administrative guidelines to implement, calculate, and process ongoing usage credits and damage claims.

PREVIOUS COUNCIL
ACTION:

September 8, 2026: The City Council received an agenda report (https://sthelenaca.portal.civicclerk.com/event/1457/files/report/3180) and presentation regarding water discoloration impacts. The Council was presented with a proposal for a one-time $500,000 Water Bill Credit allocation (estimated at approximately $200 per eligible active customer account) along with the framework for an ongoing, reporting-based credit policy for future discolored water incidents.

The Council discussed these items and directed staff to develop a draft policy for future discolored water instances.

STATEMENT OF THE
PURPOSE:

The purpose of this policy is to establish standard administrative procedures for evaluating and issuing billing credits to active water utility customers for water wasted while flushing discolored water out of their private plumbing systems during future reported incidents.

FINANCIAL IMPACT: Funding Source: Ongoing credits granted under this policy will be funded primarily through accumulated interest earnings generated within the Water Enterprise Fund, minimizing operational disruptions to planned infrastructure improvement budgets.

Base Rates & Wastewater: Base rate service charges are not subject to adjustment under this policy. Wastewater charges will not be adjusted unless specifically evaluated and authorized by the City Manager, Director of Finance, or designee.

Page 223 of 242 ends

Tracking & Precision: The deployment of smart water meters integrated with the EyeOnWater monitoring platform allows City staff to retrieve high-frequency interval usage data during verified incident windows, making credit calculations precise and transparent.

CEQA DETERMINATION: Not a CEQA Project (CEQA Guidelines §15378) BACKGROUND:

The City of St. Helena acknowledges the frustration, disruption, and inconvenience caused by discolored water issues and recognizes that clean, clear water is an essential baseline service.

Discolored water incidents occur due to a combination of seasonal source water shifts (such as temperature changes and turnover in surface water reservoirs) and distribution system disturbances like pressure shifts that mobilize legacy sediment.

To address the root causes of water clarity challenges, the City continues to pursue short and long-term infrastructure improvements, including legacy pipe cleaning and replacement, water treatment process optimization in coordination with state regulatory bodies, and the replacement project for the Bell Canyon Water Intake Tower. However, to directly address customer impacts during future discolored water events, the City Council is establishing a formal administrative policy to evaluate and issue volumetric billing credits to customers for water used to flush private plumbing systems.

Current Utility Rate Structure Reference
For context regarding customer bill impacts, St. Helena utility accounts are billed based on fixed base fees (determined by meter size) and volumetric usage measured in Hundred Cubic Feet (HCF), where 1 HCF = 748.05 gallons (cityofsthelena.gov/349/Utility-Billing-ServicesDivision). • Base Fees: Current monthly base fees range from $85.35 (standard 5/8" residential meter) to $4,524.23 (6" commercial meter).
• Tiered Volumetric Usage Rates*:
o Tier 1 (1–6 HCF): $7.55 per HCF
o Tier 2 (6–7 HCF): $15.21 per HCF
o Tier 3 (8+ HCF): $16.28 per HCF
Existing Water Filter Rebate Program
Established in October 2024 (Resolution 2024-139 - cityofsthelena.gov/336/WaterConservation-Rebates), the City continues to offer its Water Filter Rebate Program. • Residential Accounts: Single $150 incentive for eligible filtration devices purchased prior to program implementation, or replacement filters for previously installed units. • Commercial Accounts: $300 (1–3 sinks), $400 (4+ sinks), $400 (commercial restaurants), $400 (HOA facilities), plus a one-time $300 rebate for replacement filters on previously acquired devices.

Page 224 of 242 ends

As of August 2026, the City has provided rebates to 18 water customers that have applied for the program, totaling $2,700. The rebate program was started with a baseline of $50,000 from the Water Enterprise Fund.

Property Damage Claims & Property Relief
Customers affected by discolored water who experience property damage (such as stained laundry or damaged water-using appliances) may file a formal damage claim (cityofsthelena.gov/533/Claims) through the City for potential reimbursement. They may also apply for the established Water Filter Rebate Program.

DISCUSSION:

The proposed Ongoing Discolored Water Incident Credit Policy establishes a transparent, reporting-based mechanism to credit customers who flush their private lines during future discolored water events.
• Reporting Requirements: Customers experiencing discolored water must report the incident within 48 hours via the St. Helena Grapevine portal (cityofsthelena.gov/grapevine) or by telephone at (707) 968-2658. Timely reporting provides real-time geographic data that allows Public Works to map the area and dispatch targeted main line flushing or conduct onsite water quality testing. • Eligibility & Exclusions: To qualify, accounts must be active potable water accounts in good standing at the time of the incident. Accounts classified exclusively as dedicated fireline service, landscape-only irrigation service, or dedicated "standby" meters are explicitly excluded from receiving credits.
• Credit Calculation & Verification: Usage during the reported incident window is verified using high-frequency interval data retrieved from the customer's EyeOnWater smart meter account. The volumetric credit offsets flushing consumption and is calculated starting at the lowest applicable rate (Tier 1: $7.55*/HCF), progressing to higher tiers (Tier 2: $15.21*/HCF or Tier 3: $16.28*/HCF) only if the account's total billing cycle usage exceeds subsequent tier thresholds. Base rate service charges are not adjusted, and wastewater charges remain unadjusted unless authorized by the City Manager or Finance Director.

City Utility Billing staff plans to provide a quarterly report to Council on the usage of the Water Incident Credit Policy.
*Note: Tiered volumetric usage rates reflect the fee schedule in effect at the time of policy adoption (Tier 1: $7.55/HCF; Tier 2: $15.21/HCF; Tier 3: $16.28/HCF). Credits will be calculated based on the specific tiered rates adopted and active during the billing cycle in which the discolored water incident occurred.

Exhibit A - p-fi-0023_Discolored Water Incident Credit Policy.docx; Please include the following comment on the discolored water credit policy on the City Council September 22 Agenda:

The draft discolored water credit policy appears to NOT include even a MINIMAL requirement to require documentation and verification that a discolored water incident has occurred and its duration.

This is contrary to minimal City "waste, fraud and abuse" protections to ensure that transactions are auditable and verifiable. The proposed policy appears to defer to any water user's report of an incident, rather than any documentation and verification of the incident and its duration, such timestamped photographs, videos or actual inspection and verification of the actual discolored water directly by Public Works.

Attached is and please include in my public comment my recommended edit to the text of the proposed discolored water credit policy to ensure the determination and award of such credits is subject to documentation and verification under minimal, standard, auditable "waste, fraud and abuse" standards.

Thank you for your consideration of these comments. These comments are personal only and not in any official or public capacity with the City or any other entity.

Outlook
Council meeting agenda item 12.1 Water incident credit policy From Mark Smithers <[email protected]>

Cc James McCann <[email protected]>; Paul Dohring <[email protected]>; Michelle Deasy <[email protected]>; Scott Diaz <[email protected]>; Aaron Barak <[email protected]>; Kate Spadarotto <[email protected]> To Jim McCann, our mayor, and city council members
I completely understand our city trying to do something, anything to recognize the terrible years long water discoloration problem and to hopefully have the community recognize the city is now doing everything they can to mitigate and ultimately fix the problem. However, this proposed water incident credit policy, and program is not the right approach and will waste hundreds of thousands of dollars on administrative costs, deliver little financial relief, and only further customer frustrations with our water delivery. I make the following points that I hope you will accept as observations and advice such that you will see where this program falls short.

1. The policy and staff report do not provide clear and detailed instructions on how to go about reporting on grapevine. There needs to be a step-by-step instructive procedure which includes how to sign up for grapevine and exactly what information needs to be provided. A phone number needs to be provided with the extension a customer should dial. Again, what information needs to be provided: when did the incident begin, what grade of discoloration, how long did the incident last, what is the property address, what is the customer account number and phone number, etc? The instructive procedure and process needs to be written clearly and in detail to avoid confusion and frustration.

2. Is the customer required to be signed up for Eyeonwater and provide information? If yes, then a detailed clear instructive procedure needs to accompany the policy that includes how to sign up for Eyeonwater, how to get to the information on the website, and how to report it. What about customers that can’t manage to sign up for Eyeonwater?

3. There are no detailed staff processes and procedures included with the policy. There needs to be a clear and detailed process and procedure document for staff to easy the accumulation of information. We can’t start this program and just wing it or develop the information documentation as the program starts. At a minimum there needs to be a checklist and a claim process timeline. There needs to be a form (electronic or otherwise) that follows a process for the retrieval and review of information with dates of completion and documented approval steps. Customers need to know that all claims will follow the same process and procedure and will be documented appropriately for all claims no matter the amount.

4. What is the process and procedure if a customer’s claim is denied or the customer does not agree with the approved claim amount?

5. The staff report does not include any data or analytics regarding likely individual claims and amounts. My typical use charges for an entire month are less than $30. Is there a

minimum claim amount? What average claim amount is the city anticipating? Are we really talking about the potential of 15,000 claims if the average water use claim is approximately $30 (1250 customers (only half file), once a month, at $30 each claim:
2,500 x 12 x $30 = $450,000)

6. The staff report does not include any information or analysis regarding administrative costs for each claim. Based on my quick review of the policy document and the process staff will follow; I caution that fully loaded labor administrative and verification costs will be far greater than the average claim.

7. This is a new program. How will the administrative costs incurred by the General Fund be charged to the water department?

8. If the full cost of the rebate program is $500,000 (as previously suggested) and the likely administrative costs will be at least the same amount ($500,000) but in my estimation twice that amount; how do the water enterprise projected financials and bond covenants look. I’m guessing we will not be in good shape.

It is deeply concerning that the staff report and draft policy have not touched these issues. I reiterate that I understand the city’s desire to acknowledge the issue and the customer burden of paying for a product of poor quality or that can’t be used. However, the total cost of this program is significant and is better spent on cleaning and replacing pipes. The revenues of the water enterprise are fungible. It doesn’t matter if they are investment earnings or rate paying customers. Either way it is water enterprise monies, and they need to be spent to fix the problem, not place a band aid on it. What happens a year from now when we still face the same issue at lesser intervals; do we extend the program and take more money away from fixing the problem? I don’t see how staff has the bandwidth to administer this program.

Best to you all.

City Council Meeting | September 22, 2026 | Item 12.1
Submitted by: Garry L Rose, St. Helena, CA
Dear Mayor Dohring, Vice Mayor Deasy, Council Members Barak, Spadarotto, and Diaz, Acting City Manager McCann, and Director of Public Works Leach.

Establishment of an Ongoing Discolored Water Incident Credit Policy The following comments and opinions are personal and not in any official or public capacity with the City or any other entity.

The City Council and City Staff need to determine whether the proposed Ongoing Discolored Water Incident Credit Policy in Item 12.1 meaningfully satisfy most water customers.
• The proposed Policy lacks sufficient detail for the City Council to make an informed decision.
• There is no financial analysis that includes administrative costs. • Interest in income from the Water Enterprise is revenue that can be used for any expense in the enterprise including fixing the brown water issue. Using this revenue for rebates will significantly impact already scarce Water Enterprise resources.
• There is no distinction between potable water use and irrigation use. For most residences, the potable water use will be limited to Tier 1 usage. Most of Tier 2 and Tier 3 will be irrigation use with no need for a rebate. • Many commercial customers, multi-family, and Vineyard Valley are connected to single meters with charges distributed by the landlord or HOA’s, making the proposed Policy very difficult if not impossible to manage. • Water use charges in Tier 1 are a small percentage of the total water bill and will be viewed by residential customers as insignificant. Everyone wants the problem fixed.
• Commercial customers and actual financially impacted residential customers can use the existing claims process in lieu of developing a new process. • Possibly review the existing claims process to make sure a documentation process relative to brown water claims is included.

There is no practical reason to spend limited Council meeting time debating an item that is not ready for responsible action. This Policy is not needed.

Respectfully submitted, Garry L. Rose
