2 ANALYSIS:

The monthly cash and investment report provides a summary of the cash and investment accounts held by the City as of the end of that month. In order to manage its cash and investments, the City combines cash resources from all funds into a single pool consisting of a variety of accounts and securities. The balance in the pooled cash account includes cash and certain liquid investments that are available to meet the City’s current cash needs. Cash in excess of the City’s current cash needs is invested in interest-bearing investments with various maturities.

As of August 31, 2024, the market value of the City’s total investment portfolio was $64.4 million, of which $26.3 million (41%) was invested in the State Local Agency Investment Fund (LAIF) and $38.1 million (59%) was managed by Chandler (Attachment B). Detailed information regarding the securities contained in the City’s investment portfolio is provided in Attachments C and D. As of August 31, 2024, City investments consisted of the following:

The City’s investment portfolio is well-diversified with investments spread across nine different security types. Likewise, the average maturity of the City’s portfolio (except for LAIF) is approximately 2.5 years, which is within the 3.5 years target in the City’s investment policy.

FISCAL IMPACT:

All deposits and investments have been made in accordance with the City's Fiscal Year 2024/25 Investment Policy. The portfolio will allow the City to meet its expenditure requirements for the next six months. Staff remains confident that the investment portfolio is currently positioned to remain secure and sufficiently liquid.

CITY OF STANTON

REPORT TO THE CITY COUNCIL
TO: Honorable Mayor and Members of the City Council
DATE: October 8, 2024
SUBJECT: AUGUST 2024 GENERAL FUND REVENUE AND EXPENDITURE REPORT; HOUSING AUTHORITY REVENUE AND EXPENDITURE
REPORT; STATUS OF CAPITAL IMPROVEMENT PROGRAM
REPORT IN BRIEF:

The Revenue and Expenditure Report for the month ended August 31, 2024, has been provided to the City Manager in accordance with Stanton Municipal Code Section

2.20.080 (D) and is being provided to City Council. This report includes information on both the City’s General Fund and the Housing Authority Fund.

RECOMMENDED ACTIONS:

1. City Council find that this item is not subject to California Environmental Quality Act (“CEQA”) pursuant to Sections 15378(b)(5) (Organizational or administrative activities of governments that will not result in direct or indirect physical changes in the environment); and

2. Receive and file the General Fund and Housing Authority Fund August 2024 Revenue and Expenditure Reports and Status of Capital Improvement Projects for the month ended August 31, 2024.

ANALYSIS:

General Fund Revenue and Expenditure Reports
Attachments A and B summarize the General Fund’s revenue and expenditure activity through August 31, 2024. The reports include information for the month of August, on a year-to-date basis through August, the current fiscal year’s budgeted balance and the year-to-date as a percentage of the budget. In addition, for comparison purposes, the year-to-date amount, final amount, and a percentage of final for the previous fiscal year (through August) is included as well.

Item: 6F
Click here to return to the agenda.
2 As of August 31, total General Fund revenues received to date were approximately $990,782, which is 3% of the Fiscal Year 2024/25 budgeted amount and is approximately $103,882 (9%) lower than the revenues recognized for the same period last year (Attachment A, page 2). During the same period in Fiscal Year 2023/24, the City collected $317,650 for one-time developer fees (public benefit fees and beautification fees) that are no longer recorded in the General Fund. The City began recording one-time developer fees in separate funds in June 2024.

Total General Fund expenditures were approximately $5.6 million through August 31, which represents 16% of the Fiscal Year 2024/25 projected expenditures and is approximately $1.9 million (49%) higher than the expenditures incurred for the same period last year (Attachment B, page 2), primarily due to the timing difference of the first quarter payment made to the Orange County Fire Authority (OCFA). This payment of $1.4 million is reflected in expenditures through August 31 in the Fiscal Year 2024/25 activity, however, in Fiscal Year 2023/24, the first quarter payment to OCFA was made in September.

Per Attachment C, the City’s General Fund reserves and available fund balance (“discretionary fund balance”) is estimated to be $35.4 million by June 30, 2025, as shown in the table below.

Estimated
Balance
at 6/30/25
Set aside per Reserve Policy $ 14,900,000
Assigned Fund Balance 383,196
Unassigned Fund Balance 20,150,981
Total Discretionary Fund Balance $ 35,434,177
Housing Authority Revenue and Expenditure Reports
Attachment D summarizes the Housing Authority Fund’s revenue and expenditure activity through August 31, 2024. The report includes information on the activity during the month of August, information on a year-to-date basis through August, the current fiscal year’s budgeted balance and the year-to-date as a percentage of the budget. In addition, for comparison purposes, the year-to-date amount, final amount, and a percentage of final for the previous fiscal year (through August) is included as well.

As of August 31, total Housing Authority Fund revenues received to date were approximately $96,473, which is 13% of the Fiscal Year 2024/25 budgeted amount and is $76,528 (44%) less than the revenue collected through the same period last year due to the change in market value fluctuation in the Housing Authority’s Local Agency Investment Fund (LAIF) account during the month of August 2024 compared to the fluctuation during the month of August 2023.
3 Total Housing Authority Fund expenditures were approximately $537,555 through August 31, which is 11% of the Fiscal Year 2024/25 budget and $426,346 (383%) higher than the expenditures incurred for the same period last year, primarily due to emergency relocation payments made during the month of August 2024. The Housing Authority spent $309,360 on relocation costs for the Tina Pacific housing project through August 31, 2024.

Per Attachment E, the City’s Housing Authority Fund’s available fund balance is expected to be $5.1 million by June 30, 2025.

Status of Capital Improvement Projects (CIP) (Attachment F) The Fiscal Year 2024/25 CIP budget includes $8.1 million from the Fiscal Year 2024/25 Adopted Budget and $14.1 million in carryover funding from Fiscal Year 2023/24, for a total amended budget of $22.2 million as of August 31, 2024. As of August 31, capital project expenditures totaled $382,125 (2% of the amended budget) with an additional $2.6 million (12% of the amended budget) under contract (encumbered) for work currently underway, for a total amount spent or encumbered to date of $2.9 million (13% of the amended budget) as of August 31, 2024.

2. Reject all bids for the construction of the Stanton Community Center Improvement Project – Backup Generator; and

3. Authorize staff to revise the bid package and re-advertise for bids the Stanton Community Center Improvement Project – Backup Generator.

2 Bid opening for this project was on September 9, 2024. Two (2) bids were received and opened as follows:

Rank Company Bid
1 Herman Custard Electric $ 179,480
2 Newbuild Construction and
Restoration, Inc. $ 216,500
Following the bid opening, staff reviewed the submitted documents to verify that the lowest bid was responsive and compliant with the contract documents.

ANALYSIS/JUSTIFICATION:

The lowest bidder was deemed non-responsive due to an unauthorized letter of exclusions included in the bid package. The City’s instructions to bidders prohibits modification of bids including unauthorized additions and exclusions. Staff will revise the bid package to include all necessary bid items to complete this project.

The project requires that the contractor performing the work be a licensed Class A or B AND Class C-10 (Electrical Contractor). The second lowest bidder was deemed nonresponsive due to the bidder not possessing a C-10 license.

Staff will rebid this project and anticipate requesting to award a construction contract at a November 2024 City Council meeting.

FISCAL IMPACT:

None.

ENVIRONMENTAL IMPACT:

This item is not subject to California Environmental Quality Act (“CEQA”) pursuant to Sections 15378(b)(5)(Organizational or administrative activities of governments that will not result in direct or indirect physical changes in the environment).

CITY OF STANTON

REPORT TO CITY COUNCIL
TO: Honorable Mayor and Members of the City Council
DATE: October 8, 2024
SUBJECT: DISCUSSION REGARDING LOCAL PREFERENCE FOR CITY

PROCUREMENTS
REPORT IN BRIEF:

At the City Council meeting of June 25, 2024, Mayor Pro Tem Warren received consensus to review the City’s local preference policies as they relate to the City’s procurement efforts to ensure continued support of local Stanton businesses. Tonight, the Council will review the existing administrative policy and provide direction to staff.

2. Provide direction to staff.

BACKGROUND:

At its meeting of January 10, 2023, the City Council approved Administrative Policy IV-4- 12, “Purchasing Policy and Procedures.” Chapter 4 addresses procurement procedures, and Section 4.5 addresses Local Vendor Preference, as provided below.

4.5 Local Vendor Preference.

The City’s Local Vendor Preference is intended to benefit local businesses and promote the economic health of the City by keeping dollars and jobs within Stanton. For the purposes of this section, a local vendor/bidder shall be a business having a valid City Business License and a fixed business location within the incorporated City limits. A Local Vendor Preference shall not be granted for contracts involving Professional Services and Public Projects, or as otherwise prohibited by law.

Item: 9A

Minor Purchases. For purchases where the value of goods or services to be purchased total less than $3,000, every effort to utilize a local vendor shall be exercised. The City must attempt to solicit quotes from local vendors first, but quotes from non-local vendors may not be rejected on the basis of location.

Purchases of Supplies and/or Equipment. Notwithstanding the exceptions outlined below, the local vendor with the lowest local bid shall receive a two percent (2%) preference discount off their bid/quote price.

Upon applying the Local Vendor Preference, if the bid/quote from that local vendor becomes the lowest overall responsible bid/quote or becomes tied for the lowest overall responsible bid/quote, the City shall select that local vendor, even though the actual cost to the City would not be the lowest. The expectation is that the City would not face a net loss, due to the collection sales, transactions, and use taxes from the purchase.

This Local Vendor Preference does NOT apply for a local vendor under any of the following circumstances:
• State or Federal statutes or regulations require that the bid/quote be exempted from local preferences and must be awarded to the lowest responsible bidder.
• The bid/quote is part of a cooperative purchase done with other public agencies.
• The local vendor fails to demonstrate that they are a responsible bidder for the bid/quote.
• The bid/quote from the local vendor is already the overall lowest responsible bid/quote without the Local Vendor Preference discount. (In such a case, the local vendor shall be awarded the contract with their bid/quote left as-is.)
ANALYSIS/JUSTIFICATION:

A local business preference allows the City to promote local businesses, as well as benefit from enhanced economic activity as dollars re-circulate in the local economy by way of multiplier effects. Multiplier effects have been shown to benefit the community in the following ways:
• Direct effects. Benefits the local economy by directly investing money in a local business.
• Indirect effects. Occurs when money awarded to a local business results in interindustry purchases of materials, supplies, good and services. Another potential indirect effect is the increase in employment associated with greater workloads/demands.
• Induced effects. Increases in household income as a result of both the direct and indirect effects.

In these ways, the benefits to the City of making purchases through a local vendor extend beyond the value of the initial purchases. The City’s existing 2% local vendor preference promotes and supports purchasing within the City of Stanton.

FISCAL IMPACT:

There is no fiscal impact associated with the recommended actions.

ENVIRONMENTAL IMPACT:

In accordance with the requirements of California Environmental Quality Act (“CEQA”), the project is exempt pursuant to Sections 15378(a) and 15061(b)(3) of the State CEQA Guidelines (Title 14 of the California Code of Regulations).

PUBLIC NOTIFICATION:

Public notice was made through the regular agenda process.
