Ms. Nicholson reported that there is a recent guide written by the Benioff Homelessness and Housing Initiative and asked that should the City Council decide to adopt this resolution, that the City review the guides provided by the initiative to ensure that any procedures that the City takes in dealing with those who are lacking housing are done humanely and protects them from further trauma.

PROPERTIES IN THE TINA PACIFIC NEIGHBORHOOD IN RESPONSE TO
HOMELESSNESS STATE OF EMERGENCY
If the City Council adopts Resolution No. 2024- 40 declaring a Homelessness State of Emergency, staff recommends the City Council approve the authorization ofthree voluntary housing options for residents of City -owned properties in the Tina Pacific Neighborhood pursuant to the Homelessness State of Emergency.
Staff report by Ms. Hannah Shin- Heydorn, City Manager.
Public Comment:
Ms. Ugochi Anaebere Nicholson, spoke regarding their continued advocacy for the residents of the Tina Pacific community, ensuring that the City Council not only includes the residents of Tina Pacific community and it' s redevelopment of its community, but follows the law in doing so and reported that the proposed city action does not eliminate the City' s obligation to offer its tenants the right to Special and Joint Regular Meeting — November 26, 2024 - Page 14 of 19 occupy any replacement housing or community as required under the California Redevelopment Law and that the City must amend its proposed housing options to specifically state that those options provided do not replace the City' s obligations under the California Relocation Assistance Act to provide relocation assistance services and benefits to achieve permanent relocation assistance and comparable housing as identified in the California Code of Regulations. Ms.
Nicholson further reported that the proposed Resolution needs to provide this clarity so that in reviewing the housing options being made available to the residents of the Latino Pacific community they can make an informed choice about their respective housing situation. Additionally, Ms. Nicholson reported that the City needs to amend its proposed actions to ensure that it does not unlawfully deprive residents who are involuntarily displaced from their home due to an eviction, from their right to select emergency relocation assistance or the ability to move to a unit in the Tina Pacific community under either the Federal Relocation Uniform Relocation Act or the California Relocation Assistance Act, respectively and that the California Relocation Assistance Act makes clear that eviction is not a basis to deny temporary or permanent relocation assistance.
Also, there is no requirement that a tenant be in good standing, which is not defined to receive temporary or permanent relocation assistance benefits. The Uniform Relocation Act also contains limitations on the use of addiction for a cause to deny a relocation assistance payment and in the case of a no- fault eviction, such as a tenant failing to move or relocating when instructed. The Uniform Relocation Act prohibits the denial of a relocation assistance payment.
