ADA CURB RAMP INSTALLATION, PROJECT NO. WD21004
This is in response to your letter dated September 13, 2021, regarding the bid submitted by HBC Enterprises for the ADA Curb Ramp Installation ("Project").
The City of Stockton ("City") determined that HBC Enterprises, the apparent low bidder, failed to possess the required valid license at the time of bid as required by Special Provision Section 5-1.12. Further, California Business and Professions Code section 7028.15( e) states "a bid submitted to a public agency by a contractor who is not licensed in accordance with this chapter shall be considered nonresponsive and shall be rejected by the public agency." It further provides, "a local public agency shall, before awarding a contract or issuing a purchase order, verify that the contractor was properly licensed when the contractor submitted the bid."
According to the California Contractors State License Board, HBC Enterprises, License #1044524, had a suspended license at the time of bid opening, September 2, 2021. A copy of the Contractors State License Board information is enclosed for your convenience.
The City determined that HBC Enterprises' failure to comply with the Special Provisions and state code requirements resulted in a nonresponsive bid. Public Works staff will recommend to City Council it reject HBC Enterprises' bid and award a construction contract to the second lowest responsive bidder, J.J.R. Construction, Inc.
