STOCKTON CITY COUNCIL
RESOLUTION APPROVING A REFUND TO TANKERWASH USA, INC., IN THE AMOUNT OF $253,382.55, FOR OVERPAYMENT OF WASTEWATER CHARGES BILLED AND COLLECTED FOR THE PROPERTY AT 743 W. ANDERSON
Tankerwash USA, Inc . is in the California Water Service (Cal Water) area. Cal Water provides Winter Quarter Average (WQA) water usage data that is subsequently used to calculate sewer charges; and
Tankerwash USA, Inc. is also a permitted industrial user who is billed sewer charges based on metered flows; and
Billing divisions within the City of Stockton were not aware bills were sent based on both WQA and metered flow data; and
Tankerwash USA, Inc. was subjected to double billing for the wastewater service charges based on both the metered industrial flow and the WQA data provided by California Water Service; and
Duplicate charges from the period of July 2015 through August 2021, are determined to equal $253,382.55; now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF STOCKTON, AS FOLLOWS:
1. Pursuant to Stockton Municipal Code section 3.60.020 the City of Stockton approves a refund in the amount of $253,382.55 to Tankerwash USA, Inc.
2. The City Manager is hereby authorized to take whatever actions are necessary and appropriate to carry out the purpose and intent of this Resolution.
