Resolution No.

STOCKTON CITY COUNCIL

RESOLUTION AUTHORIZING THE EXECUTION OF AGREEMENT WITH YMCA OF SAN JOAQUIN FOR THE MANAGEMENT AND OPERATION OF SOUSA, BROOKING, HOLIDAY, AND OAK PARK POOLS Because the City’s aquatics staff was eliminated during bankruptcy, the City began contracting with multiple non-profit groups to assume operations of each City pool through single year agreements; and One-year agreements with multiple operators are difficult for both operators and the City because they prevent operators from building consistent swim programs and developing a loyal customer base and they create oversight and compliance challenges for the City; and In 2017, City moved to a multi-year agreement with a single operator to operate all City pools have proven successful. Operators are building consistent swim programs and are developing a loyal customer base, and On August 5, 2021, the City issued a Request for Proposal (RFP) for a multi-year agreement with a single operator for all City operated swimming pools; and The City received two proposals and, based on criteria including professional qualifications, agency experience, and financial capabilities, the City deemed YMCA of San Joaquin (YMCA) the most qualified; and With the closure of the McKinley pool, City residents have limited access to the public aquatic programs. Staff developed a collaborative agreement with the Manteca Unified School District (MUSD) for the use of the Weston Ranch High School pool in exchange for City support to fund an operator; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF STOCKTON, AS FOLLOWS:

City Manager is authorized to execute a three-year agreement and two one-year mutual options with YMCA of San Joaquin for a total amount of $405,000 for the management and operation of Brooking, Holiday, Oak, and Sousa Park Pools, attached as Exhibit 1 and incorporated herein by this reference. //

2. Pursuant to the requirements of Stockton Municipal Code section 3.68.070, City Council makes the following findings which support an exception to the competitive bidding requirements for the agreement with YMCA:

A. The City solicited competitive proposals through an RFP process.

B. The RFP process allowed the City to evaluate qualified proponents on experience and past performance, which is more important than price. A strict cost-competitive basis for the selection of an aquatics operator may lower the quality of services to be provided and impact health and safety if cost is the primary criteria of selection.

C. Contracting with a private operator is more cost effective and efficient to provide public swimming in the City’s four aquatic facilities. Current Recreation staffing is insufficient to operate the four pool aquatic facilities.

D. Use of the RFP criteria insures the best operational care, health, and safety standards, and demonstrated aquatic skills.

E. YMCA was the top ranked operator based on experience, professional qualification, and financial capability. YMCA has the necessary specialized aquatic skills and experience to successfully operate aquatics facilities in the City of Stockton.

3. The City Manager is hereby authorized to take whatever actions are necessary and appropriate to carry out the purpose and intent of this Resolution.

PASSED, APPROVED, AND ADOPTED March 1, 2022 .
