STOCKTON CITY COUNCIL
RESOLUTION TO ACCEPT AND APPROPRIATE FUNDING FROM THE CALIFORNIA STATE WATER RESOURCES CONTROL BOARD WATER AND WASTEWATER ARREARAGE PAYMENT PROGRAM IN AN AMOUNT UP TO $2,253,527.34; TO APPROVE THE ALLOCATION OF FUNDS; AND TO APPROVE A WAIVER OF ELIGIBLE CUSTOMER LATE PAYMENT FEES On July 22, 2021, the Governor signed California Assembly Bill 148 allocating $985 million in federal American Rescue Plan Act of 2021 (Public Law No. 117-2) (ARPA) funds to the California Water and Wastewater Arrearage Payment Program (Program), administered by the California State Water Resources Control Board (State Board). The Program offers community wastewater systems up to $985 million in federal ARPA funds to provide financial relief for past-due residential and commercial wastewater bills accrued during the COVID-19 pandemic relief period between March 4, 2020, and June 15, 2021; and In March 2022, the City of Stockton (City) applied for the Program and supplied all the necessary information to receive funds from the State Board Program. The City anticipates an award of up to $2,253,527.34 in Program funding; and The Program requires the City to issue a credit to eligible residential, commercial, and institutional wastewater utility accounts within the service area, notify customers in writing within 60 days, and waive all late fees for qualifying wastewater arrearages; and The City may expend up to three percent (3%) or $1 million, whichever is less, for costs incurred to apply for assistance or to comply with Program requirements; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF STOCKTON, AS FOLLOWS:

The City Manager, or designee, is hereby authorized and directed to accept and appropriate funds from the California State Water Resources Control Board Water and Wastewater Arrearage Payment Program in an amount up to $2,253,527.34.

The City Manager, or designee, is authorized to allocate funds in accordance with all Water and Wastewater Arrearage Payment Program requirements. //
//
The City Manager is directed to approve a waiver of customer late payment fees for wastewater arrearages eligible under the Water and Wastewater Arrearage Payment Program in an amount anticipated to be under $250,000.00.

The City Manager is hereby authorized to take whatever actions are necessary and appropriate to carry out the purpose and intent of this Resolution.
