Resolution No.
STOCKTON CITY COUNCIL
RESOLUTION DECLARING A STAGE 2 WATER SHORTAGE EMERGENCY In 2021, the Governor of California proclaimed states of emergency that continue today and exist across all the counties of California due to extreme and expanding drought conditions; and A water shortage means that the water supply available is insufficient to meet the normally expected customer water use at a given point in time; and The Water Shortage Contingency Plan (WSCP) describes the City’s strategic plan in preparation for and responses to water shortages with a goal to proactively prevent catastrophic service disruptions; and The WSCP includes water shortage levels (also called “stages”) and associated shortage response actions that will be implemented in the event of a water supply shortage; and The Stockton Municipal Code (SMC) Chapter 13.28 Water Conservation and SMC Chapter 13.32 Water Shortage Emergencies are complementary chapters that support the City’s WSCP and are available under Title 13; and The 2018 Water Conservation Legislation set new requirements for water shortage contingency planning with California State Legislature (Legislature) enacting two policy bills, Senate Bill (SB) 606 (Hertzberg) and Assembly Bill (AB) 1668 (Friedman), to establish a new foundation for drought planning to adapt to climate change and intense droughts in California; and The City’s WSCP was updated in 2020 to be consistent with the 2018 Water Conservation Legislation requirements; however, the City must modify SMC Chapter 13.28 and SMC Chapter 13.32 to support the new legislation requirements; and On March 28, 2022, the Governor of California issued Executive Order N-7-22, declaring a continued state of emergency due to extreme and expanding drought conditions; and On May 24, 2022, the State Water Resources Control Board adopted a resolution to advance to Stage 2 of water shortage emergency; and Title 13 Chapter 13.32 of the City of Stockton Municipal Code for Water Shortage Emergency, as aligned with the State Water Resources Control Board’s regulations of stages of water shortage emergency, requires a mandatory 20 percent reduction in water use by all customers of the City’s water system; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF STOCKTON, AS FOLLOWS:
A Stage 2 Water Shortage Emergency has been declared.
The City’s Water Shortage Emergency and Water Conservation measures, as outlined in Municipal Code sections, shall remain in full force and effect until the City Council finds that a water shortage emergency no longer exists.
The City Manager is authorized to take such actions as are necessary and appropriate to carry out the purpose and intent of this resolution.
PASSED, APPROVED, and ADOPTED July 12, 2022 .
