Section 5473 of the California Health and Safety Code gives the City of Stockton the election to have delinquent charges collected on the tax roll in the same manner as its general taxes. Appellant is the owner of a triplex located on the said property. Ap pellant stated that he had fallen behind on payments due to the pandemic and the resultant moratorium on tenant eviction which prevented him from evicting tenants who fail ed to paying rent. This led to a substantial loss of income which caused him to fall behind on the payments at issue . Unfortunate as Appellant’s situation may be, the utility services to his property are mandatory and have been provided by the City. With the City’s switch to owner billing in September, 2020 Appellant is directly responsible for these charges. Appellant may exercise the option to enter into a payment arrangement with the City of Stockton to pay off the delinquent balance by August 5, 2022 at the latest. Failure to do so by the said date will result in the delinquent balance of $4,135.36. being assessed to the said property for the 2022-2023 San Joaquin County Tax Roll.

Appellant does not dispute the charges and they must be paid .
It does seem unjust however, that the City that is looking out for the interests of its residents who are tenants by placing a moratorium on their eviction as a result of the COVID pandemic, regardless of rent arrearages, should, during that same period, switch to owner billing and further seek to assess delinquent payments to the tax roll of property owners such as the Appellant. The City already has a recorded lien against the said property. Under the circumstances, the City is to give the Appellant the opportunity to enter into an installment payment arrangement a nd defer assessment of the said delinquent payments to the next ass essment cycle.

Additional Comments/Orders:
Section 5473 of the California Health and Safety Code gives the City of Stockton the election to have delinquent charges collected on the tax roll in the same manner as its general taxes. Appellant is the owner of a triplex located on the said property. The utility services to his property are mandatory and have been provided by the City. With the City’s switch to owner billing in September, 2020 Appellant is directl y responsible for these charges. Appellant stated that he had fallen behind on payments due to the pandemic and the resultant moratorium on tenant eviction which prevented him from evicting tenants who failed to pay rent. This led to a substantial loss of income which caused him to fall behind on the payments at issue. The moratorium on tenant e viction in the City of Stockton is still in effect.

Section 5473 of the California Health and Safety Code gives the City of Stockton the election to have delinquent charges collected on the tax roll in the same manner as its general taxes. The utility services to this property are mandatory and have been provided by the City . Appellant’s issue regarding the outstanding charges is that he wanted the bills to be sent to the property address so that he could pay them. Appellant states that property address is a church and Appellant, the Pastor thereof. City s taff, according to policy, refused to make the change in the absence of official documentation to that effect as the address given when the account was set up is a different address. Appellant stated that it was unjust and unfair for bills not to be sent t o the property address and sought the cancellation of the bills on that basis. Appellant’s claims do not justify the cancellation of the outstanding bills. Appellant will need to provide the required documentation to enter into a payment arrangement with the City of Stockton to pay off the delinquent balance by August 5, 2022 at the latest.
