evised per the request of Jesse Garcia, describes certain changes in service and is an amendment to the existing agreement with an effective date of November 21, 2016. All other terms and conditions of the original existing agreement remain in full force and effect. The following attachments are referenced.

Description o
f Scope of Services change:
This proposal prov
ides design support during construction services, additional to the formerly referenced Construction Administration CA services to supplement scope added under Amendment 3 which included final design and minimal Bidding and CA services. Amendment #4 adds fee to more closely align with the services provided on the Men’s Remodel project which was completed last year and also included added design scope performed during bidding. The design scope now provides new finishes and a new opening in existing CMU into the Property Vault 46.

Section 3., T
erm: Extend contract time from 3/31/22 to 3/31/23. The 3/31/22 term was approved under Amendment 3 by the First Extension of the Contract dated 4/25/19.
Section 4., Compensation: For the additional work described in this amendment, change total compensation amount from $681,693 as authorized in Amendment 3 to $758,947. The attached 2022 Fee Schedule will be used for billing time and expense (t&m).

f Services, Schedule of Delivery, and Compensation, also indicated as EXHIBIT 1, is replaced in its entirety with the following, note that Design Support During Construction and Construction Administration are used interchangeably for this discussion.

The following describes the work required for the remodel of Women’s Restroom, Shower & Locker Rooms, Toilet Rooms 4 & 18, and abatement with new flooring in Storage 41 & Closet 43 shown on the approved Basement Floor Plan. Design has already been completed and the project has been successfully bid with the low bid at $325,000. Scope has been added in the Property Vault 46 which includes added finishes and new opening in existing CMU wall.
Several facto
rs have changed since Amendment 3 which contained limited construction administration services. Since the City has decided to bid the work to a new contractor instead of change ordering it with the existing contractor, a whole new bidding and construction sequence is planned, requiring a considerable amount of work for a very small area and small construction value. A new contractor will have to be selected in a public bid process, then mobilize, coordinate a whole new slate of subcontractors, prepare submittals, etc. Since the new contractor will be unfamiliar with the project, he/she can be expected to issue many RFIs compared to the existing contractor and subs who are already familiar with the site and its various existing conditions. Thus, the level of effort for the bidding and construction effort is significant as compared to project size. City staff will handle day-to-day affairs, minimizing the need for our services during construction.
The level
of effort for construction administration work is dependent on many factors, most of which are not entirely predictable, thus work will be completed on a T&M allowance basis. Indigo will perform all construction administration services requested by the City, and will endeavor to complete the assignment within the budget provided by this amendment. Work that requires more compensation than the cost included in this amendment is beyond the scope of this agreement, and if required would be the basis of a further amendment.

Additional services to be provided as directed by City, and may include: answer bidder questions; attend meetings; review submittals; respond to requests for information RFI; conduct final inspection; review record documents submitted by contractor; from contractor record documents, prepare “Record Drawings” for submittal to City of Stockton for safekeeping (mylars not included); and other services as may be requested by City.

Amendmen
t 3 included a total fee of $62,000 for Final Design through permitting with an allowance of $25,100 for Bidding and Construction, including a $13,000 for hazmat monitoring, leaving only $12,000 allowance for A&E construction support. Indigo spent $5,121 as of 5/12/22 for Bidding services, leaving at that time only $6,879 remaining in contract for A&E design support during construction.
Even assuming mi
nimal design support during construction services, for this small, publicly bid, complicated remodel project located in the basement of a 1980’s vintage essential services building, explaining the need for an additional amendment to cover design support during construction services this fee was low, also considering the City will not be engaging a construction manager. This amendment will allow Indigo to provide design support during construction services as requested.

ior project, this scope assumes that the essential services building exemption found in the 2019 California Administrative Code, Article 4, section 4-207 will still be found to apply to this projected by the CBO: “Existing buildings housing essential services facilities owned or leased by the state, a city, a EXHIBIT 2
city and county or a county prior to the effective date of the (Essential Services Buildings Seismic Safety Act of 1986) Act are exempt from these regulations.”
