Resolution No.
STOCKTON CITY COUNCIL
RESOLUTION AWARDING A SERVICE CONTRACT AND APPROPRIATING FUNDING FOR THE HOMELESS EMPLOYMENT LITTER PROGRAM, PROJECT NO. OM-22-013 On August 21, 2018, by Resolution No. 2018-08-21-1402-01, Council approved a Delegated Maintenance Agreement (Agreement) with the State of California, acting by and through the California Department of Transportation (Caltrans), for litter abatement on the freeway and State highway systems; and The Agreement provides reimbursement up to $121,000 each fiscal year until amended or terminated; and The City contracts with a local not-for-profit organization to hire homeless individuals to provide the cleanup services for the Homeless Employment Litter Program (HELP) project; and On December 22, 2021, the City advertised a Request for Proposals for the HELP, Project No. OM-22-013; and Ready to Work of Stockton, CA, received the highest ranking and was determined by the Selection Committee to be the most qualified firm for this project; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF STOCKTON AS FOLLOWS:
The City Council awards a three-year Service Contract between the City of Stockton and Ready to Work, not to exceed the amount of $363,000 ($121,000 each fiscal year), and the City Manager is authorized and directed to execute same, a copy of which is attached as Exhibit 1 and incorporated by this reference.
The City Council authorizes the City Manager to execute one optional two-year extension to this Service Contract, not to exceed the amount of $242,000 ($121,000 each fiscal year), for a total aggregate amount of $605,000.
The City Council Approves the appropriation of funding in the amount of $121,000 from the State Reimbursement revenue account and appropriates $121,000 for operating expenditures for each fiscal year of the Service Contract starting in Fiscal Year 2022-23 through Fiscal Year 2027-28.
Pursuant to the requirements of Stockton Municipal Code section 3.68.070, City Council makes the following findings which support an exception to the competitive bidding requirements:
The City does not have sufficient staff available to perform the work required of this operational need.
The scope of services requires a vendor experienced in hiring homeless individuals to provide the litter abatement cleanup services.
Use of the RFP process is appropriate for the Service Contract because, in addition to cost, it relies on the evaluation of years of experience as the basis for selection of a vendor. Use of the criteria helps ensure selection of a vendor that will provide the highest quality service in the most cost-effective way, which is in the public interest.
The City negotiated a contract following solicitation of competitive proposals in accordance with SMC section 3.68.070.A.3.
5. The City Manager is hereby authorized to take whatever actions are necessary and appropriate to carry out the purpose and intent of this Resolution.
PASSED, APPROVED, and ADOPTED July 26, 2022 .
