Resolution No.

STOCKTON CITY COUNCIL
RESOLUTION APPROVING THE NOTICE OF EXEMPTION NO. NOE22-22, APPROVING THE PLANS AND SPECIFICATIONS, TRANSFERRING FUNDING, AND APPROVING A CITY-COUNTY COOPERATIVE AGREEMENT FOR THE PERSHING AVENUE SIDEWALK GAP CLOSURE, PROJECT NO. WT23033 In July 2021, the San Joaquin County Public Works Department awarded a Construction Contract for the Pershing Avenue Widening project between Thornton Road and Meadow Avenue which is in the unincorporated county; and The County’s Pershing Avenue Widening project will widen Pershing Avenue to include a continuous left-turn pocket, one lane in each direction, new pavement, storm drainage, curbs, gutters, and sidewalks; and The City has a gap in its sidewalk network on the west side of Pershing Avenue from Meadow Avenue to Lincoln Road. The County has agreed to use their contractor to install the needed frontage and/or sidewalk improvements in the City’s jurisdiction with their project. A City-County Cooperative Agreement is needed to formally include City frontage and/or sidewalk improvements in the County’s Pershing Avenue Widening project; and The project is in conformance with the City’s General Plan, pursuant to California Government Code, section 65402, and is categorically exempt from the requirements of the California Environmental Quality Act (CEQA) as specified under section 15301(c) of the CEQA Guidelines, because this is a discretionary project under the City’s jurisdiction and qualifies as a project which has been determined to not have a significant effect on the environment; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF STOCKTON, AS FOLLOWS:

The City Council approves the filing of Notice of Exemption No. NOE22-22 under CEQA for the Pershing Avenue Sidewalk Gap Closure, Project No. WT23033, a copy of which is attached as Exhibit 1 and incorporated by this reference.

The City Council approves the plans and specifications for the Pershing Avenue Sidewalk Gap Closure, Project No. WT23033.

The City Council approves the transfer of funds in the amount of $400,000 from the Curb, Gutter, and Sidewalk Infill, Project No. WD18016, to the Pershing Avenue Sidewalk Gap Closure, Project No. WT23033.

4. The City Manager is hereby authorized to execute a City-County Cooperative Agreement for the Pershing Avenue Sidewalk Gap Closure, Project No. WT23033, a copy of which is attached as Exhibit 2 and incorporated by this reference.

5. Pursuant to the requirements of Stockton Municipal Code section 3.68.070, City Council makes the following findings which support an exception to the competitive bidding requirements:

A. Adding the Pershing Avenue Sidewalk Gap Closure project’s scope to the County’s existing Pershing Avenue Widening project will save the administrative expense of City staff conducting a separate construction procurement, providing the most efficient use of public funds.

B. The County competitively bid the Pershing Avenue Widening project and awarded a Construction Contract to the lowest bidder, Tom Mayo Construction.

C. The estimated unit prices for the City’s Pershing Avenue Sidewalk Gap Closure project are comparable to the unit prices for similar work on the County’s competitively bid Pershing Avenue Widening project.

D. Due to economies of scale, the County is able to add the City’s project scope to the Pershing Avenue Widening project for a competitive price.

6. The City Manager is hereby authorized to take whatever actions are necessary and appropriate to carry out the purpose and intent of this Resolution.

PASSED, APPROVED, and ADOPTED July 26, 2022 .

KEVIN J. LINCOLN II
Mayor of the City of Stockton
ATTEST:

ELIZA R. GARZA, CMC
City Clerk of the City of Stockton
