STOCKTON CITY COUNCIL
RESOLUTION APPROVING THE NOTICE OF EXEMPTION NO. NOE21-22, APPROVING THE PLANS AND SPECIFICATIONS, TRANSFERRING AND APPROPRIATING FUNDING, AND AWARDING A CONSTRUCTION CONTRACT FOR THE ada curb ramp INSTALLATION, PROJECT NO. WD22004 On June 09, 2022, the City Clerk of the City of Stockton opened, examined, and publicly declared the sealed proposals or bids offered for the ADA Curb Ramp Installation, Project No. WD22004; and The project will install 44 Americans with Disabilities Act curb ramps at various intersections citywide. The improvements will remove accessibility barriers for persons using wheelchairs or other personal assistance devices by adding new ramps; and Drago Construction, Inc. is the apparent low bidder, but did not comply with the project bid documents, particularly the California Business and Professions Code requirements; and The bid from Drago Construction, Inc. was determined to be non-responsive; and BGS Builders, Inc. is the second-lowest responsive bidder in the amount of $450,000, and its bid is regular in all respects; and The project is categorically exempt from the requirements of the California Environmental Quality Act (CEQA) as specified under section 15301(c) of the CEQA Guidelines, because this is a discretionary project under the City’s jurisdiction and qualifies as a project which has been determined to not have a significant effect on the environment; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF STOCKTON, AS FOLLOWS:
1. The City Council approves the filing of Notice of Exemption No. NOE21-22 under the CEQA for the ADA Curb Ramp Installation, Project No. WD22004, a copy of which is attached as Exhibit 1 and incorporated by this reference.
2. The City Council approves the plans and specifications for the ADA Curb Ramp Installation, Project No. WD22004.
3. The City Council approves the transfer of funds in the amount of $102,324.45 from the Sidewalk, Curb, and Gutter Repairs Program FY 2019-20, Project No. WD19015, to the ADA Curb Ramp Installation, Project No. WD22004.
4. The City Council approves the appropriation of funds in the amount of $170,000 from the Measure K Maintenance Fund to the ADA Curb Ramp Installation, Project No. WD22004.
5. The City Council awards a Construction Contract between the City of Stockton and BGS Builders, Inc. in the amount of $450,000, and the City Manager is authorized and directed to execute same, a copy of which is attached as Exhibit 2 and incorporated by this reference.
6. The City Manager is hereby authorized to take whatever actions are appropriate and necessary to carry out the purpose and intent of this Resolution.
