Resolution No.
STOCKTON CITY COUNCIL
RESOLUTION AUTHORIZING THE PURCHASE OF LIBRARY FURNITURE FOR TRACY AND MANTECA BRANCH LIBRARIES UTILIZING THE COOPERATIVE AGREEMENT WITH NATIONAL COOPERATIVE PURCHASING ALLIANCE, AND AMENDING THE FISCAL YEAR 2022-23 BUDGET FOR THE TRACY AND MANTECA BRANCHES OF STOCKTON SAN JOAQUIN COUNTY LIBRARY SYSTEM, TO REALLOCATE $200,930.00 FROM CITY-HELD COUNTY FUND BALANCE City staff recommends the purchase of furniture and fixtures from Demco, Inc. utilizing a Cooperative Purchasing Agreement with NCPA for the Tracy and Manteca branch libraries; and The National Cooperative Purchasing Alliance is a national government purchasing cooperative that leverages the purchasing power of public agencies. Master contracts are competitively solicited by lead agencies, advertised, and noticed for 30 days, and evaluated based on quality, performance, and pricing. These cooperative purchasing contracts are optional and available to state and local municipal agencies; and The FF&E products will require related services: Project Management, delivery and installation that complies with City municipal code and California prevailing wage requirements. Those items are considered “on contract” and included in the quote. Demco is using a qualified subcontractor for installation which has been vetted for compliance; and Due to inflation, the revised estimates for the Manteca and Tracy Library Branch furniture refresh projects require additional budget allocations in the amounts of $34,930.00 for Manteca and $166,000.00 for Tracy, totaling $ 200,930.00 above the adopted budget; and This budget amendment request includes contingency funding for Demco furnishings, as well as other refresh/remodel expenses (cabling, flooring, etc.); and San Joaquin County does not need to appropriate or otherwise authorize budget amendments to reallocate funds from the City-Held County Fund Balance; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF STOCKTON, AS FOLLOWS:
The City Council hereby approves the following findings in support of granting an exception to the competitive bid process pursuant to Stockton Municipal Code section 3.68.070.
City staff seeks a cost-effective, competitive process to purchase FF&E for the branch library projects. The City has an existing procurement process as an exception to the competitive bidding process using a cooperative purchasing agreement. The cooperative purchasing agreement provides an efficient, streamlined approach to procurement.
NCPA established a Cooperative Purchasing Agreement with Demco through the local Demco distributor to purchase library furniture, fixtures, and equipment.
The NCPA agreement is based on an RFP with Region 14 ESC as the lead public agency. The terms of that RFP and the resulting contract allow other public agencies to benefit from that contract.
The NCPA Cooperative Purchasing Agreement provides better pricing based on aggregated purchasing volume than the City’s singular procurement process.
Taking advantage of leveraged procurement agreements negotiated by NCPA is efficient and cost-effective. It reduces the administrative expenses of City staff conducting RFPs to source, award, and administer the contracts. The use of this contract lessens the workload of procurement staff.
The specifications of furniture, fixtures, and equipment through NCPA contracts meet the City’s procurement requirements.
Demco provides well-constructed, unique, and hard-to-find solutions for library spaces. The products ordered for this facility will match the City’s standard requirements for this project and deliver FF&E that improves space utilization.
The City Manager or designee is authorized to execute a multi-year Cooperative Purchasing Agreement for the Tracy Branch Library, in the amount of $394,606.58 with Demco, Inc, attached as Exhibit 1 and incorporated herein by this reference.
The City Manager or designee is authorized to execute a multi-year Cooperative Purchasing Agreement for the Manteca Branch Library, in the amount of $88,000.00 with Demco, Inc. attached as Exhibit 2 and incorporated by this reference. //
//
The Fiscal Year 2022-23 Annual Budget is amended to appropriate $200,930.00 from City Held County Fund Balance to the Manteca Branch Library ($34,930.00) and Tracy Branch Library ($166,000.00) accounts as needed to carry out the purpose and intent of this resolution. The City Manager is hereby authorized to take whatever actions are necessary and appropriate to carry out the purpose and intent of this Resolution.
