STOCKTON CITY COUNCIL
RESOLUTION APPROVING A REFUND OF STORMWATER FEES TO ET STOCKTON OWNER, LLC IN THE AMOUNT OF $71,371.09 FOR PROPERTY LOCATED AT 6001 SOUTH AUSTIN ROAD City of Stockton Municipal Code requires that all parcels in the City are charged a fee for Stormwater services; and ET Stockton Owner, LLC developed the parcel at 6001 South Austin Road and constructed a private stormwater system not connected to the City’s stormwater system that is fully owned and maintained by the owner; and City of Stockton Utility Billing was not aware that the parcel at 6001 South Austin Road operated a private stormwater system; and ET Stockton Owner, LLC was inadvertently billed for stormwater service based on Stockton Municipal Code 13.16.180; and Stormwater fee charges collected by the City from September 2020 through December 2021 were determined to be $71,371.09; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF STOCKTON, AS FOLLOWS:
Pursuant to Stockton Municipal Code section 3.60.020, the City of Stockton approves a refund in the amount of $71,371.09 to ET Stockton Owner, LLC.
2. The City Manager is hereby authorized to take whatever actions are necessary and appropriate to carry out the purpose and intent of this Resolution.
