City Council Meeting
January 24, 2023
Agenda Item 15.2

Presenting today:
 City Council delegate authority to the City Manager to execute a Memorandum of Understanding related to
funding for the Mossdale Tract Area Project, thus

Report supporting development in the area, including
Weston Ranch.

Recommended Action:
 Scott Shapiro, SJAFCA Counsel
 Chris Elias, SJAFCA Executive Director
 Seth Wurzel, SJAFCA Financial Consultant
Our Region Is Subject to
Flooding;
which has led to the
formation of SJAFCA
SJAFCA has 30 years in our region leading on capital
projects:
 1994-1997 – The Stockton Metro Project
 Creation of the joint powers agency
 2010-present – The Lower San Joaquin River Project
 Continuation of the joint powers agency
 2018-present – The Mossdale Tract Area Project
 Expansion of the joint powers agency
Urban Level of Protection (ULOP)
 Senate Bill 5 (2007)
 Establishes ULOP as – the “level of protection that is necessary to withstand flooding that has a 1-in-200 chance of occurring in any given year using criteria … developed by DWR.”  Links flood management and land use authority
 Must be achieved by 2028 for the Mossdale Tract
 RD 17 levees protecting Mossdale Tract, won’t comply with ULOP  Initial SB effort led by Lathrop and Manteca. Since 2018, SJAFCA has been leading the effort at constructing a ULOP-compliant project, raising needed funds, and issuing annual Adequate Progress Report updates.

Existing Approach to Mossdale Tract:
 Levee improvements to meet ULOP
 Levee height raises, slope stability improvements,
underseepage improvements (cutoff walls and seepage
berms), erosion repairs, right-of-way acquisition,
encroachment / pipe remediation & rehabilitation and the extension of the Dryland Levee in Manteca
 SJAFCA proposed a locally-funded project to meet
ULOP requirements. The financing plan relies on:
 Initial funding from Lathrop and Manteca - DONE
 Creation of an enhanced infrastructure financing district (EIFD) - DONE
 Update of a development impact fee (DIF) - DONE
 Creation of an overlay assessment district (OAD) – IN

PROGRESS
Mossdale ULOP Project Components
Today’s Action
 While SJAFCA pursues other funding for this project, including State funds and Federal funds, SJAFCA will:
 Investigate the capacity of the needed OAD and advance this to the voters;  Determine the funding gap that needs to be filled;
 Work with the State and Federal government to bring needed financial investment;  Implement this MOU which commits SJAFCA and the three Cities to develop a financial backstop should funding be needed:
• This MOU does not commit the City to provide any specific funding at this time. • This MOU does direct City Staff to work with SJAFCA and the other Cities to develop a concrete proposal which would return to the City Council for consideration. • This MOU allows SJAFCA to issue the 2022 Annual Adequate Progress Report update to support continued development in the Mossdale Tract, including the Weston Ranch / French Camp & I-5 area.
 The Cities of Lathrop and Manteca and SJAFCA have already approved the MOU. Only Stockton’s approval is needed.
