BID PROTEST FOR TRUCK HAULING SERVICES FOR ASPHALT CONCRETE AND ASPHALT CONCRETE GRINDING THROUGH DECEMBER 2024, PROJECT NO. WD23003F This is in response to your letter dated February 10, 2023, regarding the bid submitted by Valley Hauling LLC for the Truck Hauling Services for Asphalt Concrete and Asphalt Concrete Grinding through December 2024 ("Project").
The City of Stockton ("City") determined Valley Hauling LLC, the apparent low bidder, failed to submit the required bidder's security at the time of bid as required by City Standard Specifications Section 2-
1.34 and California Public Contract Code Section 20171.
City Standard Specifications Section 2-1.34 states, "all bids shall be presented under sealed cover and accompanied by one of the following forms of bidder's security: cash, a cashier's check, a certified check, or a bidder's bond executed by an admitted surety insurer, made payable to the City of Stockton. The security shall be in an amount equal to 10 percent of the amount of bid. A bid will not be considered unless one of the above described forms of bidder's security is enclosed with it." Further, California Public Contract Code Section 20171 states, "the security shall be in an amount equal to at least 10 percent of the amount bid. A bid shall not be considered unless one of the forms of bidder's security is enclosed with it."
The City determined that Valley Hauling LLC's failure to comply with the Special Provisions and state code requirements resulted in a non-responsive bid. Public Works staff will recommend that City Council reject Valley Hauling LLC's bid and award a construction contract to the second-lowest responsible bidder, California Materials, Inc.
