Resolution No.
STOCKTON CITY COUNCIL
RESOLUTION AUTHORIZING THE EXECUTION OF AGREEMENT WITH POOLS AND LIFEGUARD MANAGEMENT LLC FOR THE MANAGEMENT AND OPERATION OF SOUSA, BROOKING, HOLIDAY, AND OAK PARK POOLS On August 5, 2021, the City issued a Request for Proposal (RFP) for a multi-year agreement with a single operator for all City operated swimming pools; and The City received two proposals and, based on criteria including professional qualifications, agency experience, and financial capabilities, the City deemed YMCA of San Joaquin (YMCA) the most qualified; and On May 24, 2022, the City and the YMCA of San Joaquin entered into a multi-year agreement to operate all City swimming pools; and On March 10, 2023, the YMCA of San Joaquin notified the City that they are terminating their agreement and will not be operating any City owned pools moving forward; and On March 23, 2023, the City issued a Request for Proposal (RFP) for a single-year agreement with a single operator for all City operated swimming pools; and The City received one proposal and, based on criteria including professional qualifications, agency experience, and financial capabilities, the City deemed Pools and Lifeguard Management LLC the most qualified; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF STOCKTON, AS FOLLOWS:
City Manager is authorized to execute a one-year agreement and two one-year mutual options with Pools and Lifeguard Management LLC for a total amount of $185,000 for the management and operation of Brooking, Holiday, Oak, and Sousa Park Pools, attached as Exhibit 1 and incorporated herein by this reference.
2. Pursuant to the requirements of Stockton Municipal Code section 3.68.070, City Council makes the following findings which support an exception to the competitive bidding requirements for the agreement with Pools and Lifeguard Management LLC:
//
//
A. The City solicited competitive proposals through an RFP process.
B. The RFP process allowed the City to evaluate qualified proponents on experience and past performance, which is more important than price. A strict cost-competitive basis for the selection of an aquatics operator may lower the quality of services to be provided and impact health and safety if cost is the primary criteria of selection.
C. Contracting with a private operator is more cost effective and efficient to provide public swimming in the City’s four aquatic facilities. Current Recreation staffing is insufficient to operate the four pool aquatic facilities.
D. Use of the RFP criteria insures the best operational care, health, and safety standards, and demonstrated aquatic skills.
E. Pools and Lifeguard Management LLC was the top ranked operator based on experience, professional qualification, and financial capability. Pools and Lifeguard Management LLC has the necessary specialized aquatic skills and experience to successfully operate aquatics facilities in the City of Stockton.
3. The City Manager is hereby authorized to take whatever actions are necessary and appropriate to carry out the purpose and intent of this Resolution.
PASSED, APPROVED, AND ADOPTED May 2, 2023 .
