RESOLUTION APPROVING THE FILING OF NOTICE OF EXEMPTION NO.
NOE28-23, APPROVING THE PROJECT SPECIFICATIONS, AND AWARDING A CONSTRUCTION CONTRACT IN THE AMOUNT OF $1,215,337 TO MECHANICAL ANALYSIS/REPAIR INC. FOR THE RWCF DIGESTER GAS HOLDER DIAPHRAGM REPLACEMENT (PROJECT NO. UW24017) On July 13, 2023, the City Clerk of the City of Stockton opened, examined, and publicly declared the sealed bids offered for the RWCF Digester Gas Holder Diaphragm Replacement (Project No. UW24017); and The requirements of Stockton Municipal Code (SMC) section 3.68.090, Local Business Preference, which state that “preference shall be given to the purchase of supplies, materials, equipment, and contractual services from local merchants,” apply to the project; and Mechanical Analysis/Repair, Inc. is located within San Joaquin County, and therefore, entitled to a two percent bid preference in accordance with the Local Business Preference. Upon applying the Local Business Preference, Mechanical Analysis/Repair Inc. becomes the lowest bidder in the amount of $1,215,337; and The bid submitted by Mechanical Analysis/Repair Inc. is regular and responsive in all aspects; and The project conforms with the City’s General Plan and is exempt from the requirements of the California Environmental Quality Act (CEQA) as specified under Article 19, section 15301(b), of the CEQA Guidelines; The project also conforms with the Stockton General Plan based on Policy Land Use – 6.3; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF STOCKTON, AS FOLLOWS:
Approve the filing of the Notice of Exemption No. NOE28-23 under CEQA for the RWCF Digester Gas Holder Diaphragm Replacement (Project No. UW24017), a copy of which is attached as Exhibit 1 and incorporated by this reference.
The City Council approves the project Specifications for the RWCF Digester Gas Holder Diaphragm Replacement (Project No. UW24017), a copy of which is attached as Exhibit 2 and incorporated by this reference. //

The City Council authorizes the City Manager to execute a construction contract with Mechanical Analysis/Repair Inc. of Lodi, CA, in the amount of $1,215,337 for the RWCF Digester Gas Holder Diaphragm Replacement (Project No. UW24017), a copy of which is attached as Exhibit 3 and incorporated by this reference.
The City Manager or designee is authorized and directed to execute all documents, including, but not limited to, agreements and amendments.
The City Manager is hereby authorized to take appropriate and necessary actions to carry out the purpose and intent of this Resolution.
