Resolution No.
STOCKTON CITY COUNCIL
RESOLUTION TO RATIFY FINAL EXPENSES FOR THE EMERGENCY ENVIRONMENTAL CLEANUP AND MITIGATION OF A SANITARY SEWER OVERFLOW NEAR CORONADO AND EAST FULTON STREETS On January 29, 2023, an air relief valve (ARV) located near Coronado and East Fulton Streets failed and caused a large sanitary sewer overflow (SSO) that affected City property and two private residences. Staff from the Municipal Utilities Department (MUD), Environmental Control and Collections Divisions immediately responded, initiated work, and the following day contracted with Ponder Environmental (Ponder) to conduct extensive cleanup and mitigation of the site; and On February 24, 2023, Ponder completed the cleanup and mitigation work on the City property and two private residences; and On May 23, 2023, the City Manager approved the MUD request for emergency procurement authorization for the Coronado SSO in accordance with City Manager Emergency Contract and Procurement Policy (17.05.150), which provides a process for rapidly acquiring needed materials or services for critical, unforeseen government need amid emergency situations as defined in Chapters 2.82 and 3.68 of the Stockton Municipal Code, and City Council Resolution 2019-03-05-1109, that approved a rotating vendor list for environmental cleanup and abatement services; and All repairs and mitigation measures are complete and normal collection system operation has been restored along Coronado Street and East Fulton Street. However, due to the ongoing nature of the risk services analysis for potential claims by the impacted homeowners against this cleanup project, the MUD delayed the final reporting of these expenses to ensure all charges for the project had been submitted and validated; and Upon receiving the final invoice by Ponder, the MUD prepared and executed payment for these services; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF STOCKTON, AS FOLLOWS:
The City Council ratifies the total expenditure of $285,311.98 for cleanup and mitigation services for the emergency environmental cleanup and mitigation of the sanitary sewer overflow near Coronado and East Fulton Streets. //
