Resolution No.

STOCKTON CITY COUNCIL
RESOLUTION AWARDING A PROFESSIONAL SERVICES CONTRACT AND APPROPRIATING FUNDING CANNERY PARK, PROJECT NO. WP13270 On April 13, 2023, the City advertised a Request for Proposals (RFP) to prepare a master plan and construction documents for Cannery Park, Project No. WP13270. Four proposals were received; and The Cannery Park project will focus on improvements to include a playground, group picnic shelter, adult fitness course, meandering concrete pathways, lighting, benches, drinking fountains, and other typical city park amenities found in a neighborhood park; and After review of the proposals, it was determined that O’Dell Engineering has the necessary knowledge, experience, and staff to perform the required work. Staff negotiated a fee of $222,542 with O’Dell Engineering to prepare a master plan and construction documents; and Appropriation of additional funds is needed to fund all remaining costs to complete the master plan and construction documents and staff costs; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF STOCKTON, AS FOLLOWS:

The City Council awards a Professional Services Contract between the City of Stockton and O’Dell Engineering, in the amount of $222,542, and the City Manager is authorized and directed to execute same, a copy of which is attached as Exhibit 1 and incorporated by this reference.

The City Council approves findings pursuant to Stockton Municipal Code (SMC) section 3.68.070 in support of an exception to the competitive bidding process. These findings include:

A. The City does not have sufficient staff available to complete design documents for this project.

B. The scope of work requires a landscape architect/engineering firm experienced in preparing design documents for a neighborhood park.

C. Use of the RFP process is appropriate for this Professional Services Contract because it relies on the evaluation of professional qualifications and performance as the basis for selection of a vendor. Use of the criteria helps ensure selection of a vendor that will provide the highest quality professional service, which is in the public interest.

The City Council approves the appropriation of additional funds in the amount of $125,000 from the Public Facilities Fee Park Fund Balance to Cannery Park, Project No. WP13270.

The City Manager is hereby authorized to take whatever actions are necessary and appropriate to carry out the purpose and intent of this Resolution.

PASSED, APPROVED, and ADOPTED December 5, 2023 .
