Resolution No.
STOCKTON CITY COUNCIL
RESOLUTION APPROVING A WAIVER OF CUSTOMER CREDITS APPLIED UNDER THE STATE WATER RESOURCE CONTROL BOARD WATER AND WASTEWATER ARREARAGE PAYMENT PROGRAM The California State Water Resources Control Board administered the California Water and Wastewater Arrearage Payment Program (Program) to provide relief to water and wastewater customers experiencing financial hardships due to the COVID-19 pandemic; and The City of Stockton Municipal Utilities Department participated in the Program and issued credits on accounts to eligible customers based on the Program criteria; and A total of $2,253,527 was credited to over 11,700 wastewater customers and $1,623,889 to 4,100 water customers; and Several customers eligible for assistance were able to pay down their past-due amounts between the time the application was submitted, and the date Program funds were received from the State; and After funds were applied to customer accounts, the Program administrator determined that customers initially eligible and who had paid all or part of any past due amounts were not eligible to receive Program funds; and The State required the City repay any amounts credited to customer accounts who had already paid down past due amounts when the Program funds were applied; and A total of $56,277.72 for water and $221,471.86 for wastewater have been returned to the State; and Rate revenue will not fund the repayment as both water and wastewater utilities have sufficient funds in ‘Other Revenue’, as identified in the rate studies, to cover the cost of repayment to the State; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF STOCKTON, AS FOLLOWS:
The City Council approves waiving the responsibility of customers in the City’s water and wastewater service areas to repay to the City the Program amounts, which were credited to their account before the Program administrator clarified the eligibility criteria.
The City Manager, or designee, is hereby authorized to take appropriate and necessary actions to carry out the purpose and intent of this Resolution.
