Resolution No.

STOCKTON CITY COUNCIL
RESOLUTION APPROVING EXCEPTIONS TO THE COMPETITIVE BIDDING PROCESS AND AUTHORIZING CONTRACT AMENDMENT NO. 3 WITH USALCO, LLC FOR THE PURCHASE OF WASTEWATER TREATMENT POLYMER Polymer is used in the wastewater treatment process to improve dewatering and solids removal; and The type and quantity of polymer used is unique to each wastewater stream and relies on performance-based testing to determine the best product; and The City Council authorized a five-year (5) contract with USALCO, LLC, Motion 2019-05-21-1115, for the purchase of polymer. The total price for the five-year contract was $10,500,000. Amendments 1 and 2 approved unit cost changes and increased the total contract price to $13,000,000; and The new ultraviolet disinfection system and outfall are currently undergoing commissioning and start-up testing; and It is important to continue using the same polymer during start-up to determine if it is still the most effective product for use at the Regional Wastewater Control Facility; and The current provider, USALCO, LLC, has provided consistent polymer products and service throughout the contract period; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF STOCKTON, AS FOLLOWS:

The City Council approves findings pursuant to Stockton Municipal Code section 3.68.070 in support of an exception to the competitive bidding process for the contract extension with USALCO, LLC:

The Regional Wastewater Control Facility has unique wastewater streams that require performance-based bidding to determine the specific product that will achieve desired treatment results.

The performance-based bid process is lengthy and can take over six months to complete.

The new ultraviolet disinfection system and outfall are now undergoing commissioning and start-up testing.

It is necessary to continue using the same polymer for start-up testing to provide adequate comparison with the old system and permit requirements.

It is economically feasible to determine if the current polymer remains the most effective product for use.

USALCO has provided a consistent polymer product and service to the City throughout the contract period.

It is in the City’s best interest to extend the current contract for an additional two (2) years while startup commissioning of the RWCF Plant Modifications Project is completed and all processes are online and operating as designed.

2. The City Council authorizes the City Manager to execute a two-year contract extension with USALCO, LLC of Baltimore, Maryland, with a not-to-exceed amount of $17,791,945, a copy of which is attached as Exhibit 1 and incorporated by this reference.

3. The City Manager, or designee, is hereby authorized to take appropriate and necessary actions to carry out the purpose and intent of this Resolution.

PASSED, APPROVED, and ADOPTED May 14, 2024 .
