Resolution No.

STOCKTON CITY COUNCIL
RESOLUTION APPROVING A COOPERATIVE PURCHASE AGREEMENT AND APPROPRIATING FUNDS FOR THE VAN BUSKIRK PARK PLAYGROUND SURFACE, PROJECT NO. WP22029 Van Buskirk Park features rubberized fall surfacing to accommodate children of all abilities and is an all-access structure for children in wheelchairs. The playground was installed in 2006. The surfacing has normal wear and tear, as well as damage from intentionally set fires; and The City successfully applied for funding for the renovation of the Van Buskirk Park playground fall surfacing under the California Department of Parks and Recreation Statewide Park Program; and OMNIA Partners is a national cooperative procurement organization that offers publicly solicited contracts to government entities nationwide. OMNIA Partners serves a variety of government and non-profit organizations. The use of a Cooperative Purchase Agreement (COOP) streamlines administrative costs and procedures and takes advantage of volume purchasing while maintaining the integrity of the competitive bidding process; and OMNIA Partners has a contract with Robertson Industries, Inc. for the purchase and installation of playground fall surfacing. The quotes for playground fall surfacing installation available through OMNIA Partners’ contract meet the City’s requirements for this type of equipment; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF STOCKTON, AS FOLLOWS:

The City Council approves the appropriation of funds in the amount of $177,952 from the California Department of Parks and Recreation Statewide Park Program to the Van Buskirk Park Playground Surface, Project No. WP22029.

The City Council approves the use of a Cooperative Purchase Agreement through OMNIA Partners Contract No. R230202, to provide the City preferential pricing from Robertson Industries, Inc.

The City Council authorizes a contract in the amount of $133,207.04 with Robertson Industries, Inc. for the renovation of the Van Buskirk Park Playground Surface, Project No. WP22029, and the City Manager is authorized and directed to execute same, a copy of which is attached as Exhibit 1 and incorporated by this reference.

The City Council approves the following findings in support of an exception to the competitive bid process pursuant to Stockton Municipal Code (SMC) section 3.68.070:

OMNIA Partners established a COOP with Robertson Industries, Inc. for the purchase and repair of playground surfacing.

The Robertson Industries, Inc. COOP was established pursuant to a formal competitive bidding process conducted by OMNIA Partners on behalf of its governmental members, of which the City is one.

Taking advantage of the leveraged procurement agreement negotiated by OMNIA Partners will save the administrative expense of City staff conducting a separate procurement.

The bid specification used by OMNIA Partners has been assessed as compatible with the City’s standards.

The City Manager is hereby authorized to take whatever actions are necessary and appropriate to carry out the purpose and intent of this Resolution.

PASSED, APPROVED, and ADOPTED May 14, 2024 .

KEVIN J. LINCOLN II
Mayor of the City of Stockton
