Resolution No.

STOCKTON CITY COUNCIL
RESOLUTION AWARDING A COOPERATIVE AGREEMENT AND PROFESSIONAL SERVICES CONTRACT AND APPROPRIATING FUNDING FOR THE DR. MARTIN LUTHER KING JR. BOULEVARD UNDERPASS RECONSTRUCTION, PROJECT NO. WT24030 On June 5, 2023, the City advertised a Request for Proposals (RFP) for preliminary design and preparation of environmental documents for the Dr. Martin Luther King Jr. (MLK) Boulevard Underpass Reconstruction, Project No. WT24030. Two proposals were received; and The project will construct a new bridge overpass to carry Union Pacific Railroad tracks over MLK Boulevard. The project will also remove the old, antiquated underpass structures, widen MLK Boulevard to create a multi-modal, Americans with Disabilities Act compliant transportation facility; and After review of the proposals, it was determined that Mark Thomas and Company, Inc. has the necessary knowledge, experience, and staff to perform the required work. Staff negotiated a fee of $1,429,195 with Mark Thomas and Company, Inc. for the MLK Boulevard Underpass Reconstruction, Project No. WT24030; and The San Joaquin Regional Rail Commission (SJRRC) has agreed to partner with the City and fund 50 percent of the project costs; and Appropriation of funds is needed to fund all remaining costs to complete the preliminary design and preparation of environmental documents and staff costs; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF STOCKTON, AS FOLLOWS:

The City Council awards a Cooperative Agreement between the City of Stockton and SJRRC in the amount of $800,000, and the City Manager is authorized and directed to execute same, a copy of which is attached as Exhibit 1 and incorporated by this reference.

The City Council awards a Professional Services Contract between the City of Stockton and Mark Thomas and Company, Inc. in the amount of $1,429,195, and the City Manager is authorized and directed to execute same, a copy of which is attached as Exhibit 2 and incorporated by this reference.

The City Council approves findings pursuant to Stockton Municipal Code (SMC) section 3.68.070 in support of an exception to the competitive bidding process. These findings include:

A. The City does not have sufficient staff available to design this project or prepare the environmental documents.

B. Use of the RFP process is appropriate for this Professional Services Contract because it relies on the evaluation of professional qualifications and performance as the basis for selection of a vendor. Use of this criteria helps ensure selection of a vendor that will provide the highest quality professional service, which is in the public interest.

C. The City negotiated a contract following solicitation of competitive proposals in accordance with SMC section 3.68.070.A.3.

The City Council approves the appropriation of funds in the amount of $1,000,000 from the Public Facility Fees Street Improvement Fund balance to the MLK Boulevard Underpass Reconstruction, Project No. WT24030.

The City Manager is hereby authorized to take whatever actions are necessary and appropriate to carry out the purpose and intent of this Resolution.
