Resolution No.
STOCKTON CITY COUNCIL
AWARD A PROFESSIONAL SERVICES AGREEMENT TO GATEWAY PACIFIC CONTRACTORS, INC. TO DESIGN AND CONSTRUCT THE DELTA WATER TREATMENT PLANT GROUNDWATER RECHARGE BASIN PROJECT In 2012, the Municipal Utilities Department (MUD) dedicated the Delta Water Supply Project (DWSP) to provide a supplemental surface water supply to the City of Stockton and protect the groundwater basin through conjunctive management; and The project included a river diversion and pumping station, 12 miles of 54-inch raw water pipeline, and a 30 million gallon per day water treatment plant (DWTP), on a 130-acre parcel on Lower Sacramento Road; and
The next phase of the DWSP is the development of additional conjunctive use capabilities through groundwater recharge and storage on a 70-acre site located at the DWTP; and A groundwater recharge project will make use of water available under the City’s Water Right Permit 21176, contract supply from Woodbridge Irrigation District, and potentially other water sources; and On February 2, 2024, the City advertised the Request for Proposals (RFP) for the design and construction of the Delta Water Treatment Plant Groundwater Recharge Basin Project (PUR 24-016); and The Municipal Utilities Department staff recommends an award of a professional service agreement to Gateway Pacific Contractors, Inc. in the not-to-exceed amount of $11,033,248; and The project conforms with the City’s General Plan and the Stockton General Plan based on Policy Land Use – 6.3; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF STOCKTON, AS FOLLOWS:
The City Council approves the following findings pursuant to Stockton Municipal Code section 3.68.070 in support of an exception to the competitive bidding process:
A strict cost-competitive basis for the selection of professional services may lower the quality and thoroughness of the services provided.
Use of the RFP process is appropriate for this Professional Services Agreement because it relies on the evaluation of professional qualifications and performance as the basis for the selection of a vendor, which is a typical practice for this type of work. Use of these criteria resulted in the selection of a vendor with experience in design and construction of groundwater recharge basins in California.
Considering the size, complexity, and schedule requirements of the project, the City does not have sufficient staff resources nor expertise to design and construct a project of this size.
The City negotiated the contract following the solicitation of competitive proposals in accordance with SMC section 3.68.070.A.3.
A Professional Services Agreement to design and construct the Delta Water Treatment Plant Groundwater Recharge Basins Project and associated infrastructure in the not-to-exceed amount of $11,483,248 between the City of Stockton and Gateway Pacific Contractors, Inc. of Sacramento, CA is hereby awarded, and the City Manager is authorized and directed to execute the same, a copy of which is attached as Exhibit 1 and incorporated by this reference.
The City Manager is hereby authorized to take whatever actions are necessary and appropriate to carry out the purpose and intent of this Resolution.
PASSED, APPROVED, and ADOPTED September 10, 2024 .
