RE: Withdrawal of Bid
Job Name: Victory Park Pool – Aquatics Facilities Renovations Project No.: CR18020
Dear Mr. Mohammad,
As previously informed on 8/16/24, Tricon Construction, Inc. DBA Tricon Aquatics (Tricon) is hereby requesting to withdraw our bid that was submitted to the City of Stockton on 8/15/24 for the Victory Park Pool – Aquatics Facilities Renovations project.

Tricon received an email notification from our concrete subcontractor (BCI) at 6am of 8/16/24 that they had made a critical error on their proposal and did not include the cost for the 6" swimming pool deck, spray pad deck and other pool deck misc. items in their bid. It was inclusive in their original scope but not included in their price. This is a fatal error in the amount of approximately $400,000 that Tricon had no control over.

Unfortunately due to this circumstance, we (Tricon) will need to withdraw our bid. I apologize for this inconvenience.

Please see attached letter from our listed Concrete Subcontractor, BCI, with additional information concerning their bid error.

Sincerely,
Jonathan T. Peel

SUBJECT: Victory Park Pool – Concrete Bid

I am writing to address an error that occurred with our proposals for the Victory Park Pool project on bid day, August 15, 2024.

BCI initially intended to submit proposals for the following scopes:
• Pool Deck/Spray Ground Concrete + Reinforcing
• Pool Shell Reinforcing

Due to some last-minute scope additions, we also prepared separate proposals for:
• Structural Building Concrete + Reinforcing
• Site Concrete + Reinforcing

On bid day, our plan was to first send the already completed proposal for Pool Deck/Spray Ground Concrete + Reinforcing and Pool Shell Reinforcing, while finalizing the proposals for Structural Building Concrete + Reinforcing and Site Concrete + Reinforcing. However, while converting our Microsoft Word file for the Pool Deck/Spray Ground Concrete + Reinforcing and Pool Shell Reinforcing proposal to PDF, we mistakenly overwrote it with the incomplete proposal for Structural Concrete + Reinforcing and Site Concrete + Reinforcing. As a result, the first email we sent to Tricon Construction contained the incorrect proposal document.

We then followed up with a second email with the proposal for Structural Concrete + Reinforcing and Site Concrete + Reinforcing. This was the correct and complete proposal for that scope. Unfortunately, we did not provide the correct and complete proposal for Pool Deck/Spray Ground Concrete + Reinforcing and Pool Shell Reinforcing to Tricon Construction. In the midst of the fast-paced public bidding process, our numbers were plugged in presuming we had everything covered that we had previously discussed with Tricon Construction.

BCI's estimating department is committed to providing thorough and accurate bids. Regrettably, a clerical error on our part led to this situation. As a result, we must retract our bid. We sincerely apologize for any inconvenience this has caused.

Given the spread of other contractors' bids, we believe that Tricon Construction would still have been the apparent low bidder with our corrected proposals.

We looked forward to the opportunity to work with Tricon Construction and the City of Stockton on this project. Should the City decide to rebid, we would be eager to provide a new proposal with Tricon Construction if afforded the opportunity.

Thank you,

Garrett Whitney
