Resolution No.

STOCKTON CITY COUNCIL
RESOLUTION APPROPRIATING FUNDING AND AWARDING A PROFESSIONAL SERVICES CONTRACT FOR THE HAMMER LANE TRAFFIC SAFETY IMPROVEMENTS, PROJECT NO. WT23040/STATE PROJECT NO. HSIPSL-5008(211) On April 15, 2024, the City advertised a Request for Proposals (RFP) for design services for the Hammer Lane Traffic Safety Improvements, Project No. WT23040/State Project No. HSIPSL-5008(211). Three proposals were received; and Kimley-Horn was the most qualified and highest ranked firm; however, negotiations with Kimley-Horn were not successful with respect to scope and fee. Staff proceeded to negotiate with the next most qualified consultant, W-Trans. Staff negotiated a fee in the amount of $198,637.48 with W-Trans for design services. This fee was more than the project available funds of $1,927,800.00 with a 10 percent local match of $192,780.00; and In June 2024, staff requested additional Highway Safety Improvement Program (HSIP) funding from Caltrans to fully fund administrative and contingency costs for design. Caltrans awarded the City an additional $153,000.00 in State HSIP funding for design of the project; and Appropriation of funds is needed to fund all remaining costs to complete the design services and staff costs; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF STOCKTON, AS FOLLOWS:

The City Council approves the appropriation of HSIP funds in the amount of $256,500.00 to the Hammer Lane Traffic Safety Improvements, Project No. WT23040/State Project No. HSIPSL-5008(211).

The City Council approves findings pursuant to Stockton Municipal Code (SMC) Section 3.68.070 in support of an exception to the competitive bidding process. These findings include:

A. The City does not have sufficient staff and expertise to design this project.

B. Use of the RFP process is appropriate for this Professional Services Contract because it relies on the evaluation of professional qualifications and performance as the basis for selection of a vendor. Use of the criteria helps ensure selection of a vendor that will provide the highest quality professional service, which is in the public interest.

C. The City negotiated a contract following solicitation of competitive proposals in accordance with SMC Section 3.68.070.A.3.

The City Council awards a Professional Services Contract between the City of Stockton and W-Trans, in the amount of $198,637.48, and the City Manager is authorized and directed to execute same, a copy of which is attached as Exhibit 1 and incorporated by this reference.

The City Manager is hereby authorized to take whatever actions are necessary and appropriate to carry out the purpose and intent of this Resolution.

PASSED, APPROVED, and ADOPTED September 17, 2024 .
